The protection <strong>of</strong> witnesses <strong>and</strong> victimsWitnesses are <strong>the</strong> most important <strong>and</strong> <strong>the</strong> most frequently used means <strong>of</strong> evidence <strong>in</strong> war crimes cases.For <strong>the</strong> purpose <strong>of</strong> effective case management, it is necessary <strong>to</strong> ensure that witnesses testify withoutfear, threats or o<strong>the</strong>r <strong>for</strong>ms <strong>of</strong> pressure <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>and</strong> <strong>the</strong> trial. The effectiveness <strong>of</strong> witnessprotection mechanisms significantly affects <strong>the</strong> decision <strong>of</strong> persons who have <strong>in</strong><strong>for</strong>mation about <strong>the</strong> crimescommitted on whe<strong>the</strong>r <strong>to</strong> participate <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs aga<strong>in</strong>st <strong>the</strong> perpetra<strong>to</strong>rs <strong>of</strong> <strong>the</strong> war crimes.In <strong>the</strong> current practice regard<strong>in</strong>g war crimes prosecution <strong>in</strong> Serbia, <strong>the</strong> witness protection systemhas not been very effective, because some <strong>of</strong> <strong>the</strong> procedural protection mechanisms have not beenapplied when necessary. In addition, <strong>the</strong> nonprocedural measures <strong>for</strong> protection <strong>of</strong> <strong>in</strong>sider witnesses(<strong>for</strong>mer <strong>and</strong> active members <strong>of</strong> <strong>the</strong> armed <strong>for</strong>ces <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia) has proved <strong>to</strong> be completelyunsuccessful.3.1. Procedural protectionThe legal framework <strong>of</strong> <strong>the</strong> witness protection system <strong>in</strong> <strong>the</strong> cases <strong>of</strong> war crimes is regulated by <strong>the</strong> CPC. 10The procedural protection measures are applied <strong>in</strong> <strong>the</strong> <strong>in</strong>vestigation when undertak<strong>in</strong>g <strong>in</strong>vestigativeactions, <strong>and</strong> <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial. Dur<strong>in</strong>g <strong>the</strong> trial, <strong>the</strong>y are applied by <strong>the</strong> court, <strong>and</strong> <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>in</strong>vestigation,by <strong>the</strong> prosecu<strong>to</strong>r. 11 Procedural protection <strong>of</strong> witnesses <strong>in</strong>cludes: measures <strong>to</strong> protect <strong>the</strong> <strong>in</strong>tegrity <strong>of</strong> <strong>the</strong>witness, measures <strong>to</strong> protect particularly vulnerable witnesses <strong>and</strong> measures <strong>for</strong> protection <strong>of</strong> witnesseswhose lives, health, liberty or property are endangered because <strong>of</strong> <strong>the</strong>ir testify<strong>in</strong>g.In cases <strong>of</strong> war crimes <strong>in</strong> Serbia, <strong>the</strong>re have been examples <strong>of</strong> witnesses be<strong>in</strong>g <strong>in</strong>sulted by <strong>the</strong> defence<strong>and</strong> <strong>the</strong> defendants who were not sanctioned by <strong>the</strong> court, or <strong>in</strong>adequately sanctioned (by <strong>the</strong>pronounc<strong>in</strong>g <strong>of</strong> <strong>in</strong><strong>for</strong>mal warn<strong>in</strong>gs <strong>in</strong>stead <strong>of</strong> <strong>the</strong> <strong>in</strong>fliction <strong>of</strong> <strong>the</strong> sanctions prescribed by <strong>the</strong> CPC).Inadequate protection <strong>of</strong> witnesses <strong>dur<strong>in</strong>g</strong> <strong>the</strong> testimony causes psychological trauma, <strong>and</strong> is <strong>for</strong>witnesses - <strong>in</strong>jured parties (victims) a secondary victimi<strong>za</strong>tion.21A particular challenge is represented by <strong>the</strong> protection <strong>of</strong> victims <strong>of</strong> sexual violence <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial<strong>in</strong>terrogation.
