INSTITUTIONAL STATEMENTSDrug Free Workplace<strong>Wayne</strong> <strong>County</strong> <strong>Community</strong> <strong>College</strong> District makes every effort to providea drug-free workplace and environment. The District expressly prohibits theunlawful manufacture, distribution, dispensation, possession, or use of anycontrolled substance in the workplace. The term "controlled substance"shall mean a controlled substance in schedules I through V of Section 202 ofthe Control Substance Act (21 U.S.C. 812).Any individual found to be in violation of this policy hasengaged in a gross misconduct and is subject to disciplinary action,up to and including expulsion for students, termination foremployees, a permanent ban from the premises for visitors, and/orcriminal prosecution for all violators.All employees shall, as a condition of their employment, abide by theterms in this policy. In addition, employees engaged in the performance ofany federal grant or contract will notify their supervisor and/or personneldepartment of any criminal drug statute conviction occurring in theworkplace no later than five (5) days after such conviction (Approved6/28/89).Smoke-Free ComplianceIn compliance with the Michigan Clean Indoor Air Act, <strong>Wayne</strong> <strong>County</strong> andCity of Detroit Ordinances, <strong>Wayne</strong> <strong>County</strong> <strong>Community</strong> <strong>College</strong> District and itsfacilities are smoke-free.Statement of Compliance<strong>Wayne</strong> <strong>County</strong> <strong>Community</strong> <strong>College</strong> District (WCCCD), pursuant to therequirements of Titles VI and VII of the Civil Rights Act of 1964, Title IX of theEducation Amendments of 1972, Section 504 of the Rehabilitation Act of1973, the Age Discrimination Act of 1975, the Vietnam-Era VeteransReadjustment Assistance Act, the Elliot-Larsen Civil Rights Act, ExecutiveOrder 11246, and Title II of the Americans with Disabilities Act (ADA)complies with all Federal and State laws and regulations prohibitingdiscrimination and with all requirements and regulations of the U.S.Department of Education.It is the policy of WCCCD that no person, on the basis of race, color, religion,national origin, age, sex, height, weight, marital status, disability, or politicalaffiliation or belief, shall be discriminated against, excluded fromparticipation in, denied the benefits of, or otherwise subjected todiscrimination in employment or in any program or activity for which it isresponsible or for which it receives financial assistance from the U.S.Department of Education. Fort,Detroit, MI 48226 or by calling: 313-496-2765.Grievance ProceduresTITLE VI OF THE CIVIL RIGHTS ACT OF 1964TITLE IX OF THE EDUCATION AMENDMENT OF 1972SECTION 504 OF THE REHABILITATION ACT OF 1973AMERICANS WITH DISABILITIES ACT (ADA)If any student believes that <strong>Wayne</strong> <strong>County</strong> <strong>Community</strong> <strong>College</strong> District or anypart of the school's organization has not applied the principles and/orregulations of (1) Title VI of the Civil Rights Act of 1964; (2) Title IX of theEducation Amendment of 1972; (3) Section 504 of the Rehabilitation Act of1973; or the ADA, the student may bring forward a complaint (which shallbe referred to as a grievance through this text) to the local EqualOpportunity Compliance Coordinator at the following address:<strong>Wayne</strong> <strong>County</strong> <strong>Community</strong> <strong>College</strong> DistrictDistrict Vice Chancellor for Human Resources and Accountability2nd Floor, 801 W. Fort, Detroit, MI 48226telephone: 313-496-2765The appropriate procedures must be followed by the student in order forhis/her grievance to be thoroughly reviewed for merit. The grievanceprocedures (steps) are outlined below.Grievance Procedure For EOCC ComplaintsThe person who believes he/she has a valid basis for a grievance shalldiscuss the grievance informally on a verbal basis with the EqualOpportunity Compliance Coordinator, who shall in turn investigate andreply to the complaint with an answer to the grievance. The student maybegin formal procedures according to the following steps.Step 1A written statement of the grievance signed by the student shall be submittedto the Equal Opportunity Compliance Coordinator within five (5) businessdays of receipt of the answers to the informal grievance. The coordinatorshall further investigate the matters of grievance and reply in writing to thestudent within five (5) business days.Any complaint submitted under this procedure shall be filed at Step 1 withintwenty (20) business days after the student becomes aware or reasonablyshould have become aware of the complaint. If the complaint is not servedwithin that time, it will not be considered. Failure by the student to appealthe complaint from Step 1 to Step 2 within the stated time limit procedureshall also nullify the complaint.Step 2If the student wishes to appeal the decision of the Equal OpportunityCompliance Coordinator, the student may submit an appeal to theChancellor of the District within five (5) business days after receipt of theCoordinator's response. The Chancellor (or a designee) shall meet with allparties involved within ten (10) business days to formulate a conclusion,and respond in writing to the student within ten (10) business days.Step 3If at this point the grievance has not been satisfactorily settled, furtherappeals may be made to the Office of Civil Rights, Department of Education,Washington, D.C. 20201.148 General Information (313) 496-2600
