27Issues3.15 The 2005 election resulted in the largestnumber of third party returns for a relevantelection since PPERA was introduced in 2001,with 18 third parties submitting returns for thefirst time. The Commission’s Election 2001Campaign spending report had noted thatthere was evidence to suggest spending thatexceeded the limits by unregistered thirdparties. The increase in the number of thirdparties registered at the 2005 general electionsuggests that potential third parties had a betterunderstanding of the limits imposed by PPERA.3.16 There was however, one instance at the2005 general election where a third party wasthought to have spent in excess of the limit foran unregistered third party. The Commissionwas made aware that, during the regulatedperiod, a campaign group, Concerned Citizensfor a Shared Future, may have issued electionmaterial which exceeded the limit for a nonrecognisedthird party. The Commission is stillreviewing this issue and will take appropriateaction once its review has been completed.3.17 UNISON reported spending that exceededthe limit in Scotland. Separate limits exist onspending in different areas of the UK. Theoverspend represented less than 1% ofUNISON’s total spending during the combinedregulated period. This is the first time since theintroduction of PPERA that a spending breachhas occurred. The Commission is workingclosely with UNISON to understand how thelimit came to be exceeded and what stepswill be taken to ensure it does not recur.3.18 Two third parties, the G.M.B. and PatrickEvershed, spent more than the limit for anunregistered third party (see paragraph 3.5)before the time that they registered with theCommission. These incidences and the onereferred to in paragraph 3.16 highlight the needfor greater awareness by third parties about theduties on them in relation to campaigning at aregulated election.3.19 A number of further issues were identifiedduring the Commission’s review of the returns:• late submission of returns:12 third partiessubmitted returns after the due deadline• late payment of invoices: several third partiesdid not pay invoices within the 42-day periodrequired by legislation• lack of invoices submitted with return (onethird party) and• inclusion of items not covered under thedefinition of controlled expenditure,particularly staff costs3.20 The Commission is working together withthird parties to address these issues and willprovide continued support to improve theirunderstanding of the controls and compliancewith the legal requirements, as set out inChapter 5.Elections 2005: campaign spending: controlled spending by third parties
