(b) <strong>AGMA</strong> will permit the EMPLOYER to make audio and video tapes whichare marked and restricted for archival and study purposes for the exclusive use <strong>of</strong>the opera company for restaging and remounting productions and as provided forbelow:33. SMOKE AND FOG(1) <strong>AGMA</strong> will permit a maximum <strong>of</strong> three (3) minutes <strong>of</strong> live videoor audio tape to be used for radio and video news or magazine programsfor publicity purposes. This is restricted for NEWS or magazine broadcastonly. If an ARTIST is invited to appear as a guest ARTIST on a "talkshow" or the like, the ARTIST may utilize an (3 minute) insert where heor she is predominant for promotional and publicity purposes. Under nocircumstances may these inserts be utilized for commercial advertising <strong>of</strong>the opera company on television or radio stations.(2) Should there be any release, distribution, sale or any other usagemade <strong>of</strong> these "study" or "archival" tapes, the EMPLOYER agrees tocompensate all ARTISTS the appropriate prevailing compensation.The use <strong>of</strong> smoke and fog effects shall be governed by the following:(a) No smoke and fog devices or effects shall be permitted to be used in anyproduction unless each <strong>AGMA</strong> member scheduled to perform in that productionsshall be given two (2) weeks advance notification <strong>of</strong> the company’s intention touse same; and(b) No smoke or fog effects may be used in any production except for thosegenerated by dry ice or steam; and(c) If any previously-engaged <strong>AGMA</strong> member shall decline to perform in aproduction because <strong>of</strong> his or her reasonable belief that the effects used in suchproduction may be harmful to their voice to their health, or if any previouslyemployed <strong>AGMA</strong> member is unable to perform in a production because <strong>of</strong> illnessor vocal problems occasioned by the use <strong>of</strong> such effects in a previous productionor performance, such person shall nonetheless receive all <strong>of</strong> the compensation towhich they would have been entitled to had they performed.SECTION II - GENERAL REHEARSAL AND PERFORMANCE PROVISIONS1. REHEARSALS DURING REHEARSAL WEEKSRegardless <strong>of</strong> the number <strong>of</strong> contracts for which any ARTIST is engaged, such ARTISTmay rehearse no more than thirty six (36) hours per week nor more than six (6) hours perday during a six (6) day rehearsal week.
