qualified as war crimes accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> circumstances <strong>of</strong> <strong>the</strong> event, <strong>and</strong> which are under <strong>the</strong>jurisdiction <strong>of</strong> <strong>the</strong> prosecu<strong>to</strong>rs <strong>of</strong> general jurisdiction, <strong>and</strong> render decisions on <strong>the</strong> transfer <strong>of</strong><strong>the</strong>se cases <strong>to</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP, or it will authorize <strong>the</strong> OWCP <strong>to</strong> act <strong>in</strong> <strong>the</strong>se cases.c) The Republic Public Prosecu<strong>to</strong>r will publish a list <strong>of</strong> <strong>the</strong>se cases on its <strong>web</strong> page.Specific objective no. 2: The OWCP will have detailed <strong>and</strong> comprehensive records <strong>of</strong> unresolvedcases <strong>of</strong> war crimes.Activities:a) The Prosecu<strong>to</strong>r shall <strong>for</strong>m a Team <strong>for</strong> record<strong>in</strong>g cases compris<strong>in</strong>g two deputy prosecu<strong>to</strong>rs <strong>and</strong>an associate, who will be tasked <strong>to</strong> prepare detailed records <strong>of</strong> all cases pend<strong>in</strong>g <strong>in</strong> <strong>the</strong> OWCP;<strong>the</strong> records will consist <strong>of</strong> <strong>in</strong><strong>for</strong>mation on <strong>the</strong> most significant elements <strong>of</strong> each case (shortdescription <strong>of</strong> <strong>the</strong> crim<strong>in</strong>al <strong>of</strong>fence, qualification <strong>of</strong> <strong>the</strong> act, number <strong>of</strong> victims, affiliation <strong>to</strong> <strong>the</strong>party <strong>to</strong> <strong>the</strong> conflict, <strong>and</strong> <strong>the</strong> rank <strong>of</strong> <strong>the</strong> suspects, number <strong>of</strong> victims, available evidence, etc.).b) The Records Team shall update all subsequently received cases <strong>and</strong> <strong>for</strong>ward <strong>the</strong>m <strong>to</strong> <strong>the</strong>OWCP <strong>Strategy</strong> Draft<strong>in</strong>g Team.Specific objective no. 3: The OWCP shall have prepared <strong>and</strong> adopted <strong>the</strong> Work <strong>Strategy</strong> <strong>for</strong> <strong>the</strong>period 2015-2025.Activities:a) The Prosecu<strong>to</strong>r shall <strong>for</strong>m OWCP <strong>Strategy</strong> Draft<strong>in</strong>g Team (Team), which will comprise twodeputy prosecu<strong>to</strong>rs <strong>and</strong> an associate, who will, after <strong>the</strong> adoption <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>,have <strong>the</strong> task <strong>of</strong> moni<strong>to</strong>r<strong>in</strong>g its application (Team <strong>for</strong> <strong>the</strong> Moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> <strong>the</strong> Application <strong>of</strong> <strong>the</strong><strong>Strategy</strong>).13b) The Team shall organize expert consultation with prosecu<strong>to</strong>rs from <strong>the</strong> OWCP, <strong>the</strong> RepublicPublic Prosecu<strong>to</strong>r’s Office, judges <strong>of</strong> <strong>the</strong> Higher Court Department , <strong>the</strong> Appeals CourtDepartment, ICTY representatives, legal experts, prosecu<strong>to</strong>rs from <strong>the</strong> region, organi<strong>za</strong>tionsmoni<strong>to</strong>r<strong>in</strong>g war crimes trials, <strong>and</strong> o<strong>the</strong>r relevant collocu<strong>to</strong>rs, on <strong>the</strong> criteria <strong>for</strong> <strong>the</strong> prioriti<strong>za</strong>tion<strong>of</strong> cases. Among <strong>the</strong> criteria that will be discussed <strong>dur<strong>in</strong>g</strong> <strong>the</strong> consultation, although notnecessarily exclusively, are: i) <strong>the</strong> severity <strong>of</strong> consequences (<strong>the</strong> act <strong>of</strong> commission) <strong>and</strong> <strong>the</strong>extent <strong>of</strong> <strong>the</strong> crime (<strong>the</strong> number <strong>of</strong> victims, <strong>the</strong> proportion <strong>of</strong> destruction <strong>of</strong> property <strong>and</strong>cultural <strong>and</strong> religious facilities); ii) <strong>the</strong> role <strong>of</strong> <strong>the</strong> accused (<strong>for</strong>mal <strong>and</strong> de fac<strong>to</strong> position <strong>in</strong>military/paramilitary/police/political hierarchy); iii) availability <strong>of</strong> suspect/s; iv) availability<strong>and</strong> quality <strong>of</strong> evidence; v) cruelty <strong>and</strong> recklessness when committ<strong>in</strong>g <strong>the</strong> crim<strong>in</strong>al <strong>of</strong>fence; vii)<strong>the</strong> <strong>in</strong>terest <strong>of</strong> <strong>the</strong> public.c) A catalogue <strong>of</strong> criteria shall be created by <strong>the</strong> Team <strong>for</strong> case prioriti<strong>za</strong>tion.d) Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> criteria established, <strong>the</strong> Team shall determ<strong>in</strong>e <strong>the</strong> categori<strong>za</strong>tion <strong>of</strong> cases,<strong>in</strong>clud<strong>in</strong>g A, B, <strong>and</strong> C categories: category A <strong>in</strong>cludes priority cases, mean<strong>in</strong>g <strong>the</strong> cases whichfulfil most <strong>of</strong> <strong>the</strong> criteria established; category B <strong>in</strong>cludes middle priority cases; <strong>and</strong> categoryC <strong>in</strong>cludes <strong>the</strong> lowest priority level.Humanitarian Law Center
