MALICIOUS MISCHIEF – Willful destruction ofproperty, from actual ill will or resentment toward its owneror possessor.MALICIOUS PROSECUTION – An action with theintention of injuring the defendant and without probablecause, and which terminates in favor of the personprosecuted.MALICIOUSLY – To annoy, or injure another, or anintent to do a wrongful act, and may consist in directintention to injure, or in reckless disregard of another’srightsMALPRACTICE – Violation of a professional duty to actwith reasonable care and in good faith without fraud orcollusion. This term is usually applied to such conduct bydoctors, lawyers, or accountants.MANDAMUS – A writ issued by a court ordering a publicofficial to perform an act.MANDATE – A judicial command or order proceedingfrom a court or judicial officer, directing the proper officerto enforce a judgment, sentence, or decree.MANDATORY – Required, ordered.MANSLAUGHTER, INVOLUNTARY – Unlawfulkilling of another, without malice, when the death is causedby some other unlawful act not usually expected to result ingreat bodily harm.MANSLAUGHTER, VOLUNTARY – Unlawful killingof another, without malice, when the act is committed witha sudden extreme emotional impulse.MARIJUANA – “Cannabis” is an annual herb havingangular rough stem and deeply lobed leaves.
