NGĀTI HAUĀ DEED OF SETTLEMENT5: CULTURAL REDRESS: GENERAL5.27 An early release cultural property is to be transferred by the Crown to the trustees -5.27.1 as part <strong>of</strong> the redress to settle the non-raupatu historical claims; and5.27.2 without any other consideration to be paid or provided by the trustees or anyother person.CULTURAL REDRESS PAYMENT5.28 The Crown will pay $178,000 to the trustees on the settlement date to enable thepurchase by the trustees <strong>of</strong> additional properties.VESTING AND GIFT BACK OF TE TAPUI SCENIC RESERVE5.29 The fee simple estate <strong>of</strong> that part <strong>of</strong> Te Tapui Scenic Reserve, as shown on deed planOTS-190-26, is to be vested in the trustees, and gifted back by the trustees to theCrown and the people <strong>of</strong> New Zealand, on the terms provided by sections 83 and 84 <strong>of</strong>the draft settlement bill.WAHAROA AERODROME5.30 In this deed -5.30.1 Council’s Waharoa Aerodrome land means the land shown on deed planOTS-190-25 in part 4A <strong>of</strong> the attachments; and5.30.2 Waharoa Aerodrome land means the land shown on deed plan OTS-190-24in part 4 <strong>of</strong> the attachments; and5.30.3 Waharoa Aerodrome trust deed means a trust deed dated 6 July 1965between her Majesty the Queen, acting by and through the Minister <strong>of</strong> CivilAviation, and the Chairman, Councillors and Inhabitants <strong>of</strong> the County <strong>of</strong>Piako in relation to the Waharoa Aerodrome land, the management,administration, and control <strong>of</strong> Waharoa Aerodrome, and various other mattersin relation to Waharoa Aerodrome (as that deed may be amended from timeto time).Vesting <strong>of</strong> Waharoa Aerodrome land5.31 The Crown acknowledges that the Waharoa Aerodrome land is <strong>of</strong> cultural importanceto Ngāti Hauā.5.32 The parties, however, acknowledge that -5.32.1 under the Waharoa Aerodrome trust deed -(a) the Waharoa Aerodrome land -(i)(ii)is vested in the Matamata Piako District Council for such time asthe land is required for aerodrome and ancillary aviationpurposes; andreverts to the Crown only if no longer required for thosepurposes; and45
