ARTICLE 9. FUND BEACH SNACK BAR A/E DESIGNTo see if the <strong>Town</strong> will vote to raise and appropriate, borrow and/or transfer fromavailable funds the sum of Seventy-Five Thousand and 00/100 Dollars ($75,000.00), orany other sum, for the purpose of preparing design plans for replacement of the existingsnack bar facilities at both Nauset Beach and Skaket Beach, including all expensesincidental and related thereto; provided however that such vote shall not take effect untilthe <strong>Town</strong> votes to exempt from the limitations of total taxes imposed by MassachusettsGeneral Law Chapter 59 § 21 C (Proposition 2 1/2) amounts required to pay theprincipal and interest of the borrowing approved by such vote and further authorize theBoard of Selectmen and/or <strong>Town</strong> Administrator to apply for and accept any Federal,State, County or other funds that may be available for this purpose and to enter intoIntermunicipal Agreements for acceptance of any such grants or funds which shall beused to offset the total appropriation authorized herein, or to take any other actionrelative thereto. (3/4 Vote Required)MOTION:MOTION:ACTION:MOTION:ACTION:ACTION:To accept and adopt Article #9 as printed in the warrant and that the sumof Seventy-Five Thousand and 00/100 Dollars ($75,000.00) beappropriated for this purpose and for costs incidental and related thereto,to raise such appropriation the Treasurer, with approval of the Board ofSelectmen, is authorized to borrow the sum of Seventy-Five Thousandand 00/100 Dollars ($75,000.00), pursuant to Massachusetts GeneralLaws Chapter 44, section 7 clause (21), or any other enabling authority,and to issue bonds or notes of the <strong>Town</strong> therefore, provided however thatthis vote shall not take effect until the <strong>Town</strong> votes to exempt from thelimitations on total taxes imposed by the Massachusetts General LawChapter 59 Section 21C (Proposition 2 ½ so called) the amounts requiredto pay the principal and interest on the borrowing approved by such vote.To lay Article # 9 on the table.Voted, voice vote fails to achieve the necessary majority to lay article onthe table.To amend the main motion to exclude any reference to the Nauset BeachSnack Bar Facility and that sum to be appropriated be reduced from$75,000.00 to $12,000.00 and that these funds be transferred from FreeCash for this purpose.Voted, voice vote fails to achieve the necessary majority.On the main motion, voted, standing vote: YES=121, NO=328, vote failsto achieve the necessary 3/4 majority.60
