7AdmissionsInformationNon US Citizens/Non-Resident Aliens wishing to receive an I-20 from a school of EEG, Inc., as noted above, must firstprovide the specific school with the following credentials:Must be (at least) sixteen and a half (16 1/2) years of age.Possess and provide proof (in English) of equivalence to a U.S. high school education (please note “acceptabledocumentation” as noted above under Responsibility A.1.b.1).A refundable (based upon EBS refund policy) deposit of $5,750 (U.S. currency).Documentary evidence of means of actual support for both education and living expenses for the duration oftraining at an EBS school.Evidence of acceptable level(s) of English language proficiency through a score of 500 (or higher) on a TOEFLexaminationThe successful completion of the EBS registration paperwork (including Enrollment Agreement).Payment of the required Registration Fee (U.S. currency).Upon receipt of all the above noted materials, fees, deposits, TOEFL Test and other documentation a Form I-20“Certificate of Eligibility” will be issued to the foreign national potential student. Please note that it may take 4-6weeks for a foreign national to complete this entire process and students should plan their dates to begin schoolwith this possible time frame in mind.The completed Form I-20 will be taken by the potential student to an appropriate embassy, consulate orimmigration office as his or her country requires. 11AdmissionsInformationNormal Time to CompleteStudents should have a reasonable expectation of the time it should take to complete a program in order to plan and budgetaccordingly. Program lengths for full time and part time schedules are stated in weeks and include estimated days the schoolis closed for holidays, teacher training, special events, inclement weather and a limited number of days scheduled to allowstudents to make up missed hours as necessary for state licensing purposes.When calculating and disclosing normal time to complete and On Time Completion Rates, the number of days scheduled tomake up absence is limited to 10% of scheduled hours. For example, if a student is scheduled to attend class 7 hours per day andis enrolled in a1000 credit program, the number of days scheduled to make up absence would be determined by dividing 100(10% of the hours in the program) by 7 (number of hours scheduled per day), or 15 days.Students are permitted to make up additional absence in order to graduate, as long as they do not exceed the maximum timeframe as described in the school’s satisfactory progress policy, but they would not be counted as graduating within normal timefor purposes of the calculation and disclosure of On Time Completion Rates in Addendum B to the catalog.

13Tuition &Financial InformationFinancial AssistanceThere are two types of federal student aid available to <strong>Empire</strong> EducationGroup students:Grants – financial aid that doesn’t have to be repaid (unless, forexample, you withdraw from school and owe a refund)Loans – allow you to borrow money for your education which mustbe repaid, with interest, back to the Federal Government.Federal Pell Grant (PELL)Pell grants are the foundation of federal student financial assistance towhich aid from other federal and nonfederal sources might be added.These grants are generally awarded to undergraduate students andthe award amounts can change yearly. The maximum award for the<strong>2013</strong>-14 award year is $5,645. Unlike loans, grants are not repaid unless,for example, you withdraw from school prior to the planned programcompletion date. All federal grants are awarded to students with financialneed. The amount of your Federal Pell Grant depends on your cost ofattendance, expected family contribution, enrollment status (full or parttime)and whether you attend for a full academic year or less.Federal Supplemental EducationalOpportunity Grant (SEOG)This type of grant is awarded to undergraduate students with exceptionalfinancial need – those with the lowest Expected Family Contribution (EFC).Federal Pell Grant recipients receive priority for FSEOG awards which rangefrom $100 to $300 per award year. The amount of your award will bedetermined by the school’s Financial Assistance Office.William D. Ford Federal Direct Loan ProgramStudent loans, unlike grants, are borrowed money (monies) that must berepaid with interest.Loans made through this program are referred to as Direct Loans. Eligiblestudents and parents borrow directly from the U.S. Department ofEducation. There are three types of loans in the program:Subsidized Stafford LoanA student can borrow this type of loan to cover some or all of their schoolexpenses. The U.S. Department of Education pays the interest while you’rein school at least half-time. The amount of the loan cannot exceed astudent’s financial need and the fixed interest rate for <strong>2013</strong>-2014 is3.86percent.Unsubsidized Stafford LoanA student can borrow this type of loan to cover some or all of their schoolexpenses. The U.S. Department does not pay interest on unsubsidizedloans. A student is responsible for paying the interest that accrues on theloan from the time the loan is disbursed until it’s paid in full. The fixedinterest rate of 3.86 percent can be paid while attending school, during aperiod of deferment or forbearance or it can be accrued and the interestadded to the principle amount of the loan.PLUS LoansParents of dependent students can borrow from the PLUS Loan program.The terms and conditions of this type of loan include a requirement thatthe applicant not have an adverse credit history, a repayment period thatbegins on the date of the last disbursement of the loan and a fixed interestrate of 6.41 percent for the Direct Loan.Veterans’ Education BenefitsSome <strong>Empire</strong> Education Groups schools are approved for veteran’seducational benefits for veterans, eligible dependents of deceased ordisabled veterans and active status National Guard and Reserve personnel.Any student interested in this type of benefit must verify with the schoolrepresentative that the school is eligible for Benefits.


14Tuition &Financial Information<strong>Empire</strong>’s National Educator ScholarshipAny student enrolled in <strong>Empire</strong> Education Group’s Educator ofCosmetology Program is eligible to apply for <strong>Empire</strong>’s National EducatorScholarship. Students who have completed EEG’s CosmetologyProgram must have an application for State board license on file, haveattendance of 75% or above and satisfactory academic progress of 75%or above, have a recommendation from an instructor, and complete aninterview with the Executive Director. Students who did not completeEEG’s Cosmetology Program must have a current Cosmetology license,have attendance of 75% or above (if available) and satisfactory academicprogress of 75% or above,complete an interview with the <strong>School</strong> Directorand have a high school diploma or GED. All students need to apply andsubmit any required documentation prior to, or at the Time of, enrolling.<strong>Empire</strong> Gives Back Cosmetology EducationalEndowment ProgramProspective students may apply for the <strong>Empire</strong> Gives Back Endowmentif they are (were) a resident of a local shelter within the past 6 monthsfrom date of enrollment (confirmed by the Facility Representative, FacilitySupervisor or Individual Counselor) and a first Time cosmetology student.The student must meet all admissions requirements. One endowment isawarded per school per year.<strong>Empire</strong> Kids Peace Educational EndowmentProspective students may apply for the <strong>Empire</strong> Gives Back Endowmentif they are (were) a resident of a Kid’s Peace Facility within the past 6months from date of enrollment (confirmed by the Kid’s Peace FacilityRepresentative, Facility Supervisor or Individual Counselor) and a first Timecosmetology student. The student must meet all admissions requirements.The <strong>Empire</strong> Kids Peace Educational Endowment may be awarded no morethan five Times in <strong>Empire</strong> Education Group per year.future salon PROFESSIONAL scholarshipThe Future Salon Professional Scholarship was created by RegisCorporation to recognize African American future professionals in thecosmetology industry. Enrolled African American students applyingfor the grant must meet all <strong>Empire</strong> Education Group admissionsrequirements. The student will submit an application form to the<strong>Empire</strong> Education Group review committee. Students will be evaluatedon the basis of their application and financial need. The Future SalonProfessional Scholarship may be awarded for up to $1,000 no more than45 times per year.Ace Grant* **Prospective students should request information, an application andsalon assessment for the Ace Grant Program from the <strong>Beauty</strong> and BarberSupply Institute by calling (800) 468-2272. Ace Grant application, salonassessment and proof of high school graduate or GED should be sent toyour EEG school of interest. The Ace Grant organization will formally informthe student of the award.*Subject to a Financial Assistance package reduction based on anyadditional funding sources.**Any institutional aid will be applied to the student account when thestudent attends 750 clock hours of the first academic year.


15Tuition &Financial InformationStudent rights and ResponsibilitiesYou have the right to apply for aid to cover the school’s expenses,including tuition and fees, books and supplies, room and board andtransportation. Aid can also pay for dependant care.Make sure the financial aid office staff has all the information needed todetermine your eligibility. If you’re eligible, the aid office will send you anaward letter outlining the amount and types of aid the school will offeryou.Before the school makes your first loan disbursement, you will receive thefollowing information about your loan:-The full amount of the loan and the interest rate;-The date you must start repayment;-A list of any charge you must pay (loan fees) and information onhow those charges are collected;-Information on the yearly and total amounts you may borrow;-Information about the maximum repayment periods and theminimum repayment amount;-An explanation of default and its consequences; and-An explanation of available options for consolidating your loansand a statement that you can repay your loan(s) without penaltyat any Time.Loans, unlike grants, are borrowed money that must be repaid, withinterest. You cannot have these loans cancelled because you didn’t likethe education you received or because you are having financial difficulty.These loans are a serious obligation.You will be notified in writing whenever any funds are credited to youraccount. You may cancel all or portion or your loan if you inform yourschool within 14 days after the day your school sends you this notice, or bythe first day or the payment period.Your parent (for dependant students) may apply for a Parent Plus Loan forStudents. They have to pass a credit check. If they don’t pass, they mightstill be able to receive a loan if they can demonstrate that extenuatingcircumstances exist, or if someone they know, who can pass, agrees toendorse the loan and promises to repay it if your parents don’t.StaffingThe schools have a designated group of Financial Assistance Advisorsassigned to each school and/or at the Corporate Office of FinancialAssistance available to meet or speak with each student to assist themwith the aid process. All applications are supplied to the student at theschool and are forwarded to the Corporate Office for processing. Duringthe application and packaging process, the student speaks directly with theFinancial Assistance Coordinator in the Corporate Office to determine theiraid eligibility.Note: In order for a student to continue financial assistance eligibility,a student must maintain satisfactory progress. Written notice of SAP standing will be provided tostudents at the time of evaluation. Copies of evaluations, as well as appealresults, will be kept in the student’s file. Students that withdraw and reenrollwill return under the same SAP status as when they left, regardless ofhow long he/she has been out.In order to be meeting SAP students must maintain specified gradelevels. They must also proceed through the course at a pace leadingto completion in the maximum time frame as defined below*. SAP isevaluated at the scheduled mid-point of a program for programs of oneacademic year or less. Evaluations are at the scheduled end of eachpayment period ( every 450 scheduled clock hours) per academic year forall other programs. If a subsequent academic year is more than 450 hoursand less than 900 hours, payment periods are equal to one half of thatacademic year. If a subsequent academic year is 450 hours or less then itis considered one payment period. SAP evaluations are always concurrentwith the scheduled end of a payment period.In clock hour programs an academic year consists of 900 clock hours over aperiod of not less than 26 weeks.In clock hour programs students who do not meet academic requirements(75% cumulative grade average) or attendance requirements (75%cumulative attendance average) as of the evaluation will be considered notmaking satisfactory progress. They may lose eligibility for financial aid fromtitle IV HEA program funds, and may be subject to termination from theprogram.<strong>School</strong> holidays are not counted into the calculation of cumulativeattendance. Course incompletes and noncredit remedial courses are notapplicable and have no effect on SAP standards. Clock hours acceptedfrom another institution toward the student’s educational program arecounted as attempted and completed.FINANCIAL AID WARNING STATUSStudents who are evaluated at the end of a payment period and fail tomeet SAP are automatically placed on financial aid warning status. Theymay continue to receive assistance under the title IV HEA programs for onepayment period. Financial aid warning status may be assigned without anappeal or other action by the student. If the student does not achieve SAPby the end of that payment period eligibility for title IV program funds willcease. A student may appeal and if successful may be placed on FinancialAid Probation.FINANCIAL AID PROBATIONThe institution may place a student on financial aid probation and maydisburse title IV, HEA program funds for the subsequent payment period.All the following conditions must be met,a. The student must appeal the determination that they are not makingsatisfactory progress.b. The institution must determine that the student should be able to makesatisfactory progress during the subsequent payment period and meet theinstitution’s SAP standards at the end of that payment period.c. A student must have a basis to file an appeal. Acceptable reasons mightinclude the death of a relative, an injury or illness of the student, or otherspecial circumstances. The student must explain what caused the failureto meet the standards. They must also explain what has changed in theirsituation that will allow them to demonstrate SAP at the end of the nextpayment period. The student must submit all information relating to theappeal in writing within 10 days of being notified of not making SAP


17Tuition &Financial Informationd.If the student’s appeal is approved and he/she meets the SAPrequirements, by the end of the probationary period, they will be removedfrom probation and will be considered making SAP. If the student doesnot meet or exceed SAP by the end of the probationary period, they willbe considered not making SAP. This will result in loss of eligibility for titleIV HEA program funds. The student may also be terminated from theprogram. Students meeting the minimum requirement at any evaluationare considered to be making SAP until the next scheduled evaluation.*MAXIMUM Time FRAMEMaximum time frame for students in clock hour programs is 133% of thetime it would take to complete the scheduled hours in the program. Timeframes are based on schedule of attendance. For example, if a student’sschedule would allow for completion in 48 weeks with no absence, themaximum time frame for that student would be 133% of 48 weeks or 64weeks.If a student must attend additional time beyond maximum time frame dueto poor attendance, or to complete graduation requirements, the student’sEnrollment Agreement will terminate. The <strong>School</strong> may have any studentwhose contract terminated execute a new Agreement if the Studentis readmitted to the Program. The Student shall be required to pay thecurrent charges per Program hour or credit in effect at the time the newAgreement is executed for each Program hour or credit that the Studentmust complete. A Cumulative Grade Average of 75% must be maintained inorder to meet graduation requirements.A student seeking reinstatement after termination caused by lack of SAP orofficial interruption must first meet with a <strong>School</strong> Executive Director. TheDirector will determine if the student is eligible to re-enroll. If a studentapplies for reinstatement, he/she must document the ability to successfullycomplete the program and certify that the causes of previous difficultieshave been rectified. Students who ceased attendance while not makingSAP will return as not making SAP. They will be allowed to continue theireducation but are not eligible for title IV program funds unless they areable to re-establish SAP.

34PoliciesProfessional Development GuidelinesOur courses provide essential knowledge and skills to enable you tobe a successful professional in the salon and spa industry. Establishingprofessional work habits is a primary focus in all of our courses. Thefollowing is a general description of our student guidelines, which outlinewhat we expect from our students and what you can expect from our team.You will receive a complete listing of the school’s policies and procedures atthe time of your enrollment.AttendanceUpon registration, the student schedules a place in a particular class.Since class size is limited by state law, the <strong>School</strong> insists upon prompt andregular attendance at all times. The student is required to report to schoolat the regularly scheduled time. All students must attend according to theAchievement and Attendance Evaluation schedule. Students unable toattend classes must call in one hour before scheduled start time.Attendance is recorded to the NEAREST quarter hour.Attendance for full-time day students must be taken at the beginning andconclusion of EACH morning/afternoon session. Attendance should betaken at 9:00 AM, and again before lunch dismissal. Attendance is takenagain at the beginning of the afternoon (PM) session and prior to afternoondismissal.Attendance for part-time evening students is taken at the beginning of theevening session at 5:45 PM and again prior to dismissal. Attendance forevening students in ONLY recorded in the PM session of the attendanceregister.NOTE: Attendance is taken four (4) times per day for full-time students andtwice (2) per evening session for part-time evening students. Two entries(P or A) are required for full-time students and one entry (P or A) is requiredfor part-time evening sessions.AbsenceAn absence due to illness, death in the immediate family and/or any otherunavoidable circumstance must be reported to the school. Students whodo not complete the program within the Maximum Time frame will beterminated.TardinessPromptness in reporting to class at the beginning of each session isnecessary. Tardiness will be clocked at the nearest 1/4 hour.Schedule ChangesUnder normal circumstances, schedule changes will be granted only tothose students achieving the Achievement and Attendance Evaluationstandards. There may be circumstances where this will not be applicabledue to schedule rotation.Course Cancellation PolicyShould the need arise for the school to cancel or delay the start of aprogram, the school will work with the student to arrange for a new startdate. Should a refund be required, it will be done in accordance with therefund policy contained within this catalog.Transfer/TranscriptsStudents may transfer hours upon completion of a practical examinationthat will be given in conjunction with mock State Boards. Proficiencyexaminations will be used to determine the appropriate entry point intothe curriculum and the hours that will be accepted. Any <strong>Empire</strong> studentmaking satisfactory academic progress may transfer from one <strong>Empire</strong>school to another <strong>Empire</strong> school. Acceptance of complete hours will bebased on the receiving schools state curriculum requirement.If an <strong>Empire</strong> student wants to move to another <strong>Empire</strong> owned schoolthat is recognized by the U.S. Department of Education and the <strong>School</strong>’saccrediting body and is an additional location of the <strong>School</strong> the studentis presently attending, he/she may transfer to the additional location.However, if the student is wishing to transfer from one main school toanother main school, the student must withdraw from their present school,and then enroll at the new school. A refund calculation will be completedby the <strong>School</strong> from which they are leaving and the student may needto re-apply for Title IV funding at the new school. The student’s currentsatisfactory academic progress standing and Achievement and AttendanceEvaluation follows through to his/her new school when the student is atransfer from the main school to an additional location. <strong>Empire</strong> EducationGroup charges a fee for educational-transcripts. Tuition and other fees willbe charged based upon the hours and equipment needed.Make Up WorkMake up work is associated with any missed or failed assignments. Allpractical and lab work should be made up following an absence. Makeup work can only be completed on Tuesday, Wednesday, and Thursdayevenings from 5:00-6:00 pm and Saturdays.The student’s responsibility is to make sure he/she has obtained all notesand assignments. Once the final curriculum grade is submitted, thestudent has one (1) week to complete any make up work, provided that thestudent’s attendance is at least 50%. If the student’s attendance is less than50% then the student must re-take the module to receive a grade.


35PoliciesStudents who are absent on the day of a scheduled theory test willonly be permitted to make up any of the following if there is anapproved excused absence:-Mini Evaluation-Written Final-Practical Final-State Law Written Final-State Board Theory FinalIf there is no approved excused absence, the student will not beallowed to make up any of the above mentioned items and willreceive a zero.Weather-Related <strong>School</strong> Closings<strong>Empire</strong> Education Group does not generally close because of weatherrelatedconditions. When there is a serious “weather emergency,” whichcauses retail businesses and government offices to close, <strong>Empire</strong> willnormally cancel or delay classes. A decision to have a late opening or earlyclosing will be made by the <strong>School</strong> Director. Consult your local TV and/orradio stations for school information.Corrective ActionOur goal is to provide clear direction and feedback on your performance.When you choose to perform or behave outside of our guidelines,corrective action will be taken and may include:Written warningRemoval from class or student salon floor for the daySuspension or expulsionGRADING PROCEDUREA. Theory (lessons in review, self- tests, quizzes, tests and examinations),Practical Work (on mannequins)Student Salon/ Clinic (work on Customers and Models)Are graded on the following criteria:Grading Scale100% Outstanding A+92%-99% Above Average a85%-91% Average B79%-84% Average C75% -78% Below Average DBelow 75% Failure FB. Student Salon/Technical Sheets : Students assigned to TechnicalSheets are graded on a numerical grade, as shown above . Students whofail a Technical Sheet must retake and pass the module prior to graduation .Note: Individual lessons and examinations can be retaken if the gradefalls below 75% In this case the second score will be averaged with the firstscore. In the case of a failed curriculum, the second grade will be the gradeof record.Achievement and Attendance Evaluation (AAE)Achievement and Attendance Evaluation is the process to determine if thestudent’s performance and academic standing meets the EEG standard.The student must meet the following Achievement and AttendanceEvaluation Standards:• Must adhere to a 75% average or above Attendance Record anda 75% average or above Academics , except in Maryland.Achievement and Attendance Evaluation reports are distributed to thestudents every 6 weeks. At the Time of the evaluation the student will beidentified as being in one of four statuses:-Meets Standard: The student Meets all Achievement and Attendanceevaluation standards.-Below Standard Status: This represents the first measurement evaluationin which a student’s attendance and/or academic average does not meetthe minimum requirements. The student has a right to appeal during theBelow Standard Status. If the appeal is denied, the student remains BelowStandard until the next AAE evaluation. If the student fails to meet theminimum requirements for 2 consecutive 6 week cycles, the student isplaced in At Risk status.-At Risk Status : This represents the second measurement evaluation inwhich a student’s attendance and/or academic average does not meet theminimum requirements. The student has a right to file an appeal duringthe At Risk status until the next AAE evaluation. If the student fails to meetthe minimum requirements for 3 consecutive 6 week cycles, the student isplaced in Academic Dismissal status.-Academic Dismissal: The student will be dismissed from the <strong>School</strong>.The <strong>School</strong> staff will meet with students who are in Below Standards or AtRisk Status to review their status, advise, and create an academic plan tomeet AAE standards. The staff will offer the students the opportunity to filean appeal and follow the appeals process if applicableA student must have a basis to file an appeal. The student must explainwhat caused the failure to meet standards. They must also explain whathas changed in their situation that will allow them to demonstrate AAEat the end of the next 6 week cycle period. The student must submit allinformation relating to the appeal in writing. <strong>School</strong> administration willattach copies of advising forms relating to AAE with the submission ofappeals.The <strong>School</strong> staff will meet with students who are in academic dismissalstatus to conduct an Exit Interview and follow procedures for studenttermination.


36PoliciesNY Academic StandingAny student who is absent more than 15 percent of the total number ofinstructional hours offered during each marking period and who has notmaintained academic progress shall be placed on academic probation. Anystudent who fails to meet academic progress at the end of any markingperiod, regardless of attendance will also be placed on academic probation.A marking period is defined as 18 weeks for full time Cosmetology studentsand 36 weeks for part time Cosmetology students. There are two markingperiods for make-up Programs. The first marking period ends at themid-point of the program. Acceptable academic progress is defined as aminimum cumulative grade average of 75%.A student placed on academic probation who fails to raise his or hercumulative grade average to 75% and who fails to maintain attendancefor at least 85% of the instructional hours offered during the probationaryperiod shall be dismissed. Note: In addition to the requirements forNY Academic Standing, students are also required to maintain overallStandards of Satisfactory Academic Progress (SAP) to maintain eligibilityfor Federal Financial Assistance from title IV HEA funds. Those Standardsrequire a cumulative rate of attendance of 75% (regardless of attendanceduring a marking period), and a cumulative grade average of 75% at theend of each evaluation cycle. A full description can be found in SatisfactoryAcademic Progress (SAP) Policy.Record Retention PolicyThe student’s entire record shall be maintained for at least 6 years on-siteafter a student either terminates training or graduates. After that, theschool will maintain the following student records for 20 years off site:Evidence of compliance with the school’s admissions requirementsCredit granted for previous experience or training;Dates of admission start dates and withdrawal or completion dates;Reasons for withdrawals when known;Daily attendance;Student transcripts indicating achievements; andTuition and financial aid records, when applicable.Leave of Absence<strong>Empire</strong> Education Group does not offer leave of absences to enrolledstudents. If a student needs to interrupt his/her training, he/she must bedropped from the program and re-enrolled upon return. The re-enrollmentprocess will be according to the Re-enrollment Policy.WithdrawalAny student who withdraws from his/her contracted course or fails tocomplete his/ her training will have notice placed in his/her Student fileas to progress at the point of withdrawal. A student making satisfactoryacademic progress at the point of withdrawal may apply for re-enrollmentin the <strong>School</strong> and will be considered to be making satisfactory academicprogress and meeting Achievement and Attendance Evaluation (AAE)standards at the point of re-entry; likewise, a student not makingsatisfactory academic progress at the point of withdrawal may apply forre-enrollment in the <strong>School</strong> and will not be considered to be makingsatisfactory academic progress or meeting Achievement and AttendanceEvaluation(AAE) standards at the point of re-entry.Transfer StudentsStudents who transfer into an <strong>Empire</strong> Education Group school fromanother school system will be treated as a new Student in terms of makingsatisfactory academic progress.Grounds for Dismissal/suspensionThe <strong>School</strong> reserves the right to dismiss/suspend a student for anyreason, including but not limited to the following: providing fraudulentinformation or documentation of requirements for admission orattendance; failure to attend classes regularly; refusal to complete assignedclasses or Student Salon work; breach of school rules and regulations;falsification of school records; cheating; conduct or conditions that posea direct, adverse threat (including bullying) to other students, guests oremployees of <strong>Empire</strong> Education Group; or failure to make required cashpayments. Intentional destruction of school property, destruction ofother students’ or staff members’ property, physical violence and threatsof violence can mean immediate dismissal/suspension without previouswarning. Students are responsible for their own education equipmentand personal belongings that may have been left in the <strong>School</strong>. Theseitems must be removed by the student from the <strong>School</strong>’s premises within30 days from the date of the dismissal/suspension letter or they will beremoved by the <strong>School</strong> and disposed of accordingly. Any student who isabsent for fourteen (14) consecutive calendar days will be terminated.


37PoliciesRefund of title iv funds and refund policyrefund clauseIf a student cancels their enrollment within seven days after midnightof the day on which the enrollment agreement was signed, all moniescollected by the school shall be refunded. This cancellation will bedetermined by the postmark, written notification or day said informationis delivered or phoned to the school administrator or owner in person. Ifcancellation or termination of enrollment occurs after seven business days,but prior to or during the first week of instruction, the student is entitledto a refund of tuition, but will be charged the Registration Fee indicated onthe Enrollment Agreement.If a student withdraws or is discontinued after completion of the first weekof instruction they will be charged for the following:A. Applicants not accepted by the school shall be entitled to a refundof all monies paid.B. Thereafter, a student will be liable for1. the non-refundable registration fee, plus2. the cost of any textbooks or supplies accepted, plus3. tuition liability as of the student’s last date of physicalattendance.Tuition liability is divided by the number of quarters/terms in the program.Total Tuition liability is limited to the quarter/term during which thestudent withdrew or was terminated, and any previous quarters/termscompleted.The failure of a student to notify the director in writing of withdrawal maydelay refund of tuition due pursuant to section 5002 of the Education Law.Except that the hourly rate as per the student contract shall be substitutedfor such hours that have been made up beyond the stated program length.Enrollment time is defined as the time elapsed between the actual startingdate and the date of the student’s last day of physical attendance in theschool. Any monies due the applicant or student should be refundedwithin 30 days of formal cancellation by the student. Unofficial withdrawalsshall occur when the institution determines that the student has beenabsent 14 consecutive days from the last date of physical attendance. Anymonies due the student who unofficially withdrawals shall be made within30 days of determination by the institution that the student has unofficiallywithdrawn without notifying the institution.If a school permanently closed and no longer offered instruction aftera student enrolled, the student shall be entitled to a pro-rata refund oftuition.If a course is cancelled subsequent to a student’s enrollment, the schoolshall provide a full refund of all monies paid.Return of Title IV Funds and Refund PolicyThe law specifies how <strong>Empire</strong> Education Group must determine the amountof Title IV Program Funds that you can earn if you withdraw from school. TheTitle IV programs that are covered by this law are: Federal Pell Grants, StaffordLoans, Plus Loans and Federal Supplemental Educational Opportunity Grants(FSEOGs).When you withdraw during a payment period, if the amount of Title IVprogram funds that you have earned up to that point is received on yourbehalf less assistance than the amount that you earned, you may be ableto receive those additional funds. If you received more assistance than youearned, the school must return the excess funds.The amount of assistance that you have earned is determined on a proratabasis. For example, if you completed 30% of your payment period, youearned 30% of assistance that you were originally scheduled to receive. Onceyou have completed more than 60% of the payment period, you earn all theassistance that you were scheduled to receive.If you did not receive all the funds that you earned, you may be due a postwithdrawaldisbursement. If the post-withdrawal disbursement includesloan funds, you may choose to decline the loan funds so that you do notincur additional debt. <strong>Empire</strong> Education Group may automatically use all ora portion of your post-withdrawal disbursement (including loan funds, if youaccept them) for tuition and fees charges. It is in your best interest to allowthe school to keep the funds in order to reduce your debt to the school.Because of other eligibility requirements, there are some Title IV programfunds that you were scheduled to receive that you cannot earn once youwithdraw. For example, if you are a first-time, first-year undergraduatestudent and you have not completed the first 30 days of your program beforeyou withdraw, you may not earn any Direct Stafford Loan Funds that youwould have received had you remained enrolled past the 30th day.If you receive (or your school or parent receive on your behalf ) excess Title IVprogram funds that must be returned, your school must return the portion ofexcess equal to the lesser of1. Your institutional charges multiplied by the unearned percentage ofyour fund, or2. The entire amount of excess funds.The school must return this amount even if it didn’t keep this amount of yourTitle IV program funds.


38PoliciesIf the school is not required to return all of the excess funds, you must return the remaining amount. Any loan funds that you mustreturn, you (or your parent for a PLUS Loan) repay in accordance with the terms of the promissory note. That is, you make scheduledpayments to the holder of the loan over a period of time.Any amount of unearned grant funds that you must return is called an overpayment. The amount of a grant overpayment that you mustrepay is half of the unearned amount. You must make arrangements with your school or the Department of Education to return theunearned grant funds.The requirement for Title IV program funds when you withdraw are separate from any refund policy that your school may have.Therefore, you may still owe funds to the school to cover unpaid institutional charges. <strong>Empire</strong> Education Group may also charge youfor any Title IV program funds that the school was required to return. <strong>Empire</strong> Education Group’s refund policy is also printed on yourenrollment agreement. 39PoliciesTuition reimbursement FundThe Tuition Reimbursement Fund is designed to protect the financialinterest of students attending proprietary schools. If a school closes whileyou are in attendance prior to the completion of your educational program,then you may be eligible for a refund of all tuition expenses which you havepaid. If you drop out of school prior to completion and you file a complaintagainst the school with the State Education Department, you may beeligible to receive a tuition refund if the State Education Department is ableto provide factual support that your complaint is valid and to determinethat there was a violation of Education Law or the Commissioner’sRegulations. To file a complaint, either write the New York State EducationDepartment - Bureau of Proprietary <strong>School</strong> Supervision, 116 West 32ndStreet, 5th Floor, New York, NY 10001 or telephone (212) 643-4760.The New York State Education Department’s staff will assist you in thepreparation of a tuition reimbursement form (a sample of which shouldhave been provided to you upon enrollment).Complaint Procedure Guidelines1. A student, educator or interested party may file a complaint against theschool; however, the complaint should be in writing to the <strong>School</strong> Directorand should outline the allegations or nature of the complaint.2. The <strong>School</strong> Director will meet with the complainant within 10 calendardays of receipt of the written complaint. If after careful evaluation, theproblem cannot be solved through discussion, the complaint will bereferred to the school’s Regional Director.3. The Regional Director will respond within twenty-one (21) calendar daysof receipt of the complaint and review the allegations.If more information from the complainant is needed, a letter will besubmitted outlining the additional information required.If no further information is needed the complaint committee willact on the allegations and a letter be sent to the complainantwithin fifteen (15) calendar days, stating the steps taken to correctthe problem, or information to show that the allegations were notwarranted or based on fact.4. Denim, jeans, and workout attire are notpermitted. Skirts, pants, and capris must fall below the knee. Students arerequired to wear shoes that are closed-toe. No hats are allowed. Violation ofthe dress code is not permitted.2. All of our schools are smoke-free. Smoking is only permitted indesignated areas outside of the school; however, student smokers arerequired to keep those areas free of any debris caused by smoking.3. Sanitation guidelines and cleansing assignments must be completebefore, during and after scheduled class, service appointments and studentsalon floor times.4. Students are responsible for the cleanliness of their work area andequipment used throughout the day.5. Students are required to wear personal protective equipment (e.g.,gloves, mask and safety glasses) as specified on the Material Safety DataSheet (MSDS).6. Penalty for theft is termination of enrollment and legal prosecution.<strong>School</strong> equipment, products and supplies must be used followingclassroom or student salon floor guidelines. Misusing or taking schoolmaterials, products or equipment is not allowed.7. The use or possession of illegal mind altering drugs or alcohol on thepremises of a school or at a school function is strictly forbidden and willresult in the termination of student financial assistance and enrollment.8. Prior to class start, a student must notify the school if he/she is ill orunable to attend regularly scheduled class. Late arrivals will be clocked onthe nearest 1/4 hour.9. Each student is required to clock in upon entering and leaving theschool.10. Students are responsible for their own educational equipment andpersonal belongings. Be prepared for class and the student salon floorlearning process by having a complete tool kit, required class materials andcompleted assignments each day.11. All lockers are the property of <strong>Empire</strong> Education Group and are availableby assignment for student use. <strong>Empire</strong> Education Group reserves the rightto open and inspect lockers. A combination lock is provided for use. Nooutside lock of any type can be used or placed on lockers.12. The school’s business telephone is not available for personal calls.13. All electronic devices (cellular phones, pagers, laptops, PDAs) mustbe turned off upon reporting to school. Cellular phones are not to beused during class time. Of course, voice mail messages may be checkedand personal calls may be made at break and meal times. In case of an“emergency”, the cell phone may be used to place a call during school timewith notification to school personnel (“Emergency” is defined by Webster’sDictionary as: a sudden, generally unexpected occurrence demandingimmediate action).14. As a courtesy to our students, hair, nail and skin services may beperformed at a special rate. See your Instructor for approval.15. Safety and physical demands of the profession:a. Maintaining good body posture will eliminate straining your back, legsand feet.b. For people who are extremely sensitive, continuous exposure tocosmetic products may cause an allergic reaction.c. Wearing support hosiery and low-heeled shoes provides addedsupport and comfort, thereby preventing or reducing the possibility orvaricose veins.

Eating or drinking in a classroom or Student Salon is prohibited.Students are permitted to eat in designated areas at the times posted.18. The use or possession in the <strong>School</strong> of any item that is, or resembles,a weapon, firearm or explosive of any kind that could be used to causephysical injury is prohibited.19. Professional and courteous conduct is expected. Refer to the StudentOffense & Consequence table which can be found in the ED/AD office.Respectful communication with staff, fellow Students, and service guestsis required. Unnecessary conversation, creating noise, causing discord,abusive language or using racial, sexual, ethnic or religious slurs orreferences is prohibited and may result in termination from the program.20. Gross negligence, abuse or endangering the health or welfare of anystaff member, Student, visitor, Student Salon guest, or other, including theuse of verbal or written threats, bullying, intimidation, coercion, abusivelanguage, or inappropriate physical behavior is prohibited and may resultin termination from the program.21. Family and friends may visit the <strong>School</strong> as service guests only. Visitorsare not allowed during class or Student Salon floor hours.22. Students are not to provide cosmetology services at home in exchangefor money. It is important for youto realize that the New York State EducationDepartment's Bureau of Proprietary <strong>School</strong>Supervision closely monitors and regulatesall non-degree granting proprietary schools.The schools are required to have theirteachers meet standards in order to belicensed by the Department. <strong>School</strong>s are alsorequired to have their curriculum approvedby the New York State EducationDepartment every three years, therebyhelping to insure that all curriculum offeredin the schools are educationally sound.In addition, staff members of the Bureau ofProprietary <strong>School</strong> Supervision are often inthe school buildings monitoring theeducational programs being offered. How can a complaint be filed by a studentor employee?You should try to resolve your complaintdirectly with the school unless you believethat the school would penalize you for yourcomplaint. Use the school's internalgrievance procedure or discuss yourproblems with teachers, department heads,or the school director. We suggest that youdo so in writing and that you keep copies ofall correspondence to the school. However,the school cannot require you to do thisbefore you file a complaint with the NewYork State Education Department. If you dofile a complaint with the Department, pleaseadvise the Bureau of any action that youhave taken to attempt to resolve yourcomplaint.The steps you must take to file a complaintwith the New York State EducationDepartment are:1. Write to the New York State EducationDepartment at 116 West 32nd Street, 5thFloor, New York, New York 10001, ortelephone the Department at (212) 643-4760, requesting an interview for thepurpose of filing a written complaint. Bringall relevant documents with you to theinterview, including an enrollmentagreement, financial aid application,transcripts, etc. An investigator from theDepartment will meet with you and gothrough your complaint in detail.2. If you cannot come for an interview, senda letter or call the office to request acomplaint form. You must complete andsign this form and mail it to the office.Please include with it copies of all relevantdocuments. You should keep the originals.You must file a complaint within two yearsafter the alleged illegal conduct took place.The Bureau cannot investigate anycomplaint made more than two years afterthe date of the occurrence.3. The investigator will attempt to resolvethe complaint as quickly as possible andmay contact you in the future with follow-upquestions. You should provide allinformation requested as quickly aspossible; delay may affect the investigationof your complaint. When appropriate, theinvestigator will try to negotiate with theschool informally. If the Departmentdetermines that violations of law have beencommitted and the school fails to takesatisfactory and appropriate action then theDepartment may proceed with formaldisciplinary charges.What is the Tuition ReimbursementFund?The Tuition Reimbursement Fund isdesigned to protect the financial interest ofstudents attending proprietary schools. If aschool closes while you are in attendance,prior to the completion of your educationalprogram, then you may be eligible for arefund of all tuition expenses which youhave paid. If you drop out of school prior tocompletion and you file a complaint againstthe school with the State EducationDepartment, you may be eligible to receive atuition refund if the State EducationDepartment is able to provide factualsupport that your complaint is valid and todetermine that there was a violation ofEducation Law or the Commissioner'sRegulations as specified in Section 126.17of the Commissioner's Regulations. To file aclaim to the Tuition Reimbursement Fund,you must first file a complaint with the StateEducation Department at the addressincluded in this pamphlet. What is the tuition refund andcancellation policy?All schools must have a tuition refund andcancellation policy for each programincluded in the catalog and in the studentenrollment agreement.Read and understand the school's policyregarding tuition refund and cancellationbefore you sign the enrollment agreement. Ifyou do not understand it, or are confused bythe school's explanation, get help before yousign. You may ask for assistance from theDepartment at the address included in thispamphlet.What should students know about"private school agents?"Private <strong>School</strong> Agents are employed byschools for the purpose of recruiting orenrolling students in the school; they are notschool counselors. Private school agentscannot require a student to pay a placementor referral fee. Each school agent must belicensed by the New York State EducationDepartment, must have an Agentidentification card and must be a salariedemployee of the school. <strong>School</strong> agents whocannot show an Agent Identification Cardare breaking the law if they try to intereststudents in enrolling in a particular school orgroup of schools. The name(s) of theagent(s) who enrolled a student must appearon that student's enrollment agreement.Therefore, you should write down the nameof the agent who talked to you. Each studentwill be required to confirm the name(s) ofthe agent(s) when signing the enrollmentagreement. A full refund shall be made toany student recruited by an unlicensedprivate school agent or even by a licensedagent if there is evidence that the agentmade fraudulent or improper claims. To findout if you are eligible to receive a refund,you must follow the complaint proceduresincluded in this page.What should students know about"grants and Federal Direct Student Loans"?A grant is awarded to a student based onincome eligibility, and it does not need to berepaid (for example, New York StateTuition Assistance Program (TAP) grants orPell grants provided by the federalgovernment).Federal Direct Student Loans are low interestloans provided under the Federal DirectStudent Loan Program. The decision to applyfor such a loan is yours--the school cannot requirethat you apply for a loan. You should understandthat if you pay school tuition with moneyloaned to you from a lender you are responsiblefor repaying the loan in full, with interest, inaccordance with the terms of the loanagreement. A failure to repay the loan canhurt your credit rating and result in legalaction against you. Even if you fail tocomplete your educational program, you arestill responsible for repaying all of themoney loaned to you.It is your right to select a lender for a FederalDirect Student loan. The school cannotrequire you to apply to a particular lender orlending institution.
