This would alsobe deleted from the text of the draft Treaty if the wording was not agreed <strong>on</strong> by the end of theSpecial Sessi<strong>on</strong> of the SCCR.23. The representative of the World Blind Uni<strong>on</strong> (WBU) requested the possibility to hear anaudio of the discussi<strong>on</strong>s as they proceeded <strong>and</strong>, if possible, to see the text capti<strong>on</strong>ing if therewas a technical soluti<strong>on</strong> for that opti<strong>on</strong> <strong>and</strong> if delegati<strong>on</strong>s agreed to it. The WBU stated that itwas the organizati<strong>on</strong> that had originally asked for the Treaty <strong>and</strong> hence its interest in followingthe discussi<strong>on</strong>s was c<strong>on</strong>siderable. The representative of the WBU underscored that the text ofthe Treaty needed to be very clear, simple <strong>and</strong> effective as to serve the relevant beneficiaries.The proliferati<strong>on</strong> of clauses <strong>on</strong> things such as commercial availability, especially checking whatwas available in another country at a reas<strong>on</strong>able time <strong>and</strong> price across borders, raised c<strong>on</strong>cerns<strong>on</strong> how that could work in practice. The WBU did not c<strong>on</strong>sider that those clauses helped toachieve the aim of the Treaty, which was to ensure that a greater number of books <strong>and</strong>informati<strong>on</strong> were available to print disabled <strong>and</strong> blind people. Thus, the representative of theWBU urged delegati<strong>on</strong>s to make sure the Treaty was practical <strong>and</strong> worked for print disabled <strong>and</strong>blind people. The representative of the WBU also asked delegati<strong>on</strong>s to allow an element oftrust <strong>and</strong> flexibility when it came to the implementati<strong>on</strong> of the Treaty.24. The Chair clarified that it was not the intenti<strong>on</strong> to open a l<strong>on</strong>g discussi<strong>on</strong> <strong>on</strong> this issue,namely whether or not to allow observers access to the audio of the discussi<strong>on</strong>s taking place inan informal setting.25. The representative of Knowledge Ecology Internati<strong>on</strong>al (KEI) agreed that countries shouldbe able to freely float ideas without being identified as to who said what, but <strong>on</strong> the other h<strong>and</strong>,noted that it was also important to remember that observers needed to have freedom to reportthe character <strong>and</strong> the nature of the substantive issues discussed in the SCCR to those whowere interested in the discussi<strong>on</strong> but could not be present at the meeting.26. The Vice-Chair pointed out that regi<strong>on</strong>al coordinators had agreed to follow the same rulesas had been followed during the Intergovernmental <str<strong>on</strong>g>Committee</str<strong>on</strong>g> (IGC) <strong>on</strong> the issue of audio feedaccess. Expert groups met for informal negotiati<strong>on</strong>s am<strong>on</strong>g Member States in Room B. For allother members <strong>and</strong> observers, there was an audio feed accessible in Room A. The rules alsoimplied that there was no possibility to disclose or re-distribute any informati<strong>on</strong> related to thediscussi<strong>on</strong>s, whether in general terms or by quoting specific individuals or delegati<strong>on</strong>s. Theinformati<strong>on</strong> would not be publicly available. It was noted that sometimes delegati<strong>on</strong>s weretrying to find compromises <strong>and</strong> therefore were not necessarily expressing cleared positi<strong>on</strong>s. Ifeverything was public, this could potentially restrict delegati<strong>on</strong>s from being creative <strong>and</strong>c<strong>on</strong>structive in that informal setting. No fundamentally opposed reacti<strong>on</strong> was received inresp<strong>on</strong>se. It was decided that the SCCR would follow that rule. The Chair stressed again thatthe integrity <strong>and</strong> the informality of the SCCR negotiati<strong>on</strong>s should be respected <strong>and</strong> maintained.27. The Vice-Chair asked the <strong>WIPO</strong> Secretariat to brief the SCCR <strong>on</strong> the major achievements<strong>and</strong> outcomes of the informal negotiati<strong>on</strong>s regarding the draft Treaty.28. The <strong>WIPO</strong> Secretariat said that unfortunately, at that point, there was no a c<strong>on</strong>sensus textto present to the plenary. Work would c<strong>on</strong>tinue <strong>and</strong> it hoped something positive would come outfor the following day. With respect to the informal discussi<strong>on</strong>s, there was a proposal to addressthe situati<strong>on</strong> in which a particular country that joined the Treaty might not actually be a memberof the Berne C<strong>on</strong>venti<strong>on</strong> or TRIPS or the WCT <strong>and</strong> might not have in its nati<strong>on</strong>al law a provisi<strong>on</strong><strong>on</strong> making available <strong>and</strong> distributi<strong>on</strong> that would address the situati<strong>on</strong> where imported accessibleformat copies were being re-distributed in that country. There was a general agreement thatsuch a situati<strong>on</strong> was probably not going to be addressed in the importati<strong>on</strong> of accessible formatcopies provisi<strong>on</strong>, but that a small group would talk further about the issue. It was agreed thatsuch a situati<strong>on</strong> was narrow, but <strong>on</strong>e that could be addressed. The small group had not yet metto work <strong>on</strong> text of the Treaty that might address that particular situati<strong>on</strong>. Some Member Statesdid articulate that perhaps the Treaty provisi<strong>on</strong>s already addressed such a situati<strong>on</strong> by limitingthe distributi<strong>on</strong> of accessible format copies to beneficiary pers<strong>on</strong>s as defined in the Treaty.
