Maybank DUO Platinum MasterCard Lucky DrawDefinitionsIn these Terms and Conditions"Account" means a DUO Platinum MasterCard account maintained with the Bank inSingapore."Bank" means Malayan Banking Berhad, Singapore.“Card Transaction” means any payment made with the use of the Maybank Card."Chance" means one opportunity to win the Maybank DUO Platinum MasterCardLucky Draw."Lucky Draw" means a draw conducted at the end of the Qualifying Period and theChances will be awarded based on eligible charges made to Maybank Cards duringthis period."Maybank Card" means the DUO Platinum MasterCard issued by the Bank."Maybank Cardmembers" means persons to whom Maybank Cards have beenissued and whose Accounts are in good standing (as determined by the Bank in itssole discretion)."Prize" means a Subaru Impreza 2.0 MT Sedan (excluding Certificate OfEntitlement, registration fees, radio licence, IU unit and road tax which shall beborne by the Winner)."Qualifying Account" means, an Account, at the time of the Maybank DUO PlatinumMasterCard Lucky Draw, which, in the sole opinion of the Bank is in good standingand has not been terminated."Qualifying Period" means 21 September 2011 to 31 January 2012 (Singaporetime)."Statement of Account" means the monthly statement of accounts which is sent bythe Bank to the Maybank Cardmembers."Winner" means the winner of the Maybank DUO Platinum MasterCard Lucky Draw.Definitions importing the singular shall include the plural and vice versa.Eligibility• Only Maybank DUO Cardmembers with a Qualifying Account(s) are eligible toparticipate in the Maybank DUO Platinum MasterCard Lucky Draw.

• Maybank DUO Cardmember must be enrolled in the Maybank DUO programmewith a valid Unique DUO ID.• Employees (and their immediate families) of the Bank or of its advertisingagencies or sponsors are not eligible to participate in the Maybank DUOPlatinum MasterCard Lucky Draw.Awarding of Chances & The Draw(s)• During the Qualifying Period, Chances will be awarded to the relevantprincipal/main Maybank Cardmembers as follows:10 Chances will be awarded for each approved application for the Maybank DUOCard issued to the principal Maybank Cardmember.5 Chances will be awarded for every accumulated S$50 under a Card Transactioncharged to a Maybank DUO Card whether by the principal/main or his/hersupplementary cardmember under the same Account. Card Transactions excludecash advances, balance transfers, fund transfers and money transfers carried outusing a Maybank Card.10 Chances will be awarded for every accumulated S$50 (retail spending) chargedto a Maybank DUO Card at any Tan Chong International Limited outlet whether bythe principal/main/his/her supplementary cardmember under the same Account.• Chances accumulated are not transferable and will be cancelled by the Bankwithout incurring any liability upon the suspension, cancellation and/or terminationof any Account. Chances accumulated for a Maybank DUO Cardmember are notto be combined with chances awarded to any other Maybank DUO Cardmember.• The Bank assumes no responsibility for any loss or damage arising in connectionwith the Maybank DUO Platinum MasterCard Lucky Draw, including any lost, late,misdirected, damaged, incomplete, illegible or postage-due mail, or transactionsthat are processed late, incorrectly or lost due to computer or other electronicbreakdown or malfunction or any other reason.• The Bank reserves the right at any time to withdraw, cancel or invalidate thenumber of Chances assigned to any Account without notice or reason.• Proof of charge slips is not proof of eligible spending. Card Transactions asreflected in the monthly Statement of Account shall constitute proof of eligiblespending for purposes of the Maybank DUO Platinum MasterCard Lucky Draw.Prize• The Prize is not transferable nor exchangeable for cash, credit or kind and shall besubject to such terms and conditions which the Bank may in its sole and absolutediscretion impose. The Bank may in its sole and absolute discretion exchange or

substitute the Prize to another of equivalent or similar value without notice andliability to any person.• The Winner must at his/her own risk and expense, register the Prize within 3months from the date of notification to the Winner, bid for the Certificate ofEntitlement and liaise with the designated merchant supplying the goods orservices which is the subject-matter of the Prize in order to redeem the Prize.• The redemption of the Prize is subject to availability. The Winner is not entitled toany payment or compensation from the Bank should the Prize be forfeited.• The redemption of the Prize shall constitute a purchase of goods and/or servicesby the person redeeming the Prize from the merchant supplying the redeemedgoods or services. The Winner shall accept the Prize "as is". The Bank makes norepresentation or warranty whatsoever as to the quality or fitness for purpose orany other implied terms or conditions with respect to the Prize and assumes noliability or responsibility for the acts or defaults of the merchant or for any nondelivery,non-performance or defects in the redeemed goods and/or services. TheBank is not an agent of the merchant. Any dispute about the quality orperformance of the redeemed goods and/or services must be resolved directlywith the merchant.• The use of the redeemed goods and/or services is also subject to such otherterms and conditions as may be imposed by the merchant supplying the goods orservices.Others• The Bank reserves the right to draw 1 or more reserve winner(s) to replace theWinner subsequently found to be disqualified.• Results will be made available at www.maybank2u.com.sg and will be published ina newspaper within 7 days of the date of the Lucky Draw. The Winner will benotified by post to their last known address on record with the Bank. Except for thenotifications of the relevant Winner, the Bank shall not be obliged to enter into anycorrespondence on any matter concerning the Maybank DUO PlatinumMasterCard Lucky Draw• The Prize must be claimed in Singapore and shall be subject to such terms andconditions which the Bank may in its sole and absolute discretion impose.• The Prize, if unclaimed within 2 months from the notification to their last knownaddress or telephone number shall be donated to a charitable organisation to bechosen by the Bank. Any Maybank Cardmember whose Prize has been soforfeited shall not be entitled to any compensation notwithstanding non-receipt byhim/her of any notification.• The Lucky Draw will be held at Maybank Centre,1 Ang Mo Kio 64, Singapore569083 on 29 February 2012 at 10am and conducted via a computerised luckydraw system.

General• The Maybank Cardmembers hereby authorise the Bank to disclose and publishtheir names and other particulars to any person and in any mode and manner asthe Bank may deem appropriate in the event that he/she wins the Prize.• By participating in the Lucky Draw i.e. by meeting the eligibility requirements, eachparticipant agrees to abide by the terms and conditions stated herein. In the eventthe participant does not agree to these terms and conditions he/she should notparticipate in the Lucky Draw and should opt out by informing Maybank of thesame.• The Winner may be required to attend a prize presentation and/or participate inpublicity programmes. All expenses and/or costs incurred for such attendanceshall be borne by the Winner and the Bank reserves the right to use the name,address, photographs, information, particulars and/or documents of the Winner inany advertisement or other forms of publicity from time to time.• The Bank shall have the sole and absolute discretion to exclude any person fromparticipating in the Maybank DUO Platinum MasterCard Lucky Draw without anyobligation to furnish any notice and/or reason.• The Bank reserves the right in its sole and absolute discretion to vary, delete oradd to any of these terms and conditions from time to time or terminate theMaybank DUO Platinum MasterCard Lucky Draw at any time without notice orliability to any person.• The Bank, its related corporations, employees and/or independent contractorsshall not be liable to any person for any loss, damage and/or injury whatsoever orhowsoever caused arising from Maybank DUO Platinum MasterCard Lucky Drawand/or any use and /or enjoyment of the Prize.• The Bank's decision on all matters relating to the Maybank DUO PlatinumMasterCard Lucky Draw (including without limitation the chances awarded to theMaybank Cardmembers and the selection of the Winner of the Maybank DUOPlatinum MasterCard Lucky Draw) shall be final and binding on all participants. Inthe event of any inconsistency between these terms and conditions and anybrochure, marketing or promotional material relating to the promotion, these termsand conditions shall prevail.
