In <strong>the</strong> current practice <strong>of</strong> prosecut<strong>in</strong>g war crimes <strong>in</strong> Serbia, it is evident that <strong>the</strong> measures <strong>of</strong>nonprocedural protection do not achieve <strong>the</strong>ir purpose when it comes <strong>to</strong> <strong>in</strong>sider witnesses – <strong>for</strong>meror active members <strong>of</strong> <strong>the</strong> armed <strong>for</strong>ces <strong>of</strong> Republic <strong>of</strong> Serbia who participated <strong>and</strong>/or have knowledge<strong>of</strong> <strong>the</strong> crimes committed, ow<strong>in</strong>g <strong>to</strong> <strong>the</strong> <strong>in</strong>conclusive legal framework <strong>and</strong> <strong>in</strong>sufficient political support<strong>for</strong> this most vulnerable aspect <strong>of</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes. Among <strong>the</strong> numerous problems thath<strong>in</strong>der an effective protection <strong>of</strong> <strong>in</strong>sider witnesses <strong>and</strong> thus seriously threaten prosecut<strong>in</strong>g <strong>the</strong> personsresponsible <strong>for</strong> committed war crimes, those that st<strong>and</strong> out are: an <strong>in</strong>adequate legal framework <strong>for</strong><strong>the</strong> protection <strong>of</strong> <strong>in</strong>sider witnesses who do not enter <strong>in</strong><strong>to</strong> a protection programme, weak mechanisms<strong>for</strong> <strong>the</strong> control <strong>and</strong> supervision <strong>of</strong> <strong>the</strong> witness protection programme, non-transparent <strong>and</strong> ad hocprocedures <strong>for</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>of</strong> misconducts <strong>of</strong> members <strong>of</strong> Protection Unit, as well as <strong>the</strong> publicsupport <strong>of</strong> government representatives <strong>for</strong> war crimes suspects. The problems <strong>in</strong> <strong>the</strong> system <strong>for</strong> <strong>the</strong>protection <strong>of</strong> <strong>in</strong>sider witnesses <strong>in</strong> Serbia have been registered by several <strong>in</strong>ternational <strong>in</strong>stitutions <strong>and</strong>organi<strong>za</strong>tions. 13General objective: The lives, health <strong>and</strong> property <strong>of</strong> witnesses <strong>and</strong> <strong>in</strong>sider witnesses shall be protectedby effective measures <strong>of</strong> non-procedural protection, <strong>in</strong> an atmosphere <strong>of</strong> clear political <strong>and</strong> public/social support <strong>for</strong> <strong>the</strong> participation <strong>of</strong> <strong>in</strong>sider witnesses <strong>in</strong> <strong>the</strong> cases <strong>of</strong> war crimes.Specific objective no. 1: An effective mechanism <strong>of</strong> protection <strong>of</strong> witnesses <strong>and</strong> <strong>in</strong>sider witnesseswho do not enter <strong>in</strong><strong>to</strong> a witness protection programme is established.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry<strong>of</strong> Justice, <strong>the</strong> OWCP, <strong>the</strong> Higher Court Department <strong>and</strong> Appeals Court Department, <strong>the</strong>M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior <strong>and</strong> legal experts, who will: i) <strong>for</strong>mulate amendments <strong>to</strong> Article102, paragraph 5 <strong>of</strong> <strong>the</strong> CPC, <strong>to</strong> <strong>in</strong>troduce <strong>the</strong> obligation <strong>of</strong> <strong>the</strong> court <strong>and</strong> prosecu<strong>to</strong>r <strong>to</strong> seekprotection from <strong>the</strong> police <strong>for</strong> witnesses who report be<strong>in</strong>g threatened <strong>dur<strong>in</strong>g</strong> <strong>the</strong> proceed<strong>in</strong>gs,<strong>and</strong> <strong>the</strong>ir obligation <strong>to</strong> <strong>in</strong><strong>for</strong>m <strong>the</strong> participants <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs <strong>of</strong> <strong>the</strong> measures taken;ii) <strong>the</strong> same task <strong>for</strong>ce will draft a Pro<strong>to</strong>col on <strong>the</strong> procedure <strong>in</strong> cases <strong>of</strong> threats addressed<strong>to</strong> witnesses <strong>in</strong> war crimes cases; iii) review any fur<strong>the</strong>r amendments <strong>to</strong> <strong>the</strong> CPC <strong>and</strong> o<strong>the</strong>rregulations <strong>for</strong> <strong>the</strong> purpose <strong>of</strong> streng<strong>the</strong>n<strong>in</strong>g this component <strong>of</strong> witness protection.23b) The prosecu<strong>to</strong>rs, judges <strong>and</strong> <strong>the</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior shall consistentlyapply <strong>the</strong> mechanisms established.Specific objective no. 2: A reliable, functional <strong>and</strong> viable witness Protection Programme shall beestablished.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong>Justice, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior <strong>and</strong> <strong>the</strong> Victims <strong>and</strong> Witnesses Section <strong>of</strong> <strong>the</strong> ICTY. Thetask <strong>for</strong>ce shall prepare amendments <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> Protection <strong>of</strong> Participants <strong>in</strong> Crim<strong>in</strong>alProceed<strong>in</strong>gs which will:13 Council <strong>of</strong> Europe, European Commission, European Parliament, OSCE <strong>and</strong> Amnesty International.Humanitarian Law Center
