10A L.R.O. <strong>2002</strong> <strong>Proceeds</strong> <strong>of</strong> <strong>Crime</strong> CAP. 143s.4(b)any property held by a person to whom a person so convictedor charged has directly or indirectly made a gift caught by this<strong>Act</strong>.(4) Property is not realisable property if(a)(b)there is in force in respect <strong>of</strong> that property a forfeiture orderunder this <strong>Act</strong> or under any other enactment;a forfeiture order is proposed to be made against that propertyunder this <strong>Act</strong> or under any other enactment.(5) For the purposes <strong>of</strong> sections 20 and 21, the amount that mightbe realised at the time a confiscation order is made against a person isthe total <strong>of</strong> the values at that time <strong>of</strong> all the realisable property held bythe person, less the total amounts payable in pursuance <strong>of</strong> anobligation, where there is an obligation having priority at that time,together with the total <strong>of</strong> the values at that time <strong>of</strong> all gifts caught bythis <strong>Act</strong>.(6) For the purposes <strong>of</strong> subsection (5), an obligation has priorityat any time if it is an obligation <strong>of</strong> the person to(a)(b)(c)pay an amount due in respect <strong>of</strong> a fine, or other order <strong>of</strong> acourt, imposed or made on conviction <strong>of</strong> an <strong>of</strong>fence where thefine was imposed or the order was made before theconfiscation order;pay an amount due in respect <strong>of</strong> any tax, rate, duty, cess orother impost payable under any enactment for the time beingin force; orpay any other civil obligation as may be determined by theCourt;THE LAWS OF BARBADOSPrinted by the Government Printer, Bay Street, St. Michaelby the authority <strong>of</strong> the Government <strong>of</strong> Barbados
