an Employment Tribunal instead. Packed with
practical illustrations, this seminar will change
your thinking and will definitely improve your
success rate and your personal reputation with
Employment Judges.
difference?
• Claims and issues - what do these words
mean?
• How does an Employment Tribunal approach
the hearing of a case? What do they want to
know?
• Claim and Response Forms - what to include
and what to leave out
• Using and abusing Rules of Procedure
• What you need to know about witness
statements. Your words or those of the
witness? Detailed practical guidance on
drafting.
• Why a bundle of documents should be more
than just a lever arch file!
• Contributory fault, duty to mitigate and Polkey
• How to act for an employer who has an
apparently “hopeless” case
• Advocacy and the likes and dislikes of
Employment Judges
• Prepare schedules of loss like never before
- what should they look like and why
• Practical tips on negotiating settlements
• How do the Recoupment Regulations work?
• Skeleton Arguments and closing speeches
- make yourself an expert
Covenants, Garden
Leave and Other Ways
to Protect an Employer
Advanced/Update/Intermediate - 6 hours CPD
How easy is it for an employer to prevent an
employee going to work for a rival or taking
confidential information? Whilst it has become
increasingly difficult to enforce restrictive
covenants, there is plenty an employer can do to
protect itself.
This course will examine the various options and
remedies available to employers, including:
• Drafting restrictive covenants and the need to
include a severance clause
• Garden leave clauses and their relationship
with covenants
• Confidentiality clauses
• Alternative strategies including reliance on
implied terms, fiduciary duties, intellectual
property rights and retaining employees
• Remedies
The course will then look at how to commence
proceedings to enforce contract terms,
compliance with the CPR and settlement offers.
Speaker: Trevor Leuty who is now a consultant
solicitor with Banks Kelly, has specialised in
motor industry law for almost 30 years and has
Interviewing Witnesses:
how to unlock their
memories
Advanced/Intermediate - 6 hours CPD
This practical course will train you to use the
techniques of cognitive interviewing.
Cognitive interviewing is a forensic tool that uses
a series of memory retrieval techniques designed
to increase the amount of information that can
be obtained from a witness or client by using key
principles of how people best recall information.
Litigation lawyers in some of the biggest law
firms in the UK use this structured technique to
create the maximum opportunity for witnesses
to remember exactly what happened.
It is much more effective than simply asking
your witness questions, which typically
interrupts them and restricts the natural flow of
information.
Using cognitive interviewing will increase
the completeness and accuracy of what your
witnesses can remember, helping them to
remember clearly things that happened many
months, or even many years, ago.
It will enable you to:
• Be in a stronger position to assess litigation
risks and make decisions about a case
• Prepare cases and take statements based on
the full facts from your witnesses
• Obtain up to 40% more relevant information
• Obtain uncontaminated evidence from
witnesses
• Obtain more facts and details from witnesses
first time, so that you reduce the need for
costly re-interviews and comply with the Woolf
protocols for statements
Speaker: Dave Barney, specialises in training
lawyers in interviewing and investigating
techniques. He has trained over 3000 lawyers in
the last 15 years and has worked with all of the
top 10 UK law firms.
Dealing with Ill
Health in the
Workplace
Advanced/Update/Intermediate - 3 hours CPD
Dealing with the problem of ill health in the
workplace is one of the most difficult issues
facing employers and employees. Dismissing
an employee because they are ill is often a
very difficult decision for an employer to make,
and also a difficult decision for an employee to
consider as being reasonable. As a consequence,
both parties often feel that the outcome is
unsatisfactory.
This course will look at the issues from both
the employers’ and employees’ perspective.
It will cover both the question of how an
employer should deal with both short term
but persistent absence due to ill health, and
also long term absences and the effect of the
Disability Discrimination Act. It will also look at
the difficult issues surrounding ill health relating
to maternity.
The course will look at various scenarios and will
encourage everyone to participate.
Work Related
Death - The Criminal
Consequences
Update - 5 hours CPD
Public interest and prosecution activity
surrounding work related deaths has never been
greater. The substantial reach of the Corporate
Manslaughter and Corporate Homicide Act has
added to the huge scope of the Health and
Safety at Work Act, and the new Sentencing
Guidelines have set a very substantial starting
point for fines. It is easy to forget that individuals
can be prosecuted for manslaughter arising from
a work related death. The lecture will examine:
• What the clients should know now in the hope
it will prevent an accident and how to respond
properly if it does
• How the client and the lawyer should respond
to a work related death
• How to deal with the investigation, including
the interview
• What are the appropriate offences, Corporate
Manslaughter, offences under the Health and
Safety at Work etc, Act or offences under the
Regulations?
• Who are the appropriate defendants: company,
public body, partnership or individual?
• The important issues in considering plea
• The critical issues relating to the basis of plea
• The aftermath; acquittal, conviction, sentence,
costs, remediation and publicity
Speaker: David Travers QC practices from the
Chambers of Stephen Hockman QC at 6 Pump
10 Employment Law
Change Management:
Getting it Right with a
“can do” Attitude
Intermediate - 6 hours CPD
As businesses move out of recession, they need
to be mean and lean. Competition remains fierce;
every penny makes a difference. Clients want
lawyers who can say “yes you can”. Change is not
just an option. It is a necessity. Reorganisations,
variation of contracts, redundancy and the
alternatives are all part of your armoury.
By reference to “real life” practical exercises this
seminar will enable you to respond positively
to requests for help from your clients, both
employees and employers. Procedures adopted
by employers in these cases are always put under
the microscope by the Tribunal and since April
09 increased compensation is still a harsh reality
for those who get it wrong. There can hardly
be any business which has not at some time
been involved in making changes of one kind or
another.
This seminar will help you understand the
law and procedures associated with “change
management” and will specifically consider:
• What principles will the Tribunal apply? Where
do they come from?
• How to manage change within Section 98(4)
• Redundancy or SOSR - does it matter?
• Pools, criteria, scoring mechanisms - how to
get it right
• Bumping - a requirement or an option?
• The business case - what would be “sound
business reasons”?
• Definition of “consultation” to give you a
framework
• Statutory consultation requirements under
Section 188 TULRA
• Lay-off and short term working - the statutory
schemes
• What did we learn from the statutory
procedures before April 09?
• Appeals and Polkey - the “get out of jail free”
cards
• How to deal with the conscientious objector
Speaker: Jonathan Whittaker is a Partner and
persuasive advocacy in the full merits hearing.
It will be based on tailor-made case studies
and realistic practical exercises, with delegate
performance and personal feedback as a central
element. Areas covered will include:
• Examination-in-chief: how to present your own
witnesses effectively
• Cross-examination: challenging your
opponent’s witnesses
• Re-examination: when and how to do it
Employment Tribunal
Compensation:
“Show me the Money”
Intermediate - 5 hours CPD
What is the claim worth? That’s the question
uppermost in your client’s mind. Early, accurate
assessment of remedies is essential for managing
your client’s expectations and for the costeffective
preparation and presentation of
employment tribunal claims. It is an issue which
requires the exercise of judgment as well as a
grasp of fast-changing principles and one which
is too often avoided until the end.
This course will include guidance on how to
prepare schedules of loss and counter-schedules
(which advanced your case and assist the
tribunal) and tailor-made case studies.
It will also cover legal principles and recent
developments in the following fields:
• Unfair dismissal compensation: general
principles, loss of a chance, mitigation, future
losses, holiday pay, the overlap with wrongful
dismissal, benefits and allowances,
recoupment, tax
• Additional remedies in discrimination cases:
the tortious measure, personal injury and
injury to feelings, interest
• Adjustments: PILON, contributory conduct,
Polkey reductions, s31 Employment Act 2002,
statutory cap
• Supplementary and other non-compensatory
awards (the basic award etc)
