For the purpose of this Article only, “teacher” includes an<br />

individual whose application for certification is pending with<br />

the Ontario College of Teachers. O.E.C.T.A. shall advise<br />

the Board, in writing, of the amount of fees authorized by the<br />

Association in keeping with its Constitutions and By-Laws.<br />

The Board shall remit the total amounts so deducted to the<br />

Ontario English Catholic Teachers Association within thirty<br />

(30) working days of the collection.<br />

3) The Board shall deduct the College of Teachers’ fee from<br />

the teacher’s salaries in equal instalments of no more than<br />

thirty dollars ($30) dollars prior to January of each school<br />

year.<br />

4) Prior to June 30 th , the <strong>Durham</strong> <strong>Secondary</strong> Branch Affiliate<br />

Executive of O.E.C.T.A. shall notify the Board of any levy to<br />

be deducted during the following year. If no such notification<br />

is given prior to June 30 th , it shall be assumed that the<br />

amount of the levy previously being deducted by the Board<br />

is to remain in force during the following school year. Such<br />

levy shall be forwarded to the Branch Affiliate within thirty<br />

(30) days of each deduction. The <strong>Durham</strong> <strong>Secondary</strong><br />

Bargaining Unit of O.E.C.T.A. agrees to indemnify the Board<br />

against any claims that may be made against it as a result of<br />

the Board making such deductions.<br />

5) The Board will have its banking firm deposit the pay of each<br />

teacher in an account designated by the teacher. On or<br />

before each scheduled pay day, every teacher shall receive<br />

an itemized statement of deductions. The statements will be<br />

addressed individually and in envelopes.<br />

Collective Agreement 2004-2008<br />

ARTICLE VI – RETIREMENT AND GRATUITY<br />

6:01 Retirement<br />

Any teacher, who has attained the age of 65 years on or before<br />

August 31 st of any year, shall retire on June 30 th of that year.<br />

Those who reach 65 years of age on or after September 1 st of<br />

any year, shall retire on June 30 th of the following year.<br />

Extension, upon application, may be granted at the discretion of<br />

the Board.<br />

6:02 Gratuity – Qualifications to Retire<br />

1) A retiring employee is one who ceases to be employed by<br />

the Board on account of age or health and applies for, and<br />

receives, a retirement pension from the Teacher’s Pension<br />

Plan.<br />

2) Each employee, retiring at normal or earlier date, provided<br />

the employee has a record of ten (10) years service with the<br />

Board prior to retirement, shall be granted a gratuity in<br />

accordance with the Gratuity Table.<br />

6:03 Grandparenting<br />

The provisions of Article VI will not apply to teachers whose<br />

service with the Board commences on or after September 1,<br />

1983. Teachers employed by the Board on August 31, 1983 are<br />

guaranteed, when eligible as per conditions of Article 7:01 (1982-<br />

83 Collective Agreement) or Article 6:02 (1989-91 Collective<br />

Agreement), the benefits under Article VII contained in the 1982-<br />

83 Collective Agreement, and the terms and conditions of Article<br />

VI may not be changed in the future insofar as they pertain to<br />

those teachers employed by the Board on August 31, 1983.<br />

All teachers employed by the Board on August 31, 1983, have<br />

been provided with a letter guaranteeing benefits as outlined in<br />

this Article.
