Majorproposals are made in relation to arrangements for dealing with Standardsissues. Other significant proposals include proposed changes to therecording of member votes and increases in the contract procurement tenderaward thresholds. A number of consequential corrective and “tidy up”amendments are also proposed.
1 BACKGROUND1.1 Part 2 Article 1.3 of the Constitution requires the Authority to conductan annual review of the operation of the Constitution and Article 14requires the Monitoring Officer to assist in that process by submittingproposals for consideration by the Authority. This report sets out anumber of proposed changes.2 GENERAL REVIEW ISSUES2.1 Appendix 1 sets out proposals for changes to various provisions of theConstitution which are recommended in order to improve theiroperation, correct errors and make additional adjustmentsconsequential upon any changes proposed in Appendix 2. Amongstthe more significant changes are proposed changes to the recording ofvotes by Members, increases in the contract procurement tender awardprocedure financial thresholds and a new delegated power to CX/CFOto enter into non-statutory / non-binding mutual support arrangements.3 STANDARDS ISSUES3.1 Major changes are proposed in Appendix 2 consequent upon theGovernment decision to revoke the highly prescriptive LocalGovernment Act 2000 statutory scheme requirements and to replacethem with a less prescriptive scheme with limited sanctions. Theproposals in Appendix 2 which are being made, following detailedconsideration and recommendation by both the Standards Committeeand the Executive Committee, include the proposed disestablishmentof a dedicated Standards Committee and the vesting of Standardsissue matters within the remit of the Executive Committee and theadoption of a revised Members Code of Practice and procedure forinvestigating complaints. The necessary secondary legislation toimplement the new arrangements for dealing with standards issueswith effect from 1 st July 2012 was made on 6 th June (SI No 1463/2012Commencement Order No 6). This Order implements the provisions ofthe Localism Act 2011 which repeals the mandatory requirement tomaintain a Standards Committee and changes the arrangements forinvestigating members and limits the sanction powers. A relatedstatutory instrument (Si No 1464/ 201) also brings in to force on1 st July 2012 the new “Disclosable Pecuniary Interests” requirementsunder which Members are required to notify the Monitoring Officer ofspecified interests to be recorded in a new Register of Interests.2 FINANCIAL IMPLICATIONSNone arising from this report
