Cost of Tender Documents: Tender fee of Rs. 1,000/- is to be remitted along withthe techno-commercial bid in the form of a crossed Bank Draft favoring “ElectronicsCorporation of India Limited” from a nationalized bank payable at Hyderabad. The cost oftender document is non- refundable.Earnest Money Deposit (EMD): Earnest money deposit of Rs. 2,00,000/- shall besubmitted along with the techno-commercial bid in the form of a Demand Draft favoring“Electronics Corporation of India Limited” or a Bank Guarantee valid for a period of sixmonths drawn from a nationalized bank payable at Hyderabad. The EMD deposited byunsuccessful bidders will be refunded without interest after finalization of the order. TheEMD of the successful bidder will be appropriated towards Security Deposit. The bids willnot be considered in the absence of payment towards the cost of tender documents andEMD.Security Deposit (SD): The successful bidder will be required to remit a SecurityDeposit equivalent to 10% of the Purchase Order value exclusive of taxes and duties etc.after adjusting the EMD amount already remitted. GENERAL TERMS AND CONDITIONSThis tender and any order resulting from this tender shall be governed by the followingterms and conditions of contract and the supplier quoting against this tender shall bedeemed to have read and understood the same. In case counter terms & conditions ofbusiness have been offered by the supplier, ECIL shall not be deemed to be governedby those unless specific written acceptance thereof has been obtained from ECIL.1. Terms of Prices: Quotations shall be submitted on FOR Hyderabad or FORdestination basis including transit insurance. Incase of Ex-works / Ex-godown /FOR dispatching station the approximate packing, forwarding and freight shall beindicated by the supplier. Hyderabad suppliers shall arrange free delivery at ourstores.2. Validity of quote: The quotation shall remain valid for a minimum period of 90days from tender opening date.3. Performance Bank Guarantee: Vendor shall submit a Performance BankGuarantee for 10% of purchase order value covering standard warranty period of 2years from the date of acceptance of goods by ECIL.4. Payment terms: Payment will be made with in 60 days from the date of acceptanceof goods on pro-rata basis by ECIL.5. Insurance: The supplier shall insure goods for all transit risks if the payment termis FOR Hyderabad or FOR destination unless otherwise stated specifically by thesupplier in their quotation. The insurance of goods against payment term Ex-workswill be arranged by ECIL.6. Liquidated Damages: Delivery time is the essence of the contract. In the event ofany delay in supply beyond the agreed delivery schedule, liquidated damages willbe recovered @ 0.5% per week of delay or part thereof subject to a maximum of10% of the value of the order.7. Force Majeure: If the execution of the purchase order is delayed beyond theperiod stipulated in the purchase order as a result of outbreak of hostilities,declaration of an embargo or blockage or fire, flood, acts of nature or any othercontingency beyond the supplier’s control due to act of God, then ECIL may allowsuch additional time by extending the delivery period as justified by thecircumstances of the case and its decision in this regard shall be final. Power failurewill not be considered as a Force Majeure condition.3

8. Risk purchase: In case of failure to deliver the goods within the delivery datestipulated in the purchase order unless prior extension of delivery period isobtained, ECIL will be at liberty to obtain such items as necessary from othersource and / or cancel the order and in either case ECIL reserves the right to recoverfrom the supplier the additional amount spent plus 10% to cover incidentalexpenses.9. Dispute Resolution: Any dispute arising out of purchase order or interpretation ofany clause or terms and conditions hereof shall be settled through conciliation byboth ECIL and the supplier, under the specific provisions of Arbitration andConciliation Act 1996. Only courts in Ranga Reddy District, State of AndhraPradesh, India, have exclusive jurisdiction over this order.10. Right to Reject: The purchaser reserves the right to reject any or all offers whollyor in part with out assigning any reason.11. Short Closure: ECIL has the right to short close the tender even after evaluatingthe quotations without assigning any reason.12. Bank details: The supplier shall give along with the quotation name of theirBanker, Bank Account Number and also Income Tax Permanent Account Number(PAN).13. Jurisdiction: All disputes arising in connection with executing the purchase orderwill be subject to jurisdiction of the Courts in Hyderabad and Secunderabad only.4

Criteria for acceptance of tenders1. Technical Specifications: Vendor shall comply with the technical specificationsgiven in the technical document. Experience: Vendor shall provide details with documentary evidence theexperience in manufacturing & supply of EMI/EMC complied Personal RuggedWorkstations to MOD Projects --- Complied / Not complied3. Service Center: Details of service center locations / Engineers working.4. Facilities: Details of factory, assembly and testing facility.5. Warranty: 2-year free warranty to be provided against all manufacturing defectsfor the supplied goods -----Complied / Not complied6. PRCs shall be EMI/EMC complied as per the 461 C test CE01, CE03, CS01, CS02, CS 06, RE 02, and RS 03. Status of EMI/EMC compliance will be the majorcriteria of technical qualification. Certification from a reputed Indian Laboratoryshall be submitted for a PRC. 3 rd party certification is not considered.7. PRCs shall comply environment specifications as per details given in the tenderdocument.8. The commercial offer of vendor who satisfies the above technical requirement onlywill be opened. Offers from Indian vendors only will be considered.9. Warranty: 2-year warranty and extended warranty is to be provided at ECIL,Hyderabad. Engineers of vendor need not visit our sites. ECIL site engineers willresolve minor defects. The used spares are to be replenished by the supplier.Extended Warranty of 3 years is to be offered on the same terms.10. The Vendor has to reconfirm the EMI/EMC and environmental specifications byconducting these tests on sample unit in the ordered configuration.11. The Supplier shall indicate quality system procedures followed duringmanufacturing & testing to ensure confirmation of product quality to relevantstandard.12. The supplier shall prepare an Acceptance Test Procedure (ATP), and obtainclearance from the Buyer before offering for inspection.13. The End User and Buyer will carry out inspection at suppliers end beforeacceptance of the item as per the ATP.14. Mechanical and interfacing diagram: Design & Engineering of the PRC shallmeet Technical, EMI/EMC and Environmental specifications. No further schematic5

manufacturing drawings will be provided by ECIL.15. Quality systems & procedures: The Supplier shall provide quality systemprocedures followed during manufacturing & testing to ensure confirmation ofproduct quality to relevant standards16. Inspection: ECIL engineers along with user representatives will carry out stagewise inspection at supplier’s premises ---- Acceptable / Not Acceptable.17. Acceptance of tenders: No tender will be accepted after due date. ECIL will not beresponsible for postal / courier delay or lost in transit if any.Note: Vendor shall provide documentary proof to prove his adherence to the qualifyingcriteria where ever necessary. Claims without support documents will not be considered.6
