THE PRADD PROJECT<strong>Property</strong> <strong>Rights</strong> Artisanal Diamond Development Liberia (PRADD) was established through a Memor<strong>and</strong>umof Underst<strong>and</strong>ing between the United States Agency for International Development (USAID) <strong>and</strong> theGovernment of Liberia (GOL) to assist with improved compliance with the Kimberley Process CertificationScheme (KPCS). PRADD works closely with Liberia’s Ministry of <strong>L<strong>and</strong></strong>s, Mines <strong>and</strong> Energy (MLME) <strong>and</strong>the Department of Planning <strong>and</strong> Development (DPD).PRADD Liberia is structured around five components or Intermediate Results (IRs):IR1:IR2:IR3:IR4:IR5:Individual <strong>and</strong> community l<strong>and</strong> <strong>and</strong> natural resource rights in target areas clarified, recognized, <strong>and</strong>secured.Reliability <strong>and</strong> efficiency of systems monitoring artisanal diamond production <strong>and</strong> marketingincreased.Benefits of artisanal diamond mining to local communities increased.Capacity to mitigate environmental impacts of artisanal mining strengthened.Stakeholder access to information on artisanal diamond mining issues, mining policy, property rights,<strong>and</strong> best practices increased.TERMS OF REFERENCE OF THE CONSULTANCYUnder IR1, PRADD Liberia needs to conduct a formal analysis of the existing laws, policies, <strong>and</strong> regulationsgoverning statutory property rights systems in mining <strong>and</strong> its interface with Liberian l<strong>and</strong>, forestry, <strong>and</strong> waterlegislation in order to identify gaps <strong>and</strong> contradictions that either are causing or have the potential to createpoints of friction with customary rights regimes in the artisanal mining sector.The development of comprehensive policy recommendations through a strategic policy analysis is criticallyimportant to:• Secure <strong>and</strong> clarify l<strong>and</strong> tenure rights for artisanal mining communities;• Reduce smuggling <strong>and</strong> illicit mining in the artisanal mining sector;• Increase the registration <strong>and</strong> marketing of diamonds through the formal chain of custody <strong>and</strong> incompliance with KPCS;• Clarify <strong>and</strong> simplify the steps for obtaining a mining license primarily for artisanal <strong>and</strong> small-scaleminers (Class B <strong>and</strong> C licenses);• Promote environmentally friendly mining techniques <strong>and</strong> environmental regeneration in mined outareas;• Resolve conflicts at the point of diamond mining <strong>and</strong> within marketing channels;• Promote alternative livelihood activities for community development; <strong>and</strong>• Promote organizational development <strong>and</strong> facilitate access to micro-finance opportunities for miners.To this end, the objectives of this report are to:• Analyze gaps <strong>and</strong> contradictions in the current legal framework <strong>and</strong> mining realities which arebarriers to improved compliance with KPCS requirements;• Suggest new <strong>and</strong> improved policy options <strong>and</strong> legal frameworks to increase the amount of diamondsentering the chain of custody;• Increase the benefits from diamond mining to artisanal diamond mining communities; <strong>and</strong>• Suggest options to improve environmental reclamation.PRADD LIBERIA: A REVIEW OF THE LEGAL, REGULATORY AND POLICY FRAMEWORKGOVERNING ARTISANAL DIAMOND MINING IN LIBERIA 3
