If this proves ineffective or he thinks best toproceed in court at once, he shall bring the case before theCivil Service Court, which may, on the first offence, fine, imprisonor dismiss the offender or impose anytwo Qr a11 ^T&e penalties, but on the secondoffense shall dismiss the guilty official. Theaction of the court shall not be confined to enforcing themerit system in respect to the appointment, promotion andretention of employees. It may dismiss any officer or employeeof the city for misconduct or incompetence, and proceedingsfor this purpose may be instituted by the Mayor,City Attorney, Controller, Superintendent of Schools, Directorof Public Works, oor other head of department, andupon affidavit that a, department head has been requestedto bring such action on reasonable cause and has refused,any ten citizens may institute such proceedings in said court.Any employee or group of employees or any officer mayappeal to the court to prevent or punish a breach of the CivilService Rules, or to decide any question relating to hours,wages or conditions of service, and its decisionafter ful1 tearing of all sides, shall have theforce of law subject only to the referendumif a petition for it is filed in the court within 30 days after suchdecision is published.5. In respect to any non^elective officer OTemployee a petition for dismissal signed by anumber of voters of the city equal to a majority of the totalvote cast at the last preceding municipal election, shall bemandatory upon the head of the department involved andupon the Civil Service Court, and shall be good and necessarycause for an order of removal.10The object of overlapping the term of the mayor is to give a year fornny partisan feeling awakened in the campaign to die away, and for themayor to become thoroly acquainted with the character and capacity of thevarious department heads. Under such circumstances the mayor is much lesslikely to be elected on a spoils basis and is also less likely to fill the officeswith his political or personal friends than is the case where the offices govacant at the time he comes to the chair. Thus we gain the advantages ofthe appointment system in securing scientific experts instead of politicians forthe heads of departments and at the same time reduce to the lowest termsthe dangers of the appointing power.The ideal we think would be that such officers as superintendent of
