www.tui.ieState Examinations <strong>2006</strong>What if I am unhappy withthe outcome of theAdjudication Process?The Adjudication process is voluntary andeither party has the right to reject thedetermination of the Adjudicator. If eitherparty wishes to reject the determination,he/ she shall write to the Department ofEducation and Science stating that theywish to reject the determination. Thedetermination will be set aside and neitherparty can rely on the determination inany subsequent proceedings brought bythe appellant.The appellant may at any stage pursue theirstatutory rights under the Protection ofEmployees (Fixed Term Work) Act, 2003.Review of ProcessThe operation and continuation of theAdjudication Process shall be reviewed by theDepartment of Education and Science every6 months.IMPORTANT!Please pay close attention to deadlinesfor appeals.• Please inform the relevant <strong>TUI</strong> head officeofficial (Peter MacMenamin, Declan Glynnor Annette Dolan) of your intention toappeal prior to submitting appeal.Advance Payments <strong>2006</strong>Following consultation between the SECand the teachers’ unions the followingarrangement has been arrived at regardingthe level of advances payable to writtenexaminers contracted by the SEC for the<strong>2006</strong> examinations:• €500 forfirst time appointees• €1200 forAssistant Examinerswith previous serviceas examiners• €2000 forAdvising Examinersand higher levelsThe change in the level of advance amountspayable is required on foot of auditingrequirements from the Controller &Auditor General’s Office and to meetcurrent regulations issued by the RevenueCommissioners.It is notable that the prepayment ofpostage by the SEC since 2005 in respectof examiner postage has significantlyreduced the out-of-pocket expenses arisingfor examiners.These advance payments will be madethrough Electronic Funds Transfer system(ie. Paypath).Payment by Electronic FundsTransfer (EFT) methodIt is proposed to pay contract staff by EFTmethod for all work carried out for the<strong>2006</strong> examination season and thereafter.The following is an outline of the expectedissue date of advances. These are similar toprevious years except in the case of staffappointed as superintendents:• Oral/PracticalExaminers Advancesto issue during secondweek of examining• SuperintendentsAdvances to beprocessed by SECwithin 2 days ofDistribution• Written ExaminersAdvances to beprocessed by theSEC within 3 daysof the conclusionof conferenceFinal payments are expected to issue on asimilar to previous years ie.30 days afterthe receipt of correctly completed claimforms, provided they are returned in atimely fashion when the work is completed.18 <strong>TUI</strong> NEWS
