www.tui.ieState Examinations 2006What if I am unhappy withthe outcome of theAdjudication Process?The Adjudication process is voluntary andeither party has the right to reject thedetermination of the Adjudicator. If eitherparty wishes to reject the determination,he/ she shall write to the Department ofEducation and Science stating that theywish to reject the determination. Thedetermination will be set aside and neitherparty can rely on the determination inany subsequent proceedings brought bythe appellant.The appellant may at any stage pursue theirstatutory rights under the Protection ofEmployees (Fixed Term Work) Act, 2003.Review of ProcessThe operation and continuation of theAdjudication Process shall be reviewed by theDepartment of Education and Science every6 months.IMPORTANT!Please pay close attention to deadlinesfor appeals.• Please inform the relevant TUI head officeofficial (Peter MacMenamin, Declan Glynnor Annette Dolan) of your intention toappeal prior to submitting appeal.Advance Payments 2006Following consultation between the SECand the teachers’ unions the followingarrangement has been arrived at regardingthe level of advances payable to writtenexaminers contracted by the SEC for the2006 examinations:• €500 forfirst time appointees• €1200 forAssistant Examinerswith previous serviceas examiners• €2000 forAdvising Examinersand higher levelsThe change in the level of advance amountspayable is required on foot of auditingrequirements from the Controller &Auditor General’s Office and to meetcurrent regulations issued by the RevenueCommissioners.It is notable that the prepayment ofpostage by the SEC since 2005 in respectof examiner postage has significantlyreduced the out-of-pocket expenses arisingfor examiners.These advance payments will be madethrough Electronic Funds Transfer system(ie. Paypath).Payment by Electronic FundsTransfer (EFT) methodIt is proposed to pay contract staff by EFTmethod for all work carried out for the2006 examination season and thereafter.The following is an outline of the expectedissue date of advances. These are similar toprevious years except in the case of staffappointed as superintendents:• Oral/PracticalExaminers Advancesto issue during secondweek of examining• SuperintendentsAdvances to beprocessed by SECwithin 2 days ofDistribution• Written ExaminersAdvances to beprocessed by theSEC within 3 daysof the conclusionof conferenceFinal payments are expected to issue on asimilar to previous years ie.30 days afterthe receipt of correctly completed claimforms, provided they are returned in atimely fashion when the work is completed.18 TUI NEWS
Congress MotionsResolutions Carried, Congress 2006AADULT EDUCATION7 Co. LimerickThis Congress deplores the delaying bythe VECs in giving permanent contractsto teachers in the adult education andlifelong learning sector. That this sector berecognised as a vital centre for social inclusionand be supported by permanent contractedstaff, increased places, and realistic grants forthe VTOS and PLC sector.2 Co. KerryCongress instructs the Executive to initiate acampaign to develop the Adult and FurtherEducation Sector to levels similar to that inother European Countries.Congress states its belief that the V.E.C.sector is the only national statutory agencyadequately equipped to be the primeprovider of Adult & Further Educationin the future.BALLOCATION/CLASS SIZE/PTR15 Co. DublinThis Congress directs the Executive todemand of the government the restorationof the 16:1 pupil-teacher ratio in all state runpost-primary schools.9 Co. Carlow(Amended by Dublin C&C)That full time guidance counsellors beallocated to all vocational schools, communitycolleges and community schools on the basisof a 250:1 ratio.11 Co. CarlowTo reduce class numbers to a maximum oftwenty for practical subjects instead of thecurrent ‘recommended’ number with theconsequential increase in teacher allocation.APPRENTICESHIP122 Dublin CollegesCongress instructs the Executive to informFAS and ITAC that third level TUI membersare concerned and disappointed withthe mechanism used during the nationalcurriculum review of the Standard BasedApprenticeship system.It should be emphasised that,(a) under the 1999 Qualifications (Educationand Training) Act that FAS is obligedto gain agreement from secondaryproviders (Institutes of Technology andthe DIT) in relation to any changes (notjust consultation).(b) the 70% pass mark should have beenreviewed as research shows it is notbeen operated as defined by the presentprogramme document procedures.CCONDITIONSOF SERVICE – 2nd LEVEL23 Tipperary NRIn view of the introduction and adaptationof the Child Protection Guidelines in all2nd level schools and the guidelines set outthere-in for the reporting and investigatingof allegations against TUI members. ThisCongress request the Executive Committeeas a matter of urgency to negotiate theterms of the Guidelines with the Departmentof Education and Science under thefollowing headings:• A proper procedure for the investigationof an alleged incident against a teacher.• That a time-scale by which aninvestigation must be completed.• Method by which a teacher can seeknatural justices if accused in the wrong.Congress further instructs the ExecutiveCommittee to report to branches inSeptember 2006 on the progress of thenegotiations with the DES on these issues.26 Co. MonaghanThat Congress directs the Executive toseek an agreement with the DES wherebyany teacher who qualifies for long-serviceincrement is entitled to a reduction in teachinghours equivalent to assistant principal.40 Co. KildareThat Congress instructs the ExecutiveCommittee to negotiate with the Departmentof Education and Science that teachers in theVocational Schools and Community Collegesbe given personal days entitlement on a parwith those available to our colleagues involuntary secondary sector.28 Connemara C&C(Amended by Waterford)Incremental CreditThat TUI take all steps to oppose theinherent injustice of the D.E.Sc/Finance beingsole judge and paymaster of the incrementalentitlements of teachers and lecturers.In this regard it is proposed that:• the TUI Executive survey the membershipbranch by branch to determine the extentand magnitude of the incremental yearsnot thus recognised or paid to membersto date.• the TUI, in cooperation with, andindependently of, other teacher Unionsdemand an independently assessedresolution of such outstanding claimsto be a condition of any subsequentwage agreement.• the TUI determine its Union policyto have an agreed independent bodydetermine the incremental scale positionof all teachers/college lecturers in future.35 Co. LimerickThat all teachers away on school businessshould be entitled to a lunch break andlunch allowance.20 Limerick C&CCongress directs the Executive to ensure thatthe DES applies the Contract of Indefiniteduration to lay Chaplains.59 Dublin City PPThat the new school year shall be the 1stof September or later and that TUI willnever agree, under any circumstances, tothe re-opening of schools during the monthof August as happened at the beginning ofschool year 2005/06.39 Tipperary SRThat this Union calls on the Executive tonegotiate that the percentage permanencyshould be ninety five per cent per school inthe VEC sector.
