2008<br />

Policies <strong>an</strong>d Procedures M<strong>an</strong>uals<br />

Prior to services being delivered, it is essential that the <strong>immigration</strong> <strong>program</strong>’s policies be documented in a m<strong>an</strong>ual for the<br />

agency leadership to endorse <strong>an</strong>d staff to follow. The policies should include: agency’s mission statement; <strong>program</strong>’s service<br />

philosophy; <strong>program</strong> operations; services provided <strong>an</strong>d locations; eligibility criteria; confidentiality <strong>an</strong>d conflicts of interest;<br />

client rights <strong>an</strong>d responsibilities; client griev<strong>an</strong>ce policy, supervision, staff qualifications <strong>an</strong>d functions; <strong>an</strong>d <strong>program</strong><br />

evaluation. The m<strong>an</strong>ual should be read <strong>an</strong>d updated at least once a year, <strong>an</strong>d more often in the first year as the <strong>program</strong><br />

unfolds.<br />

To provide clients with quality <strong>legal</strong> <strong>immigration</strong> services, carefully pl<strong>an</strong>ned <strong>an</strong>d documented case m<strong>an</strong>agement forms <strong>an</strong>d<br />

procedures are needed. Forms will include: Consultation Form; Referral List; Intake; Client Agreement; Fee Schedule; Fee<br />

Waiver <strong>an</strong>d Sliding Scale Agreements; Required Documents Checklist; Case File Construction Checklist; Quality Control<br />

Checklist; <strong>an</strong>d Termination Letter template among others.<br />

These two sets of documents will help ensure professionalism, quality services to clients <strong>an</strong>d <strong>program</strong> sustainability. They<br />

will assist in training new staff as the <strong>program</strong> exp<strong>an</strong>ds.<br />

Fin<strong>an</strong>ces<br />

Agencies that are recognized by the Board of Immigration Appeals (BIA) to provide <strong>legal</strong> services may charge "nominal<br />

fees," <strong>an</strong>d c<strong>an</strong>not support their <strong>program</strong> solely through fees. According to training from Catholic Legal Immigration<br />

Network, <strong>an</strong> agency should try to maintain 50% or less of their income from fees. They also suggested that most agencies<br />

across the country charge too little fees <strong>an</strong>d in almost all cases should raise their fees. The BIA has never given specific<br />

guidelines of what are "nominal fees" <strong>an</strong>d has approved fee structures of all different levels.<br />

The Immigration Program will be supported through 50% fees <strong>an</strong>d 50% gr<strong>an</strong>ts or private sources. Services will be provided<br />

only to the extent that resources are available, <strong>an</strong>d there will be no deficit spending. Based on the funding, it will be<br />

calculated the number of clients that c<strong>an</strong> be served in a year. Once this number is reached, the agency will refer clients<br />

elsewhere until new funding is secured.<br />

Through direct inquiries, it has been found that some of the gr<strong>an</strong>ts currently held by Refugee Services c<strong>an</strong> be used to pay for<br />

<strong>immigration</strong> services <strong>an</strong>d trainings. They are as follows:<br />
