(o) Developing Artist - A singing Artist formerly a member <strong>of</strong> the Young <strong>Artists</strong>Training Program, engaged to perform Leading, Featured or Supporting Roles.17. PAYMENT TO ARTISTS(e) When EMPLOYER provides (or is prepared to provide) suitable lodging,EMPLOYER may satisfy the per diem requirement herein by the payment <strong>of</strong> anamount equal to the daily meal allowance as specified under provisions for eachcategory <strong>of</strong> ARTIST covered by this Agreement, if applicable.(f) Off Site Rehearsals - When an ARTIST is required to rehearse thirty (30)miles beyond the central point <strong>of</strong> departure [Central City], but is not required tostay overnight, the EMPLOYER shall compensate the ARTIST with a partial perdiem <strong>of</strong> twenty dollars ($20) for such rehearsal(s).(1) The above allowances shall be paid in lieu <strong>of</strong>, and not in additionto, the per diem allowance provided for in each ARTIST’s respectivesection for each such day <strong>of</strong> rehearsal outside Central City.(2) This allowance shall not be paid to ARTISTS who are alreadyreceiving no less than the per diem provided for herein for out-<strong>of</strong>-townperformances in his/her contractual compensation.21. EXTRA MEAL COMPENSATION FOR RUN OUT ENGAGEMENTS(a) Run-Out Engagements - When an ARTIST is required to perform thirty(30) miles beyond the central point <strong>of</strong> departure [Central City], but is not requiredto stay overnight, the EMPLOYER shall compensate the ARTIST with thefollowing meal allowance as applicable:MEALALLOWANCESUMMER OF20073%SUMMER OF20083.5%SUMMER OF20094%Breakfast $12.15 $12.58 13.08Lunch $16.15 $17.23 $17.92Dinner $24.38 $25.23 $26.24Total Meal $53.18 $55.04 $57.24The above allowances shall not be paid however if the ARTIST is already specificallyreceiving no less than the per diem provided for herein for out-<strong>of</strong>-town performances inhis/her contractual compensation.2
26. REHEARSAL, DRESSING ROOM & PERFORMANCE FACILITIES &CONDITIONS(b) All rehearsal rooms shall be maintained in clean condition and properlysupplied to ensure a constructive working environment for all ARTISTS.Fulfillment <strong>of</strong> this condition includes:(1) Adequate Lighting – replace ceiling bulbs and provide additionallamps with power cords, as requested by ARTISTS;(2) Adequate number <strong>of</strong> available chairs in the building which shall bein good repair;(3) Adequate number <strong>of</strong> music stands available for music needed forrehearsals.28. FILMING, BROADCASTING, TELEVISING, ETC.(a) Except as provided for below, the EMPLOYER agrees that it will not film,tape, make video and/or audio cassettes, broadcast, record or televise from thestage or any studio or otherwise, any rehearsals and/or performances in which theARTIST appears, by wire, wireless, radio, telephone, wireless process, television,motion picture, recording, mechanical, electrical or telephone device now in useor hereafter developed, or any combination <strong>of</strong> such devices; <strong>AGMA</strong>, however,shall consider a request by the EMPLOYER for a waiver <strong>of</strong> the foregoingprovision, and the granting <strong>of</strong> such a waiver shall be at the absolute discretion <strong>of</strong><strong>AGMA</strong> and upon such terms and conditions as are determined by <strong>AGMA</strong>.(1) <strong>AGMA</strong> will permit the EMPLOYER to make, and the ARTISTagrees to allow, the audio recording <strong>of</strong> three performances <strong>of</strong> eachproduction each season. A composite recording will be created from theserecordings with the approval <strong>of</strong> the General/Artistic Director and thenaired once by Colorado Public Radio. It is agreed and understood thatthere will be no additional compensation for these recordings or for thesingle broadcast.(2) The use <strong>of</strong> these audio recordings and <strong>of</strong> the resulting compositerecording <strong>of</strong> each production is strictly limited as described in (1) above.Should there be an opportunity to otherwise release, distribute, broadcast,sell or make any other use whatsoever <strong>of</strong> such recording(s) theEMPLOYER and <strong>AGMA</strong> agree to meet and to negotiate in advance theterms and conditions that shall so govern. However, the EMPLOYERshall be allowed to use these recordings for promotional purposes pursuantto the expressed terms <strong>of</strong> subparagraph (b) (1) and (2) below.3
