NGĀTI HAUĀ DEED OF SETTLEMENT4: SETTLEMENT4.6.2 may benefit particular members, or particular groups <strong>of</strong> members, <strong>of</strong> NgātiHauā if the trustees <strong>of</strong> the Ngāti Hauā Iwi Trust so determine in accordancewith the procedures <strong>of</strong> that trust.IMPLEMENTATION4.7 The settlement legislation will, on the terms provided by sections 15 to 20 <strong>of</strong> the draftsettlement bill -4.7.1 settle the non-raupatu historical claims; and4.7.2 exclude the jurisdiction <strong>of</strong> any court, tribunal, or other judicial body in relationto the non-raupatu historical claims and the settlement; and4.7.3 provide that the legislation referred to in section 17(2) <strong>of</strong> the draft settlementbill does not apply -(a)(b)(c)(d)(e)to a cultural redress property; orto a commercial redress property; orto a purchased deferred selection property, a purchased second right <strong>of</strong>deferred purchase property, or an early release cultural property, ifsettlement <strong>of</strong> the property has been effected; orto any RFR land; orfor the benefit <strong>of</strong> Ngāti Hauā or a representative entity; and4.7.4 require any resumptive memorial to be removed from a computer register forany <strong>of</strong> the following properties:(a)(b)(c)a redress property, if settlement <strong>of</strong> the property has been effected:a purchased deferred selection property, a purchased second right <strong>of</strong>deferred purchase property, or an early release cultural property, ifsettlement <strong>of</strong> the property has been effected:any RFR land; and4.7.5 provide that the rule against perpetuities and the Perpetuities Act 1964 doesnot -(a)apply to a settlement document; or(b) prescribe or restrict the period during which -(i)(ii)the trustees <strong>of</strong> the Ngāti Hauā Iwi Trust, in their capacity astrustees, may hold or deal with property; andthe Ngāti Hauā Iwi Trust may exist; and4.7.6 require the Secretary for Justice to make copies <strong>of</strong> this deed publiclyavailable.4.8 Part 1 <strong>of</strong> the general matters schedule provides for other action in relation to thesettlement.38
