- 9 -2.9 INACTIVE PERMIT APPLICATION2.9.1 Where an application for a permit remains incomplete or inactive for thirty (30)days after it is submitted, the application may be deemed by the Chief<strong>Building</strong> Official to have been abandoned and the application shall bereturned to the applicant along with a notice of abandonment.2.9.2 Where the application for permit has been deemed abandoned and returnedto the applicant, it shall be accompanied by a refund of the applicable fees inaccordance with the provisions for refund of fees described in Schedule “A” ofthis by-<strong>law</strong>.2.9.3 Once an application is deemed to be abandoned and the applicant is notified,a new application shall be filed for the proposed work.2.10 SEWAGE SYSTEM PERMITS2.10.1 The Administration and Enforcement Section of Division B Part 8 of the<strong>Building</strong> Code with respect to sewage systems remains the responsibility ofthe Regional Municipality of <strong>Niagara</strong>.2.10.2 Any applicant wishing to make application for a sewage system permit underthe provisions of Division B Part 8 of the <strong>Building</strong> Code shall do so by makingapplication to the Regional Municipality of <strong>Niagara</strong>.2.11 LIMITING DISTANCE AGREEMENTS2.11.1 An applicant may enter into a Limiting Distance Agreement with the City asprovided for in Sentence (8) of Division B – Article 3.2.3.1 or in Sentence (5)of Division B – Article 9.10.14.12 of the <strong>Building</strong> Code.SECTION 3PLANS AND SPECIFICATIONS3.1 INFORMATION SUFFICIENT TO DETERMINE CONFORMITY3.1.1 Sufficient information shall be submitted with each application for a permit toenable the Chief <strong>Building</strong> Official to determine whether or not the proposedconstruction, demolition, change of use or transfer of permit will comply withthe requirements of the Act, the <strong>Building</strong> Code and any other applicable <strong>law</strong>.3.2 COMPLETE SETS3.2.1 Each application shall, unless otherwise specified by the Chief <strong>Building</strong>Official, be accompanied by complete sets of plans and specifications asdescribed herein as well as in Schedule “B” of this by-<strong>law</strong>.
