Concerned by the tragic conflict and cont<strong>in</strong>u<strong>in</strong>gbloodshed <strong>in</strong> Cambodia, the Paris Conference on Cambodia wasconvened, at the <strong>in</strong>vitation of the Government of the FrenchRepublic, <strong>in</strong> order to achieve an <strong>in</strong>ternationally guaranteedcomprehensive settlement which would restore peace to thatcountry. The Conference was held <strong>in</strong> two sessions, the firstfrom 30 July to 30 August 1989, and the second from 21 to 23October 1991.2. The Co-Presidents of the Conference were H. E.Mr. Roland DUMAS, M<strong>in</strong>ister for Foreign Affairs of the FrenchRepublic, and H. E. Mr. Ali ALATAS, M<strong>in</strong>ister for ForeignAffairs of the Republic of Indonesia.3. The follow<strong>in</strong>g States participated <strong>in</strong> the Conference :Australia, Brunei Darussalam, Cambodia, Canada, the People'sRepublic of Ch<strong>in</strong>a, the French Republic, the Republic of India,the Republic of Indonesia, Japan, the Lao People's DemocraticRepublic, Malaysia, the Republic of the Philipp<strong>in</strong>es, theRepublic of S<strong>in</strong>gapore, the K<strong>in</strong>gdom of Thailand, the Union ofSoviet Socialist Republics, the United K<strong>in</strong>gdom of Great Brita<strong>in</strong>and Northern Ireland, the United States of America and theSocialist Republic of Vietnam.In addition, the Non-Aligned Movement was represented atthe Conference by its current Chairman at each session, namelyZimbabwe at the first session and Yugoslavia at the secondsession.4. The Conference organized itself <strong>in</strong>to three work<strong>in</strong>gcommittees of the whole, which met throughout the first sessionof the Conference. The Ad HocCommittee held several meet<strong>in</strong>gs dur<strong>in</strong>g the first session of theConference.The Coord<strong>in</strong>ation Committee of the Conference, chaired bythe representatives of the two Co-Presidents, was establishedand given responsibility for general coord<strong>in</strong>ation of the workof the other four committees. The Coord<strong>in</strong>ation Committee met atboth the first and second sessions of the Conference. An<strong>in</strong>formal meet<strong>in</strong>g of the Coord<strong>in</strong>ation Committee was also held <strong>in</strong>New York on 21 September 1991.7. At the conclusion of the first session, theConference had achieved progress <strong>in</strong> elaborat<strong>in</strong>g a wide varietyof elements necessary for the achievement of a comprehensivesettlement of the conflict <strong>in</strong> Cambodia. The Conference noted,however, that it was not yet possible to achieve acomprehensive settlement. It was therefore decided to suspendthe Conference on 30 August 1989. However, <strong>in</strong> do<strong>in</strong>g so, theConference urged all parties concerned to <strong>in</strong>tensify theirefforts to achieve a comprehensive settlement, and asked theCo-Presidents to lend their good offices to facilitate theseefforts.8. Follow<strong>in</strong>g the suspension of the first session of theConference, the Co-Presidents and the Secretary-General of theUnited Nations undertook extensive consultations, <strong>in</strong> particularwith the five permanent members of the United Nations SecurityCouncil, with the Supreme National Council of Cambodia, andwith other participants <strong>in</strong> the Paris Conference. The object ofthese consultations was to forge agreement on all aspects of asettlement, to ensure that all <strong>in</strong>itiatives to this end werecompatible and to enhance the prospects of end<strong>in</strong>g the bloodshed<strong>in</strong> Cambodia at the earliest possible date. The efforts of theCo-Presidents and the Secretary-General paved the way for thereconven<strong>in</strong>g of the Paris Conference on Cambodia.Vol. 1663, 1-28613

AGREEMENT ON A COMPREHENSIVE POLITICAL SETTLEMENT OFTHE CAMBODIA CONFLICT, with annexes on the mandate forUNTAC, military matters, elections, repatriation ofCambodian refugees and displaced persons, and thepr<strong>in</strong>ciples for a new Cambodian constitution;2. AGREEMENT CONCERNING THE SOVEREIGNTY, INDEPENDENCE,TERRITORIAL INTEGRITY AND INVIOLABILITY, NEUTRALITY ANDNATIONAL UNITY OF CAMBODIA; and3. DECLARATION ON THE REHABILITATION AND RECONSTRUCTIONOF CAMBODIA.These <strong>in</strong>struments represent an elaboration of the"Framework for a Comprehensive Political Settlement of theCambodia Conflict" adopted by the five permanent members of theUnited Nations Security Council on 28 August 1990,! and ofelements of the work accomplished at the first session of theConference. These <strong>in</strong>struments, which together form thecomprehensive settlement the achievement of which was theobjective of the Paris Conference, are be<strong>in</strong>g presented forsignature to the States participat<strong>in</strong>g <strong>in</strong> the Paris Conference.On behalf of Cambodia, the <strong>in</strong>struments will be signed by thetwelve members of the supreme National Council of Cambodia,which is the unique legitimate body and source of authorityenshr<strong>in</strong><strong>in</strong>g the sovereignty, <strong>in</strong>dependence and unity of Cambodia.12. The States participat<strong>in</strong>g <strong>in</strong> the Conference call uponthe Co-Presidents of the Conference to transmit an authenticcopy of the comprehensive political settlement <strong>in</strong>struments tothe Secretary-General of the United Nations. The Statesparticipat<strong>in</strong>g <strong>in</strong> the Conference request the Secretary-Generalto take the appropriate steps <strong>in</strong> order to enable considerationof the comprehensive settlement by the United Nations SecurityCouncil at the earliest opportunity. They pledge their full cooperation <strong>in</strong> the fulfilment of this comprehensive settlementand their assistance <strong>in</strong> its implementation.Above all, <strong>in</strong> view of the recent tragic history ofCambodia, the States participat<strong>in</strong>g <strong>in</strong> the Conference committhemselves to promote and encourage respect for and observanceof human rights and fundamental freedoms <strong>in</strong> Cambodia, asembodied <strong>in</strong> the relevant <strong>in</strong>ternational <strong>in</strong>struments to whichthey are party.13. The States participat<strong>in</strong>g <strong>in</strong> the Conference requestthe International Committee of the Red Cross to facilitate, <strong>in</strong>accordance with its pr<strong>in</strong>ciples, the release of prisoners of warand civilian <strong>in</strong>ternees. They express their read<strong>in</strong>ess to assistthe ICRC <strong>in</strong> this task.14. 1992 United Nations — Treaty Series • Nations Unies — Recueil des Traités________59(2) The Signatories further <strong>in</strong>vite the United NationsSecurity Council to provide UNTAC with the mandate set forth <strong>in</strong>this Agreement and to keep its implementation under cont<strong>in</strong>u<strong>in</strong>greview through periodic reports submitted by the Secretary-General.Section IIISupreme National CouncilArticle 3The Supreme National Council (here<strong>in</strong>after referred to as"the SNC") is the unique legitimate body and source ofauthority <strong>in</strong> which, throughout the transitional period, thesovereignty, <strong>in</strong>dependence and unity of Cambodia are enshr<strong>in</strong>ed.Article 4The members of the SNC shall be committed to the hold<strong>in</strong>gof free and fair elections organized and conducted by theUnited Nations as the basis for form<strong>in</strong>g a new and legitimateGovernment.Article 5The SNC shall, throughout the transitional period,represent Cambodia externally and occupy the seat of Canibodiaat the United Nations, <strong>in</strong> the United Nations specializedagencies, and <strong>in</strong> other <strong>in</strong>ternational <strong>in</strong>stitutions and<strong>in</strong>ternational conferences.Article 6The SNC hereby delegates to the United Nations allpowers necessary to ensure the implementation of thisAgreement, as described <strong>in</strong> annex 1.Vol. 1663, 1-28613


60 United Nations — Treaty Series • Nations Unies — Recueil des Traités______1992In order to ensure a neutral political environmentconducive to free and fair general elections, adm<strong>in</strong>istrativeagencies, bodies and offices which could directly <strong>in</strong>fluence theoutcome of elections will be placed under direct United Nationssupervision or control. In that context, special attention willbe given to foreign affairs, national defence, f<strong>in</strong>ance, publicsecurity and <strong>in</strong>formation. To reflect the importance of thesesubjects, UNTAC needs to exercise such control as is necessaryto ensure the strict neutrality of the bodies responsible forthem. The United Nations, <strong>in</strong> consultation with the SNC, willidentify which agencies, bodies and offices could cont<strong>in</strong>ue tooperate <strong>in</strong> order to ensure normal day-to-day life <strong>in</strong> thecountry.Article 7The relationship between the SNC, UNTAC and exist<strong>in</strong>gadm<strong>in</strong>istrative structures is set forth <strong>in</strong> annex 1.Section IVWithdrawal of foreign forcesand its verificationArticle 6Immediately upon entry <strong>in</strong>to force of this Agreement, anyforeign forces, advisers, and military personnel rema<strong>in</strong><strong>in</strong>g <strong>in</strong>Cambodia, together with their weapons, ammunition, andequipment, shall be withdrawn from Cambodia and not bereturned. Such withdrawal and non-return will be subject toUNTAC verification <strong>in</strong> accordance with annex 2.Vol. 1663, 1-28613

All forces shall immediatelydisengage and refra<strong>in</strong> from all hostilities and from anydeployment, movement or action which would extend the territorythey control or which might lead to renewed fight<strong>in</strong>g.The Signatories hereby <strong>in</strong>vite the Security Council ofthe United Nations to request the Secretary-General to providegood offices to assist <strong>in</strong> this process until such time as themilitary component of UNTAC is <strong>in</strong> position to supervise,monitor and verify it.Article 10Upon entry <strong>in</strong>to force of this Agreement, there shall bean immediate cessation of all outside military assistance toall Cambodian Parties.Article 11The objectives of military arrangements dur<strong>in</strong>g thetransitional period shall be to stabilize the securitysituation and build confidence among the parties to theconflict, so as to re<strong>in</strong>force the purposes of this Agreement andto prevent the risks of a return to warfare.Detailed provisions regard<strong>in</strong>g UNTAC 1 s supervision,monitor<strong>in</strong>g, and verification of the cease-fire and relatedmeasures, <strong>in</strong>clud<strong>in</strong>g verification of the withdrawal of foreignforces and the regroup<strong>in</strong>g, cantonment and ultimate dispositionof all Cambodian forces and their weapons dur<strong>in</strong>g thetransitional period are set forth <strong>in</strong> annex 1, section C, andannex 2.Vol. 1663, 1-28613


62 United Nations — Treaty Series • Nations Unies — Recueil des Traités______1992PART IIELECTIONSArticle 12The Cambodian people shall have the right to determ<strong>in</strong>etheir own political future through the free and fair electionof a constituent assembly, which will draft and approve a newCambodian Constitution <strong>in</strong> accordance with Article 23 andtransform itself <strong>in</strong>to a legislative assembly, which will createthe new Cambodian Government. This election will be held underUnited Nations auspices <strong>in</strong> a neutral political environment withfull respect for the national sovereignty of Cambodia.Article 13UNTAC shall be responsible for the organization andconduct of these elections based on the provisions of annex 1,section D, and annex 3.Article 14All Signatories commit themselves to respect the resultsof these elections once certified as free and fair by theUnited Nations.PART IIIHUMAN RIGHTSArticle 151. To this end,(a) Cambodia undertakes :- to ensure respect for and observance of human rightsand fundamental freedoms <strong>in</strong> Cambodia ;- to support the right of all Cambodian citizens toundertake activities which would promote and protecthuman rights and fundamental freedoms ;- to take effective measures to ensure that the policiesand practices of the past shall never be allowed toreturn ;to adhere to relevant <strong>in</strong>ternational human rights<strong>in</strong>struments ;(b) the other Signatories to this Agreement undertake topromote and encourage respect for and observance of humanrights and fundamental freedoms <strong>in</strong> Cambodia as embodied <strong>in</strong> therelevant <strong>in</strong>ternational <strong>in</strong>struments and the relevant resolutionsof the United Nations General Assembly, <strong>in</strong> order, <strong>in</strong>particular, to prevent the recurrence of human rights abuses.Article 16UNTAC shall be responsible dur<strong>in</strong>g the transitionalperiod for foster<strong>in</strong>g an environment <strong>in</strong> which respect for humanrights shall be ensured, based on the provisions of annex 1,section E.Article 17After the end of the transitional period, the UnitedNations Commission on Human Rights should cont<strong>in</strong>ue to monitorclosely the human rights situation <strong>in</strong> Cambodia, <strong>in</strong>clud<strong>in</strong>g, ifnecessary, by the appo<strong>in</strong>tment of a Special Rapporteur who wouldVol. 1663, 1-28613

The <strong>in</strong>struments of accession shall be deposited withthe Governments of the French Republic and the Republic ofIndonesia. For each State acced<strong>in</strong>g to the Agreement it shallenter <strong>in</strong>to force on the date of deposit of its <strong>in</strong>struments ofaccession. In accordance with article 6 of the Agreement, UNTACwill exercise the powers necessary to ensure the implementationof this Agreement, <strong>in</strong>clud<strong>in</strong>g those relat<strong>in</strong>g to the organizationand conduct of free and fair elections and the relevantaspects of the adm<strong>in</strong>istration of Cambodia.2. The follow<strong>in</strong>g mechanism will be used to resolve allissues relat<strong>in</strong>g to the implementation of this Agreement whichmay arise between the Secretary-General's SpecialRepresentative and the Supreme National Council (SNC) :(a) The SNC offers advice to UNTAC, which will complywith this advice provided there is a consensus among themembers of the SNC and provided this advice is consistent withthe objectives of the present Agreement ;(b) If there is no consensus among the members of theSNC despite every endeavour of its President, H.R.H. SamdechNORODOM SIHANOUK, the President will be entitled to make thedecision on what advice to offer to UNTAC, tak<strong>in</strong>g fully <strong>in</strong>toaccount the views expressed <strong>in</strong> the SNC. UNTAC will comply withthe advice provided it is consistent with the objectives of thepresent Agreement ;(c) If H.R.H. Samdech NORODOM SIHANOUK, President of theSNC, the legitimate representative of Cambodian sovereignty, isnot, for whatever reason, <strong>in</strong> a positon to make such a decision,his power of decision will transfer to the Secretary-General'sSpecial Representative. Samdech NORODOM SIHANOUK, President ofthe SNC, the legitimate representative of Cambodiansovereignty, is not, for whatever reason, <strong>in</strong> a position to act,his power to act will transfer to the Secretary-General'sSpecial Representative who Bay take the necessary action ;(e) In all cases, the Secretary-General's SpecialRepresentative will determ<strong>in</strong>e whether advice or action of theSNC is consistent with the present Agreement.3. The Secretary-General's Special Representative orhis delegate will attend the meet<strong>in</strong>gs of the SNC and of anysubsidiary body which might be established by it and give itsmembers all necessary <strong>in</strong>formation on the decisions taken byUNTAC.Section B. Civil adm<strong>in</strong>istration1. In accordance with Article 6 of the Agreement, alladm<strong>in</strong>istrative agencies, bodies and offices act<strong>in</strong>g <strong>in</strong> the fieldof foreign affairs, national defence, f<strong>in</strong>ance, public securityand <strong>in</strong>formation will be placed under the direct control ofUNTAC, which will exercise it as necessary to ensure strictneutrality. In this respect, the Secretary-General's SpecialRepresentative will determ<strong>in</strong>e what is necessary and may issuedirectives to the above-mentioned adm<strong>in</strong>istrative agencies,bodies and offices. Such directives may be issued to and willb<strong>in</strong>d all Cambodian Parties.2. In accordance with article 6 of the Agreement, theSecretary-General's Special Representative, <strong>in</strong> consultationwith the SNC, will determ<strong>in</strong>e which other adm<strong>in</strong>istrativeagencies, bodies and offices could directly <strong>in</strong>fluence theVol. 1663, 1-28613

These adm<strong>in</strong>istrative agencies, bodies andoffices will be placed under direct supervision or control ofUNTAC and will comply with any guidance provided by it.3. In accordance with Article 6 of the Agreement, theSecretary-General's Special Representative, <strong>in</strong> consultationwith the SNC, will identify which adm<strong>in</strong>istrative agencies,bodies, and offices could cont<strong>in</strong>ue to operate <strong>in</strong> order toensure normal day-to-day life <strong>in</strong> Cambodia, if necessary, undersuch supervision by UNTAC as it considers necessary.4. In accordance with article 6 of the Agreement, theauthority of the Secretary-General's Special Representativewill <strong>in</strong>clude the power to :(a) Install <strong>in</strong> adm<strong>in</strong>istrative agencies, bodies andoffices of all the Cambodian Parties, United Nations personnelwho will have unrestricted access to all adm<strong>in</strong>istrativeoperations and <strong>in</strong>formation ;(b) Require the reassignment or removal of anypersonnel of such adm<strong>in</strong>istrative agencies, bodies and offices.5. (a) On the basis of the <strong>in</strong>formation provided <strong>in</strong>Article I, paragraph 3, of annex 2, the Special Representativeof the Secretary-General will determ<strong>in</strong>e, after consultationwith the Cambodian Parties, those civil police necessary toperform law enforcement <strong>in</strong> Cambodia. All Cambodian Partieshereby undertake to comply with the determ<strong>in</strong>ation made by theSpecial Representative <strong>in</strong> this regard ;(b) All civil police will operate under UNTACsupervision or control, <strong>in</strong> order to ensure that law and orderare ma<strong>in</strong>ta<strong>in</strong>ed effectively and impartially, and that humanrights and fundamental freedoms are fully protected. Inconsultation with the SNC, UNTAC will supervise other lawenforcement and judicial processes throughout Cambodia to theextent necessary to ensure the atta<strong>in</strong>ment of these objectives.Vol. 1663, 1-28613

If the Secretary-General's Special Representativedeems it necessary, UNTAC, <strong>in</strong> consultation with the SNC, willundertake <strong>in</strong>vestigations of compla<strong>in</strong>ts and allegationsregard<strong>in</strong>g actions by the exist<strong>in</strong>g adm<strong>in</strong>istrative structures <strong>in</strong>Cambodia that are <strong>in</strong>consistent with or work aga<strong>in</strong>st theobjectives of this comprehensive political settlement. UNTACwill also be empowered to undertake such <strong>in</strong>vestigation on itsown <strong>in</strong>itiative. UNTAC will take, when necessary, appropriatecorrective steps.Saction C. - Military functions1. UNTAC will supervise, monitor and verify thewithdrawal of foreign forces, the cease-fire and relatedmeasures <strong>in</strong> accordance with annex 2, <strong>in</strong>clud<strong>in</strong>g :(a) Verification of the withdrawal from Cambodia of allcategories of foreign forces, advisers and military personneland their weapons, ammunition and equipment, and their nonreturn to Cambodia ;(b) Liaison with neighbour<strong>in</strong>g Governments over anydevelopments <strong>in</strong> or near their territory that could endanger theimplementation of this Agreement ;(c) Monitor<strong>in</strong>g the cessation of outside militaryassistance to all Cambodian Parties ;(d) Locat<strong>in</strong>g and confiscat<strong>in</strong>g caches of weapons andmilitary supplies throughout the country ;(e) Assist<strong>in</strong>g with clear<strong>in</strong>g m<strong>in</strong>es and undertak<strong>in</strong>gtra<strong>in</strong><strong>in</strong>g programmes <strong>in</strong> m<strong>in</strong>e clearance and a m<strong>in</strong>e awarenessprogramme among the Cambodian people.2. UNTAC will supervise the regroup<strong>in</strong>g and relocat<strong>in</strong>g ofall forces to specifically designated cantonment areas on thebasis of an operational time-table to be agreed upon, <strong>in</strong>accordance with annex 2.Vol. 1663, 1-28613

As th forces enter the cantonments, UNTAC will<strong>in</strong>itiate the process of arms control and reduction specified <strong>in</strong>annex 2.4. UNTAC will take necessary steps regard<strong>in</strong>g the phasedprocess of demobilization of the military forces of theparties, <strong>in</strong> accordance with annex 2.5. UNTAC will assist, as necessary, the InternationalCommittee of the Red Cross <strong>in</strong> the release of all prisoners ofwar and civilian <strong>in</strong>ternees.Section D.Elections1. UNTAC will organize and conduct the electionreferred to <strong>in</strong> Part II of this Agreement <strong>in</strong> accordance withthis section and annex 3.2. UNTAC may consult with the SNC regard<strong>in</strong>g theorganization and conduct of the electoral process.3. In the exercise of its responsibilities <strong>in</strong> relationto the electoral process, the specific authority of UNTAC will<strong>in</strong>clude the follow<strong>in</strong>g :(a) The establishment, <strong>in</strong> consultation with the SNC, ofa system of laws, procedures and adm<strong>in</strong>istrative measuresnecessary for the hold<strong>in</strong>g of a free and fair election <strong>in</strong>Cambodia, <strong>in</strong>clud<strong>in</strong>g the adoption of an electoral law and of acode of conduct regulat<strong>in</strong>g participation <strong>in</strong> the election <strong>in</strong> amanner consistent with respect for human rights and prohibit<strong>in</strong>gcoercion or f<strong>in</strong>ancial <strong>in</strong>ducement <strong>in</strong> order to <strong>in</strong>fluence voterpreference ;(b) The suspension or abrogation, <strong>in</strong> consultation withthe SNC, of provisions of exist<strong>in</strong>g laws which could defeat theobjects and purposes of this Agreement ;Vol. 1663, 1-28613


74 United Nations — Treaty Series • Nations Unies — Recueil des Traités______1992(c) The design and implementation of a voter ducationprogramme, cover<strong>in</strong>g all aspects of the election, to support theelection process ;(d) The design and implementation of a system of voterregistration, as a first phase of the electoral process, toensure that eligible voters have the opportunity to register,and the subsequent preparation of verified voter registrationlists ;(e) The design and implementation of a system ofregistration of political parties and lists of candidates ;(f) Ensur<strong>in</strong>g fair access to the media, <strong>in</strong>clud<strong>in</strong>g press,television and radio, for all political parties contest<strong>in</strong>g <strong>in</strong>the election ;(g) The adoption and implementation of measures tomonitor and facilitate the participation of Cambodians <strong>in</strong> theelections, the political campaign, and the ballot<strong>in</strong>gprocedures ;(h) The design and implementation of a system ofballot<strong>in</strong>g and poll<strong>in</strong>g, to ensure that registered voters havethe opportunity to vote ;(i) The establishment, <strong>in</strong> consultation with the SNC, ofco-ord<strong>in</strong>ated arrangements to facilitate the presence of foreignobservers wish<strong>in</strong>g to observe the campaign and vot<strong>in</strong>g ;(j) Overall direction of poll<strong>in</strong>g and the vote count ;(k) The identification and <strong>in</strong>vestigation of compla<strong>in</strong>tsof electoral irregularities, and the tak<strong>in</strong>g of appropriatecorrective action ;Vol. 1663, 1-28613

In carry<strong>in</strong>g out its responsibilities under thepresent section, UNTAC will establish a system of safeguards toassist it <strong>in</strong> ensur<strong>in</strong>g the absence of fraud dur<strong>in</strong>g the electoralprocess, <strong>in</strong>clud<strong>in</strong>g arrangements for Cambodian representativesto observe the registration and poll<strong>in</strong>g procedures and theprovision of an UNTAC mechanism for hear<strong>in</strong>g and decid<strong>in</strong>gcompla<strong>in</strong>ts.5. The timetable for the various phases of the electoralprocess will be determ<strong>in</strong>ed by UNTAC, <strong>in</strong> consultation with theSNC as provided <strong>in</strong> paragraph 2 of this section. The duration ofthe electoral process will not exceed n<strong>in</strong>e months from thecommencement of voter registration.6. In organiz<strong>in</strong>g and conduct<strong>in</strong>g the electoral process,UNTAC will make every effort to ensure that the system andprocedures adopted are absolutely impartial, while theoperational arrangements are as adm<strong>in</strong>istratively simple andefficient as possible.Section E. Human rightsIn accordance with article 16, UNTAC will makeprovisions for :(a) The development and implementation of a programme ofhuman rights education to promote respect for and understand<strong>in</strong>gof human rights ;(b) General human rights oversight dur<strong>in</strong>g thetransitional period ;(c) The <strong>in</strong>vestigation of human rights compla<strong>in</strong>ts, and,where appropriate, corrective action.Vol. 1663, 1-28613

All Cambodian Parties (here<strong>in</strong>after referred to as "theParties") agree to observe a comprehensive cease-fire on landand water and <strong>in</strong> the air. This cease-fire will be implemented<strong>in</strong> two phases. Dur<strong>in</strong>g the first phase, the cease-fire will beobserved with the assistance of the Secretary-General of theUnited Nations through his good offices. Dur<strong>in</strong>g the secondphase, which should commence as soon as possible, the ceasefire will be supervised, monitored and verified by UNTAC. TheCommander of the military component of UNTAC, <strong>in</strong> consultationwith the Parties, shall determ<strong>in</strong>e the exact time and date atwhich the second phase will commence. This date will be set atleast four weeks <strong>in</strong> advance of its com<strong>in</strong>g <strong>in</strong>to effect.2. The Parties undertake that, upon the sign<strong>in</strong>g of thisAgreement, they will observe a cease-fire and will order theirarmed forces immediately to disengage and refra<strong>in</strong> from allhostilities and any deployment, movement or action that wouldextend the territory they control or that might lead to aresumption of fight<strong>in</strong>g, pend<strong>in</strong>g the commencement of thesecond phase. "Forces" are agreed to <strong>in</strong>clude all regular,prov<strong>in</strong>cial, district, paramilitary, and other auxiliary forces.Dur<strong>in</strong>g the first phase, the Secretary-General of the UnitedNations will provide his good offices to the Parties to assistthem <strong>in</strong> its observance. The Parties undertake to co-operatewith the Secretary-General or his representatives <strong>in</strong> theexercise of his good offices <strong>in</strong> this regard.3. The Parties agree that, immediately upon the sign<strong>in</strong>g of thisAgreement, the follow<strong>in</strong>g <strong>in</strong>formation will be provided to theUnited Nations :Vol. 1663, 1-28613

The deployment will be depicted on a nap marked withlocations of all troop positions, occupied or unoccupied,<strong>in</strong>clud<strong>in</strong>g stag<strong>in</strong>g camps, supply bases and supply routes ;(b) Comprehensive lists of arms, ammunition andequipment held by their forces, and the exact locations atwhich those arms, ammunition and equipment are deployed ;(c) Detailed record of their m<strong>in</strong>e-fields, <strong>in</strong>clud<strong>in</strong>gtypes and characteristics of m<strong>in</strong>es laid and <strong>in</strong>formation ofbooby traps used by them together with any <strong>in</strong>formationavailable to them about m<strong>in</strong>e-fields laid or booby traps used bythe other Parties;(d) Total strength of their police forces, organization,precise numbers and locations of deployments, as well ascomprehensive lists of their arms, ammunition and equipment,and the exact locations at which those arms, ammunition andequipment are deployed.4. Immediately upon his arrival <strong>in</strong> Cambodia, and not later thanfour weeks before the beg<strong>in</strong>n<strong>in</strong>g of the second phase, theCommander of the military component of UNTAC will, <strong>in</strong>consultation with the Parties, f<strong>in</strong>alize UNTAC's plan for theregroupment and cantonment of the forces of the Parties and forthe storage of their arms, ammunition and equipment, <strong>in</strong>accordance with Article III of this annex. This plan will<strong>in</strong>clude the designation of regroupment and cantonment areas,as well as an agreed timetable. The cantonment areas will beestablished at battalion size or larger.5. The Parties agree to take steps to <strong>in</strong>form their forces atleast two weeks before the beg<strong>in</strong>n<strong>in</strong>g of the second phase, us<strong>in</strong>gall possible means of communication, about the agreed date andtime of the beg<strong>in</strong>n<strong>in</strong>g of the second phase, about the agreedplan for the regroupment and cantonment of their forces and forVol. 1663, 1-28613

The Parties shall scrupulously observe the cease-fire andwill not resume any hostilities by land, water or air. Thecommanders of their armed forces will ensure that all troopsunder their command rema<strong>in</strong> on their respective positions,pend<strong>in</strong>g their movement to the designated regroupment areas, andrefra<strong>in</strong> from all hostilities and from any deployment ormovement or action which would extend the territory theycontrol or which might lead to a resumption of fight<strong>in</strong>g.Article IILiaison System and Mixed Military WorX<strong>in</strong>q GroupA Mixed Military Work<strong>in</strong>g Group (MMWG) will beestablished with a view to resolv<strong>in</strong>g any problems that mayarise <strong>in</strong> the observance of the cease-fire. It will be chairedby the most senior United Nations military officer <strong>in</strong> Cambodiaor his representative. Each Party agrees to designate anofficer of the rank of brigadier or equivalent to serve on theMMWG. Its composition, method of operation and meet<strong>in</strong>g placeswill be determ<strong>in</strong>ed by the most senior United Nations militaryofficer <strong>in</strong> consultation with the Parties. Similar liaisonarrangements will be made at lower military command levels toresolve practical problems on the ground.Article XIIRegroupaient and cantonnant of the forces of the Partiesand storage of tbeir »r»«- «"«unitiop and equipment1. In accordance with the operational timetable referred to <strong>in</strong>paragraph 4 of article I of the present annex, all forces ofthe Parties that are not already <strong>in</strong> designated cantonmentareas will report to designated regroupment areas, which willVol. 1663, 1-28613

The Parties agree to arrange for all theirforces, with all their arms, ammunition and equipment, toreport to regroupment areas with<strong>in</strong> two weeks after thebeg<strong>in</strong>n<strong>in</strong>g of the second phase. All personnel who have reportedto the regroupment areas will thereafter be escorted bypersonnel of the military component of UNTAC, with their arms,ammunition and eguipment, to designated cantonment areas. AllParties agree to ensure that personnel report<strong>in</strong>g to theregroupment areas will be able to do so <strong>in</strong> full safety andwithout any h<strong>in</strong>drance.2. On the basis of the <strong>in</strong>formation provided <strong>in</strong> accordance withparagraph 3 of article I of the present annex, UNTAC willconfirm that the regroupmant and cantonment processes havebeen completed <strong>in</strong> accordance with the plan referred to <strong>in</strong>paragraph 4 of article I of this annex. UKTAC will endeavour tocomplete these processes with<strong>in</strong> four weeks from the date of thebeg<strong>in</strong>n<strong>in</strong>g of the second phase. On the completion of regroupmentof all forces and of their movement to cantonment areas,respectively, the Commander of the military component of UKTACwill so <strong>in</strong>form each of the four Parties.3. The Parties agree that, as their forces enter the designatedcantonment areas, their personnel will be <strong>in</strong>structed by theircommanders to immediately hand over all their arms, ammunitionand eguipment to UKTAC for storage <strong>in</strong> the custody of UKTAC.4. UKTAC will check the arms, ammunition and equipment handedover to it aga<strong>in</strong>st the lists referred to <strong>in</strong> paragraph 3. b) ofarticle I of this annex, <strong>in</strong> order to verify that all the arms,ammunition and equipment <strong>in</strong> the possession of the Parties havebeen placed under its custody.Vol. 1663, 1-28613

Such resupply will be conf<strong>in</strong>ed toitems of a non-lethal nature such as food, water, cloth<strong>in</strong>g andmedical supplies as well as provision of medical care.Article VUltimate disposition of the forces of the Partiesand of their anus, """"unitiop and equipment1. In order to re<strong>in</strong>force the objectives of a comprehensivepolitical settlement, m<strong>in</strong>imize the risks of a return towarfare, stabilize the security situation and build confidenceamong the Parties to the conflict, all Parties agree toundertake a phased and balanced process of demobilization of atleast 70 per cent of their military forces. This process shallbe undertaken <strong>in</strong> accordance with a detailed plan to be drawnup by UHTAC on the basis of the <strong>in</strong>formation provided underArticle I of this annex and <strong>in</strong> consultation with the Parties.It should be completed prior to the end of the process ofregistration for the elections and on a date to be determ<strong>in</strong>edby the Special Representative of the Secretary-General.2. The Cambodian Parties hereby commit themselves to demobilizeall their rema<strong>in</strong><strong>in</strong>g forces before or shortly after theelections and, to the extent that full demobilization isunatta<strong>in</strong>able, to respect and abide by whatever decision thenewly elected government that emerges <strong>in</strong> accordance withArticle 12 of this Agreement takes with regard to the<strong>in</strong>corporation of parts or all of those forces <strong>in</strong>to a newnational army. Upon completion of the demobilization referredto <strong>in</strong> paragraph 1, the Cambodian Parties and the SpecialRepresentative of the Secretary-General shall undertake areview regard<strong>in</strong>g the f<strong>in</strong>al disposition of the forces rema<strong>in</strong><strong>in</strong>gVol. 1663, 1-28613


1992 United Nations — Treaty Series • Nations Unies — Recueil des Traités________81<strong>in</strong> the cantonments, with a view to determ<strong>in</strong><strong>in</strong>g which of thefollow<strong>in</strong>g shall apply :(a) If the Parties agree to proceed with thedemobilization of all or some of the forces rema<strong>in</strong><strong>in</strong>g <strong>in</strong> thecantonments, preferably prior to or otherwise shortly after theelections, the Special Representative shall prepare a timetable for so do<strong>in</strong>g, <strong>in</strong> consultation with them.(b) Should total demobilization of all of the residualforces before or shortly after the elections not be possible,the Parties hereby undertake to make available all of theirforces rema<strong>in</strong><strong>in</strong>g <strong>in</strong> cantonments to the newly elected governmentthat emerges <strong>in</strong> accordance with Article 12 of this Agreement,for consideration for <strong>in</strong>corporation <strong>in</strong>to a new national army.They further agree that any such forces which are not<strong>in</strong>corporated <strong>in</strong>to the new national army will be demobilizedforthwith accord<strong>in</strong>g to a plan to be prepared by the SpecialRepresentative. With regard to the ultimate disposition of therema<strong>in</strong><strong>in</strong>g forces and all the arms, ammunition and equipment,UNTAC, as its withdraws from Cambodia, shall reta<strong>in</strong> suchauthority as is necessary to ensure an orderly transfer to thenewly elected government of those responsibilities it hasexercised dur<strong>in</strong>g the transitional period.3. UNTAC will assist, as required, with the r <strong>in</strong>t gration <strong>in</strong>tocivilian life of the forces demobilized prior to the elections.4. (a) UNTAC will control and guard all the arms, ammunitionand equipment of the Parties throughout the transitionalperiod;(b) As the cantoned forces are demobilized <strong>in</strong> accordancewith paragraph 1 above, there will be a parallel reduction byUNTAC of the arms, ammunition and equipment stored on site <strong>in</strong>the cantonment areas. For the forces rema<strong>in</strong><strong>in</strong>g <strong>in</strong> thecantonment areas, access to their arms, ammunition andequipment shall only be on the basis of the explicitVol. 1663, 1-28613

UNTAC shall be provided, no later than two weeks before thecommencement of the second phase of the cease-fire, withdetailed <strong>in</strong>formation <strong>in</strong> writ<strong>in</strong>g regard<strong>in</strong>g the withdrawal offoreign forces. This <strong>in</strong>formation shall <strong>in</strong>clude the follow<strong>in</strong>gelements :(a) Total strength of these forces and theirorganization and deployment ;(b) Comprehensive lists of arms, ammunition andequipment held by these forces, and their exact locations ;(c) Withdrawal plan (already implemented or to beimplemented), <strong>in</strong>clud<strong>in</strong>g withdrawal routes, border cross<strong>in</strong>gpo<strong>in</strong>ts and time of departure from Cambodia.2. On the basis of the <strong>in</strong>formation provided <strong>in</strong> accordance withparagraph 1 above, UNTAC will undertake an <strong>in</strong>vestigation <strong>in</strong> themanner it deems appropriate. The Party provid<strong>in</strong>g the<strong>in</strong>formation will be required to make personnel available toaccompany UNTAC <strong>in</strong>vestigators.Vol. 1663, 1-28613

Upon confirmation of the presence of any foreign forces,UNTAC will immediately deploy military personnel with theforeign forces and accompany them until they have withdrawnfrom Cambodian territory. UNTAC will also establish checkpo<strong>in</strong>tson withdrawal routes, border cross<strong>in</strong>g po<strong>in</strong>ts and airfields toverify the withdrawal and ensure the non-return of allcategories of foreign forces.4. The Mixed Military Work<strong>in</strong>g Group (MMWG) provided for <strong>in</strong>article II of this annex will assist UNTAC <strong>in</strong> fulfill<strong>in</strong>g theabove-mentioned tasks.Article VIICessation of outside military assistanceto all Cambodian Parties1. All Parties undertake, from the time of the sign<strong>in</strong>g of thisAgreement, not to obta<strong>in</strong> or seek any outside militaryassistance, <strong>in</strong>clud<strong>in</strong>g weapons, ammunition and militaryequipment from outside sources.2. The Signatories whose territory is adjacent to Cambodia,namely, the Governments of the Lao People's DemocraticRepublic, the K<strong>in</strong>gdom of Thailand and the Socialist Republic ofVietnam, undertake to :(a) Prevent the territories of their respective States,<strong>in</strong>clud<strong>in</strong>g land territory, territorial sea and air space, frombe<strong>in</strong>g used for the purpose of provid<strong>in</strong>g any form of militaryassistance to any of the Cambodian Parties. Resupply of suchitems as food, water, cloth<strong>in</strong>g and medical supplies throughtheir territories will be allowed, but shall, without prejudiceto the provisions of sub-paragraph (c) below, be subject toUNTAC supervision upon arrival <strong>in</strong> Cambodia ;(b) Provide written confirmation to the Commander of themilitary component of UNTAC, not later than four weeks afterthe second phase of the cease-fire beg<strong>in</strong>s, that no forces,Vol. 1663, 1-28613


84 United Nations — Treaty Series • Nations Unies — Recueil des Traités______1992aras, ammunition or military equipment of any of the CambodianParties are present on their territories ;(c) Receive an UNTAC liaison officer <strong>in</strong> each of theircapitals and designate an officer of the rank of colonel orequivalent, not later than four weeks after the beg<strong>in</strong>n<strong>in</strong>g ofthe second phase of the cease-fire, <strong>in</strong> order to assist UNTAC <strong>in</strong><strong>in</strong>vestigat<strong>in</strong>g, with due respect for their sovereignty, anycompla<strong>in</strong>ts that activities are tak<strong>in</strong>g place on theirterritories that are contrary to the provisions of thecomprehensive political settlement.3. To enable UNTAC to monitor the cessation of outsideassistance to all Cambodian Parties, the Parties agree that,upon signature of this Agreement, they will provide to UNTACany <strong>in</strong>formation available to them about the routes and means bywhich military assistance, <strong>in</strong>clud<strong>in</strong>g weapons, ammunition andmilitary equipment, have been supplied to any of the Parties.Immediately after the second phase of the cease-fire beg<strong>in</strong>s,UNTAC will take the follow<strong>in</strong>g practical measures :(a) Establish check-po<strong>in</strong>ts along the routes and atselected locations along the Cambodian side of the border andat airfields <strong>in</strong>side Cambodia ;(b) Patrol the coastal and <strong>in</strong>land waterways of Cambodia;(c) Ma<strong>in</strong>ta<strong>in</strong> mobile teams at strategic locations with<strong>in</strong>Cambodia to patrol and <strong>in</strong>vestigate allegations of supply ofarms to any of the Parties.Article VIIICaches of veapons and military supplies1. In order to stabilize the security situation, buildconfidence and reduce arms and military supplies throughoutCambodia, each Party agrees to provide to the Commander of themilitary component of UNTAC, before a date to be determ<strong>in</strong>ed byVol. 1663, 1-28613

On the basis of <strong>in</strong>formation received, the military componentof UNTAC shall, after the date referred to <strong>in</strong> paragraph 1,deploy verification teams to <strong>in</strong>vestigate each report anddestroy each cache found.Article ZZUnexploded ordnance devices1. Soon after arrival <strong>in</strong> Cambodia, the military component ofUNTAC shall ensure, as a first step, that all known m<strong>in</strong>efields are clearly marked.2. The Parties agree that, after completion of the regroupmentand cantonment processes <strong>in</strong> accordance with Article III of thepresent annex, they will make available m<strong>in</strong>e-clear<strong>in</strong>g teamswhich, under the supervision and control of UNTAC militarypersonnel, will leave the cantonment areas <strong>in</strong> order to assist<strong>in</strong> remov<strong>in</strong>g, disarm<strong>in</strong>g or deactivat<strong>in</strong>g rema<strong>in</strong><strong>in</strong>g unexplodedordnance devices. Those m<strong>in</strong>es or objects which cannot beremoved, disarmed or deactivated will be clearly marked <strong>in</strong>accordance with a system to be devised by the militarycomponent of UNTAC.3. UNTAC shall :(a) Conduct a mass public education programme <strong>in</strong> therecognition and avoidance of explosive devices ;(b) Tra<strong>in</strong> Cambodian volunteers to dispose of unexplodedordnance devices ;(c) Provide emergency first-aid tra<strong>in</strong><strong>in</strong>g to Cambodianvolunteers.Vol. 1663, 1-28613

After the beg<strong>in</strong>n<strong>in</strong>g of the second phase, upon receipt of any<strong>in</strong>formation or compla<strong>in</strong>t from one of the Parties relat<strong>in</strong>g to apossible case of non-compliance with any of the provisions ofthe present annex or related provisions, UNTAC will undertakean <strong>in</strong>vestigation <strong>in</strong> the manner which it deems appropriate.Where the <strong>in</strong>vestigation takes place <strong>in</strong> response to a compla<strong>in</strong>tby one of the Parties, that Party will be required to makepersonnel available to accompany the UNTAC <strong>in</strong>vestigators. Theresults of such <strong>in</strong>vestigation will be conveyed by UNTAC to thecompla<strong>in</strong><strong>in</strong>g Party and the Party compla<strong>in</strong>ed aga<strong>in</strong>st, and ifnecessary to the SNC.2. UNTAC will also carry out <strong>in</strong>vestigations on its own<strong>in</strong>itiative <strong>in</strong> other cases when it has reason to believe orsuspect that a violation of this annex or related provisionsmay be tak<strong>in</strong>g place.Articl» ZIRelease of prisoners of varThe military component of UNTAC will provide assistanceas required to the International Committee of the Red Cross <strong>in</strong>the latter 1 s discharge of its functions relat<strong>in</strong>g to the releaseof prisoners of war.Article ZIIRepatriation and resettlement of displaced CambodiansThe military component of UNTAC will provide assistanceas necessary <strong>in</strong> the repatriation of Cambodian refugees anddisplaced persons carried out <strong>in</strong> accordance with articles 19and 20 of this Agreement, <strong>in</strong> particular <strong>in</strong> the clear<strong>in</strong>g ofm<strong>in</strong>es from repatriation routes, reception centres andresettlement areas, as well as <strong>in</strong> the protection of thereception centres.Vol. 1663, 1-28613

The constituent assembly referred to <strong>in</strong> article 12 ofthe Agreement shall consist of 120 members. With<strong>in</strong> three monthsfrom the date of the election, it shall complete its tasks ofdraft<strong>in</strong>g and adopt<strong>in</strong>g a new Cambodian Constitution andtransform itself <strong>in</strong>to a legislative assembly which will form anew Cambodian Government.2. The election referred to <strong>in</strong> Article 12 of theAgreement will be held throughout Cambodia on a prov<strong>in</strong>cialbasis <strong>in</strong> accordance with a system of proportionalrepresentation on the basis of lists of candidates put forwardby political parties.3. All Cambodians, <strong>in</strong>clud<strong>in</strong>g those who at the time ofsignature of this Agreement are Cambodian refugees anddisplaced persons, will have the same rights, freedoms andopportunities to take part <strong>in</strong> the electoral process.4. Every person who has reached the age of eighteen atthe time of application to register, or who turns eighteendur<strong>in</strong>g the registration period, and who either was born <strong>in</strong>Cambodia or is the child of a person born <strong>in</strong> Cambodia, will beeligible to vote <strong>in</strong> the election.5. Political parties may be formed by any group of fivethousand registered voters. Party platforms shall be consistentwith the pr<strong>in</strong>ciples and objectives of the Agreement on acomprehensive political settlement.6. Party affiliation will be required <strong>in</strong> order to standfor election to the constituent assembly. Political partieswill present lists of candidates stand<strong>in</strong>g for election on theirbehalf, who will be registered voters.Vol. 1663, 1-28613

Vot<strong>in</strong>g will be by secret ballot, with provision madeto assist those who are disabled or who cannot read or write.9. The freedoms of speech, assembly and movement will befully respected. As part of the comprehensive political settlement,every assistance will need to be given to Cambodian refugeesand displaced persons as well as to countries of temporaryrefuge and the country of orig<strong>in</strong> <strong>in</strong> order to facilitate thevoluntary return of all Cambodian refugees and displacedpersons <strong>in</strong> a peaceful and orderly manner. It must also beensured that there would be no residual problems for thecountries of temporary refuge. The country of orig<strong>in</strong> withresponsibility towards its own people will accept their returnas conditions become conducive.PART IICONDITIONS CONDUCIVE TO THE RETURN OF REFUGEESAND DISPLACED PERSONS2. The task of rebuild<strong>in</strong>g the Cambodian nation willrequire the harness<strong>in</strong>g of all its human and natural resources.To this end, the return to the place of their choice ofCambodians from their temporary refuge and elsewhere outsidetheir country of orig<strong>in</strong> will make a major contribution.3. Every effort should be made to ensure that theconditions which have led to a large number of Cambodianrefugees and displaced persons seek<strong>in</strong>g refuge <strong>in</strong> othercountries should not recur. Nevertheless, some Cambodianrefugees and displaced persons will wish and be able to returnspontaneously to their homeland.Vol. 1663, 1-28613

There must be full respect for the human rights andfundamental freedoms of all Cambodians, <strong>in</strong>clud<strong>in</strong>g those of therepatriated refugees and displaced persons, <strong>in</strong> recognition oftheir entitlement to live <strong>in</strong> peace and security, free from<strong>in</strong>timidation and coercion of any k<strong>in</strong>d. These rights would<strong>in</strong>clude, <strong>in</strong>ter alia, freedom of movement with<strong>in</strong> Cambodia, thechoice of domicile and employment, and the right to property.5. In accordance with the comprehensive politicalsettlement, every effort should be made to create concurrently<strong>in</strong> Cambodia political, economic and social conditions conduciveto the return and harmonious <strong>in</strong>tegration of the cambodianrefugees and displaced persons.6. With a view to ensur<strong>in</strong>g that refugees and displacedpersons participate <strong>in</strong> the elections, mass repatriation shouldcommence and be completed as soon as possible, tak<strong>in</strong>g <strong>in</strong>toaccount all the political, humanitarian, logistical, technicaland socio-economic factors <strong>in</strong>volved, and with the co-operationof the SNC.7. Repatriation of Cambodian refugees and displacedpersons should be voluntary and their decision should be taken<strong>in</strong> full possession of the facts. Choice of dest<strong>in</strong>ation with<strong>in</strong>Cambodia should be that of the <strong>in</strong>dividual. The unity of thefamily must be preserved.PART IIIOPERATIONAL FACTORS8. Consistent with respect for pr<strong>in</strong>ciples of nationalsovereignty <strong>in</strong> the countries of temporary refuge and orig<strong>in</strong>,and <strong>in</strong> close co-operation with the countries of temporaryrefuge and orig<strong>in</strong>, full access by the Office of the UnitedNations High Commissioner for Refugees (UNHCR), ICRC and otherrelevant <strong>in</strong>ternational agencies should be guaranteed to allVol. 1663, 1-28613


1992 United Nations — Treaty Series • Nations Unies — Recueil des Traités________91Cambodian refugees and displaced persons, with a view to theage'ncies undertak<strong>in</strong>g the census, trac<strong>in</strong>g, medical assistance,food distribution and other activities vital to the dischargeof their mandate and operational responsibilities ; such accessshould also be provided <strong>in</strong> Cambodia to enable the relevant<strong>in</strong>ternational organizations to carry out their traditionalmonitor<strong>in</strong>g as well, as operational responsibilities.9. In the context of the comprehensive politicalsettlement, the signatories note with satisfaction that theSecretary-General of the United Nations has entrusted UNHCRwith the role of leadership and co-ord<strong>in</strong>ation among<strong>in</strong>tergovernmental agencies assist<strong>in</strong>g with the repatriation andrelief of Cambodian refugees and displaced persons. TheSignatories look to all non-governmental organizations to coord<strong>in</strong>ate as much as possible their work for the Cambodianrefugees and displaced persons with that of UNHCR.10. The SNC, the Governments of the countries <strong>in</strong> whichthe Cambodian refugees and displaced persons have soughttemporary refuge, and the countries which contribute to therepatriation and <strong>in</strong>tegration effort, will wish to monitorclosely and facilitate the repatriation of the returnees. An adhoc consultative body should be established for a limited termfor these purposes. The UNHCR, the ICRC, and other<strong>in</strong>ternational agencies as appropriate, as well as UNTAC, wouldbe <strong>in</strong>vited to jo<strong>in</strong> as full participants.11. Adeguately monitored short-term repatriationassistance should be provided on an impartial basis to enablethe families and <strong>in</strong>dividuals return<strong>in</strong>g to Cambodia to establishtheir lives and livelihoods harmoniously <strong>in</strong> their society.These <strong>in</strong>terim measures would be phased out and replaced <strong>in</strong> thelonger term by the reconstruction programme.12. Those responsible for organiz<strong>in</strong>g and supervis<strong>in</strong>g therepatriation operation will need to ensure that conditions ofsecurity are created for the movement of the refugees andVol. 1663, 1-28613

The constitution will be the supreme law of the land.It may be amended only by a designated process <strong>in</strong>volv<strong>in</strong>glegislative approval, popular referendum, or both.2. Cambodia's tragic recent history requires specialmeasures to assure protection of human rights. Therefore, theconstitution will conta<strong>in</strong> a declaration of fundamental rights,<strong>in</strong>clud<strong>in</strong>g the rights to life, personal liberty, security,freedom of movement, freedom of religion, assembly andassociation <strong>in</strong>clud<strong>in</strong>g political parties and trade unions, dueprocess and equality before the law, protection from arbitrarydeprivation of property or deprivation of private propertywithout just compensation, and freedom from racial, ethnic,religious or sexual discrim<strong>in</strong>ation. It will prohibit theretroactive application of crim<strong>in</strong>al law. The declaration willbe consistent with the provisions of the Universal Declarationof Human Rights and other relevant <strong>in</strong>ternational <strong>in</strong>struments.Aggrieved <strong>in</strong>dividuals will be entitled to have the courtsadjudicate and enforce these rights.3. Such steps may <strong>in</strong>clude, <strong>in</strong>ter alia, reference of thematter to the Security Council of the United Nations orrecourse to the means for the peaceful settlement of disputesreferred to <strong>in</strong> Article 33 of the Charter of the United Nations.3. The parties to this Agreement may also call upon theassistance of the co-chairmen of the Paris Conference onCambodia.4. The primary objective of the reconstruction of Cambodiashould be the advancement of the Cambodian nation and people,without discrim<strong>in</strong>ation or prejudice, and with full respect forhuman rights and fundamental freedom for all. The achievementof this objective requires the full implementation of thecomprehensive political settlement.2. The ma<strong>in</strong> responsibility for decid<strong>in</strong>g Cambodia'sreconstruction needs and plans should rest with the Cambodianpeople and the government formed after free and fair elections.No attempt should be made to impose a development strategy onCambodia from any outside source or deter potential donors fromcontribut<strong>in</strong>g to the reconstruction of Cambodia.3. International, regional and bilateral assistance to Cambodiashould be co-ord<strong>in</strong>ated as much as possible, complement andsupplement local resources and be made available impartiallywith full regard for Cambodia's sovereignty, priorities,<strong>in</strong>stitutional means and absorptive capacity.4. In the context of the reconstruction effort, economic aidshould benefit all areas of Cambodia, especially the moredisadvantaged, and reach all levels of society.5. The implementation of an <strong>in</strong>ternational aid effort would haveto be phased <strong>in</strong> over a period that realistically acknowledgesboth political and technical imperatives. The launch<strong>in</strong>g ofan <strong>in</strong>ternational reconstruction plan and an appeal forcontributions should take place at an appropriate t<strong>in</strong>e, so asto ensure its success.7. No effective programme of national reconstruction can be<strong>in</strong>itiated without detailed assessments of Cambodia's human,natural and other economic assets. It will be necessary for acensus to be conducted, developmental priorities identified,and the availability of resources, <strong>in</strong>ternal and external,determ<strong>in</strong>ed.To this end there will be scope for send<strong>in</strong>g to Cambodiafact-f<strong>in</strong>d<strong>in</strong>g missions from the United Nations system,<strong>in</strong>ternational f<strong>in</strong>ancial <strong>in</strong>stitutions and other agencies, withthe consent of the future Cambodian Government.8. With the achievement of the comprehensive politicalsettlement, it is now possible and desirable to <strong>in</strong>itiate aprocess of rehabilitation, address<strong>in</strong>g immediate needs, and tolay the groundwork for the preparation of medium - and longtermreconstruction plans.9. For this period of rehabilitation, the United NationsSecretary-General is requested to help co-ord<strong>in</strong>ate theprogramme guided by a person appo<strong>in</strong>ted for this purpose.10. In this rehabilitation phase, particular attention willneed to be given to food security, health, hous<strong>in</strong>g, tra<strong>in</strong><strong>in</strong>g,education, the transport network and the restoration ofCambodia's exist<strong>in</strong>g basic <strong>in</strong>frastructure and public utilities.11. The implementation of a longer-term <strong>in</strong>ternationaldevelopment plan for reconstruction should await the formationof a government follow<strong>in</strong>g the elections and the determ<strong>in</strong>ationand adoption of its own policies and priorities.Vol. 1663, 1-28613

This reconstruction phase should promote Cambodianentrepreneurship and make use of the private sector, amongother sectors, to help advance self-susta<strong>in</strong><strong>in</strong>g economic growth.It would also benefit from regional approaches, <strong>in</strong>volv<strong>in</strong>g,<strong>in</strong>ter alia, <strong>in</strong>stitutions such as the Economic and SocialCommission for Asia and the Pacific (ESCAP) and the MekongCommittee, and Governments with<strong>in</strong> the region ; and fromparticipation by non-governmental organizations.13. In order to harmonize and monitor the contributions thatwill be made by the <strong>in</strong>ternational community to thereconstruction of Cambodia after the formation of a governmentfollow<strong>in</strong>g the elections, a consultative body, to be called theInternational Committee on the Reconstruction of Cambodia(ICORC), should be set up at an appropriate time and be open topotential donors and other relevant parties.
