<strong>Exploring</strong> <strong>Links</strong> <strong>between</strong> <strong>Trafficking</strong> <strong>and</strong> <strong>Migration</strong>This Paper explores the first point of movement (please refer to the GAATWWorking Paper on <strong>Links</strong> with Labour for discussion on “exploitation” <strong>and</strong>end results of trafficking 3 ). Though trafficking involves both internal <strong>and</strong>international movement, the focus here is on international movement. Wewould value continued conversations about how discussions in this papermight look differently when applied more directly to internal migration.The glossary <strong>and</strong> table below define other migration-related terms. Whilethere are distinctive elements to each term, sometimes it is hard to separatethem in practice. 4 For instance, the category a person is in can change overtime; s/he could be in a smuggled situation one day <strong>and</strong> the next find her/himself in a trafficking situation. Or, in legal terms, it may not be possibleto prove “force” or “exploitation” with enough evidence. Further, thoughthey might be defined as such legally, a person might not think they were“forced” to move, or they might not think the work they do is “exploitative”.Under each country’s legislation, being labeled a certain category hasimplications for rights protection <strong>and</strong> exercise (i.e. whether a person isdeported, thinks they need to hide from authorities, can access assistance<strong>and</strong> justice, or can live <strong>and</strong> work freely, to name just a few).These categories not only matter legally but also socially. Often traffickingcarries the stigma of sex work. Refugees similarly often face discriminationby people who believe they are “economic migrants” cheating the State’ssystem. Equally, governments <strong>and</strong> wider society label migrants in terms oftheir legal status. Migrants also label themselves, many preferring “Mother”,“Congolese”, “Hindu”, or simply “Woman” – terms that they feel describetheir whole selves better.Migrant – someone who leaves her/his community or country of origin tolive, <strong>and</strong> possibly work <strong>and</strong>/or marry in another place. “Migrant” is anoverarching term that covers many special categories of migrants,including refugees, smuggled, trafficked <strong>and</strong> undocumented persons.Each of these special categories has a few elements that make it distinctfrom the others (see “YES” marks in table below).Refugee – a person who has been, or fears being, persecuted in her/hiscountry <strong>and</strong> is forced to leave. 5 Environmental or climate refugees arethose who flee natural disasters. Similar to refugees are InternallyDisplaced Persons, who have been forced to move but have not lefttheir country of origin.Smuggled person – someone who travels voluntarily but illegally to anothercountry with the assistance of a third party, whom he or she pays. 6Trafficked person – a person who is coerced, deceived or forced tomove within her/his country or to another country for the purpose ofexploitation. 7Undocumented migrant – a person who does not have legal immigrationstatus in a transit or destination country (or even in a different regionof her/his own country). A person can enter a country without legalstatus, or can enter with status <strong>and</strong> lose it later. (We prefer using theterm “undocumented migrant” to the term “illegal migrant”. Illegal is adescription for something a person does, rather than for the person his/herself.)5
