(b) AGMA will permit the EMPLOYER to make audio and video tapes whichare marked and restricted for archival and study purposes for the exclusive use ofthe opera company for restaging and remounting productions and as provided forbelow:33. SMOKE AND FOG(1) AGMA will permit a maximum of three (3) minutes of live videoor audio tape to be used for radio and video news or magazine programsfor publicity purposes. This is restricted for NEWS or magazine broadcastonly. If an ARTIST is invited to appear as a guest ARTIST on a "talkshow" or the like, the ARTIST may utilize an (3 minute) insert where heor she is predominant for promotional and publicity purposes. Under nocircumstances may these inserts be utilized for commercial advertising ofthe opera company on television or radio stations.(2) Should there be any release, distribution, sale or any other usagemade of these "study" or "archival" tapes, the EMPLOYER agrees tocompensate all ARTISTS the appropriate prevailing compensation.The use of smoke and fog effects shall be governed by the following:(a) No smoke and fog devices or effects shall be permitted to be used in anyproduction unless each AGMA member scheduled to perform in that productionsshall be given two (2) weeks advance notification of the company’s intention touse same; and(b) No smoke or fog effects may be used in any production except for thosegenerated by dry ice or steam; and(c) If any previously-engaged AGMA member shall decline to perform in aproduction because of his or her reasonable belief that the effects used in suchproduction may be harmful to their voice to their health, or if any previouslyemployed AGMA member is unable to perform in a production because of illnessor vocal problems occasioned by the use of such effects in a previous productionor performance, such person shall nonetheless receive all of the compensation towhich they would have been entitled to had they performed.SECTION II - GENERAL REHEARSAL AND PERFORMANCE PROVISIONS1. REHEARSALS DURING REHEARSAL WEEKSRegardless of the number of contracts for which any ARTIST is engaged, such ARTISTmay rehearse no more than thirty six (36) hours per week nor more than six (6) hours perday during a six (6) day rehearsal week. If the weekly or daily hourly limitations for4
ehearsal are exceeded, excess hours shall be considered “overtime” and shall be paid atthe Overtime Rate indicated in each ARTISTS’ Section, as applicable.2. REHEARSALS DURING PERFORMANCE WEEKSAfter a production has opened, the EMPLOYER shall be entitled to not more than four(4) hours of rehearsal for such production during a performance week without additionalcompensation to ARTISTS. No rehearsals shall be scheduled within two (2) hours of anyARTIST’s make-up call prior to a dress rehearsal or performance, except in emergencycases or unless requested by the ARTIST. All hours of rehearsal scheduled in excess ofthe four (4) hours permitted above shall be paid at the hourly rehearsal rate indicated ineach ARTISTS’ Section, as applicable.3. REHEARSALS FOR PRINCIPALS ENGAGED ON A PER PERFORMANCEBASISARTISTS engaged by the EMPLOYER on a Per Performance basis may be required torehearse, without additional compensation, for not more than three (3) hours prior to eachspecific single performance of a production for which s/he is engaged. In no event mayany PRINCIPAL rehearse more than a total of six (6) hours per production withoutadditional compensation. All additional hours of rehearsal shall be paid at the applicablehourly rehearsal rate indicated in the Principal Artists Section.4. REHEARSAL AND PERFORMANCE PROVISIONSRegardless of the number of contracts for which an ARTIST is engaged, the followingshall apply:(a) No rehearsal, costume fitting, or ARTIST service required byEMPLOYER shall be scheduled before 10:00 A.M.(b) No rehearsal shall end later than 11:30 P.M. except dress rehearsals, whichmay last until 12:30 A.M.(c) During each week each ARTIST shall receive one (1) Free Day duringwhich there shall be no rehearsal, costume fitting, or ARTIST service of any kindrequired by EMPLOYER scheduled whatsoever.(d) On a performance day, an ARTIST singing a Leading or Featured Roleshall not be called for any rehearsal of that same production, except in emergencycases or unless otherwise requested by ARTIST.(e) No rehearsal or performance shall be scheduled sooner than twelve (12)hours following the end of the preceding evening’s rehearsal or performance,except in emergency cases or unless otherwise requested by ARTIST.
