ADOPTING RECORDS RETENTION AND DISPOSITIONSCHEDULEfinicncidAld. Horovitz and duly adopted, ayes all.Mayor Jones noted <strong>the</strong> resolution had <strong>to</strong> <strong>be</strong> adopted by April 30 or norecords could <strong>be</strong> disposed of after that date until a resolution is adopted.Mayor Jones reported <strong>the</strong> State budget has <strong>be</strong>en approved.He said<strong>the</strong> City <strong>will</strong> continue <strong>to</strong> receive <strong>the</strong> increase in CHIPS aid but <strong>will</strong> loseone -third of its sewer aid, with <strong>the</strong> o<strong>the</strong>r two- thirds scheduled <strong>to</strong> <strong>be</strong> phasedout next year. This <strong>will</strong> result in a two <strong>to</strong> three percent increase inwastewater charges. He said that recreation and Youth Bureau aid <strong>will</strong> remain<strong>the</strong> same. He noted real estate taxes <strong>will</strong> increase due <strong>to</strong> <strong>the</strong> City notreceiving any increase in state revenue sharing aid for <strong>the</strong> third year in arow.In addition, County revenue sharing aid has <strong>be</strong>en abolished which also<strong>will</strong> result in greater tax bills <strong>to</strong> property owners.RESOLUTION # 23 - 1989. AUTHORIZING EXPENDITURES FROM HIGHWAY EQUIPMENTRESERVE FUND FOR TWO WHEEL DRIVE PICKUP TRUCKAld. Angelino introduced <strong>the</strong> following and moved its adoption:WHEREAS, <strong>the</strong> Highway Superintendent has notified <strong>the</strong> Common Council of<strong>the</strong> breakdown of <strong>the</strong> # 31 loader which is used at <strong>the</strong> landfill and on o<strong>the</strong>rCity projects; andWHEREAS, <strong>the</strong> <strong>City'</strong> s second loader is an older piece of equipment and issubject <strong>to</strong> breakdowns; andWHEREAS,such equipment is necessary for daily work at <strong>the</strong> landfill;andWHEREAS, <strong>the</strong> Common Council deems <strong>the</strong> repair of such loader <strong>to</strong> <strong>be</strong> of anemergency nature; now, <strong>the</strong>refore <strong>be</strong> itRESOLVED, that repair of <strong>the</strong> # 31 loader of <strong>the</strong> City of Norwich highwayfleet <strong>be</strong> and hereby is declared an emergency; and, fur<strong>the</strong>r <strong>be</strong> itRESOLVED, that <strong>the</strong> Mayor <strong>be</strong> and hereby is authorized <strong>to</strong> approve costsassociated with such repair without entertaining formal bids for same.1Seconded by Ald. APPOINTING COMMUNITY DEVELOPMENT DIRECTOR AS FAIRHOUSING OFFICERAld. Guinn introduced <strong>the</strong> following and movedits adoption:WHEREAS, <strong>the</strong> City of Norwich has adopted a Fair Housing Code; andWHEREAS, such Code provides for <strong>the</strong> appointment of a Fair Housing Officer;now, <strong>the</strong>refore <strong>be</strong> itRESOLVED, that <strong>the</strong> Community Development Direc<strong>to</strong>r <strong>be</strong> and hereby isdesignated <strong>to</strong> act as <strong>the</strong> Fair Housing Officer for <strong>the</strong> City of Norwich.Seconded by Ald. O'Neil and duly adopted, ayes all.Prior <strong>to</strong> <strong>the</strong> vote, Mayor Jones said <strong>the</strong> Codes Enforcement Officer previsaid<strong>the</strong> Codes Office feels that since <strong>the</strong> Communi-ously held <strong>the</strong> title. Hety Development Office deals more directly with <strong>the</strong> fair housing issue <strong>the</strong>position would <strong>be</strong> <strong>be</strong>tter served by <strong>the</strong> Community Development Direc<strong>to</strong>r.C. D. Direc<strong>to</strong>r Zakrevsky said <strong>the</strong> position would entail posting noticesabout <strong>the</strong> Fair Housing Law in public areas and receiving complaints whichwould <strong>be</strong> forwarded <strong>to</strong> HUD. Ald. Horovitz questioned whe<strong>the</strong>r <strong>the</strong> work would<strong>be</strong> <strong>be</strong>tter handled by Codes due <strong>to</strong> <strong>the</strong> existing workload of <strong>the</strong> Community

Mr. Zakrevsky said his office already performs <strong>the</strong>functions and is responsible <strong>to</strong> HUD for such functions.RESOLUTION # 26 - 1989. ADOPTING DRUG - FREE WORKPLACE CERTIFICATIONPROVISIONSAld. Guinn introduced <strong>the</strong> following and movedits adoption:1WHEREAS, Congress has adopted as part of omnibus' drug legislation, <strong>the</strong>Drug -Free Workplace Act of 1988, requiring grantees ofcertify that <strong>the</strong>y <strong>will</strong> provide drug -free workplaces; andfederal agencies <strong>to</strong>from aWHEREAS, such certification is a precondition for receiving a grantfederal agency; andWHEREAS, <strong>the</strong> City of Norwich has a grant pending <strong>be</strong>fore <strong>the</strong> federalDepartment of Housing and Urban Development for a Small Cities CommunityDevelopment Block Grant; andWHEREAS, H. U. D. has notified <strong>the</strong> City that it must provide such certifi-cation immediately in order <strong>to</strong> <strong>be</strong> considered for Small Cities funding review;now, <strong>the</strong>refore <strong>be</strong> itRESOLVED, that <strong>the</strong> Mayor <strong>be</strong> and hereby is authorized and directed <strong>to</strong>sign such certification as may <strong>be</strong> required by <strong>the</strong> federal government as itrelates <strong>to</strong> a drug -free workplace and <strong>to</strong> take such actions as may <strong>be</strong> necessary<strong>to</strong> implement <strong>the</strong> provisions of such certification.Seconded by Ald. Horovitz and duly adopted, ayes all.1Prior <strong>to</strong> <strong>the</strong> vote, Mayor Jones noted that a bill was passed by Congresson Novem<strong>be</strong>r 18, 1988, requiring certification that municipalities <strong>will</strong> providea drug -free workplace. He noted if <strong>the</strong> certification is not filedimmediately, HUD <strong>will</strong> not consider <strong>the</strong> Small Cities grant application submittedlast week. He said notice of <strong>the</strong> needed certification had <strong>be</strong>en receivedthat day.Ald. Carpenter moved <strong>to</strong> receive Local Law No.1 of 1989, and set apublic hearing for May 9, 1989 at 7: 00 p. m. Seconded by Ald. Guinn andduly adopted, ayes all.LOCAL LAW NO. 1OF 1989A LOCAL LAW TO MERGE THE BOARD OF WATER COMMISSIONERS ANDTHE WASTE WATER TREATMENT COMMISSIONBE IT ENACTED by <strong>the</strong> Common Council of <strong>the</strong> City of Norwich,as follows:NewYork,Section 1. Title VI of <strong>the</strong> Charter of <strong>the</strong> City of Norwich <strong>be</strong> andhereby is amended asfollows:Title VIBoard of Water CommissionersSection 130.Appointments.There shall <strong>be</strong> a Board of Water Commissioners <strong>to</strong> consist of<strong>the</strong> nine mem<strong>be</strong>rs of <strong>the</strong> Board of Water Commissioners and <strong>the</strong>Waste Water Treatment Commission in office on May 1,1989, whoshall <strong>be</strong> continued for <strong>the</strong> duration of <strong>the</strong>ir terms, two of whichshall expire on Decem<strong>be</strong>r 31 in <strong>the</strong> years 1989,1990, 1991, and1993, and one of which shall expire on Decem<strong>be</strong>r 31,1992. Thereaf-ter, each mem<strong>be</strong>r shall <strong>be</strong> appointed by <strong>the</strong> Mayor, with approval of


4545five mem<strong>be</strong>rs; <strong>the</strong><strong>the</strong> Common Council, for a term of five years {appointments <strong>to</strong> said Board are <strong>to</strong> <strong>be</strong> made by <strong>the</strong> Mayor with approv-al of Common Council; <strong>the</strong> five ( 5) mem<strong>be</strong>rs first appointed shallserve for terms of one, two, three, four and five years respectively,and <strong>the</strong>ir successors shall <strong>be</strong> appointed for terms of fiveyears. Nothing herein contained shall affect <strong>the</strong> terms of <strong>the</strong>mem<strong>be</strong>rs of <strong>the</strong> present and existing Board }.Section 131.Vacancies and removal.In case of a vacancy from any cause whatsoever,Allshall fill <strong>the</strong> vacancy by appointment for <strong>the</strong> unexpired term.Commissioners shall continue <strong>to</strong> serve until <strong>the</strong>ir successors areappointed and have qualified.<strong>the</strong>MayorNo mem<strong>be</strong>r of such Board shall <strong>be</strong> removed except for incompetencyor misconduct shown at a public hearing <strong>be</strong>fore <strong>the</strong> Mayor of<strong>the</strong> city {,} and Common Council, upon due notice and upon statedcharges.Mem<strong>be</strong>rs of <strong>the</strong> Board shall serve without compensation,shall <strong>be</strong> entitled <strong>to</strong> reimbursement, payable from <strong>the</strong> operation andmaintenance account, for <strong>the</strong>ir actual and necessary expenses incurredin <strong>the</strong> performance of <strong>the</strong>ir official duties.butSection 132.Duties of Board.It shall <strong>be</strong> <strong>the</strong> duty of <strong>the</strong> Board <strong>to</strong> proceed as efficientlyas possible in <strong>the</strong> management, operation,maintenance and repairof and in <strong>the</strong> construction of improvements and <strong>be</strong>tterments of andSuch waterextensions <strong>to</strong> <strong>the</strong> water system of <strong>the</strong> City of Norwich.system shall include { included <strong>the</strong>} water supply, treatmentand distribution { system }, sanitary sewers, and wastewater treatmentfacilities and operations, as <strong>the</strong> same may <strong>be</strong> hereafterimproved, <strong>be</strong>ttered and extended. The Board shall perform <strong>the</strong>duties assumed by <strong>the</strong> City of Norwich in <strong>the</strong> bond resolution authorizing<strong>the</strong> financing of <strong>the</strong> acquisition of <strong>the</strong> water systemrelative <strong>to</strong> <strong>the</strong> establishment and maintenance of <strong>the</strong> several fundsand accounts, and shall have control,care and management of <strong>the</strong>water and sewer { system revenue} funds, <strong>the</strong> public lands,dams, reservoirs, filter plants, rights -of -way,watercourses,drainage areas contribu<strong>to</strong>ry <strong>the</strong>re<strong>to</strong> and all things and mattersappurtenant <strong>to</strong> <strong>the</strong> { water} system. In addition <strong>to</strong> <strong>the</strong> powers andduties which are hereby set forth, <strong>the</strong> Board shall have such o<strong>the</strong>rand fur<strong>the</strong>r powers as may <strong>be</strong> requisite <strong>to</strong> <strong>the</strong> efficient performanceof <strong>the</strong> duties imposed hereunder. The Board shall have powerand<strong>to</strong> appoint from its mem<strong>be</strong>rs a Chairman and a Vice - Chairman,a Secretary {,} who may or may not <strong>be</strong> a mem<strong>be</strong>r of <strong>the</strong> Board, and <strong>to</strong>appoint such administra<strong>to</strong>rs, engineers and o<strong>the</strong>r assistants andemployees, whose reasonable compensation shall <strong>be</strong> determined andfixed by <strong>the</strong> Board subject <strong>to</strong> approval by <strong>the</strong> Common Council.1CityThe Board may adopt a common seal, <strong>be</strong>aring <strong>the</strong> legend "of Norwich, Board of Water Commissioners and use <strong>the</strong> same forau<strong>the</strong>ntication of its officialacts.All contracts and o<strong>the</strong>rpapers <strong>to</strong> <strong>be</strong> executed pursuant <strong>to</strong> resolution adopted by <strong>the</strong> Board,involving <strong>the</strong> expenditures of twenty -five hundred dollars or lessmay <strong>be</strong> executed in <strong>the</strong> name of <strong>the</strong> City of Norwich Board of WaterCommissioners, and under <strong>the</strong> seal of <strong>the</strong> Board and attested by <strong>the</strong>signature of its Chairman and Secretary. Notwithstanding <strong>the</strong>law, <strong>the</strong> Board, inprovisions of any general, special or localcases of emergency, may expend or contract <strong>to</strong> expend <strong>the</strong> moneysAll contracts shall <strong>be</strong>necessary for such emergency purposes.payable primarily out of <strong>the</strong> revenues of <strong>the</strong> { water} system, whichsystem shall at all times <strong>be</strong> and always remain self - supporting asprovided by <strong>the</strong> General Municipal Law in relation <strong>to</strong> <strong>the</strong> fixingand collection of rates, fees, <strong>to</strong>lls and service charges and pay-ment of bonds and interest.


6455'All resolutions of <strong>the</strong> Board shall require, for <strong>the</strong>ir adop-tion, <strong>the</strong> favorable votes of at least a majority of <strong>the</strong> mem<strong>be</strong>rsof <strong>the</strong> Board.Section 133 { 142 }. Policy of <strong>the</strong> Board.The Board shall keep <strong>the</strong> { city water} system at all timesself- supporting and it shall <strong>be</strong> managed in <strong>the</strong> most efficientmanner consistent with sound economy and public advantages, <strong>to</strong> <strong>the</strong>end that <strong>the</strong> services of <strong>the</strong> system shall <strong>be</strong> furnished at <strong>the</strong>lowest possible cost ra<strong>the</strong>r than a source of revenue <strong>to</strong> <strong>the</strong> city,and such { water} system shall <strong>be</strong> operated for <strong>the</strong> use and <strong>be</strong>nefi<strong>to</strong>f those served by it and for <strong>the</strong> promotion of <strong>the</strong> welfare and<strong>the</strong> improvement of <strong>the</strong> health, safety, comfort and convenience of<strong>the</strong> inhabitants of <strong>the</strong> city.forSection 134 { 133 }. Treasurer of <strong>the</strong> Board -- duties.1The City Cham<strong>be</strong>rlain of <strong>the</strong> City of Norwich shall act as <strong>the</strong>Treasurer of <strong>the</strong> Board and shall deposit in { a} bank { account or)accounts, entitled " Water { System Revenue} Fund " {,} and " SewerFund ", such funds <strong>to</strong> <strong>be</strong> separate from any o<strong>the</strong>r accounts of <strong>the</strong>city, all moneys received from rents, rates, fees and o<strong>the</strong>rcharg-es of <strong>the</strong> { water} system, and shall not commingle such moneys witho<strong>the</strong>r moneys or funds of <strong>the</strong> city. He shall keep separate booksof account of all such moneys of <strong>the</strong> { water} system and of expenditures<strong>the</strong>refrom. The Board may delegate <strong>to</strong> him <strong>the</strong> duty of colwater}syslectingrents, rates, fees and o<strong>the</strong>r charges of <strong>the</strong> {tem. Because of <strong>the</strong> additional duties imposed upon him with relation<strong>to</strong> <strong>the</strong> { water} system, compensation may <strong>be</strong> paid him and <strong>the</strong>employees of his office in such amount as <strong>the</strong> Board shall determine<strong>to</strong> <strong>be</strong> reasonable. Such compensation shall <strong>be</strong> in addition <strong>to</strong><strong>the</strong> compensation received by him or by <strong>the</strong> employees of his officefor o<strong>the</strong>r duties here<strong>to</strong>fore performed for <strong>the</strong> city.Section 135 { 134}. Budget.On or <strong>be</strong>fore <strong>the</strong> first day of Oc<strong>to</strong><strong>be</strong>r in each fiscal year,<strong>the</strong> Board shall adopt and submit <strong>to</strong> <strong>the</strong> Common Council { a} budgets{,}entitled " Annual Budgets of Water System ". Such budgetsshall include separately for both <strong>the</strong> Water Fund and <strong>the</strong>Sewer Fund ( a) a budget message explaining briefly <strong>the</strong> operationof <strong>the</strong> { water} system, and setting forth <strong>the</strong> improvements, <strong>be</strong>ttermentsand extensions of <strong>the</strong> { water} system which <strong>the</strong> Board <strong>be</strong>lievesshould <strong>be</strong> constructed within <strong>the</strong> next five fiscal years,b) a statement of <strong>the</strong> moneys estimated <strong>to</strong> <strong>be</strong> received during <strong>the</strong>ensuing fiscal year from rents, rates, fees and o<strong>the</strong>r charges of<strong>the</strong> { water} system ( hereinafter referred <strong>to</strong> as " Revenues ") andc) a statement of proposed expenditures itemized under <strong>the</strong> headings" Operating Reserve Account ", {and} " Bond and Interest Ac-count," " Operation and Maintenance Account," and " Bond RetirementAccount." Under <strong>the</strong> four ( 4) proposed headings of expenditures,provision shall <strong>be</strong> made for <strong>the</strong> setting aside of such moneys in<strong>the</strong> respective accounts as shall <strong>be</strong> required by <strong>the</strong> bond resolution.Under <strong>the</strong> expenditure heading " Operating Reserve Account"shall appear an explanation of <strong>the</strong> amount which <strong>the</strong> Board estimates<strong>to</strong> <strong>be</strong> necessary for <strong>the</strong> construction of improvements or<strong>be</strong>tterments or extensions expected <strong>to</strong> <strong>be</strong> made during <strong>the</strong> ensuingfiscal year and under <strong>the</strong> heading " Bond Retirement Account" <strong>the</strong>reshall appear a statement of <strong>the</strong> principal amount of outstandingwater system} bonds which <strong>the</strong> Board recommends should <strong>be</strong> purchasedor redeemed by <strong>the</strong> city during <strong>the</strong> ensuing fiscal year.The above provisions shall <strong>be</strong> construed <strong>to</strong> state <strong>the</strong> minimum requirementsand <strong>the</strong> Board may include such fur<strong>the</strong>r itemization andexplanations as it may deem advisable. The Common Council may notvary <strong>the</strong> titles, headings of expenditure or conditions of administrationspecified in <strong>the</strong> budget and shall in no event reduce <strong>the</strong>provision required by any and all bond resolutions for <strong>the</strong> Bondand Interest Account. Before reducing any item of proposed expen-


456 7diture, <strong>the</strong> Common Council shall cause <strong>to</strong> <strong>be</strong> published in <strong>the</strong>official newspaper a notice setting forth <strong>the</strong> nature of <strong>the</strong> proposedchanges and fixing a place and time, not less than five daysafter publication, at which <strong>the</strong> Common Council <strong>will</strong> hold a pub-lic hearing <strong>the</strong>reon.The annual budget shall <strong>be</strong> adopted by <strong>the</strong> favorable votes ofTheat least a majority of all <strong>the</strong> mem<strong>be</strong>rs of <strong>the</strong> Common Council.annual budget shall <strong>be</strong> finally adopted not later than <strong>the</strong> fourthday prior <strong>to</strong> <strong>the</strong> <strong>be</strong>ginning of <strong>the</strong> fiscal year and should <strong>the</strong> CommonCouncil take no final action on or prior <strong>to</strong> such day,<strong>the</strong>budget, as submitted by <strong>the</strong> Board, shall <strong>be</strong> deemed <strong>to</strong> have <strong>be</strong>enUpon final adoption, <strong>the</strong>finally adopted by <strong>the</strong> Common Council.Aannual budget shall <strong>be</strong> in effect for <strong>the</strong> ensuing fiscal year.copy of each annual budget, as finally adopted, shall <strong>be</strong> certifiedby <strong>the</strong> City Clerk and filed in <strong>the</strong> office of <strong>the</strong> City Cham<strong>be</strong>r<strong>the</strong>severallain. From <strong>the</strong> effective date of <strong>the</strong> annual budget,amounts stated <strong>the</strong>rein under <strong>the</strong> respective headings of expenditure{,}shall <strong>be</strong> and <strong>be</strong>come appropriated <strong>to</strong> <strong>the</strong> several objectsand purposes <strong>the</strong>rein named. As and when moneys <strong>be</strong>come available<strong>the</strong>refor, <strong>the</strong> Board shall provide for <strong>the</strong> allocation of moneys in<strong>the</strong> respective accounts of <strong>the</strong> { water} system.<strong>the</strong> Secretary, or o<strong>the</strong>r mem<strong>be</strong>r of <strong>the</strong> Board so designated,TheChairman andshallapprove in writing vouchers for all reasonable and necessary expenditures.The City Cham<strong>be</strong>rlain shall make payments from <strong>the</strong> respectiveaccounts in accordance with such allocations and vouchers.No moneys shall <strong>be</strong> drawn out of <strong>the</strong> water or sewer { supply revenue}funds except on checks signed by <strong>the</strong> City Cham<strong>be</strong>rlain.1Section 136 { 135 }. Audit report.Withinsixty days after <strong>the</strong> end of each fiscal year, an inde-water} systempendent audit of <strong>the</strong> moneys and accounts of <strong>the</strong> {The writtenshall <strong>be</strong> made by a committee designated by <strong>the</strong> Board.report of such audit shall <strong>be</strong> submitted by <strong>the</strong> Board <strong>to</strong> <strong>the</strong> CommonCouncil.Section 137 { 136 }. Payment in lieu of property taxes.In order that <strong>the</strong> { water} system shall <strong>be</strong> at all times self -system} revenuesupporting, <strong>the</strong> city shall pay in<strong>to</strong> <strong>the</strong> water {fund <strong>the</strong> fair and reasonable cost of water supplied by <strong>the</strong> { water}system for public buildings and o<strong>the</strong>r public uses in accordancewith rentals or rates fairly equivalent <strong>to</strong> rentals or ratescharged for water, comparable <strong>to</strong> private users.There shall <strong>be</strong>charged <strong>to</strong> <strong>the</strong> revenues of <strong>the</strong> { water} system and <strong>the</strong>re shall <strong>be</strong>paid <strong>to</strong> <strong>the</strong> city from <strong>the</strong> Operating Reserve Account of such system,an amount equal <strong>to</strong> <strong>the</strong> property taxes which would <strong>be</strong> payable<strong>to</strong> <strong>the</strong> city in such fiscal year from a privately owned water system;such payment shall <strong>be</strong> made annually if <strong>the</strong> revenues of <strong>the</strong>water} system <strong>be</strong> sufficient and shall <strong>be</strong> designated Payment inLieu of Property Taxes.Section 138 { 137 }. At<strong>to</strong>rney for Board.The City At<strong>to</strong>rney of <strong>the</strong> City of Norwich shall <strong>be</strong> <strong>the</strong> at<strong>to</strong>rneyat law for, and legal advisor of <strong>the</strong> Board, and shall upon itsrequest, ei<strong>the</strong>r personally or through such assistants as he maydesignate, furnish it with advice, in a similar manner <strong>to</strong> thatrequired of him with relation <strong>to</strong> o<strong>the</strong>r departments or boards of<strong>the</strong> City of Norwich, but this shall not limit <strong>the</strong> Board in retainingo<strong>the</strong>r counsel in a particular matter, if in <strong>the</strong> judgmen<strong>to</strong>f <strong>the</strong> Board, circumstances warrant.In view of <strong>the</strong> additional du-comtieswhich may <strong>be</strong> thus imposed upon <strong>the</strong> Corporation Counsel,pensation may <strong>be</strong> paid <strong>to</strong> <strong>the</strong> Corporation Counsel or mem<strong>be</strong>rs of hisstaff in such amount as <strong>the</strong> Board may deemreasonable, such compen-sation <strong>to</strong> <strong>be</strong> in addition <strong>to</strong> any amounts received from <strong>the</strong> city foro<strong>the</strong>r work.


8457Section 139 { 138 }. Collection of rates, rentals and fees.In accordance with <strong>the</strong> provisions of <strong>the</strong> General MunicipalLaw, and <strong>the</strong> provisions of any bond resolution passed by <strong>the</strong> Com-mon Council, <strong>the</strong> Common Council shall prescri<strong>be</strong> and collect reasonablerates, rentals, fees or o<strong>the</strong>r charges for <strong>the</strong> supply of waterand for disposal of wastewater, including water supplied <strong>the</strong>city for fire protection and for public buildings and o<strong>the</strong>ruses and shall revise such rates, rentals,from time <strong>to</strong> time whenever necessary so that <strong>the</strong> {shall<strong>be</strong> and always remain self - supporting.publicfees or o<strong>the</strong>r chargeswater}systemSuch water and waste-water rates, rentals, fees and o<strong>the</strong>r charges shall <strong>be</strong> recommendedby <strong>the</strong> Board of Water Commissioners and shall <strong>be</strong> adopted by <strong>the</strong>Common Council by ordinance, which ordinance may also provide <strong>the</strong>terms and conditions of payment.The Board shall cause { cuase} all { water} rents and fees<strong>to</strong> <strong>be</strong> collected and shall prepare, or cause {,} <strong>to</strong> <strong>be</strong> prepared, alist or roll containing <strong>the</strong> name of each person, company, corpora-tion or association owning lots or buildings, indebted or <strong>to</strong> <strong>be</strong>-orcome indebted <strong>to</strong> said city for <strong>the</strong> use of water, water meters, {for} sewer services or o<strong>the</strong>r fees or charges { <strong>to</strong> <strong>be</strong> known aswater rents,} accrued or chargeable upon each lot, part of lot orbuilding.The City Cham<strong>be</strong>rlain is empowered <strong>to</strong> collect all unpaid chargesin <strong>the</strong> same manner, upon <strong>the</strong> same notice, by <strong>the</strong> same proceedings,with <strong>the</strong> same powers of sale for unpaid { water} rents andfees, under <strong>the</strong> same penalties, subject <strong>to</strong> <strong>the</strong> same fees andinterest, and having <strong>the</strong> same lien upon <strong>the</strong> property, as <strong>the</strong> gener-al city taxes.Such { water} rents and fees shall <strong>be</strong> a lien on <strong>the</strong> realproperty upon which <strong>the</strong> water is used or at which wastewater isdisposed and such liens shall <strong>be</strong> a continuing lien upon <strong>the</strong> propertyin which <strong>the</strong> water is used or at which wastewater is dis-posed.The Common Council may adopt o<strong>the</strong>r ordinances, not inconsistentwith <strong>the</strong> law and with this Act, for <strong>the</strong> enforcement of <strong>the</strong>collection of { water} rent {al }s and fees and relating <strong>to</strong> <strong>the</strong> useof <strong>the</strong> water and sewer, and may enforce observance <strong>the</strong>reof bycutting off <strong>the</strong> supply of water or by <strong>the</strong> imposition of penalties.Section 140 { 139}. Sale of services { water} outside ofcity limits.The Board, with approval of <strong>the</strong> Common Council, may contractwith and sell <strong>to</strong> any person, firm or corporation without <strong>the</strong> limitsof said city, right <strong>to</strong> make connection with <strong>the</strong> water distribution{g} or <strong>the</strong> sewer mains { pipes} of said city for <strong>the</strong>purpose of drawing water <strong>the</strong>refrom and for <strong>the</strong> supply of sewagesystem services, at such prices and on such conditions as <strong>the</strong>Board shall determine.Section 141 { 140 }. Amended or supplemental budget.The Board may at any time adopt and submit <strong>to</strong> <strong>the</strong> CommonCouncil, and <strong>the</strong> Common Council may adopt as submitted, an amendedor supplemental annual budget for <strong>the</strong> remainder of <strong>the</strong> <strong>the</strong>n currentfiscal year. Such supplemental budget may increase or decrease<strong>the</strong> estimate of revenues and <strong>the</strong> amount <strong>to</strong> <strong>be</strong> paid in<strong>to</strong> <strong>the</strong>Operation and Maintenance Account and may increase or decrease <strong>the</strong>principal amount of callable bonds <strong>to</strong> <strong>be</strong> purchased or redeemedduring <strong>the</strong> remainder of <strong>the</strong> <strong>the</strong>n current fiscal year.Section 142 { 141 }. Payment of existing bonds.
