defence counsel, representatives <strong>of</strong> non-governmental organi<strong>za</strong>tions, victims, <strong>for</strong>mer witnesses from <strong>the</strong>Protection Programme <strong>for</strong> <strong>the</strong> participants <strong>in</strong> <strong>the</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs, legal experts, <strong>and</strong> <strong>the</strong> analyses<strong>of</strong> judgments <strong>and</strong> o<strong>the</strong>r documents rendered with regard <strong>to</strong> war crimes proceed<strong>in</strong>gs conducted <strong>in</strong> <strong>the</strong>country <strong>and</strong> <strong>the</strong> region <strong>of</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>. Dur<strong>in</strong>g <strong>the</strong> research, <strong>the</strong> HLC’s collocu<strong>to</strong>rs agreed that <strong>the</strong>adoption <strong>of</strong> a state strategy <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes would represent a significant stimulus <strong>for</strong>this important social process <strong>and</strong> a <strong>to</strong>ol <strong>for</strong> address<strong>in</strong>g a number <strong>of</strong> issues <strong>in</strong> this area. The Analysis alsoconta<strong>in</strong>s 75 recommendations addressed <strong>to</strong> <strong>the</strong> state bodies <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia <strong>and</strong> <strong>to</strong> <strong>in</strong>ternationalac<strong>to</strong>rs, <strong>for</strong> <strong>the</strong> purpose <strong>of</strong> enhanc<strong>in</strong>g various sec<strong>to</strong>rs <strong>of</strong> war crimes prosecution <strong>in</strong> Serbia, <strong>and</strong> particularlywith an eye <strong>to</strong> harmoni<strong>za</strong>tion with <strong>in</strong>ternational st<strong>and</strong>ards <strong>in</strong> certa<strong>in</strong> areas.After publish<strong>in</strong>g <strong>the</strong> Analysis, <strong>the</strong> HLC organized five consultative meet<strong>in</strong>gs with representatives <strong>of</strong><strong>in</strong>stitutions <strong>of</strong> Serbia <strong>and</strong> o<strong>the</strong>r ac<strong>to</strong>rs who participated <strong>in</strong> <strong>the</strong> production <strong>of</strong> <strong>the</strong> Analysis. 3 Dur<strong>in</strong>g <strong>the</strong>consultative meet<strong>in</strong>gs, <strong>the</strong> representatives <strong>of</strong> <strong>in</strong>stitutions <strong>and</strong> experts provided <strong>the</strong>ir assistance <strong>in</strong> <strong>the</strong>fur<strong>the</strong>r articulation <strong>of</strong> recommendations <strong>for</strong> <strong>the</strong> improvement <strong>of</strong> certa<strong>in</strong> aspects <strong>of</strong> <strong>the</strong> prosecution<strong>of</strong> war crimes <strong>in</strong> Serbia. The conclusions <strong>and</strong> recommendations from <strong>the</strong>se sessions are embodied <strong>in</strong><strong>the</strong> <strong>Model</strong> <strong>Strategy</strong>.The <strong>Model</strong> <strong>Strategy</strong> def<strong>in</strong>es <strong>the</strong> activities, activity leaders <strong>and</strong> resources necessary <strong>for</strong> <strong>the</strong> fulfill<strong>in</strong>g<strong>of</strong> objectives aimed at <strong>the</strong> resolution <strong>of</strong> <strong>the</strong> problems encountered <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes,<strong>and</strong> also at <strong>the</strong> significant <strong>in</strong>tensification <strong>of</strong> <strong>the</strong> work on <strong>the</strong>se cases <strong>in</strong> <strong>the</strong> follow<strong>in</strong>g 10 years. The<strong>Model</strong> <strong>Strategy</strong> covers <strong>the</strong> period 2015-2025, s<strong>in</strong>ce this period represents <strong>the</strong> key period <strong>for</strong> br<strong>in</strong>g<strong>in</strong>gresponsible <strong>in</strong>dividuals <strong>to</strong> justice. In <strong>the</strong> period follow<strong>in</strong>g 2015-2025, <strong>the</strong> <strong>in</strong>tensity <strong>of</strong> court proceed<strong>in</strong>gsis expected <strong>to</strong> drop, ow<strong>in</strong>g <strong>to</strong> <strong>the</strong> passage <strong>of</strong> time <strong>and</strong> life span <strong>of</strong> witnesses, perpetra<strong>to</strong>rs, <strong>and</strong> survivors;however, it is not expected <strong>to</strong> s<strong>to</strong>p completely. In this sense, <strong>the</strong> <strong>Model</strong> <strong>Strategy</strong> represents a valuableguidel<strong>in</strong>e <strong>for</strong> <strong>the</strong> work <strong>of</strong> <strong>in</strong>stitutions even <strong>in</strong> <strong>the</strong> period follow<strong>in</strong>g 2025.8<strong>War</strong> crimes trials represent a precondition <strong>for</strong> <strong>the</strong> democrati<strong>za</strong>tion <strong>of</strong> a society, affirmation <strong>of</strong><strong>the</strong> culture <strong>of</strong> human rights <strong>and</strong> <strong>the</strong> rule <strong>of</strong> law, <strong>and</strong> reconciliation between peoples <strong>in</strong> <strong>the</strong> region.Follow<strong>in</strong>g <strong>the</strong> completion <strong>of</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> International Crim<strong>in</strong>al Tribunal <strong>for</strong> <strong>the</strong> <strong>Former</strong> <strong>Yugoslavia</strong>(ICTY), local judicial <strong>in</strong>stitutions represent <strong>the</strong> only mechanism <strong>for</strong> establish<strong>in</strong>g crim<strong>in</strong>al justice <strong>for</strong><strong>the</strong> wrongdo<strong>in</strong>gs committed <strong>dur<strong>in</strong>g</strong> <strong>the</strong> n<strong>in</strong>eteen-n<strong>in</strong>eties. In addition <strong>to</strong> this, <strong>the</strong> establish<strong>in</strong>g <strong>of</strong><strong>in</strong>dividual crim<strong>in</strong>al responsibility <strong>for</strong> war crimes on <strong>the</strong> terri<strong>to</strong>ry <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> representspart <strong>of</strong> <strong>the</strong> <strong>for</strong>mal conditions <strong>for</strong> Serbia’s accession <strong>to</strong> <strong>the</strong> European Union, as <strong>in</strong>tegrated <strong>in</strong> <strong>the</strong>negotiation chapter 23 (Rule <strong>of</strong> Law).The HLC believes that <strong>the</strong> adoption <strong>and</strong> <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> <strong>Strategy</strong> would be <strong>the</strong> key guarantee<strong>of</strong> <strong>the</strong> dedication <strong>of</strong> government authorities <strong>to</strong> this significant social process, <strong>and</strong> <strong>the</strong> fulfillment <strong>of</strong><strong>the</strong> legal <strong>and</strong> civili<strong>za</strong>tional obligations <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia <strong>to</strong>wards victims <strong>of</strong> <strong>the</strong> war crimescommitted <strong>dur<strong>in</strong>g</strong> <strong>the</strong> 1990’s.The HLC calls <strong>for</strong> <strong>the</strong> Republic <strong>of</strong> Serbia’s M<strong>in</strong>istry <strong>of</strong> Justice <strong>to</strong> establish a task <strong>for</strong>ce <strong>for</strong> <strong>the</strong> discussion<strong>of</strong> <strong>the</strong> <strong>Model</strong> <strong>Strategy</strong>, thus <strong>in</strong>itiat<strong>in</strong>g <strong>the</strong> process <strong>of</strong> <strong>the</strong> production <strong>of</strong> a government strategy <strong>for</strong> <strong>the</strong>prosecution <strong>of</strong> war crimes <strong>in</strong> Serbia <strong>for</strong> <strong>the</strong> period 2015-2025, <strong>and</strong> an accompany<strong>in</strong>g action plan,which would <strong>the</strong>n be proposed <strong>to</strong> <strong>the</strong> Governement <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia <strong>for</strong> adoption.3 List <strong>of</strong> participants enclosed <strong>in</strong> Annex 1.Humanitarian Law Center


IntroductionThe political crisis <strong>and</strong> <strong>the</strong> break-up <strong>of</strong> <strong>the</strong> Socialist Federal Republic <strong>of</strong> <strong>Yugoslavia</strong> resulted <strong>in</strong> five<strong>in</strong>ternational <strong>and</strong> <strong>in</strong>ternal armed conflicts – <strong>in</strong> Slovenia (June-July 1991), Croatia (1991-95), Bosnia<strong>and</strong> Herzegov<strong>in</strong>a (1992-95), Kosovo (1998-99), <strong>and</strong> Macedonia (February – August 2001). Theconflicts were marked by serious, systematic <strong>and</strong> mass violations <strong>of</strong> <strong>in</strong>ternational humanitarianlaw. The conflicts resulted <strong>in</strong> more than 130,000 casualties, most <strong>of</strong> whom were civilians. More than11,000 people are still registered as miss<strong>in</strong>g. Tens <strong>of</strong> thous<strong>and</strong>s <strong>of</strong> people were deta<strong>in</strong>ed <strong>in</strong> camps<strong>and</strong> collection centres, where <strong>the</strong>y endured <strong>to</strong>rture, sexual violence, <strong>in</strong>human treatment, <strong>and</strong> o<strong>the</strong>rsorts <strong>of</strong> violence <strong>and</strong> humiliat<strong>in</strong>g treatment. Approximately 4.5 million people were <strong>for</strong>ced <strong>to</strong> leave<strong>the</strong>ir homes. The conflicts were marked by large-scale destruction <strong>and</strong> loot<strong>in</strong>g <strong>of</strong> private <strong>and</strong> publicproperty, <strong>in</strong>dustrial facilities, cultural <strong>and</strong> religious facilities, etc.The Government <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia’s stance is that every case <strong>of</strong> war crimes has <strong>to</strong> be<strong>in</strong>vestigated <strong>and</strong> appropriately punished <strong>in</strong> accordance with <strong>the</strong> applicable domestic <strong>and</strong> <strong>in</strong>ternationalprovisions, regardless <strong>of</strong> <strong>the</strong> national or religious background, or any o<strong>the</strong>r personal characteristic<strong>of</strong> a victim or a perpetra<strong>to</strong>r. All <strong>in</strong>dividuals who are suspected <strong>of</strong> committ<strong>in</strong>g war crimes, ei<strong>the</strong>r <strong>in</strong><strong>the</strong> capacity <strong>of</strong> direct perpetra<strong>to</strong>rs, or as comm<strong>and</strong>ers or persons responsible <strong>for</strong> <strong>the</strong>se crimes on<strong>the</strong> basis <strong>of</strong> comm<strong>and</strong> responsibility, have <strong>to</strong> be brought <strong>to</strong> justice <strong>in</strong> accordance with domestic <strong>and</strong><strong>in</strong>ternational law.9The establish<strong>in</strong>g <strong>of</strong> <strong>in</strong>dividual crim<strong>in</strong>al responsibility <strong>for</strong> war crimes committed <strong>dur<strong>in</strong>g</strong> <strong>the</strong> n<strong>in</strong>eteenn<strong>in</strong>etiesrepresents a necessary condition <strong>for</strong> <strong>the</strong> rule <strong>of</strong> law <strong>and</strong> <strong>the</strong> streng<strong>the</strong>n<strong>in</strong>g <strong>of</strong> <strong>the</strong> credibility <strong>of</strong><strong>in</strong>stitutions, particularly <strong>the</strong> credibility <strong>of</strong> <strong>the</strong> judicial bodies <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia. In <strong>the</strong> light <strong>of</strong><strong>the</strong> strong determ<strong>in</strong>ation <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia <strong>to</strong> become a member <strong>of</strong> <strong>the</strong> European Union (EU),<strong>the</strong> prosecution <strong>of</strong> <strong>in</strong>dividuals responsible <strong>for</strong> <strong>the</strong> most serious violations <strong>of</strong> human rights represents astrong expression <strong>of</strong> <strong>the</strong> affirmation <strong>of</strong> basic pr<strong>in</strong>ciples that <strong>the</strong> EU rests on – <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong> <strong>the</strong> rule<strong>of</strong> law <strong>and</strong> <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong> respect <strong>for</strong> human rights <strong>and</strong> freedoms. The prosecution <strong>of</strong> war crimes alsorepresents <strong>the</strong> most significant step <strong>to</strong>wards <strong>the</strong> build<strong>in</strong>g <strong>of</strong> good neighbour <strong>relation</strong>s, reconciliationbetween peoples, <strong>and</strong> susta<strong>in</strong>able peace <strong>in</strong> <strong>the</strong> region <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>.After <strong>the</strong> adoption <strong>of</strong> Resolution 1503 by <strong>the</strong> UN Security Council <strong>in</strong> 2003, which announced <strong>the</strong>completion <strong>of</strong> <strong>the</strong> m<strong>and</strong>ate <strong>of</strong> <strong>the</strong> International Crim<strong>in</strong>al Tribunal <strong>for</strong> <strong>the</strong> <strong>Former</strong> <strong>Yugoslavia</strong> (ICTY),<strong>and</strong> called on <strong>the</strong> successor states <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> <strong>to</strong> re<strong>in</strong><strong>for</strong>ce <strong>the</strong>ir domestic capacities <strong>for</strong><strong>the</strong> prosecution <strong>of</strong> war crimes, <strong>the</strong> Republic <strong>of</strong> Serbia passed <strong>the</strong> Law on Organi<strong>za</strong>tion <strong>and</strong> Jurisdiction<strong>of</strong> Government Authorities <strong>in</strong> <strong>War</strong> <strong>Crimes</strong> Proceed<strong>in</strong>gs (Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong> <strong>War</strong> <strong>Crimes</strong>),which established specialized <strong>in</strong>stitutions <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes – <strong>the</strong> Office <strong>of</strong> <strong>the</strong> <strong>War</strong><strong>Crimes</strong> Prosecu<strong>to</strong>r (OWCP), specialized trial chambers, police <strong>in</strong>vestigation <strong>and</strong> witness protectionunits, <strong>and</strong> <strong>the</strong> service <strong>for</strong> <strong>the</strong> witnesses/victims support. O<strong>the</strong>r laws <strong>and</strong> bylaws have also been passedHumanitarian Law Center


<strong>of</strong> perpetra<strong>to</strong>rs, <strong>and</strong> <strong>the</strong>se are <strong>in</strong>dictments raised aga<strong>in</strong>st perpetra<strong>to</strong>rs who held lower rank<strong>in</strong>gpositions <strong>in</strong> <strong>the</strong> political, military <strong>and</strong> police hierarchy. The decisions <strong>of</strong> <strong>the</strong> OWCP <strong>to</strong> file <strong>in</strong>dictments<strong>in</strong> certa<strong>in</strong> cases has po<strong>in</strong>ted <strong>to</strong> <strong>the</strong> lack <strong>of</strong> clear criteria accord<strong>in</strong>g <strong>to</strong> which cases are be<strong>in</strong>g selectedfrom <strong>the</strong> group <strong>of</strong> unresolved cases which are pend<strong>in</strong>g pre-<strong>in</strong>vestigation phase, be<strong>for</strong>e <strong>the</strong> launch<strong>in</strong>g <strong>of</strong><strong>in</strong>vestigations. Certa<strong>in</strong> <strong>in</strong>dictments, accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> assessment <strong>of</strong> <strong>the</strong> expert public, have representedan irrational spend<strong>in</strong>g <strong>of</strong> resources, bear<strong>in</strong>g <strong>in</strong> m<strong>in</strong>d a number <strong>of</strong> o<strong>the</strong>r cases with serious evidentiarymaterial collected by <strong>the</strong> ICTY, with regard <strong>to</strong> which <strong>the</strong> OWCP has never launched <strong>in</strong>vestigations.Compared <strong>to</strong> <strong>the</strong> prosecution <strong>of</strong>fices which have <strong>the</strong> same competences <strong>in</strong> <strong>the</strong> region, <strong>in</strong> BiH <strong>and</strong>Croatia <strong>in</strong> particular, <strong>the</strong> <strong>in</strong>dica<strong>to</strong>rs <strong>of</strong> <strong>the</strong> OWCP’s work are visibly poorer. Due <strong>to</strong> <strong>the</strong> small number<strong>of</strong> cases ongo<strong>in</strong>g be<strong>for</strong>e <strong>the</strong> trial chambers <strong>in</strong> <strong>the</strong> period 2011-2014, <strong>the</strong>ir capacities have rema<strong>in</strong>edunused, <strong>and</strong> <strong>the</strong> judges sitt<strong>in</strong>g <strong>in</strong> <strong>the</strong>se chambers were appo<strong>in</strong>ted <strong>to</strong> act <strong>in</strong> cases <strong>of</strong> organized crime.The results <strong>of</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> OWCP do not meet <strong>the</strong> expectations <strong>of</strong> a concerned public, or <strong>of</strong> <strong>the</strong>survivors <strong>and</strong> families <strong>of</strong> victims <strong>of</strong> war crimes committed.As <strong>for</strong> <strong>the</strong> cases <strong>in</strong> which prosecution has yet <strong>to</strong> beg<strong>in</strong>, <strong>the</strong>re are more than 800 pend<strong>in</strong>g cases <strong>in</strong><strong>the</strong> OWCR records. Alongside <strong>the</strong> new cases that <strong>the</strong> OWCP will certa<strong>in</strong>ly take up <strong>in</strong> its work, <strong>the</strong>pend<strong>in</strong>g cases represent a serious challenge <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes <strong>in</strong> Serbia, <strong>and</strong> po<strong>in</strong>t <strong>to</strong>possible failures <strong>in</strong> establish<strong>in</strong>g justice <strong>in</strong> <strong>the</strong> case <strong>of</strong> a large number <strong>of</strong> crimes committed <strong>dur<strong>in</strong>g</strong> <strong>the</strong>1990’s.Consider<strong>in</strong>g <strong>the</strong> current dynamics <strong>in</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> OWCP, it is clear that <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>for</strong>thcom<strong>in</strong>gperiod <strong>of</strong> 10 years, less than 10% <strong>of</strong> <strong>the</strong> exist<strong>in</strong>g pend<strong>in</strong>g cases will be completed if <strong>the</strong> OWCP ma<strong>in</strong>ta<strong>in</strong>s<strong>the</strong> current dynamics - <strong>and</strong> this assessment excludes <strong>the</strong> new cases. These anticipated results <strong>of</strong> <strong>the</strong>work <strong>of</strong> <strong>the</strong> OWCP po<strong>in</strong>t <strong>to</strong> <strong>the</strong> need <strong>for</strong> a new approach <strong>in</strong> order <strong>to</strong> resolve a substantial number <strong>of</strong>unresolved cases <strong>in</strong> <strong>the</strong> <strong>for</strong>eseeable period <strong>of</strong> time.There are a number <strong>of</strong> reasons lead<strong>in</strong>g <strong>to</strong> this unsatisfac<strong>to</strong>ry level <strong>of</strong> efficiency. The OWCP lacks<strong>the</strong> clearly def<strong>in</strong>ed work<strong>in</strong>g strategy necessary <strong>for</strong> efficient operation <strong>in</strong> a complex field such as <strong>the</strong>prosecution <strong>of</strong> war crimes. The OWCP <strong>and</strong> <strong>the</strong> <strong>War</strong> <strong>Crimes</strong> Investigative Service (WCIS), as <strong>the</strong>key <strong>in</strong>stitutions responsible <strong>for</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>and</strong> prosecution <strong>of</strong> war crimes cases, do not havesufficient f<strong>in</strong>ancial <strong>and</strong> human resources <strong>for</strong> work on such a larger number <strong>of</strong> cases, certa<strong>in</strong> <strong>of</strong><strong>the</strong>m very complex. A number <strong>of</strong> problems have also been identified <strong>in</strong> <strong>the</strong> work <strong>and</strong> communicationbetween <strong>the</strong>se two <strong>in</strong>stitutions. The problems concern<strong>in</strong>g protection <strong>of</strong> <strong>in</strong>sider witnesses also affects<strong>the</strong> possibility <strong>of</strong> start<strong>in</strong>g a larger number <strong>of</strong> cases. 511On <strong>the</strong> o<strong>the</strong>r h<strong>and</strong>, <strong>the</strong>re are a number <strong>of</strong> circumstances, which may have a positive effect on <strong>the</strong>likelihood <strong>of</strong> more efficient work by <strong>the</strong> <strong>in</strong>stitutions specialized <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes,<strong>the</strong> OWCP <strong>in</strong> particular; hence <strong>the</strong>y should be utilized more <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>for</strong>thcom<strong>in</strong>g period. By thisis meant that, <strong>dur<strong>in</strong>g</strong> its m<strong>and</strong>ate, <strong>the</strong> ICTY collected substantial amounts <strong>of</strong> documents which are<strong>in</strong>valuable <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes, which are available <strong>to</strong> <strong>the</strong> OWCP <strong>to</strong>day through variousmechanisms. A number <strong>of</strong> crimes have been reconstructed, as well as <strong>the</strong> contexts <strong>in</strong> which <strong>the</strong>ywere committed, as have <strong>the</strong> structure <strong>of</strong> <strong>the</strong> armed <strong>for</strong>ces <strong>and</strong> political authorities on <strong>the</strong> basis <strong>of</strong><strong>the</strong> factual <strong>and</strong> legal conclusions reached by this court. The OWCP also has direct cooperation with<strong>the</strong> prosecution <strong>of</strong>fices <strong>of</strong> <strong>the</strong> same competences <strong>in</strong> <strong>the</strong> region, which allows <strong>for</strong> an easy exchange <strong>of</strong>evidence <strong>and</strong> <strong>in</strong><strong>for</strong>mation.5 See Chapter 3.2. <strong>for</strong> more <strong>in</strong><strong>for</strong>mation on problems <strong>and</strong> measures <strong>for</strong> enhanc<strong>in</strong>g non-procedural protection.Humanitarian Law Center


General objective: By 2025, <strong>the</strong> OWCP will have prosecuted all priority cases <strong>of</strong> war crimes aga<strong>in</strong>stperpetra<strong>to</strong>rs accessible <strong>to</strong> <strong>the</strong> <strong>in</strong>stitutions <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia; it will also have provided evidence<strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> o<strong>the</strong>r perpetra<strong>to</strong>rs be<strong>for</strong>e <strong>the</strong> state <strong>in</strong>stitutions <strong>of</strong> <strong>the</strong> countries <strong>to</strong> which <strong>the</strong>seperpetra<strong>to</strong>rs are accessible by means <strong>of</strong> regional cooperation, <strong>and</strong> it will have prosecuted at least half<strong>of</strong> <strong>the</strong> mid-priority cases.1.1. OWCP’s strategy <strong>for</strong> act<strong>in</strong>g <strong>in</strong> cases <strong>of</strong> war crimesAccord<strong>in</strong>g <strong>to</strong> <strong>the</strong> <strong>in</strong><strong>for</strong>mation by <strong>the</strong> OWCP, <strong>the</strong>re are more than 800 cases aga<strong>in</strong>st identified <strong>and</strong>unidentified <strong>in</strong>dividuals pend<strong>in</strong>g pre-<strong>in</strong>vestigative phase <strong>and</strong> it is certa<strong>in</strong> that this number will <strong>in</strong>crease<strong>in</strong> <strong>the</strong> <strong>for</strong>thcom<strong>in</strong>g period.The prosecu<strong>to</strong>r <strong>of</strong>fices responsible <strong>for</strong> cases <strong>of</strong> war crimes <strong>in</strong> <strong>the</strong> region <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>,which deal with similar workloads <strong>of</strong> unresolved cases (BiH <strong>and</strong> Croatia), have adopted strategydocuments express<strong>in</strong>g <strong>the</strong>ir determ<strong>in</strong>ation <strong>to</strong> achieve <strong>the</strong> resolution <strong>of</strong> priority <strong>and</strong> <strong>the</strong> most complexcases, <strong>and</strong> def<strong>in</strong><strong>in</strong>g <strong>the</strong> criteria <strong>to</strong> be followed <strong>in</strong> <strong>the</strong> identification <strong>of</strong> <strong>the</strong>se cases, action plans <strong>for</strong> <strong>the</strong>secases, required resources, etc.12The adoption <strong>of</strong> a similar strategy document is important <strong>for</strong> <strong>the</strong> future work <strong>of</strong> <strong>the</strong> OWCP <strong>and</strong>efficient prosecution <strong>of</strong> war crimes <strong>in</strong> Serbia, <strong>for</strong> a number <strong>of</strong> reasons. First <strong>of</strong> all, <strong>the</strong> OWCP’s <strong>Strategy</strong><strong>for</strong> act<strong>in</strong>g <strong>in</strong> unresolved cases <strong>of</strong> war crimes (OWCP’s <strong>Strategy</strong>) would establish objectives <strong>and</strong>deadl<strong>in</strong>es <strong>for</strong> action <strong>in</strong> cases <strong>and</strong> <strong>in</strong> <strong>the</strong> cases that will be assigned <strong>to</strong> OWCP <strong>in</strong> <strong>the</strong> future. This wouldcontribute <strong>to</strong> a more rational use <strong>of</strong> <strong>the</strong> OWCP’s resources <strong>and</strong> <strong>the</strong> establish<strong>in</strong>g <strong>of</strong> measurable criteria<strong>for</strong> <strong>the</strong> assessment <strong>of</strong> <strong>the</strong> success <strong>of</strong> <strong>the</strong> work <strong>of</strong> this <strong>in</strong>stitution. The OWCP’s <strong>Strategy</strong> will <strong>in</strong>troducetransparency <strong>to</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> OWCP <strong>and</strong> contribute <strong>to</strong> <strong>the</strong> streng<strong>the</strong>n<strong>in</strong>g <strong>of</strong> <strong>the</strong> credibility <strong>of</strong> this<strong>in</strong>stitution <strong>in</strong> <strong>the</strong> eyes <strong>of</strong> <strong>the</strong> public.Prior <strong>to</strong> <strong>the</strong> beg<strong>in</strong>n<strong>in</strong>g <strong>of</strong> <strong>the</strong> production <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>, it will be necessary <strong>to</strong> establish <strong>the</strong>exact number <strong>and</strong> nature <strong>of</strong> unresolved cases <strong>of</strong> war crimes under <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP. Itwill also be necessary <strong>to</strong> establish <strong>the</strong> exact number <strong>of</strong> cases <strong>of</strong> war crimes still pend<strong>in</strong>g be<strong>for</strong>e courts<strong>of</strong> general jurisdiction <strong>and</strong> <strong>in</strong>itiate <strong>the</strong>ir transfer <strong>to</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP, ow<strong>in</strong>g <strong>to</strong> <strong>the</strong> lack <strong>of</strong>capacities <strong>in</strong> <strong>the</strong> courts <strong>and</strong> prosecution <strong>of</strong>fices <strong>of</strong> <strong>the</strong> general jurisdiction <strong>to</strong> prosecute cases <strong>of</strong> warcrimes.Specific objective no. 1: All cases <strong>of</strong> war crimes <strong>and</strong> o<strong>the</strong>r crim<strong>in</strong>al <strong>of</strong>fences which could becharacterized as war crimes which are pend<strong>in</strong>g be<strong>for</strong>e <strong>the</strong> courts <strong>and</strong> prosecution <strong>of</strong>fices <strong>of</strong> generaljurisdiction, are transferred <strong>to</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice will <strong>in</strong>itiate <strong>the</strong> procedure <strong>for</strong> <strong>the</strong> amendment <strong>of</strong> Article 20 Paragraph2 <strong>of</strong> <strong>the</strong> Law on <strong>the</strong> Public Prosecu<strong>to</strong>r’s Office, hence extend<strong>in</strong>g <strong>the</strong> power <strong>of</strong> <strong>the</strong> RepublicPublic Prosecu<strong>to</strong>r <strong>to</strong> authorize <strong>the</strong> Prosecu<strong>to</strong>r <strong>for</strong> Organized Crime <strong>to</strong> act <strong>in</strong> cases from <strong>the</strong>competence <strong>of</strong> ano<strong>the</strong>r prosecu<strong>to</strong>r, <strong>for</strong> <strong>the</strong> purpose <strong>of</strong> a more efficient prosecution or someo<strong>the</strong>r important reasons <strong>to</strong> <strong>the</strong> <strong>War</strong> <strong>Crimes</strong> Prosecu<strong>to</strong>r as well.b) The Republic Public Prosecu<strong>to</strong>r shall, <strong>in</strong> accordance with Article 20 Paragraph 1 <strong>and</strong> Article 29Paragraph 3 Item 2 <strong>of</strong> <strong>the</strong> Law on <strong>the</strong> Public Prosecu<strong>to</strong>r’s Office, will conduct supervision <strong>of</strong> <strong>the</strong>cases <strong>of</strong> war crimes <strong>and</strong> o<strong>the</strong>r crim<strong>in</strong>al <strong>of</strong>fences committed <strong>dur<strong>in</strong>g</strong> <strong>the</strong> armed conflicts, <strong>to</strong> beHumanitarian Law Center


qualified as war crimes accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> circumstances <strong>of</strong> <strong>the</strong> event, <strong>and</strong> which are under <strong>the</strong>jurisdiction <strong>of</strong> <strong>the</strong> prosecu<strong>to</strong>rs <strong>of</strong> general jurisdiction, <strong>and</strong> render decisions on <strong>the</strong> transfer <strong>of</strong><strong>the</strong>se cases <strong>to</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP, or it will authorize <strong>the</strong> OWCP <strong>to</strong> act <strong>in</strong> <strong>the</strong>se cases.c) The Republic Public Prosecu<strong>to</strong>r will publish a list <strong>of</strong> <strong>the</strong>se cases on its <strong>web</strong> page.Specific objective no. 2: The OWCP will have detailed <strong>and</strong> comprehensive records <strong>of</strong> unresolvedcases <strong>of</strong> war crimes.Activities:a) The Prosecu<strong>to</strong>r shall <strong>for</strong>m a Team <strong>for</strong> record<strong>in</strong>g cases compris<strong>in</strong>g two deputy prosecu<strong>to</strong>rs <strong>and</strong>an associate, who will be tasked <strong>to</strong> prepare detailed records <strong>of</strong> all cases pend<strong>in</strong>g <strong>in</strong> <strong>the</strong> OWCP;<strong>the</strong> records will consist <strong>of</strong> <strong>in</strong><strong>for</strong>mation on <strong>the</strong> most significant elements <strong>of</strong> each case (shortdescription <strong>of</strong> <strong>the</strong> crim<strong>in</strong>al <strong>of</strong>fence, qualification <strong>of</strong> <strong>the</strong> act, number <strong>of</strong> victims, affiliation <strong>to</strong> <strong>the</strong>party <strong>to</strong> <strong>the</strong> conflict, <strong>and</strong> <strong>the</strong> rank <strong>of</strong> <strong>the</strong> suspects, number <strong>of</strong> victims, available evidence, etc.).b) The Records Team shall update all subsequently received cases <strong>and</strong> <strong>for</strong>ward <strong>the</strong>m <strong>to</strong> <strong>the</strong>OWCP <strong>Strategy</strong> Draft<strong>in</strong>g Team.Specific objective no. 3: The OWCP shall have prepared <strong>and</strong> adopted <strong>the</strong> Work <strong>Strategy</strong> <strong>for</strong> <strong>the</strong>period 2015-2025.Activities:a) The Prosecu<strong>to</strong>r shall <strong>for</strong>m OWCP <strong>Strategy</strong> Draft<strong>in</strong>g Team (Team), which will comprise twodeputy prosecu<strong>to</strong>rs <strong>and</strong> an associate, who will, after <strong>the</strong> adoption <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>,have <strong>the</strong> task <strong>of</strong> moni<strong>to</strong>r<strong>in</strong>g its application (Team <strong>for</strong> <strong>the</strong> Moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> <strong>the</strong> Application <strong>of</strong> <strong>the</strong><strong>Strategy</strong>).13b) The Team shall organize expert consultation with prosecu<strong>to</strong>rs from <strong>the</strong> OWCP, <strong>the</strong> RepublicPublic Prosecu<strong>to</strong>r’s Office, judges <strong>of</strong> <strong>the</strong> Higher Court Department , <strong>the</strong> Appeals CourtDepartment, ICTY representatives, legal experts, prosecu<strong>to</strong>rs from <strong>the</strong> region, organi<strong>za</strong>tionsmoni<strong>to</strong>r<strong>in</strong>g war crimes trials, <strong>and</strong> o<strong>the</strong>r relevant collocu<strong>to</strong>rs, on <strong>the</strong> criteria <strong>for</strong> <strong>the</strong> prioriti<strong>za</strong>tion<strong>of</strong> cases. Among <strong>the</strong> criteria that will be discussed <strong>dur<strong>in</strong>g</strong> <strong>the</strong> consultation, although notnecessarily exclusively, are: i) <strong>the</strong> severity <strong>of</strong> consequences (<strong>the</strong> act <strong>of</strong> commission) <strong>and</strong> <strong>the</strong>extent <strong>of</strong> <strong>the</strong> crime (<strong>the</strong> number <strong>of</strong> victims, <strong>the</strong> proportion <strong>of</strong> destruction <strong>of</strong> property <strong>and</strong>cultural <strong>and</strong> religious facilities); ii) <strong>the</strong> role <strong>of</strong> <strong>the</strong> accused (<strong>for</strong>mal <strong>and</strong> de fac<strong>to</strong> position <strong>in</strong>military/paramilitary/police/political hierarchy); iii) availability <strong>of</strong> suspect/s; iv) availability<strong>and</strong> quality <strong>of</strong> evidence; v) cruelty <strong>and</strong> recklessness when committ<strong>in</strong>g <strong>the</strong> crim<strong>in</strong>al <strong>of</strong>fence; vii)<strong>the</strong> <strong>in</strong>terest <strong>of</strong> <strong>the</strong> public.c) A catalogue <strong>of</strong> criteria shall be created by <strong>the</strong> Team <strong>for</strong> case prioriti<strong>za</strong>tion.d) Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> criteria established, <strong>the</strong> Team shall determ<strong>in</strong>e <strong>the</strong> categori<strong>za</strong>tion <strong>of</strong> cases,<strong>in</strong>clud<strong>in</strong>g A, B, <strong>and</strong> C categories: category A <strong>in</strong>cludes priority cases, mean<strong>in</strong>g <strong>the</strong> cases whichfulfil most <strong>of</strong> <strong>the</strong> criteria established; category B <strong>in</strong>cludes middle priority cases; <strong>and</strong> categoryC <strong>in</strong>cludes <strong>the</strong> lowest priority level.Humanitarian Law Center


e) The Team shall create a draft <strong>Strategy</strong> <strong>for</strong> <strong>the</strong> OWCP, which will <strong>in</strong>clude (but will not belimited <strong>to</strong>) <strong>the</strong> follow<strong>in</strong>g elements:i. Catalogue <strong>of</strong> cases listed by categories;ii. Action Plan <strong>for</strong> work on cases <strong>in</strong> A <strong>and</strong> B categories up till 2025;iii. Prelim<strong>in</strong>ary assessment <strong>of</strong> necessary resources <strong>for</strong> <strong>the</strong> meet<strong>in</strong>g <strong>of</strong> objectives <strong>and</strong> deadl<strong>in</strong>esestablished by <strong>the</strong> OWCP’s <strong>Strategy</strong> <strong>and</strong> accompany<strong>in</strong>g Action Plan;iv. Guidel<strong>in</strong>es <strong>for</strong> <strong>the</strong> use <strong>of</strong> <strong>the</strong> evidence <strong>and</strong> facts established be<strong>for</strong>e <strong>the</strong> ICTY, <strong>the</strong>application <strong>of</strong> provisions <strong>of</strong> <strong>in</strong>ternational law (particularly <strong>the</strong> provisions relat<strong>in</strong>g <strong>to</strong>comm<strong>and</strong> responsibility <strong>and</strong> crimes aga<strong>in</strong>st humanity), <strong>the</strong> support <strong>to</strong> <strong>the</strong> <strong>in</strong>jured parties<strong>for</strong> <strong>the</strong> purpose <strong>of</strong> prov<strong>in</strong>g <strong>the</strong>ir compensation claims <strong>dur<strong>in</strong>g</strong> <strong>the</strong> crim<strong>in</strong>al trial, etc;v. Action Plan <strong>for</strong> <strong>in</strong>vestigations <strong>in</strong><strong>to</strong> property acquired through <strong>the</strong> commission <strong>of</strong> warcrimes;f) The Prosecu<strong>to</strong>r shall discuss <strong>and</strong> adopt <strong>the</strong> OWCP’s <strong>Strategy</strong> upon receiv<strong>in</strong>g <strong>the</strong> op<strong>in</strong>ion <strong>of</strong> <strong>the</strong>Republic Public Prosecu<strong>to</strong>r;g) At a press conference, <strong>the</strong> Prosecu<strong>to</strong>r shall present <strong>the</strong> criteria <strong>for</strong> case categori<strong>za</strong>tion, <strong>the</strong>quantitative elements <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong> <strong>and</strong> Action Plan <strong>and</strong> o<strong>the</strong>r aspects <strong>of</strong> <strong>the</strong>OWCP’s <strong>Strategy</strong>, <strong>the</strong> publication <strong>of</strong> which is not <strong>to</strong> jeopardize any <strong>in</strong>vestigations <strong>and</strong> <strong>the</strong>work <strong>of</strong> <strong>the</strong> OWCP <strong>in</strong> certa<strong>in</strong> cases.14Specific objective no. 4: The OWCP shall implement <strong>the</strong> <strong>Strategy</strong> <strong>of</strong> <strong>the</strong> OWCP <strong>in</strong> l<strong>in</strong>e with <strong>the</strong>objectives <strong>and</strong> deadl<strong>in</strong>es set.Activities:a) The Prosecu<strong>to</strong>r <strong>and</strong> his deputies shall have annual work schedules <strong>for</strong> <strong>the</strong> follow<strong>in</strong>g yearcompleted by December 31 st , <strong>in</strong> l<strong>in</strong>e with <strong>the</strong> Action Plan <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>, <strong>and</strong> submit<strong>the</strong>m <strong>to</strong> <strong>the</strong> Team <strong>for</strong> Moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> <strong>the</strong> Application <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>;b) The Team <strong>for</strong> <strong>the</strong> moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> <strong>the</strong> application <strong>of</strong> OWCP’s <strong>Strategy</strong> shall coord<strong>in</strong>ate <strong>the</strong>application <strong>and</strong> submit quarterly reports <strong>to</strong> <strong>the</strong> Prosecu<strong>to</strong>r;c) The OWCP shall produce annual reports on <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> <strong>Strategy</strong> <strong>and</strong> submit<strong>the</strong>m <strong>to</strong> <strong>the</strong> Republic Public Prosecu<strong>to</strong>r, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice <strong>and</strong> <strong>the</strong> Committee <strong>for</strong> <strong>the</strong>Judiciary <strong>of</strong> <strong>the</strong> National Assembly;d) The Committee <strong>for</strong> <strong>the</strong> Judiciary <strong>of</strong> <strong>the</strong> National Assembly shall discuss <strong>the</strong> report on <strong>the</strong>implementation <strong>of</strong> <strong>the</strong> <strong>Strategy</strong> <strong>in</strong> a session attended by <strong>the</strong> Prosecu<strong>to</strong>r, <strong>and</strong> adopt <strong>the</strong>conclusion;e) <strong>the</strong> Prosecu<strong>to</strong>r shall present summary results from <strong>the</strong> annual report at a press conference.Humanitarian Law Center


1.2. Streng<strong>the</strong>n<strong>in</strong>g capacities <strong>of</strong> OWCP <strong>and</strong> WCISStreng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> capacities <strong>of</strong> <strong>the</strong> <strong>in</strong>stitutions responsible <strong>for</strong> launch<strong>in</strong>g crim<strong>in</strong>al proceed<strong>in</strong>gsrepresents one <strong>of</strong> <strong>the</strong> key conditions <strong>for</strong> enhanc<strong>in</strong>g efficiency <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes. TheOWCP <strong>and</strong> WCIS do not have adequate capacities at <strong>the</strong> moment <strong>for</strong> <strong>the</strong> efficient implementation <strong>of</strong>a greater number <strong>of</strong> <strong>in</strong>vestigations <strong>and</strong> <strong>of</strong> <strong>in</strong>vestigations <strong>in</strong> more complex cases, which would result <strong>in</strong><strong>the</strong> fil<strong>in</strong>g <strong>of</strong> viable <strong>in</strong>dictments. The f<strong>in</strong>ancial resources that <strong>the</strong>y have are not sufficient even <strong>for</strong> <strong>the</strong>implementation <strong>of</strong> <strong>the</strong>ir basic competences. The OWCP did not obta<strong>in</strong> a m<strong>in</strong>imum <strong>in</strong>crease <strong>of</strong> <strong>the</strong> budgetafter it assumed <strong>the</strong> competence <strong>for</strong> launch<strong>in</strong>g <strong>in</strong>vestigations <strong>in</strong> accordance with <strong>the</strong> amendments <strong>to</strong> <strong>the</strong>Crim<strong>in</strong>al Procedure Code (CPC) <strong>in</strong> 2012. As <strong>for</strong> human resources, both <strong>in</strong>stitutions share <strong>the</strong> sameproblems: an <strong>in</strong>sufficient number <strong>of</strong> employees, <strong>the</strong> lack <strong>of</strong> cont<strong>in</strong>uous tra<strong>in</strong><strong>in</strong>g, etc.It is necessary <strong>to</strong> harmonize <strong>the</strong> employment policy, <strong>the</strong> hir<strong>in</strong>g policy <strong>in</strong> <strong>the</strong> WCIS <strong>and</strong> <strong>the</strong> process <strong>of</strong>evaluation <strong>of</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> WCIS with <strong>the</strong> needs emerg<strong>in</strong>g from specific nature <strong>of</strong> <strong>the</strong> prosecution<strong>of</strong> war crimes. At <strong>the</strong> moment, <strong>the</strong>re are no legal acts or bylaws def<strong>in</strong><strong>in</strong>g vett<strong>in</strong>g procedures <strong>for</strong> jobc<strong>and</strong>idates <strong>in</strong> <strong>the</strong> WCIS with regard <strong>to</strong> <strong>the</strong>ir engagement <strong>dur<strong>in</strong>g</strong> <strong>the</strong> armed conflicts, which <strong>in</strong> practiceleads <strong>to</strong> hav<strong>in</strong>g <strong>for</strong>mer colleagues <strong>of</strong> <strong>the</strong> suspects conduct<strong>in</strong>g <strong>in</strong>vestigations. Besides this, <strong>the</strong> Chief <strong>of</strong><strong>the</strong> WCIS does not have efficient sanctions <strong>for</strong> employees who do not meet <strong>the</strong> expected pr<strong>of</strong>essionalst<strong>and</strong>ards <strong>of</strong> work.Specific objective no. 1: The OWCP <strong>and</strong> WCIS shall have all <strong>the</strong> f<strong>in</strong>ancial <strong>and</strong> human resourcesnecessary <strong>for</strong> <strong>the</strong> efficient prosecution <strong>of</strong> a greater number <strong>of</strong> cases <strong>and</strong> <strong>of</strong> more complex cases <strong>in</strong>accordance with <strong>the</strong> objectives <strong>and</strong> deadl<strong>in</strong>es set by <strong>the</strong> OWCP’s <strong>Strategy</strong>.Activities:a) The State Prosecu<strong>to</strong>rial Council (SPC) shall create a task <strong>for</strong>ce compris<strong>in</strong>g representatives <strong>of</strong><strong>the</strong> SPC, OWCP, Republic Public Prosecu<strong>to</strong>r, <strong>and</strong> expert with <strong>the</strong> requisite pr<strong>of</strong>iles, which willproduce an analysis <strong>of</strong> <strong>the</strong> needs <strong>of</strong> <strong>the</strong> OWCP with regard <strong>to</strong> <strong>the</strong> objectives <strong>and</strong> deadl<strong>in</strong>es setby <strong>the</strong> <strong>Prosecution</strong> <strong>Strategy</strong>, <strong>and</strong> tak<strong>in</strong>g <strong>in</strong><strong>to</strong> account <strong>the</strong> prelim<strong>in</strong>ary assessment <strong>of</strong> necessaryresources prepared by <strong>the</strong> Team <strong>for</strong> <strong>the</strong> draft<strong>in</strong>g <strong>of</strong> <strong>the</strong> OWCP’s <strong>Strategy</strong>; <strong>the</strong> analysis willestablish needs with regard <strong>to</strong> f<strong>in</strong>ancial resources, technical equipment, <strong>the</strong> number <strong>of</strong>employees <strong>and</strong> associates, <strong>the</strong> scope <strong>of</strong> <strong>the</strong>ir tasks, <strong>the</strong> type <strong>and</strong> level <strong>of</strong> tra<strong>in</strong><strong>in</strong>g <strong>and</strong> <strong>the</strong> <strong>for</strong>m<strong>of</strong> engagement <strong>of</strong> experts <strong>of</strong> <strong>the</strong> specific pr<strong>of</strong>iles necessary <strong>for</strong> conduct<strong>in</strong>g <strong>in</strong>vestigations <strong>in</strong>complex cases, etc.15b) The M<strong>in</strong>istry <strong>of</strong> Interior shall create a task <strong>for</strong>ce compris<strong>in</strong>g representatives <strong>of</strong> <strong>the</strong> WCIS,OWCP, M<strong>in</strong>istry <strong>of</strong> Interior Jo<strong>in</strong>t Affairs Department, <strong>and</strong> experts with <strong>the</strong> requisite pr<strong>of</strong>iles,which will produce an analysis <strong>of</strong> <strong>the</strong> needs (budget, equipment, human resources, need <strong>for</strong>tra<strong>in</strong><strong>in</strong>g) with regard <strong>to</strong> <strong>the</strong> objectives <strong>and</strong> deadl<strong>in</strong>es set by <strong>the</strong> <strong>Prosecution</strong> <strong>Strategy</strong>;c) The Prosecu<strong>to</strong>r shall render new Rules <strong>of</strong> Systemati<strong>za</strong>tion <strong>and</strong> Organi<strong>za</strong>tion <strong>of</strong> Work, <strong>in</strong>accordance with <strong>the</strong> report produced by <strong>the</strong> Task Force on <strong>the</strong> needs <strong>of</strong> <strong>the</strong> OWCP;d) The responsible m<strong>in</strong>istries shall implement <strong>the</strong> plans <strong>for</strong> enhanc<strong>in</strong>g <strong>the</strong> capacities <strong>in</strong>accordance with <strong>the</strong> analysis;e) The M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior shall create a task <strong>for</strong>ce, which will def<strong>in</strong>e <strong>the</strong> amendments <strong>to</strong> <strong>the</strong> Ruleson <strong>the</strong> <strong>in</strong>ternal organi<strong>za</strong>tion <strong>and</strong> systemati<strong>za</strong>tion <strong>of</strong> job positions <strong>in</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Interior, whichHumanitarian Law Center


would: i) <strong>in</strong>troduce special criteria <strong>for</strong> employment <strong>in</strong> <strong>the</strong> WCIS, which would provide <strong>for</strong> not hav<strong>in</strong>gpersons who participated <strong>in</strong> <strong>the</strong> armed conflicts <strong>in</strong> any capacity employed <strong>in</strong> this department; ii)<strong>in</strong>troduce m<strong>and</strong>a<strong>to</strong>ry pr<strong>of</strong>essional tra<strong>in</strong><strong>in</strong>g <strong>for</strong> members <strong>of</strong> <strong>the</strong> WCIS <strong>in</strong> <strong>the</strong> field <strong>of</strong> <strong>the</strong> methodology<strong>of</strong> war crimes <strong>in</strong>vestigation <strong>and</strong> <strong>in</strong>ternational humanitarian law; iii) re<strong>in</strong><strong>for</strong>ce <strong>the</strong> powers <strong>of</strong> <strong>the</strong> chief<strong>of</strong> <strong>the</strong> WCIS with regard <strong>to</strong> dismissals, appo<strong>in</strong>tments, <strong>and</strong> awards given <strong>to</strong> members <strong>of</strong> this service;c) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate an amendment <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong> <strong>War</strong><strong>Crimes</strong> which will, <strong>in</strong> accordance with <strong>the</strong> Judicial Re<strong>for</strong>m <strong>Strategy</strong>, Law on <strong>the</strong> State<strong>Prosecution</strong>’s Council, <strong>and</strong> <strong>the</strong> Law on <strong>the</strong> Judicial Academy, <strong>in</strong>troduce a m<strong>and</strong>a<strong>to</strong>ry tra<strong>in</strong><strong>in</strong>g<strong>for</strong> prosecu<strong>to</strong>rs act<strong>in</strong>g <strong>in</strong> cases <strong>of</strong> war crimes on matters relat<strong>in</strong>g <strong>to</strong> <strong>in</strong>ternational humanitarian<strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law;d) The Programme Council <strong>of</strong> <strong>the</strong> Judicial Academy shall, <strong>dur<strong>in</strong>g</strong> <strong>the</strong> creation <strong>of</strong> a programme <strong>of</strong>cont<strong>in</strong>uous m<strong>and</strong>a<strong>to</strong>ry tra<strong>in</strong><strong>in</strong>g <strong>for</strong> prosecu<strong>to</strong>rs <strong>and</strong> a special tra<strong>in</strong><strong>in</strong>g programme <strong>for</strong> assistantprosecu<strong>to</strong>rs <strong>and</strong> legal tra<strong>in</strong>ees hired <strong>in</strong> <strong>the</strong> OWCP, particularly consider <strong>the</strong>ir needs regard<strong>in</strong>g<strong>the</strong> acquisition <strong>of</strong> pr<strong>of</strong>essional knowledge regard<strong>in</strong>g <strong>the</strong> practice <strong>of</strong> <strong>in</strong>ternational crim<strong>in</strong>alcourts, <strong>and</strong> <strong>the</strong> practice <strong>of</strong> <strong>the</strong> courts <strong>in</strong> <strong>the</strong> region <strong>in</strong> <strong>the</strong> war crimes cases.Specific objective no. 2: An improved organi<strong>za</strong>tional structure <strong>for</strong> <strong>the</strong> OWCP <strong>and</strong> <strong>and</strong> a normativeframework <strong>for</strong> mutual cooperation shall be put <strong>in</strong> place.Activities:16a) The M<strong>in</strong>istry <strong>of</strong> Justice shall create a task <strong>for</strong>ce consist<strong>in</strong>g <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong>Justice, M<strong>in</strong>istry <strong>of</strong> Interior <strong>and</strong> OWCP, which will create a Pro<strong>to</strong>col on cooperation between<strong>the</strong> OWCP <strong>and</strong> M<strong>in</strong>istry <strong>of</strong> Interior <strong>in</strong> <strong>the</strong> crim<strong>in</strong>al <strong>in</strong>vestigation <strong>of</strong> war crimes, regulate<strong>the</strong> obligations <strong>and</strong> procedures <strong>for</strong> action <strong>of</strong> <strong>the</strong> <strong>and</strong> OWCP <strong>dur<strong>in</strong>g</strong> <strong>in</strong>vestigation <strong>and</strong> pre<strong>in</strong>vestigationactivities, <strong>in</strong> l<strong>in</strong>e with <strong>the</strong> CPC;b) The M<strong>in</strong>ister <strong>of</strong> <strong>the</strong> Interior shall adopt amendments <strong>to</strong> <strong>the</strong> Rules on <strong>the</strong> <strong>in</strong>ternal organi<strong>za</strong>tion<strong>and</strong> systemati<strong>za</strong>tion <strong>of</strong> duties <strong>in</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Interior accord<strong>in</strong>g <strong>to</strong> which: i) <strong>the</strong> WCIS willget higher position <strong>in</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Interior hierarchy, mean<strong>in</strong>g <strong>the</strong> rank <strong>of</strong> Department;ii) an Operation fund shall be established <strong>for</strong> <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g <strong>of</strong> WCIS operations <strong>in</strong> pre<strong>in</strong>vestigationproceed<strong>in</strong>gs, as well a procedures <strong>for</strong> <strong>the</strong> use <strong>of</strong> this Fund.c) The OWCP will organize regular meet<strong>in</strong>gs with <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, , <strong>and</strong> o<strong>the</strong>r bodies <strong>and</strong>units, <strong>in</strong>volved <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes, <strong>the</strong> <strong>to</strong>pic <strong>of</strong> which would be <strong>the</strong> discussion <strong>of</strong>current problems <strong>and</strong> challenges <strong>in</strong> war crimes prosecution.1.3. Cooperation with prosecutions <strong>in</strong> <strong>the</strong> region, <strong>the</strong> ICTY, <strong>and</strong> o<strong>the</strong>r <strong>in</strong>stitutionsThe armed conflicts <strong>in</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> <strong>and</strong> <strong>the</strong>ir consequences were <strong>of</strong> a regional <strong>and</strong> crossbordernature. Dur<strong>in</strong>g <strong>the</strong> armed conflicts, <strong>the</strong> state borders were porous. <strong>Armed</strong> <strong>for</strong>ces controlled byone state would cross <strong>to</strong> <strong>the</strong> terri<strong>to</strong>ry <strong>of</strong> o<strong>the</strong>r states <strong>and</strong> carry out operations <strong>in</strong> which mass crimeswere <strong>of</strong>ten committed. Civilians, <strong>in</strong>clud<strong>in</strong>g victims’ families <strong>and</strong> survivors <strong>of</strong> crimes, were exposed <strong>to</strong>systematic <strong>for</strong>ced relocations <strong>and</strong> deportation.Upon <strong>the</strong> cease <strong>of</strong> hostilities, a significant number <strong>of</strong> displaced persons failed <strong>to</strong> return <strong>to</strong> <strong>the</strong>ir prewarresidences. The facilitated conditions <strong>and</strong> procedures <strong>for</strong> obta<strong>in</strong><strong>in</strong>g citizenships <strong>in</strong> some <strong>of</strong> <strong>the</strong>Humanitarian Law Center


successor states <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> enabled a great number <strong>of</strong> <strong>in</strong>dividuals <strong>to</strong> have multiplecitizenships <strong>of</strong> <strong>the</strong>se states. Today, victims, witnesses <strong>and</strong> perpetra<strong>to</strong>rs <strong>of</strong> a crime <strong>of</strong>ten reside <strong>in</strong>different states. All <strong>the</strong>se circumstances, along with <strong>the</strong> fact that <strong>the</strong> successor states <strong>of</strong> <strong>the</strong> <strong>for</strong>mer<strong>Yugoslavia</strong> <strong>for</strong>bid extradition <strong>of</strong> <strong>the</strong>ir citizens <strong>to</strong> o<strong>the</strong>r countries, make <strong>the</strong> prosecution <strong>of</strong> war crimescommitted <strong>in</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> almost impossible without <strong>the</strong> cooperation <strong>of</strong> <strong>the</strong> responsible<strong>in</strong>stitutions <strong>in</strong> <strong>the</strong> region <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>.In 2005, <strong>the</strong> OWCP signed memor<strong>and</strong>a on cooperation with <strong>the</strong> State At<strong>to</strong>rney’s Office <strong>of</strong> <strong>the</strong> Republic<strong>of</strong> Croatia <strong>and</strong> <strong>the</strong> Prosecu<strong>to</strong>r’s Office <strong>of</strong> BiH, thus allow<strong>in</strong>g <strong>for</strong> direct cooperation <strong>and</strong> communicationbetween <strong>the</strong> respective prosecutions. 6 The cooperation between <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong> Prosecu<strong>to</strong>r’s Office<strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Montenegro was established by <strong>the</strong> sign<strong>in</strong>g <strong>of</strong> a memor<strong>and</strong>um on cooperation <strong>in</strong>2007. The OWCP collects evidence <strong>in</strong> Kosovo <strong>in</strong>dependently through <strong>the</strong> facilitation <strong>of</strong> <strong>the</strong> EULEXMission, on <strong>the</strong> basis <strong>of</strong> a memor<strong>and</strong>um on cooperation signed between <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Interior <strong>and</strong>EULEX. At this moment, <strong>the</strong> OWCP does not have direct cooperation with Kosovo prosecu<strong>to</strong>rs.The key importance <strong>of</strong> memor<strong>and</strong>a on direct cooperation lies <strong>in</strong> <strong>the</strong> opportunity <strong>to</strong> provide evidence<strong>and</strong> <strong>in</strong><strong>for</strong>mation by one signa<strong>to</strong>ry party <strong>to</strong> ano<strong>the</strong>r, enabl<strong>in</strong>g <strong>the</strong> prosecution <strong>of</strong> suspects because <strong>of</strong><strong>the</strong>ir accessibility <strong>to</strong> <strong>the</strong> authorities <strong>of</strong> this party. By <strong>the</strong> end <strong>of</strong> March 2015, thanks <strong>to</strong> <strong>the</strong> cooperationbetween <strong>the</strong> prosecutions <strong>in</strong> <strong>the</strong> region, <strong>the</strong> OWCP filed <strong>in</strong>dictments aga<strong>in</strong>st 37 persons. At <strong>the</strong>same time, <strong>the</strong> OWCP delivered evidence <strong>to</strong> <strong>the</strong> prosecution <strong>of</strong>fices <strong>in</strong> <strong>the</strong> region <strong>and</strong> <strong>the</strong> EULEXInvestigation Unit, which resulted <strong>in</strong> a significant number <strong>of</strong> <strong>in</strong>dictments. 7 Despite <strong>the</strong> existence <strong>of</strong> <strong>the</strong>signed memor<strong>and</strong>a on cooperation, <strong>in</strong> several cases <strong>the</strong> OWCP <strong>in</strong>sisted on conduct<strong>in</strong>g <strong>in</strong>vestigationsaga<strong>in</strong>st suspects who were <strong>in</strong>accessible <strong>to</strong> <strong>the</strong> prosecution authorities <strong>in</strong> Serbia, which led <strong>in</strong> practice<strong>to</strong> “parallel <strong>in</strong>vestigations”, thus violat<strong>in</strong>g regional cooperation based on <strong>the</strong> pr<strong>in</strong>ciple <strong>of</strong> mutual trust. 8The possibility <strong>of</strong> hav<strong>in</strong>g parallel <strong>in</strong>vestigations led <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong> State Prosecu<strong>to</strong>r’s Office <strong>of</strong> BiH<strong>to</strong> sign an additional Pro<strong>to</strong>col on cooperation <strong>in</strong> January 2013, by which each party was obliged <strong>to</strong><strong>in</strong><strong>for</strong>m <strong>the</strong> o<strong>the</strong>r party with<strong>in</strong> three months from <strong>the</strong> sign<strong>in</strong>g <strong>of</strong> <strong>the</strong> agreement about all proceed<strong>in</strong>gsconducted aga<strong>in</strong>st citizens <strong>of</strong> <strong>the</strong> o<strong>the</strong>r party. 9 The same Pro<strong>to</strong>col envisaged <strong>the</strong> creation <strong>of</strong> a list <strong>of</strong>priorities <strong>in</strong> <strong>the</strong> cooperation between OWCP <strong>and</strong> <strong>the</strong> State Prosecu<strong>to</strong>r’s Office <strong>of</strong> BiH. The OWCP, atthis time, does not have such pro<strong>to</strong>cols signed with o<strong>the</strong>r countries <strong>in</strong> <strong>the</strong> region.17The documents collected by <strong>the</strong> ICTY <strong>dur<strong>in</strong>g</strong> its m<strong>and</strong>ate represent important sources <strong>of</strong> <strong>in</strong><strong>for</strong>mation<strong>and</strong> <strong>the</strong> evidentiary basis <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong>fices act<strong>in</strong>g <strong>in</strong> cases <strong>of</strong> war crimes committed <strong>in</strong> <strong>the</strong>region <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>. The OWCP has access <strong>to</strong> all <strong>the</strong> data bases <strong>of</strong> this court, <strong>in</strong>clud<strong>in</strong>g<strong>the</strong> non-public database <strong>of</strong> <strong>the</strong> ICTY Office <strong>of</strong> <strong>the</strong> Prosecu<strong>to</strong>r, through direct access as well asthrough “liaison <strong>of</strong>ficers” - <strong>the</strong> OWCP <strong>of</strong>ficers physically located <strong>in</strong> <strong>the</strong> <strong>of</strong>fice <strong>of</strong> <strong>the</strong> ICTY Office <strong>of</strong><strong>the</strong> Prosecu<strong>to</strong>r. In <strong>the</strong> perspective <strong>of</strong> <strong>the</strong> work <strong>of</strong> OWCP, <strong>the</strong> use <strong>of</strong> evidence from <strong>the</strong> ICTY judicialdatabases is <strong>of</strong> key significance <strong>for</strong> br<strong>in</strong>g<strong>in</strong>g suspected war crim<strong>in</strong>als <strong>to</strong> justice. necessary <strong>to</strong> remove all <strong>the</strong> obstacles <strong>to</strong> obta<strong>in</strong><strong>in</strong>g relevant documents <strong>and</strong> re<strong>in</strong><strong>for</strong>ce <strong>the</strong> <strong>in</strong>ternalcapacities <strong>of</strong> <strong>the</strong> OWCP <strong>in</strong> <strong>the</strong> search <strong>for</strong> <strong>the</strong>se documents. Also, it is very important <strong>to</strong> address <strong>the</strong>matter <strong>of</strong> <strong>the</strong> fate <strong>of</strong> <strong>the</strong> non-public database <strong>of</strong> <strong>the</strong> ICTY Office <strong>of</strong> <strong>the</strong> Prosecu<strong>to</strong>r, on which <strong>the</strong>Security Council has not yet rendered a decision.The archives <strong>of</strong> <strong>in</strong>stitutions like <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior, M<strong>in</strong>istry <strong>of</strong> Defence, Military Archive,Military Security Agency, Security In<strong>for</strong>mation Agency, courts <strong>of</strong> general jurisdiction <strong>and</strong> o<strong>the</strong>rs arevery valuable <strong>for</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>of</strong> war crimes. However, some <strong>of</strong> <strong>the</strong>se <strong>in</strong>stitutions have refused <strong>to</strong>deliver documents which are <strong>in</strong> <strong>the</strong>ir position <strong>to</strong> <strong>the</strong> OWCP, with <strong>the</strong> explanation that <strong>the</strong> documentshave been destroyed or that <strong>the</strong>y do not exist, thus violat<strong>in</strong>g <strong>the</strong> obligation <strong>of</strong> all state authoritiesaccord<strong>in</strong>g <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> prosecution <strong>of</strong> war crimes <strong>to</strong> deliver every piece <strong>of</strong> evidence which<strong>the</strong>y possess, at <strong>the</strong> request <strong>of</strong> <strong>the</strong> OWCP. The additional problem is <strong>the</strong> legal regime regulat<strong>in</strong>g <strong>the</strong>confidentiality <strong>of</strong> documents, particularly <strong>the</strong> right <strong>of</strong> certa<strong>in</strong> <strong>in</strong>stitutions <strong>to</strong> make certa<strong>in</strong> documentsimportant <strong>for</strong> establish<strong>in</strong>g crim<strong>in</strong>al responsibility <strong>for</strong> war crimes <strong>in</strong>accessible <strong>to</strong> <strong>the</strong> public.Specific objective no. 1: Improved cooperation shall be achieved between <strong>the</strong> prosecution <strong>of</strong>fices <strong>in</strong><strong>the</strong> region through <strong>the</strong> enhancement <strong>of</strong> <strong>the</strong> normative framework <strong>and</strong> <strong>the</strong> establish<strong>in</strong>g <strong>of</strong> priorities <strong>in</strong>cooperation.Activities:a) The OWCP shall <strong>in</strong>itiate <strong>the</strong> amendment <strong>of</strong> <strong>the</strong> exist<strong>in</strong>g agreements on cooperation with BiH,Croatia, Montenegro, which would regulate:i. <strong>the</strong> creation <strong>of</strong> jo<strong>in</strong>t <strong>in</strong>vestigation teams <strong>in</strong> cases <strong>of</strong> a cross-border character;18ii.<strong>the</strong> organi<strong>za</strong>tion <strong>of</strong> <strong>the</strong> quarterly meet<strong>in</strong>gs <strong>of</strong> <strong>in</strong>vestigation teams;iii. <strong>the</strong> establishment <strong>of</strong> <strong>the</strong> obligation <strong>to</strong> <strong>in</strong><strong>for</strong>m <strong>the</strong> o<strong>the</strong>r party on <strong>the</strong> procedures <strong>in</strong>itiatedaga<strong>in</strong>st <strong>the</strong>ir citizens (with Croatia <strong>and</strong> Montenegro);iv.The establishment <strong>of</strong> a list <strong>of</strong> priority cases <strong>for</strong> cooperation (with Croatia <strong>and</strong> Montenegro).b) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate <strong>the</strong> sign<strong>in</strong>g <strong>of</strong> <strong>the</strong> Agreement between <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong>EULEX Mission, which would lay down <strong>the</strong> framework <strong>of</strong> cooperation between <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong>Kosovo prosecu<strong>to</strong>rs <strong>in</strong> <strong>the</strong> exchange <strong>of</strong> evidence <strong>and</strong> cooperation <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes;c) The OWCP shall implement entirely <strong>the</strong> agreements signed with prosecu<strong>to</strong>rs <strong>in</strong> <strong>the</strong> region.Specific objective no. 2: An <strong>in</strong>creased amount <strong>of</strong> evidence from ICTY material shall be used by <strong>the</strong>OWCP <strong>in</strong> its work.Activities:a) The OWCP shall <strong>in</strong>itiate consultation with representatives <strong>of</strong> <strong>the</strong> ICTY <strong>and</strong> <strong>the</strong> prosecution<strong>of</strong>fices <strong>in</strong> <strong>the</strong> region with regard <strong>to</strong> <strong>the</strong> easy provision <strong>of</strong> documents <strong>and</strong> <strong>to</strong> <strong>the</strong> future use <strong>and</strong>access <strong>of</strong> <strong>the</strong> ICTY Office <strong>of</strong> <strong>the</strong> Prosecu<strong>to</strong>r database;b) The OWCP shall <strong>in</strong>itiate with <strong>the</strong> ICTY <strong>the</strong> tra<strong>in</strong><strong>in</strong>g <strong>of</strong> prosecu<strong>to</strong>rs <strong>and</strong> associates <strong>in</strong> <strong>the</strong>Humanitarian Law Center


OWCP regard<strong>in</strong>g <strong>the</strong> skills <strong>of</strong> search<strong>in</strong>g ICTY databases.Specific objective no.3: Archival material <strong>of</strong> <strong>in</strong>stitutions relevant <strong>for</strong> <strong>the</strong> prosecution <strong>of</strong> war crimesshall be made accessible <strong>to</strong> <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong> public.Activity:a) The National Assembly, <strong>the</strong> Prime M<strong>in</strong>ister <strong>and</strong> <strong>the</strong> President <strong>of</strong> <strong>the</strong> Republic will withdraw<strong>the</strong> categori<strong>za</strong>tion <strong>of</strong> confidentiality, <strong>in</strong> l<strong>in</strong>e with Article 26 <strong>of</strong> <strong>the</strong> Law on <strong>the</strong> confidentiality<strong>of</strong> <strong>in</strong><strong>for</strong>mation, from all documents possessed by <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Interior, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong>Defence, <strong>the</strong> Military Archive, <strong>the</strong> Military Security Agency, <strong>and</strong> o<strong>the</strong>r <strong>in</strong>stitutions whichrefer <strong>to</strong> <strong>the</strong> <strong>in</strong>volvement <strong>of</strong> representatives <strong>of</strong> <strong>the</strong>se <strong>in</strong>stitutions <strong>in</strong> <strong>the</strong> armed conflicts <strong>in</strong><strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>; exceptionally, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Defence, Military Security Agency,Security In<strong>for</strong>mation Agency <strong>and</strong> M<strong>in</strong>istry <strong>of</strong> Interior can dem<strong>and</strong> certa<strong>in</strong> <strong>in</strong><strong>for</strong>mation <strong>in</strong> thiscategory <strong>of</strong> documents <strong>to</strong> rema<strong>in</strong> confidential, <strong>the</strong> decision on which shall be rendered by <strong>the</strong>Commissioner <strong>for</strong> In<strong>for</strong>mation <strong>of</strong> Public Importance.2. Enhanc<strong>in</strong>g <strong>the</strong> capacity <strong>of</strong> <strong>the</strong> Department <strong>for</strong> <strong>War</strong> <strong>Crimes</strong> <strong>of</strong><strong>the</strong> Higher Court <strong>and</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> BelgradeThe Department <strong>for</strong> <strong>War</strong> <strong>Crimes</strong> <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade (Higher Court Department) <strong>and</strong><strong>the</strong> Department <strong>for</strong> <strong>War</strong> <strong>Crimes</strong> <strong>of</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade (Appeals Court Department)that conduct war crimes proceed<strong>in</strong>gs <strong>in</strong> first, second <strong>and</strong> third <strong>in</strong>stance trials act promptly, withoutundue delays <strong>in</strong> <strong>the</strong> conduct <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs <strong>and</strong> pass<strong>in</strong>g <strong>of</strong> judgments. Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> experts,<strong>the</strong> judgments are <strong>in</strong> most cases fair <strong>and</strong> <strong>in</strong> accordance with <strong>the</strong> law. However, <strong>in</strong> some cases it hasbeen noted that <strong>the</strong>re is a deviation from <strong>the</strong> facts established be<strong>for</strong>e <strong>the</strong> ICTY, <strong>and</strong> that <strong>the</strong>re is notsufficient reference <strong>to</strong> <strong>the</strong> provisions <strong>of</strong> <strong>in</strong>ternational humanitarian law <strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law.What is more, when it comes <strong>to</strong> penal policy, <strong>the</strong> courts use <strong>the</strong> <strong>in</strong>stitute <strong>of</strong> mitigat<strong>in</strong>g circumstanceswithout adequate explanation <strong>and</strong> established st<strong>and</strong>ards, <strong>and</strong> <strong>the</strong>y also use <strong>the</strong> <strong>in</strong>stitute <strong>of</strong> reduction<strong>of</strong> sentence below <strong>the</strong> statu<strong>to</strong>ry m<strong>in</strong>imum.19The system <strong>of</strong> appo<strong>in</strong>t<strong>in</strong>g judges <strong>to</strong> trial chambers established by <strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong><strong>War</strong> <strong>Crimes</strong> does not conta<strong>in</strong> pr<strong>in</strong>ciples <strong>and</strong> guidel<strong>in</strong>es <strong>for</strong> <strong>the</strong> pr<strong>of</strong>essional tra<strong>in</strong><strong>in</strong>g <strong>of</strong> judges thatenable <strong>the</strong>m <strong>to</strong> work on war crimes cases. Judges with no experience <strong>and</strong> tra<strong>in</strong><strong>in</strong>g <strong>in</strong> <strong>the</strong> application <strong>of</strong><strong>in</strong>ternational humanitarian law <strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law are appo<strong>in</strong>ted <strong>to</strong> trial chambers. This isparticularly apparent when it comes <strong>to</strong> <strong>the</strong> third <strong>in</strong>stance chamber, which decides on complex matters<strong>of</strong> <strong>the</strong> <strong>in</strong>ternational humanitarian law. This chamber is composed <strong>of</strong> judges who have no experienceor tra<strong>in</strong><strong>in</strong>g <strong>in</strong> this field <strong>of</strong> law. On <strong>the</strong> o<strong>the</strong>r h<strong>and</strong>, judges who have acquired a certa<strong>in</strong> specializedknowledge <strong>and</strong> experience by work<strong>in</strong>g <strong>in</strong> <strong>the</strong>se chambers are sent <strong>to</strong> work on cases <strong>of</strong> general ororganized crime. This system does not provide <strong>the</strong> necessary st<strong>and</strong>ards <strong>of</strong> judges’ competence,particularly bear<strong>in</strong>g <strong>in</strong> m<strong>in</strong>d <strong>the</strong> need <strong>for</strong> <strong>the</strong> <strong>in</strong>crease <strong>of</strong> <strong>the</strong> number <strong>of</strong> cases <strong>and</strong> <strong>the</strong> prosecution <strong>of</strong>more complex cases.The Higher Court Department lacks significant funds <strong>for</strong> cover<strong>in</strong>g <strong>the</strong> costs <strong>in</strong>curred <strong>in</strong> connectionwith <strong>the</strong> conduct <strong>of</strong> proceed<strong>in</strong>gs, such as f<strong>in</strong>anc<strong>in</strong>g <strong>the</strong> defense, experts, etc.General objective: The f<strong>in</strong>ancial, human <strong>and</strong> technical capacities <strong>of</strong> <strong>the</strong> trial chambers conduct<strong>in</strong>g <strong>the</strong>war crimes trials is improved.Humanitarian Law Center


Specific objective no.1: The Higher Court Department <strong>and</strong> Appeals Court Department have all <strong>the</strong>f<strong>in</strong>ancial <strong>and</strong> human resources necessary <strong>to</strong> conduct a larger number <strong>of</strong> cases <strong>and</strong> more complex cases<strong>of</strong> war crimes.Activities:a) The High Judicial Council shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> HigherCourt Department, <strong>the</strong> Appeals Court Department, <strong>and</strong> expert <strong>of</strong> <strong>the</strong> requisite pr<strong>of</strong>ile,who will create an analysis <strong>of</strong> <strong>the</strong> needs <strong>of</strong> <strong>the</strong> departments <strong>in</strong> respect <strong>to</strong> <strong>the</strong> objectives <strong>and</strong>deadl<strong>in</strong>es set down by <strong>the</strong> OWCP’s <strong>Strategy</strong>; <strong>the</strong> analysis will establish <strong>the</strong> needs <strong>of</strong> <strong>the</strong>departments <strong>in</strong> regard <strong>to</strong> <strong>the</strong> number <strong>of</strong> chambers, f<strong>in</strong>ancial means, technical equipment, <strong>the</strong>number <strong>of</strong> employees <strong>and</strong> associates, <strong>the</strong> scope <strong>of</strong> <strong>the</strong>ir duties, <strong>the</strong> type <strong>and</strong> level <strong>of</strong> tra<strong>in</strong><strong>in</strong>g,<strong>the</strong> conditions <strong>and</strong> <strong>for</strong>m <strong>of</strong> engagement <strong>of</strong> experts <strong>of</strong> <strong>the</strong> requisite pr<strong>of</strong>ile <strong>for</strong> expert support <strong>to</strong><strong>the</strong> work <strong>of</strong> <strong>the</strong> judges, etc;b) The relevant m<strong>in</strong>istries shall implement plans <strong>for</strong> <strong>the</strong> enhancement <strong>of</strong> capacities <strong>in</strong> accordancewith <strong>the</strong> above-mentioned reports;Specific objective no. 2: The level <strong>of</strong> judges’ expertise <strong>in</strong> <strong>in</strong>ternational humanitarian law, as wellas <strong>in</strong> <strong>the</strong> practice <strong>of</strong> <strong>in</strong>ternational crim<strong>in</strong>al courts <strong>and</strong> courts <strong>in</strong> <strong>the</strong> region <strong>and</strong> <strong>the</strong>ir application <strong>in</strong>proceed<strong>in</strong>gs <strong>for</strong> war crimes, shall be enhanced.Activities:20a) The M<strong>in</strong>istry <strong>of</strong> Justice will <strong>in</strong>itiate an amendment <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong> <strong>War</strong><strong>Crimes</strong> which will <strong>in</strong>troduce cont<strong>in</strong>uous m<strong>and</strong>a<strong>to</strong>ry tra<strong>in</strong><strong>in</strong>g on <strong>in</strong>ternational humanitarianlaw <strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law <strong>for</strong> <strong>the</strong> judges who deal with war crimes cases <strong>in</strong> <strong>the</strong> first,second <strong>and</strong> third <strong>in</strong>stance courts, <strong>in</strong> accordance with <strong>the</strong> Judicial Re<strong>for</strong>m <strong>Strategy</strong>, <strong>the</strong> Law on<strong>the</strong> State <strong>Prosecution</strong> Council <strong>and</strong> <strong>the</strong> Law on <strong>the</strong> Judicial Academy;b) When creat<strong>in</strong>g <strong>the</strong> cont<strong>in</strong>uous m<strong>and</strong>a<strong>to</strong>ry programmes <strong>for</strong> judges <strong>and</strong> <strong>the</strong> special tra<strong>in</strong><strong>in</strong>gprogrammes <strong>for</strong> judicial assistants <strong>and</strong> <strong>in</strong>terns who are engaged by <strong>the</strong> OWCP, <strong>the</strong> ProgrammeCouncil <strong>of</strong> <strong>the</strong> Judicial Academy shall specifically address <strong>the</strong>ir needs <strong>in</strong> terms <strong>of</strong> acquir<strong>in</strong>gexpertise <strong>in</strong> <strong>relation</strong> <strong>to</strong> <strong>the</strong> practice <strong>of</strong> <strong>in</strong>ternational crim<strong>in</strong>al courts <strong>and</strong> practice <strong>of</strong> <strong>the</strong> courts<strong>in</strong> <strong>the</strong> region;c) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate an amendment <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong> <strong>War</strong><strong>Crimes</strong>, which will <strong>in</strong>troduce <strong>the</strong> possibility that <strong>the</strong> Chamber may, at its own <strong>in</strong>itiative or at<strong>the</strong> request <strong>of</strong> parties, <strong>and</strong> after hear<strong>in</strong>g <strong>the</strong> parties <strong>in</strong>volved, decide <strong>to</strong> accept as proven <strong>the</strong>facts established by a f<strong>in</strong>al judgment rendered by <strong>the</strong> ICTY;d) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate an amendment <strong>of</strong> <strong>the</strong> Court’s Rules accord<strong>in</strong>g <strong>to</strong> which<strong>the</strong> President <strong>of</strong> <strong>the</strong> Higher Court Department will have <strong>the</strong> obligation <strong>of</strong> conven<strong>in</strong>g a session<strong>of</strong> <strong>the</strong> department once every two months;e) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate <strong>the</strong> hold<strong>in</strong>g <strong>of</strong> annual conferences <strong>for</strong> judges deal<strong>in</strong>g withwar crimes cases <strong>in</strong> <strong>the</strong> region <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>.Humanitarian Law Center


3. The protection <strong>of</strong> witnesses <strong>and</strong> victimsWitnesses are <strong>the</strong> most important <strong>and</strong> <strong>the</strong> most frequently used means <strong>of</strong> evidence <strong>in</strong> war crimes cases.For <strong>the</strong> purpose <strong>of</strong> effective case management, it is necessary <strong>to</strong> ensure that witnesses testify withoutfear, threats or o<strong>the</strong>r <strong>for</strong>ms <strong>of</strong> pressure <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>and</strong> <strong>the</strong> trial. The effectiveness <strong>of</strong> witnessprotection mechanisms significantly affects <strong>the</strong> decision <strong>of</strong> persons who have <strong>in</strong><strong>for</strong>mation about <strong>the</strong> crimescommitted on whe<strong>the</strong>r <strong>to</strong> participate <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs aga<strong>in</strong>st <strong>the</strong> perpetra<strong>to</strong>rs <strong>of</strong> <strong>the</strong> war crimes.In <strong>the</strong> current practice regard<strong>in</strong>g war crimes prosecution <strong>in</strong> Serbia, <strong>the</strong> witness protection systemhas not been very effective, because some <strong>of</strong> <strong>the</strong> procedural protection mechanisms have not beenapplied when necessary. In addition, <strong>the</strong> nonprocedural measures <strong>for</strong> protection <strong>of</strong> <strong>in</strong>sider witnesses(<strong>for</strong>mer <strong>and</strong> active members <strong>of</strong> <strong>the</strong> armed <strong>for</strong>ces <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia) has proved <strong>to</strong> be completelyunsuccessful.3.1. Procedural protectionThe legal framework <strong>of</strong> <strong>the</strong> witness protection system <strong>in</strong> <strong>the</strong> cases <strong>of</strong> war crimes is regulated by <strong>the</strong> CPC. 10The procedural protection measures are applied <strong>in</strong> <strong>the</strong> <strong>in</strong>vestigation when undertak<strong>in</strong>g <strong>in</strong>vestigativeactions, <strong>and</strong> <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial. Dur<strong>in</strong>g <strong>the</strong> trial, <strong>the</strong>y are applied by <strong>the</strong> court, <strong>and</strong> <strong>dur<strong>in</strong>g</strong> <strong>the</strong> <strong>in</strong>vestigation,by <strong>the</strong> prosecu<strong>to</strong>r. 11 Procedural protection <strong>of</strong> witnesses <strong>in</strong>cludes: measures <strong>to</strong> protect <strong>the</strong> <strong>in</strong>tegrity <strong>of</strong> <strong>the</strong>witness, measures <strong>to</strong> protect particularly vulnerable witnesses <strong>and</strong> measures <strong>for</strong> protection <strong>of</strong> witnesseswhose lives, health, liberty or property are endangered because <strong>of</strong> <strong>the</strong>ir testify<strong>in</strong>g.In cases <strong>of</strong> war crimes <strong>in</strong> Serbia, <strong>the</strong>re have been examples <strong>of</strong> witnesses be<strong>in</strong>g <strong>in</strong>sulted by <strong>the</strong> defence<strong>and</strong> <strong>the</strong> defendants who were not sanctioned by <strong>the</strong> court, or <strong>in</strong>adequately sanctioned (by <strong>the</strong>pronounc<strong>in</strong>g <strong>of</strong> <strong>in</strong><strong>for</strong>mal warn<strong>in</strong>gs <strong>in</strong>stead <strong>of</strong> <strong>the</strong> <strong>in</strong>fliction <strong>of</strong> <strong>the</strong> sanctions prescribed by <strong>the</strong> CPC).Inadequate protection <strong>of</strong> witnesses <strong>dur<strong>in</strong>g</strong> <strong>the</strong> testimony causes psychological trauma, <strong>and</strong> is <strong>for</strong>witnesses - <strong>in</strong>jured parties (victims) a secondary victimi<strong>za</strong>tion.21A particular challenge is represented by <strong>the</strong> protection <strong>of</strong> victims <strong>of</strong> sexual violence <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial<strong>in</strong>terrogation. <strong>of</strong> pronounc<strong>in</strong>g <strong>in</strong><strong>for</strong>mal warn<strong>in</strong>gs, shall pronounce <strong>for</strong>mal reprim<strong>and</strong>s <strong>and</strong> sanction <strong>the</strong>participants <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs who <strong>in</strong>sult a witness <strong>dur<strong>in</strong>g</strong> <strong>the</strong> exam<strong>in</strong>ation, <strong>in</strong> accordancewith <strong>the</strong> CPC;b) When pronounc<strong>in</strong>g <strong>the</strong> sentence or a reprim<strong>and</strong> <strong>to</strong> a participant <strong>in</strong> <strong>the</strong> proceed<strong>in</strong>gs, <strong>the</strong>Presid<strong>in</strong>g Judge <strong>of</strong> <strong>the</strong> Higher Court Department chamber shall expla<strong>in</strong> <strong>the</strong> reasons beh<strong>in</strong>d<strong>the</strong> sanction<strong>in</strong>g <strong>of</strong> <strong>the</strong> conduct <strong>to</strong>wards <strong>the</strong> <strong>in</strong>jured party or witness;c) The judges <strong>of</strong> <strong>the</strong> Higher Court Department shall <strong>in</strong><strong>for</strong>m <strong>the</strong> Bar Associations regularly onpenalties pronounced <strong>to</strong> defense counsel, <strong>in</strong> accordance with Article 370, paragraph 3 <strong>of</strong> <strong>the</strong>CPC <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia, <strong>and</strong> submit a discipl<strong>in</strong>ary compla<strong>in</strong>t <strong>to</strong> <strong>the</strong> Bar Associationaga<strong>in</strong>st lawyers who violate;d) The Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong> war crimes cases with<strong>in</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice shall,as part <strong>of</strong> <strong>the</strong> tra<strong>in</strong><strong>in</strong>g programme <strong>for</strong> defense lawyers, organize a special tra<strong>in</strong><strong>in</strong>g programmeon victims’ rights <strong>and</strong> needs; 12Specific objective no. 2: The <strong>in</strong>jured parties – victims <strong>of</strong> sexual abuse shall receive an effectiveprotection <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial, <strong>in</strong> accordance with <strong>in</strong>ternational st<strong>and</strong>ards.Activities:22a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> <strong>the</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry<strong>of</strong> Justice, <strong>the</strong> Republic Public Prosecu<strong>to</strong>r, <strong>the</strong> OWCP, <strong>the</strong> departments <strong>for</strong> war crimes <strong>of</strong> <strong>the</strong>Higher Court <strong>in</strong> Belgrade <strong>and</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade <strong>and</strong> experts <strong>in</strong> <strong>the</strong> fields <strong>of</strong>crim<strong>in</strong>al <strong>and</strong> crim<strong>in</strong>al procedural law. The task <strong>for</strong>ce shall propose amendments <strong>to</strong> <strong>the</strong> CPCwhich would <strong>in</strong>troduce special rules <strong>of</strong> evidence <strong>in</strong> <strong>the</strong> cases <strong>of</strong> sexual <strong>of</strong>fences: i) a prohibitionon acceptance <strong>of</strong> earlier sexual conduct <strong>of</strong> <strong>the</strong> victim as evidence <strong>in</strong> <strong>the</strong> proceed<strong>in</strong>gs; ii) <strong>the</strong>rule <strong>of</strong> evidence, by which <strong>for</strong> <strong>the</strong> pro<strong>of</strong> <strong>of</strong> rape it is not necessary <strong>to</strong> corroborate it with o<strong>the</strong>revidence; <strong>and</strong> iii) <strong>the</strong> rule that <strong>the</strong> consent <strong>of</strong> <strong>the</strong> victim is not grounds <strong>for</strong> exemption fromresponsibility <strong>of</strong> <strong>the</strong> perpatra<strong>to</strong>rs, if <strong>the</strong> victim feared <strong>for</strong> <strong>the</strong>ir own life or <strong>the</strong> life <strong>of</strong> personsclose <strong>to</strong> <strong>the</strong>m.b) The judges <strong>and</strong> prosecu<strong>to</strong>rs shall consistently apply mechanisms <strong>for</strong> <strong>the</strong> protection <strong>of</strong> witnesses<strong>and</strong> <strong>in</strong>jured parties – victims <strong>of</strong> sexual violence.3.2. The measures <strong>of</strong> nonprocedural protection <strong>of</strong> witnessesThe measures <strong>of</strong> nonprocedural protection are applied <strong>to</strong> witnesses who, because <strong>of</strong> <strong>the</strong>ir testimonies,are exposed <strong>to</strong> threats <strong>to</strong> life, health <strong>and</strong> property, which are addressed <strong>to</strong> <strong>the</strong>m personally or <strong>the</strong>ir family.Non-procedural witness protection is achieved through <strong>the</strong> use <strong>of</strong> regular <strong>in</strong>stitutional mechanisms<strong>for</strong> <strong>the</strong> protection <strong>of</strong> fundamental human rights <strong>and</strong> freedoms (non-procedural protection <strong>in</strong> <strong>the</strong>narrow sense), <strong>and</strong> through <strong>the</strong> special protection programme <strong>in</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs (ProtectionProgramme). The legal framework <strong>for</strong> non-procedural protection is <strong>the</strong> CPC <strong>and</strong> <strong>the</strong> Law on <strong>the</strong>Protection <strong>of</strong> Participants <strong>in</strong> Crim<strong>in</strong>al Proceed<strong>in</strong>gs.12 See section 6 on Defense <strong>for</strong> more <strong>in</strong><strong>for</strong>mation on <strong>the</strong> establish<strong>in</strong>g <strong>of</strong> <strong>the</strong> Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong>war crimes cases with<strong>in</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice <strong>and</strong> <strong>the</strong> jurisdiction <strong>of</strong> this body.Humanitarian Law Center


In <strong>the</strong> current practice <strong>of</strong> prosecut<strong>in</strong>g war crimes <strong>in</strong> Serbia, it is evident that <strong>the</strong> measures <strong>of</strong>nonprocedural protection do not achieve <strong>the</strong>ir purpose when it comes <strong>to</strong> <strong>in</strong>sider witnesses – <strong>for</strong>meror active members <strong>of</strong> <strong>the</strong> armed <strong>for</strong>ces <strong>of</strong> Republic <strong>of</strong> Serbia who participated <strong>and</strong>/or have knowledge<strong>of</strong> <strong>the</strong> crimes committed, ow<strong>in</strong>g <strong>to</strong> <strong>the</strong> <strong>in</strong>conclusive legal framework <strong>and</strong> <strong>in</strong>sufficient political support<strong>for</strong> this most vulnerable aspect <strong>of</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes. Among <strong>the</strong> numerous problems thath<strong>in</strong>der an effective protection <strong>of</strong> <strong>in</strong>sider witnesses <strong>and</strong> thus seriously threaten prosecut<strong>in</strong>g <strong>the</strong> personsresponsible <strong>for</strong> committed war crimes, those that st<strong>and</strong> out are: an <strong>in</strong>adequate legal framework <strong>for</strong><strong>the</strong> protection <strong>of</strong> <strong>in</strong>sider witnesses who do not enter <strong>in</strong><strong>to</strong> a protection programme, weak mechanisms<strong>for</strong> <strong>the</strong> control <strong>and</strong> supervision <strong>of</strong> <strong>the</strong> witness protection programme, non-transparent <strong>and</strong> ad hocprocedures <strong>for</strong> <strong>the</strong> <strong>in</strong>vestigation <strong>of</strong> misconducts <strong>of</strong> members <strong>of</strong> Protection Unit, as well as <strong>the</strong> publicsupport <strong>of</strong> government representatives <strong>for</strong> war crimes suspects. The problems <strong>in</strong> <strong>the</strong> system <strong>for</strong> <strong>the</strong>protection <strong>of</strong> <strong>in</strong>sider witnesses <strong>in</strong> Serbia have been registered by several <strong>in</strong>ternational <strong>in</strong>stitutions <strong>and</strong>organi<strong>za</strong>tions. 13General objective: The lives, health <strong>and</strong> property <strong>of</strong> witnesses <strong>and</strong> <strong>in</strong>sider witnesses shall be protectedby effective measures <strong>of</strong> non-procedural protection, <strong>in</strong> an atmosphere <strong>of</strong> clear political <strong>and</strong> public/social support <strong>for</strong> <strong>the</strong> participation <strong>of</strong> <strong>in</strong>sider witnesses <strong>in</strong> <strong>the</strong> cases <strong>of</strong> war crimes.Specific objective no. 1: An effective mechanism <strong>of</strong> protection <strong>of</strong> witnesses <strong>and</strong> <strong>in</strong>sider witnesseswho do not enter <strong>in</strong><strong>to</strong> a witness protection programme is established.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry<strong>of</strong> Justice, <strong>the</strong> OWCP, <strong>the</strong> Higher Court Department <strong>and</strong> Appeals Court Department, <strong>the</strong>M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior <strong>and</strong> legal experts, who will: i) <strong>for</strong>mulate amendments <strong>to</strong> Article102, paragraph 5 <strong>of</strong> <strong>the</strong> CPC, <strong>to</strong> <strong>in</strong>troduce <strong>the</strong> obligation <strong>of</strong> <strong>the</strong> court <strong>and</strong> prosecu<strong>to</strong>r <strong>to</strong> seekprotection from <strong>the</strong> police <strong>for</strong> witnesses who report be<strong>in</strong>g threatened <strong>dur<strong>in</strong>g</strong> <strong>the</strong> proceed<strong>in</strong>gs,<strong>and</strong> <strong>the</strong>ir obligation <strong>to</strong> <strong>in</strong><strong>for</strong>m <strong>the</strong> participants <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs <strong>of</strong> <strong>the</strong> measures taken;ii) <strong>the</strong> same task <strong>for</strong>ce will draft a Pro<strong>to</strong>col on <strong>the</strong> procedure <strong>in</strong> cases <strong>of</strong> threats addressed<strong>to</strong> witnesses <strong>in</strong> war crimes cases; iii) review any fur<strong>the</strong>r amendments <strong>to</strong> <strong>the</strong> CPC <strong>and</strong> o<strong>the</strong>rregulations <strong>for</strong> <strong>the</strong> purpose <strong>of</strong> streng<strong>the</strong>n<strong>in</strong>g this component <strong>of</strong> witness protection.23b) The prosecu<strong>to</strong>rs, judges <strong>and</strong> <strong>the</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior shall consistentlyapply <strong>the</strong> mechanisms established.Specific objective no. 2: A reliable, functional <strong>and</strong> viable witness Protection Programme shall beestablished.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong>Justice, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior <strong>and</strong> <strong>the</strong> Victims <strong>and</strong> Witnesses Section <strong>of</strong> <strong>the</strong> ICTY. Thetask <strong>for</strong>ce shall prepare amendments <strong>to</strong> <strong>the</strong> Law on <strong>the</strong> Protection <strong>of</strong> Participants <strong>in</strong> Crim<strong>in</strong>alProceed<strong>in</strong>gs which will:13 Council <strong>of</strong> Europe, European Commission, European Parliament, OSCE <strong>and</strong> Amnesty International.Humanitarian Law Center


i. Establish a mechanism <strong>for</strong> <strong>in</strong>vestigation <strong>in</strong><strong>to</strong> compla<strong>in</strong>ts filed by persons under protection,<strong>to</strong> be carried out by <strong>the</strong> body composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> Protection Unit, <strong>the</strong>OWCP <strong>and</strong> <strong>the</strong> Chief <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior Internal Control Sec<strong>to</strong>r;ii. Specify <strong>the</strong> content <strong>and</strong> procedure <strong>for</strong> <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> Protection Unit’s dutieswhen it comes <strong>to</strong> persons <strong>in</strong> <strong>the</strong> protection programme, as regards social, economic, legal <strong>and</strong>psychological assistance, as prescribed by <strong>the</strong> Law on <strong>the</strong> Protection <strong>of</strong> Participants <strong>in</strong> Crim<strong>in</strong>alProceed<strong>in</strong>gs, <strong>and</strong> establish a mechanism <strong>of</strong> control over <strong>the</strong> fulfillment <strong>of</strong> <strong>the</strong>se duties;iii. Streng<strong>the</strong>n <strong>the</strong> mechanism <strong>for</strong> <strong>the</strong> moni<strong>to</strong>r<strong>in</strong>g <strong>of</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> Commission <strong>and</strong> <strong>the</strong>Protection Unit by <strong>the</strong> competent committees <strong>of</strong> <strong>the</strong> National Assembly, by <strong>in</strong>troduc<strong>in</strong>g am<strong>and</strong>a<strong>to</strong>ry review <strong>and</strong> evaluation <strong>of</strong> reports made by <strong>the</strong> Commission <strong>and</strong> <strong>the</strong> ProtectionUnit on <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> Programme, by <strong>the</strong> parliamentary committees <strong>in</strong>charge <strong>of</strong> justice <strong>and</strong> security;iv. Establish <strong>the</strong> <strong>for</strong>mal subord<strong>in</strong>ation <strong>of</strong> <strong>the</strong> Chief <strong>of</strong> <strong>the</strong> Protection Unit <strong>to</strong> <strong>the</strong> Prosecu<strong>to</strong>r,by requr<strong>in</strong>g b<strong>in</strong>d<strong>in</strong>g op<strong>in</strong>ion <strong>of</strong> <strong>the</strong> Prosecu<strong>to</strong>r when appo<strong>in</strong>t<strong>in</strong>g a chief <strong>for</strong> this unit, <strong>and</strong><strong>in</strong>clud<strong>in</strong>g <strong>the</strong> role <strong>of</strong> <strong>the</strong> Prosecu<strong>to</strong>r <strong>in</strong> <strong>the</strong> career advancement <strong>of</strong> <strong>the</strong> members <strong>of</strong> this unit;b) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce composed <strong>of</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry<strong>of</strong> Justice, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Public Adm<strong>in</strong>istration <strong>and</strong> Local Self-Government <strong>and</strong> <strong>the</strong> OWCP. The task <strong>for</strong>ce will prepare proposals <strong>for</strong> bylaws which willregulate <strong>the</strong> <strong>the</strong> procedure <strong>for</strong> <strong>the</strong> identity change <strong>of</strong> persons <strong>in</strong> <strong>the</strong> Programme <strong>for</strong> WitnessProtection;24c) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>mulate <strong>and</strong> <strong>in</strong>itiate amendments <strong>to</strong> <strong>the</strong> Law on M<strong>in</strong>istries <strong>and</strong><strong>the</strong> Law on <strong>the</strong> Protection Programme <strong>for</strong> Participants <strong>in</strong> Crim<strong>in</strong>al Proceed<strong>in</strong>gs, with <strong>the</strong> aim<strong>of</strong> transferr<strong>in</strong>g <strong>the</strong> Protection Unit from <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior <strong>to</strong> <strong>the</strong>jurisdiction <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, <strong>and</strong> <strong>the</strong> <strong>in</strong>troduction <strong>of</strong> specific criteria <strong>for</strong> employment<strong>in</strong> <strong>the</strong> Protection Unit, which will ensure that this service does not employ persons who had <strong>in</strong>any capacity participated <strong>in</strong> <strong>the</strong> armed conflicts <strong>in</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong>.4. Victims/Witnesses SupportThe ma<strong>in</strong> objective <strong>of</strong> <strong>the</strong> measures <strong>of</strong> support <strong>for</strong> victims (<strong>in</strong>jured parties) <strong>and</strong> witnesses <strong>dur<strong>in</strong>g</strong> <strong>the</strong>crim<strong>in</strong>al proceed<strong>in</strong>gs, is <strong>the</strong>ir protection from (re)traumatisation <strong>and</strong> (secondary) victimi<strong>za</strong>tion. Ona broader scale, <strong>the</strong> measures <strong>of</strong> support <strong>for</strong> victims <strong>and</strong> witnesses represent an important element <strong>of</strong><strong>in</strong>stitutional support <strong>for</strong> war crimes trials, <strong>and</strong> a message <strong>to</strong> <strong>the</strong> wider community that participation <strong>in</strong>war crimes proceed<strong>in</strong>gs is <strong>the</strong> concern <strong>and</strong> responsibility <strong>of</strong> <strong>the</strong> entire society.When it comes <strong>to</strong> provid<strong>in</strong>g support <strong>to</strong> victims, clear <strong>in</strong>ternational st<strong>and</strong>ards that regulate <strong>the</strong> obligations<strong>of</strong> <strong>in</strong>stitutions <strong>to</strong> <strong>the</strong> victims <strong>of</strong> crim<strong>in</strong>al acts be<strong>for</strong>e, <strong>dur<strong>in</strong>g</strong> <strong>and</strong> after crim<strong>in</strong>al proceed<strong>in</strong>gs, have beenestablished. The most important document is Directive 2012/29/EU <strong>of</strong> <strong>the</strong> European Parliament <strong>and</strong><strong>the</strong> Council <strong>of</strong> Europe on <strong>the</strong> establishment <strong>of</strong> m<strong>in</strong>imum st<strong>and</strong>ards <strong>of</strong> rights, support <strong>and</strong> protection<strong>of</strong> victims <strong>of</strong> crimes. Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> Directive <strong>and</strong> o<strong>the</strong>r <strong>in</strong>ternational st<strong>and</strong>ards, among o<strong>the</strong>r th<strong>in</strong>gs,<strong>the</strong> support measures must be implemented <strong>in</strong> <strong>the</strong> earliest stage <strong>of</strong> <strong>the</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs, <strong>and</strong> on<strong>the</strong> basis <strong>of</strong> assessment <strong>of</strong> <strong>the</strong> <strong>in</strong>dividual needs <strong>of</strong> <strong>the</strong> persons <strong>the</strong>y are <strong>in</strong>tended <strong>for</strong>. The <strong>in</strong>stitutions <strong>and</strong>o<strong>the</strong>r participants that come <strong>in</strong><strong>to</strong> contact with victims must be tra<strong>in</strong>ed <strong>to</strong> work with <strong>the</strong>m.Humanitarian Law Center


The support measures <strong>for</strong> victims which are applied by Serbian <strong>in</strong>stitutions <strong>in</strong> war crimes casesare not <strong>in</strong> accordance with <strong>in</strong>ternational st<strong>and</strong>ards. Among <strong>the</strong> many deficiencies, <strong>the</strong> ones that aremost apparent are: <strong>the</strong> lack <strong>of</strong> a system <strong>for</strong> <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>the</strong> victims about <strong>the</strong> development <strong>of</strong> <strong>the</strong> case,non-existent psychological support be<strong>for</strong>e, <strong>dur<strong>in</strong>g</strong> <strong>and</strong> after <strong>the</strong> trial, <strong>the</strong> weak capacity <strong>and</strong> narrowjurisdiction <strong>of</strong> <strong>the</strong> Service <strong>for</strong> assistance <strong>and</strong> support <strong>to</strong> witnesses <strong>and</strong> victims with<strong>in</strong> <strong>the</strong> Higher CourtDepartment (Assistance <strong>and</strong> Support Service).Support <strong>for</strong> witnesses <strong>and</strong> victims <strong>in</strong> war crimes cases be<strong>for</strong>e <strong>the</strong> Department <strong>of</strong> <strong>the</strong> Higher Court,which is provided by <strong>the</strong> Assistance <strong>and</strong> Support Service, <strong>in</strong>cludes two types <strong>of</strong> measures - logisticalassistance <strong>in</strong> travel organi<strong>za</strong>tion, <strong>and</strong> emotional support be<strong>for</strong>e, <strong>dur<strong>in</strong>g</strong> <strong>and</strong> immediately after <strong>the</strong> trial.The o<strong>the</strong>r objective needs <strong>and</strong> rights <strong>of</strong> victims <strong>and</strong> witnesses guaranteed by <strong>in</strong>ternational st<strong>and</strong>ardsare not addressed. In addition, <strong>the</strong> procedures relat<strong>in</strong>g <strong>to</strong> contact<strong>in</strong>g witnesses <strong>and</strong> victims from <strong>the</strong>region <strong>and</strong> organiz<strong>in</strong>g <strong>the</strong>ir trips are substantially <strong>and</strong> <strong>for</strong>mally <strong>in</strong>conclusive. Thus, <strong>in</strong> terms <strong>of</strong> victims<strong>and</strong> witnesses from Kosovo <strong>and</strong> BiH, <strong>the</strong> Assistance <strong>and</strong> Support Service does not have any k<strong>in</strong>d<strong>of</strong> communication with <strong>the</strong> witnesses <strong>and</strong> victims be<strong>for</strong>e <strong>the</strong>ir arrival at <strong>the</strong> court, which, amongo<strong>the</strong>r th<strong>in</strong>gs, makes it difficult <strong>to</strong> establish a <strong>relation</strong>ship <strong>of</strong> trust between <strong>the</strong> representatives <strong>of</strong><strong>the</strong> Assistance <strong>and</strong> Support Service <strong>and</strong> <strong>the</strong> victim/witness – a trust which is essential <strong>for</strong> provid<strong>in</strong>gemotional support <strong>dur<strong>in</strong>g</strong> a trial. Communication with <strong>the</strong> victims <strong>and</strong> witnesses from Croatia iscarried out thanks <strong>to</strong> good <strong>in</strong>terpersonal <strong>relation</strong>ships with <strong>the</strong> Department <strong>for</strong> <strong>the</strong> support <strong>of</strong> victims<strong>and</strong> witnesses with <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Croatia, but with no <strong>for</strong>mal pro<strong>to</strong>col oncooperation between <strong>the</strong> two services. 14Fur<strong>the</strong>rmore, <strong>in</strong> view <strong>of</strong> <strong>the</strong> fact that <strong>the</strong> Assistance <strong>and</strong> Support Service is part <strong>of</strong> <strong>the</strong> Higher CourtDepartment, by <strong>in</strong>troduc<strong>in</strong>g <strong>the</strong> new concept <strong>of</strong> crim<strong>in</strong>al proceed<strong>in</strong>gs (January 2012), <strong>in</strong> which <strong>the</strong> <strong>in</strong>vestigationis transferred <strong>to</strong> <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> OWCP, <strong>the</strong> support <strong>for</strong> victims <strong>and</strong> witnesses <strong>in</strong> <strong>the</strong> <strong>in</strong>vestigationstage is <strong>for</strong>mally exempted from <strong>the</strong> jurisdiction <strong>of</strong> <strong>the</strong> Assistance <strong>and</strong> Support Service. At present, <strong>dur<strong>in</strong>g</strong> <strong>the</strong><strong>in</strong>vestigation, certa<strong>in</strong> measures <strong>of</strong> support are provided by <strong>the</strong> employees <strong>of</strong> <strong>the</strong> OWCP <strong>and</strong> <strong>the</strong> Assistance<strong>and</strong> Support Service, but with <strong>the</strong> approval <strong>of</strong> <strong>the</strong> President <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade.25General objective: A comprehensive system <strong>of</strong> support <strong>for</strong> victims <strong>and</strong> witnesses <strong>in</strong> proceed<strong>in</strong>gs <strong>for</strong>war crimes <strong>in</strong> accordance with <strong>the</strong> EU <strong>and</strong> o<strong>the</strong>r <strong>in</strong>ternational st<strong>and</strong>ards is established.Specific objective no. 1: Streng<strong>the</strong>n<strong>in</strong>g <strong>the</strong> role <strong>and</strong> <strong>the</strong> capacity <strong>of</strong> <strong>the</strong> Assistance <strong>and</strong> Support Service.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate <strong>the</strong> creation <strong>of</strong> a task <strong>for</strong>ce which will be composed <strong>of</strong>representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, <strong>the</strong> Higher Court Department, <strong>the</strong> OWCP, <strong>the</strong>representative <strong>of</strong> <strong>the</strong> Assistance <strong>and</strong> Support Service, a judge with experience <strong>the</strong> first <strong>in</strong>stancecases <strong>of</strong> war crimes <strong>and</strong> an expert with <strong>the</strong> requisite pr<strong>of</strong>ile. The task <strong>for</strong>ce will <strong>for</strong>mulateamendments <strong>to</strong> <strong>the</strong> CPC <strong>and</strong> <strong>the</strong> Court’s Rules which will enable <strong>the</strong> psychologist from <strong>the</strong>Assistance <strong>and</strong> Support Service <strong>to</strong>: i) be present <strong>in</strong> <strong>the</strong> courtroom <strong>dur<strong>in</strong>g</strong> <strong>the</strong> trial; ii) exercise<strong>the</strong> obligation <strong>to</strong> warn <strong>the</strong> presid<strong>in</strong>g judge if it comes <strong>to</strong> a deterioration <strong>of</strong> <strong>the</strong> psychologicalstate <strong>of</strong> <strong>the</strong> victim; iii) exercise <strong>the</strong> right <strong>to</strong> suggest <strong>to</strong> <strong>the</strong> court that a witness be granted <strong>the</strong>status <strong>of</strong> a particularly sensitive witness;14 Full name: The Department <strong>for</strong> <strong>the</strong> Support <strong>of</strong> Victims/Witnesses <strong>in</strong> Crim<strong>in</strong>al Proceed<strong>in</strong>gs <strong>and</strong> Proceed<strong>in</strong>gs<strong>for</strong> <strong>War</strong> <strong>Crimes</strong>.Humanitarian Law Center


) In accordance with <strong>the</strong> needs identified, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice shall, <strong>in</strong> cooperation with <strong>the</strong>M<strong>in</strong>istry <strong>of</strong> F<strong>in</strong>ance, establish a long-term <strong>and</strong> susta<strong>in</strong>able system <strong>of</strong> f<strong>in</strong>ancial support <strong>for</strong> <strong>the</strong><strong>in</strong>stitutions <strong>and</strong> NGOs provid<strong>in</strong>g assistance <strong>to</strong> victims;c) The M<strong>in</strong>istry <strong>of</strong> Justice shall, <strong>in</strong> cooperation with <strong>the</strong> mentioned <strong>in</strong>stitutions <strong>and</strong> NGOs,<strong>in</strong>itiate <strong>and</strong> implement a campaign <strong>of</strong> <strong>in</strong><strong>for</strong>m<strong>in</strong>g victims about <strong>the</strong> work <strong>of</strong> <strong>the</strong>se <strong>in</strong>stitutions<strong>and</strong> <strong>the</strong> NGOs, as well as about <strong>the</strong> content <strong>of</strong> <strong>the</strong> measures <strong>of</strong> support that <strong>the</strong>y can receive;d) The OWCP shall, <strong>in</strong> cooperation with <strong>the</strong> Assistance <strong>and</strong> Support Service, <strong>for</strong>mulate apro<strong>to</strong>col <strong>for</strong> <strong>the</strong> m<strong>and</strong>a<strong>to</strong>ry <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>of</strong> victims about all aspects <strong>of</strong> <strong>the</strong>ir cases about which<strong>the</strong>y have an <strong>in</strong>terest <strong>in</strong> know<strong>in</strong>g (<strong>the</strong> judgement, <strong>the</strong> provisional release <strong>of</strong> <strong>the</strong> defendant, etc).e) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>in</strong>itiate <strong>the</strong> creation <strong>of</strong> a task <strong>for</strong>ce composed <strong>of</strong> representatives<strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Health <strong>and</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Labour, Employment, <strong>and</strong>Veterans <strong>and</strong> Social Policy, Assistance <strong>and</strong> Support Service <strong>and</strong> representatives <strong>of</strong> NGOs whohave relevant longtime experience <strong>in</strong> provid<strong>in</strong>g support <strong>to</strong> victims <strong>and</strong> experts with requisitepr<strong>of</strong>iles. The task <strong>for</strong>ce will conduct wider consultations with relevant experts, <strong>in</strong>stitutions<strong>and</strong> NGOs on <strong>the</strong> needs, exist<strong>in</strong>g legal <strong>and</strong> <strong>in</strong>stitutional frameworks, experience <strong>and</strong> goodpractices <strong>in</strong> provid<strong>in</strong>g support <strong>to</strong> victims, with a special focus on <strong>the</strong> role, resources, practice<strong>and</strong> needs <strong>of</strong> <strong>the</strong> centers <strong>for</strong> social work <strong>and</strong> healthcare <strong>in</strong>stitutions, <strong>in</strong> connection withprovid<strong>in</strong>g psychosocial support <strong>to</strong> victims;f) The competent M<strong>in</strong>istries shall implement <strong>the</strong> recommendations <strong>of</strong> <strong>the</strong> task <strong>for</strong>ce <strong>in</strong> order <strong>to</strong>improve <strong>the</strong> system <strong>of</strong> support <strong>to</strong> victims <strong>and</strong> witnesses.Specific objective no. 4: A system <strong>of</strong> cont<strong>in</strong>uous education <strong>of</strong> all representatives <strong>of</strong> all <strong>in</strong>stitutions thatcome <strong>in</strong><strong>to</strong> contact with victims is established.27a) The SPC <strong>and</strong> <strong>the</strong> HCC will h<strong>and</strong> down a decision on <strong>the</strong> <strong>in</strong>troduction <strong>of</strong> a special programme<strong>of</strong> cont<strong>in</strong>uous tra<strong>in</strong><strong>in</strong>g <strong>for</strong> prosecu<strong>to</strong>rs, as well as <strong>for</strong> judges who conduct war crimes trials,on work<strong>in</strong>g with victims, <strong>and</strong> <strong>the</strong>ir rights <strong>and</strong> needs; <strong>and</strong> <strong>the</strong> identification <strong>of</strong> needs, creation<strong>of</strong> tra<strong>in</strong><strong>in</strong>g content <strong>and</strong> implementation <strong>of</strong> <strong>the</strong> tra<strong>in</strong><strong>in</strong>g will be <strong>the</strong> responsibility <strong>of</strong> <strong>the</strong> JudicialAcademy, <strong>in</strong> accordance with <strong>the</strong> Law on <strong>the</strong> Judicial Academy;b) The M<strong>in</strong>istry <strong>of</strong> Justice <strong>and</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> <strong>the</strong> Interior shall <strong>in</strong>itiate <strong>the</strong> creation <strong>of</strong> m<strong>and</strong>a<strong>to</strong>rycont<strong>in</strong>uous education <strong>for</strong> <strong>the</strong> court guards <strong>and</strong> o<strong>the</strong>r <strong>of</strong>ficials who come <strong>in</strong><strong>to</strong> contact withvictims, <strong>and</strong>/or allow accredited domestic <strong>and</strong> <strong>for</strong>eign <strong>in</strong>stitutions <strong>and</strong> orgsanisations <strong>to</strong>provide this type <strong>of</strong> tra<strong>in</strong><strong>in</strong>g.5. Defence <strong>of</strong> <strong>the</strong> accusedAn efficient <strong>and</strong> competent defence counsel is one <strong>of</strong> <strong>the</strong> basic preconditions <strong>for</strong> <strong>the</strong> fairness <strong>and</strong>credibility <strong>of</strong> court proceed<strong>in</strong>gs <strong>in</strong> cases <strong>of</strong> war crimes. Hav<strong>in</strong>g pr<strong>of</strong>essional defence counsel has apositive effect on <strong>the</strong> efficiency <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs <strong>and</strong> thus on <strong>the</strong> sav<strong>in</strong>g <strong>of</strong> <strong>in</strong>stitutional resources.The imperative <strong>of</strong> hav<strong>in</strong>g a cont<strong>in</strong>uous pr<strong>of</strong>essional development <strong>for</strong> <strong>the</strong> defence counsel <strong>in</strong> <strong>the</strong> field<strong>of</strong> <strong>in</strong>ternational humanitarian law <strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law emerges from <strong>the</strong> complex nature <strong>of</strong>war crimes trials, <strong>the</strong> limited opportunities <strong>for</strong> ga<strong>in</strong><strong>in</strong>g tra<strong>in</strong><strong>in</strong>g <strong>and</strong> knowledge <strong>in</strong> <strong>the</strong> <strong>the</strong>se areas <strong>of</strong>Humanitarian Law Center


law be<strong>for</strong>e local courts, <strong>and</strong> <strong>the</strong> constant evolution <strong>of</strong> this branches <strong>of</strong> law. The Law on <strong>the</strong> <strong>Prosecution</strong><strong>of</strong> <strong>War</strong> <strong>Crimes</strong> does not establish a criterion <strong>of</strong> expertise <strong>for</strong> at<strong>to</strong>rneys <strong>in</strong> <strong>the</strong> subject <strong>of</strong> <strong>in</strong>ternationalhumanitarian law <strong>and</strong> <strong>in</strong>ternational crim<strong>in</strong>al law as a precondition <strong>for</strong> act<strong>in</strong>g as defence counsel <strong>in</strong>cases <strong>of</strong> war crimes. The conditions <strong>for</strong> <strong>the</strong> defence counsel appo<strong>in</strong>ted by <strong>the</strong> court are 10 years <strong>of</strong>experience <strong>in</strong> <strong>the</strong> field <strong>of</strong> crim<strong>in</strong>al law <strong>and</strong> a certificate on <strong>the</strong> underst<strong>and</strong><strong>in</strong>g <strong>of</strong> human rights law.Besides <strong>the</strong>se problems, <strong>the</strong> accused also deal with problems <strong>in</strong> <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g <strong>of</strong> a competent defencecounsels. Defence <strong>in</strong> cases <strong>of</strong> war crimes is one <strong>of</strong> <strong>the</strong> most expensive, due <strong>to</strong> <strong>the</strong> complexity <strong>of</strong> crim<strong>in</strong>allaw relat<strong>in</strong>g <strong>to</strong> war crimes <strong>and</strong> due <strong>to</strong> <strong>the</strong> severe punishments prescribed <strong>for</strong> <strong>the</strong>se acts. Very <strong>of</strong>ten<strong>the</strong> accused withdraw <strong>the</strong> power <strong>of</strong> at<strong>to</strong>rney issued <strong>to</strong> <strong>the</strong> defence counsel <strong>of</strong> <strong>the</strong>ir choos<strong>in</strong>g <strong>dur<strong>in</strong>g</strong> <strong>the</strong>course <strong>of</strong> <strong>the</strong> proceed<strong>in</strong>gs, because <strong>the</strong>y are no longer able <strong>to</strong> pay <strong>for</strong> <strong>the</strong> defence.The defence <strong>of</strong> <strong>the</strong> accused is not <strong>in</strong> an equal position when compared <strong>to</strong> <strong>the</strong> OWCP with regard <strong>to</strong> <strong>the</strong>acquirement <strong>of</strong> evidence outside <strong>the</strong> terri<strong>to</strong>ry <strong>of</strong> Serbia. While <strong>the</strong> OWCP has signed memor<strong>and</strong>a <strong>of</strong>underst<strong>and</strong><strong>in</strong>g on direct cooperation with prosecution <strong>of</strong>fices <strong>of</strong> <strong>the</strong> same competences <strong>in</strong> <strong>the</strong> region,defence lawyers are advised <strong>to</strong> undertake long-last<strong>in</strong>g <strong>in</strong>ternational legal aid procedures or <strong>to</strong> acquireevidence on <strong>the</strong>ir own.General objective: St<strong>and</strong>ards <strong>of</strong> defence <strong>in</strong> cases <strong>of</strong> war crimes is improved.Specific objective no.1: Improved pr<strong>of</strong>essional capacities <strong>of</strong> defence counsel <strong>in</strong> cases <strong>of</strong> war crimes.Activities:28a) The M<strong>in</strong>istry <strong>of</strong> Justice shall <strong>for</strong>m a task <strong>for</strong>ce consist<strong>in</strong>g <strong>of</strong> representatives <strong>of</strong> this M<strong>in</strong>istry, <strong>the</strong>Bar Association <strong>of</strong> Serbia, <strong>the</strong> Lawyers Chamber <strong>of</strong> Belgrade, <strong>the</strong> Higher Court Department<strong>and</strong> experts from <strong>the</strong> requisite areas <strong>of</strong> <strong>in</strong>terest, who will prepare a draft law on amendments <strong>to</strong><strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong> <strong>War</strong> <strong>Crimes</strong>, which would <strong>in</strong>troduce two cumulative conditions<strong>for</strong> defence counsel act<strong>in</strong>g <strong>in</strong> cases <strong>of</strong> war crimes, act<strong>in</strong>g <strong>in</strong> <strong>the</strong> capacity <strong>of</strong> counsel <strong>for</strong> <strong>the</strong>accused choos<strong>in</strong>g or as appo<strong>in</strong>ted counsel – <strong>the</strong> condition <strong>of</strong> expertise <strong>and</strong> <strong>the</strong> condition <strong>of</strong>knowledge; <strong>the</strong> amendments will also envisage establish<strong>in</strong>g a special body <strong>of</strong> pr<strong>of</strong>essionals– a Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong> war crimes cases, which would be responsible <strong>for</strong><strong>the</strong> verification <strong>of</strong> <strong>the</strong> conditions met <strong>and</strong> <strong>the</strong> implementation <strong>of</strong> programmes necessary <strong>for</strong>fulfill<strong>in</strong>g <strong>the</strong> condition <strong>of</strong> knowledge;b) The same task <strong>for</strong>ce, with <strong>the</strong> participation <strong>of</strong> experts <strong>of</strong> requisite pr<strong>of</strong>ile, shall also prepare adraft document with <strong>the</strong> amendments <strong>to</strong> <strong>the</strong> Rules <strong>for</strong> <strong>the</strong> systemati<strong>za</strong>tion <strong>and</strong> organi<strong>za</strong>tion<strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, which will establish <strong>the</strong> Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong> warcrimes cases, as part <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice Judicial Department, <strong>and</strong> also <strong>the</strong> Rules <strong>of</strong>procedure <strong>for</strong> this body; <strong>the</strong> Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong> war crimes cases shall have<strong>the</strong> follow<strong>in</strong>g powers: i) <strong>to</strong> provide legal <strong>and</strong> adm<strong>in</strong>istrative support <strong>to</strong> defence counsel <strong>in</strong>cases <strong>of</strong> war crimes; ii) <strong>to</strong> determ<strong>in</strong>e criteria <strong>for</strong> fulfill<strong>in</strong>g <strong>the</strong> conditions related <strong>to</strong> knowledge<strong>and</strong> expertise, <strong>and</strong> <strong>to</strong> verify fulfilment <strong>of</strong> <strong>the</strong>se conditions by defence at<strong>to</strong>rneys; iii) <strong>to</strong> design<strong>and</strong> organize pr<strong>of</strong>essional tra<strong>in</strong><strong>in</strong>g <strong>for</strong> at<strong>to</strong>rneys who <strong>in</strong>tend <strong>to</strong> represent <strong>in</strong> cases <strong>of</strong> warcrimes, <strong>for</strong> <strong>the</strong> purpose <strong>of</strong> fulfill<strong>in</strong>g <strong>the</strong> condition <strong>of</strong> knowledge; iv) <strong>to</strong> organize o<strong>the</strong>r tra<strong>in</strong><strong>in</strong>gprogrammes; v) <strong>to</strong> execute o<strong>the</strong>r tasks important <strong>for</strong> <strong>the</strong> improvement <strong>of</strong> <strong>the</strong> st<strong>and</strong>ard <strong>of</strong>crim<strong>in</strong>al defence <strong>in</strong> cases <strong>of</strong> war crimes;c) The President <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade shall render a decision on <strong>the</strong> assignment <strong>to</strong> <strong>the</strong>Humanitarian Law Center


Department <strong>for</strong> crim<strong>in</strong>al defence <strong>in</strong> war crimes cases <strong>of</strong> adequate facilities <strong>in</strong> <strong>the</strong> build<strong>in</strong>g <strong>of</strong><strong>the</strong> Special Court <strong>in</strong> Ustanička Street.Specific objective no. 2: The system <strong>for</strong> <strong>the</strong> f<strong>in</strong>anc<strong>in</strong>g <strong>of</strong> ex <strong>of</strong>ficio defence <strong>in</strong> cases <strong>of</strong> war crimes shallbe improved.Activities:a) The M<strong>in</strong>ister <strong>of</strong> Justice shall amend <strong>the</strong> Regulations on <strong>the</strong> Fee <strong>for</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> Appo<strong>in</strong>tedAt<strong>to</strong>rneys, so that fee will be 75% <strong>of</strong> <strong>the</strong> fee def<strong>in</strong>ed <strong>in</strong> <strong>the</strong> Bar Association Tariff <strong>for</strong>representation <strong>in</strong> <strong>the</strong> ma<strong>in</strong> hear<strong>in</strong>g <strong>in</strong> war crimes cases.b) The M<strong>in</strong>istry <strong>of</strong> Justice shall provide regular f<strong>in</strong>ancial resources <strong>to</strong> <strong>the</strong> Higher Court <strong>in</strong>Belgrade <strong>and</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade <strong>in</strong> order <strong>to</strong> pay fees <strong>to</strong> <strong>the</strong> appo<strong>in</strong>ted at<strong>to</strong>rneys.Specific objective no. 3: An agreement shall be signed allow<strong>in</strong>g <strong>for</strong> <strong>the</strong> simplified acquisition <strong>of</strong>evidence <strong>in</strong> cases <strong>of</strong> war crimes by defence counsel.Activity:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall start an <strong>in</strong>itiative <strong>for</strong> <strong>the</strong> sign<strong>in</strong>g <strong>of</strong> an <strong>in</strong>ter-governmentalagreement with <strong>the</strong> successor states <strong>of</strong> <strong>the</strong> <strong>for</strong>mer <strong>Yugoslavia</strong> on a simplified procedure <strong>of</strong>acquisition <strong>of</strong> evidence <strong>in</strong> cases <strong>of</strong> war crimes by defence counsel.6. Represent<strong>in</strong>g war crimes trials <strong>in</strong> publicAn important part <strong>of</strong> <strong>the</strong> process <strong>of</strong> deal<strong>in</strong>g with <strong>the</strong> past is <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>the</strong> public about war crimestrials <strong>and</strong> <strong>the</strong> facts about <strong>the</strong> crimes that have been judicially established. The acceptance <strong>of</strong> <strong>the</strong> judicialfacts about <strong>the</strong> crimes committed is one <strong>of</strong> <strong>the</strong> key preconditions <strong>for</strong> hav<strong>in</strong>g an objective image <strong>of</strong> <strong>the</strong>past <strong>and</strong> <strong>for</strong> <strong>the</strong> creation <strong>of</strong> a social memory <strong>of</strong> <strong>the</strong> crimes committed. The significance <strong>of</strong> <strong>the</strong> objective,cont<strong>in</strong>uous <strong>and</strong> timely <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>of</strong> <strong>the</strong> public about war crimes trials has been recognized by <strong>the</strong><strong>in</strong>ternational crim<strong>in</strong>al tribunals.29Only <strong>the</strong> OWCP <strong>in</strong> Serbia has a developed programme <strong>for</strong> <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>the</strong> public about war crimes trials<strong>and</strong> <strong>the</strong> work <strong>of</strong> this <strong>in</strong>stitution, <strong>and</strong> it is carried out by <strong>the</strong> OWCP’s Outreach Office <strong>and</strong> <strong>the</strong> OWCP’s<strong>web</strong> page. However, this service does not have <strong>the</strong> resources necessary <strong>for</strong> <strong>the</strong> implementation <strong>of</strong> <strong>the</strong>activities envisaged. The reports by non-governmental organi<strong>za</strong>tions, <strong>the</strong> Humanitarian Law Centre <strong>in</strong>particular, which moni<strong>to</strong>r <strong>and</strong> analyse war crimes trials <strong>and</strong> <strong>in</strong><strong>for</strong>m <strong>the</strong> local <strong>and</strong> <strong>in</strong>ternational publicabout <strong>the</strong>m, also contribute <strong>to</strong> <strong>the</strong> process <strong>of</strong> <strong>in</strong><strong>for</strong>m<strong>in</strong>g <strong>the</strong> public about war crimes trials.The Higher Court Department <strong>and</strong> Appeals Court Department, act<strong>in</strong>g <strong>in</strong> <strong>the</strong> first <strong>and</strong> <strong>the</strong> second<strong>in</strong>stances <strong>in</strong> war crimes cases do not have special Outreach <strong>of</strong>fices. They <strong>in</strong><strong>for</strong>m public through public<strong>relation</strong>s <strong>of</strong>fices <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade <strong>and</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade. However,<strong>in</strong><strong>for</strong>mation about war crimes trials provided by <strong>the</strong>se <strong>of</strong>fices is scarce <strong>and</strong> sporadic, <strong>and</strong> <strong>the</strong>y provideonly basic <strong>in</strong><strong>for</strong>mation about each case. When <strong>the</strong>re is need <strong>of</strong> a pr<strong>of</strong>essional explanation <strong>of</strong> courtrul<strong>in</strong>gs, <strong>the</strong> media do not have a person <strong>to</strong> turn <strong>to</strong>, <strong>and</strong> it <strong>of</strong>ten happens that representatives <strong>of</strong> <strong>the</strong>OWCP provide <strong>the</strong>se explanations <strong>in</strong>stead <strong>of</strong> <strong>the</strong> court. Trial chambers do not have <strong>the</strong>ir basic <strong>web</strong>pages, whilst <strong>the</strong> rul<strong>in</strong>gs rendered by <strong>the</strong> Department <strong>of</strong> <strong>the</strong> Higher Court are not available onl<strong>in</strong>e atHumanitarian Law Center


<strong>the</strong> <strong>web</strong> page <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade.These problems have made a significant contribution <strong>to</strong> <strong>the</strong> poor visibility <strong>of</strong> war crimes trials <strong>in</strong>Serbia. The research <strong>in</strong><strong>to</strong> public op<strong>in</strong>ion <strong>in</strong> Serbia shows that most <strong>of</strong> <strong>the</strong> citizens are not able <strong>to</strong> nameeven one war crimes case prosecuted be<strong>for</strong>e <strong>the</strong> local courts, <strong>and</strong> not able <strong>to</strong> state a s<strong>in</strong>gle <strong>in</strong>stitutionparticipat<strong>in</strong>g <strong>in</strong> <strong>the</strong> prosecution <strong>of</strong> war crimes. 15Non-governmental organi<strong>za</strong>tions <strong>and</strong> <strong>the</strong> media moni<strong>to</strong>r<strong>in</strong>g war crimes trials are fac<strong>in</strong>g obstacles<strong>in</strong> access<strong>in</strong>g judicial documents <strong>and</strong> <strong>the</strong> broadcast<strong>in</strong>g <strong>of</strong> trials due problematic <strong>in</strong>terpretation <strong>of</strong> <strong>the</strong>relevant legal provisions by courts. Namely, <strong>the</strong> Higher Court Department <strong>and</strong> <strong>the</strong> Appeals CourtDepartment limit access <strong>to</strong> judgments through <strong>the</strong> so-called process <strong>of</strong> anonymi<strong>za</strong>tion (redaction,blackouts) <strong>of</strong> certa<strong>in</strong> parts <strong>of</strong> <strong>the</strong> judgments conta<strong>in</strong><strong>in</strong>g personal <strong>in</strong><strong>for</strong>mation which should beprotected <strong>in</strong> accordance with <strong>the</strong> Law on <strong>the</strong> Protection <strong>of</strong> Personal In<strong>for</strong>mation. What happens<strong>in</strong> practice is that a substantial part <strong>of</strong> <strong>the</strong> judgements relat<strong>in</strong>g <strong>to</strong> witnesses <strong>and</strong> <strong>the</strong> accused areblacked out, <strong>and</strong> <strong>the</strong> blacked out parts spread <strong>to</strong> <strong>in</strong><strong>for</strong>mation which is not considered personal<strong>in</strong><strong>for</strong>mation, <strong>and</strong> <strong>the</strong> reader is thus deprived <strong>of</strong> access <strong>to</strong> <strong>the</strong> facts established by <strong>the</strong> judgment <strong>in</strong>question. Also, <strong>the</strong> rules <strong>for</strong> anonymi<strong>za</strong>tion <strong>of</strong> judgments rendered by <strong>the</strong> Appeals Court Department<strong>and</strong> <strong>the</strong> Higher Court Department differ, because <strong>the</strong> Higher Court <strong>in</strong> Belgrade has not yet adopted<strong>the</strong> Rules <strong>of</strong> Anonymi<strong>za</strong>tion, whereas <strong>the</strong> Appeals Court Department applies <strong>the</strong> Rules on m<strong>in</strong>imumanonymi<strong>za</strong>tion <strong>in</strong> court decisions rendered by <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade.30Unlike <strong>in</strong> cases <strong>of</strong> organized crime, <strong>the</strong> media have not broadcast <strong>the</strong> ma<strong>in</strong> hear<strong>in</strong>gs held <strong>in</strong> cases <strong>of</strong>war crimes, despite <strong>the</strong> existence <strong>of</strong> a legal provision which allows this (Article 16a <strong>of</strong> <strong>the</strong> Law on <strong>the</strong><strong>Prosecution</strong> <strong>of</strong> <strong>War</strong> <strong>Crimes</strong>). In practice, <strong>the</strong> media are prevented from do<strong>in</strong>g so, because a stricterprocedure, prescribed by <strong>the</strong> Court’s Rules <strong>in</strong>stead <strong>of</strong> Article 16a <strong>of</strong> <strong>the</strong> Law on <strong>the</strong> <strong>Prosecution</strong> <strong>of</strong><strong>War</strong> <strong>Crimes</strong>, is be<strong>in</strong>g applied. Accord<strong>in</strong>g <strong>to</strong> <strong>the</strong> Court’s Rules, <strong>the</strong> President <strong>of</strong> <strong>the</strong> Court may grantpermission <strong>for</strong> <strong>the</strong> record<strong>in</strong>g <strong>of</strong> <strong>the</strong> ma<strong>in</strong> hear<strong>in</strong>g only with <strong>the</strong> consent <strong>of</strong> <strong>the</strong> Presid<strong>in</strong>g Judge, parties<strong>to</strong> <strong>the</strong> proceed<strong>in</strong>gs, <strong>and</strong> participants <strong>in</strong> <strong>the</strong> actions that are be<strong>in</strong>g recorded (Article 60).General objective: The visibility <strong>of</strong> war crimes trials <strong>in</strong> public shall be streng<strong>the</strong>ned.Specific objective no. 1: A outreach <strong>of</strong>fices with<strong>in</strong> <strong>the</strong> <strong>of</strong> <strong>the</strong> Higher Court Department <strong>and</strong> <strong>the</strong>Appeals Court Department shall be established.Activities:a) The M<strong>in</strong>istry <strong>of</strong> Justice shall create a task <strong>for</strong>ce consist<strong>in</strong>g <strong>of</strong> <strong>the</strong> representatives <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry,<strong>of</strong> <strong>the</strong> Higher Court Department <strong>and</strong> <strong>the</strong> Appeals Court Department, <strong>and</strong> <strong>of</strong> <strong>the</strong> SupremeCourt <strong>of</strong> Cessation, <strong>and</strong> expert <strong>of</strong> requisite pr<strong>of</strong>ile, which would propose a model <strong>for</strong> <strong>the</strong> public<strong>relation</strong>s <strong>of</strong>fice <strong>in</strong> <strong>the</strong> Higher Court Department <strong>and</strong> <strong>the</strong> Appeals Court Department;b) The President <strong>of</strong> <strong>the</strong> Higher Court <strong>in</strong> Belgrade <strong>and</strong> <strong>the</strong> President <strong>of</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong>Belgrade shall amend <strong>the</strong> Rules on Internal organi<strong>za</strong>tion <strong>and</strong> Systemati<strong>za</strong>tion <strong>of</strong> Workplaces <strong>in</strong><strong>the</strong> Higher Court <strong>in</strong> Belgrade <strong>and</strong> <strong>the</strong> Court <strong>of</strong> Appeals <strong>in</strong> Belgrade, thus establish<strong>in</strong>g outreach<strong>of</strong>fices <strong>in</strong> l<strong>in</strong>e with <strong>the</strong> f<strong>in</strong>d<strong>in</strong>gs <strong>and</strong> recommendations <strong>of</strong> <strong>the</strong> task <strong>for</strong>ce;15 Belgrade Centre <strong>for</strong> Human Rights, „Attitudes <strong>to</strong>wards war crimes issues, ICTY <strong>and</strong> <strong>the</strong> national judiciary“,public survey, Oc<strong>to</strong>ber 2011, available at http://www.osce.org/serbia/90422?download=true.Humanitarian Law Center


) The public <strong>relation</strong>s <strong>of</strong>fices <strong>of</strong> <strong>the</strong> OWCP, <strong>the</strong> Higher Court Department <strong>and</strong> <strong>the</strong> AppealsCourt Department shall prepare a brochure <strong>for</strong> <strong>the</strong> media relat<strong>in</strong>g <strong>to</strong> <strong>the</strong> procedure <strong>and</strong>conditions <strong>for</strong> <strong>the</strong> record<strong>in</strong>g <strong>of</strong> ma<strong>in</strong> hear<strong>in</strong>gs, <strong>and</strong> publish it on <strong>the</strong>ir <strong>web</strong> pages.7. Application <strong>of</strong> <strong>the</strong> <strong>Strategy</strong> <strong>and</strong> Moni<strong>to</strong>r<strong>in</strong>gFor <strong>the</strong> purpose <strong>of</strong> moni<strong>to</strong>r<strong>in</strong>g <strong>the</strong> efficiency <strong>and</strong> quality <strong>of</strong> <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> measuresfrom <strong>the</strong> <strong>Strategy</strong> <strong>and</strong> assessment <strong>of</strong> <strong>the</strong> results achieved, <strong>the</strong> Government <strong>of</strong> Serbia shall establish amoni<strong>to</strong>r<strong>in</strong>g body, which will moni<strong>to</strong>r <strong>and</strong> coord<strong>in</strong>ate <strong>the</strong> work <strong>of</strong> all <strong>in</strong>stitutions responsible <strong>for</strong> <strong>the</strong>application <strong>of</strong> <strong>the</strong> measures.At <strong>the</strong> proposal <strong>of</strong> <strong>the</strong> M<strong>in</strong>istry <strong>of</strong> Justice, <strong>the</strong> Government <strong>of</strong> <strong>the</strong> Republic <strong>of</strong> Serbia will <strong>for</strong>m a st<strong>and</strong><strong>in</strong>g<strong>and</strong> pr<strong>of</strong>essional Moni<strong>to</strong>r<strong>in</strong>g Body with<strong>in</strong> 30 days from <strong>the</strong> day <strong>of</strong> <strong>the</strong> adoption <strong>of</strong> <strong>the</strong> <strong>Strategy</strong>, whichwill be tasked with moni<strong>to</strong>r<strong>in</strong>g <strong>the</strong> apllication <strong>of</strong> <strong>the</strong> <strong>Strategy</strong>. Mode <strong>of</strong> operation <strong>and</strong> support <strong>to</strong> <strong>the</strong> work <strong>of</strong> <strong>the</strong> Moni<strong>to</strong>r<strong>in</strong>g Bodya) All <strong>in</strong>stitutions engaged <strong>in</strong> <strong>the</strong> execution <strong>of</strong> <strong>the</strong> measures prescribed by <strong>the</strong> <strong>Strategy</strong> shallreport twice a year <strong>to</strong> <strong>the</strong> Moni<strong>to</strong>r<strong>in</strong>g Body regard<strong>in</strong>g <strong>the</strong> activities undertaken;b) The Moni<strong>to</strong>r<strong>in</strong>g Body shall meet twice a year;32c) The Moni<strong>to</strong>r<strong>in</strong>g Body shall file annual reports <strong>to</strong> <strong>the</strong> Government <strong>of</strong> Serbia on <strong>the</strong> execution<strong>of</strong> measures from <strong>the</strong> <strong>Strategy</strong>, which may conta<strong>in</strong> proposals <strong>of</strong> fur<strong>the</strong>r measures <strong>for</strong> <strong>the</strong>enhancement <strong>of</strong> <strong>the</strong> implementation <strong>of</strong> <strong>the</strong> strategic measures, or <strong>the</strong> def<strong>in</strong>ition <strong>of</strong> newspecific objectives.
