INTRODUCTION<br />

Who Is This M<strong>an</strong>ual For?<br />

I<br />

f you are reading this m<strong>an</strong>ual, your agency is already engaged in providing <strong>immigration</strong> <strong>legal</strong> services or is contemplating<br />

doing so. If you are already providing such services, you underst<strong>an</strong>d how acute the need for competent <strong>legal</strong> services is in<br />

your community <strong>an</strong>d you may be thinking about exp<strong>an</strong>ding the scope of the services you offer.<br />

If your agency is considering offering <strong>immigration</strong> <strong>legal</strong> services for the first time, you may be pl<strong>an</strong>ning to start a <strong>program</strong><br />

from scratch with the support of other community partners or thinking of adding the provision of <strong>legal</strong> services to the menu<br />

of social services you already offer. Perhaps you are a refugee resettlement agency that w<strong>an</strong>ts to offer <strong>immigration</strong> services to<br />

your refugee clients. Perhaps you offer ESL <strong>an</strong>d citizenship classes <strong>an</strong>d m<strong>an</strong>y of your students are asking for your help in<br />

completing the necessary <strong>legal</strong> work to become citizens. Perhaps you are part of a church or other community org<strong>an</strong>ization<br />

that works regularly with immigr<strong>an</strong>ts, <strong>an</strong>d have realized that they need low-cost <strong>immigration</strong> <strong>legal</strong> help.<br />

If you already offer <strong>immigration</strong> <strong>legal</strong> services, you may be looking to exp<strong>an</strong>d your <strong>program</strong> or to make your existing<br />

<strong>program</strong> more systematized <strong>an</strong>d professional. You may be considering adding more staff, <strong>an</strong>d trying to decide what kind of<br />

staff to hire. You may be looking for ideas about how to set up <strong>program</strong> m<strong>an</strong>agement systems for a <strong>program</strong> that has been<br />

operating for a while without m<strong>an</strong>y.<br />

This m<strong>an</strong>ual recognizes the import<strong>an</strong>ce of providing <strong>legal</strong> services to immigr<strong>an</strong>ts <strong>an</strong>d strives to make it easier to start or<br />

exp<strong>an</strong>d such a <strong>program</strong>. The goal of this m<strong>an</strong>ual is to explain the key elements involved in making a decision regarding the<br />

creation or exp<strong>an</strong>sion of <strong>an</strong> <strong>immigration</strong> <strong>legal</strong> services <strong>program</strong> <strong>an</strong>d to lay out the principles, practices, resources, <strong>an</strong>d model<br />

documents necessary to operate a well-m<strong>an</strong>aged, fin<strong>an</strong>cially sustainable, high quality <strong>program</strong>.<br />

Because nonprofit <strong>immigration</strong> <strong>legal</strong> <strong>program</strong>s come in a wide r<strong>an</strong>ge of shapes, sizes, <strong>an</strong>d locations—from agencies with<br />

multiple attorneys on staff to agencies with one or two accredited representatives, from agencies in remote rural areas to<br />

agencies in large urb<strong>an</strong> areas, from agencies that h<strong>an</strong>dle a few <strong>immigration</strong> services to agencies that take on a wide r<strong>an</strong>ge of<br />

<strong>immigration</strong> matters, from agencies that are part of large national networks to st<strong>an</strong>d-alone agencies—we have tried in this<br />

m<strong>an</strong>ual to provide guid<strong>an</strong>ce to different types of <strong>program</strong>s. M<strong>an</strong>y practices will be common to all providers, but certain<br />

<strong>program</strong>s face their own unique challenges, <strong>an</strong>d we have tried to address as m<strong>an</strong>y of those as possible.<br />

What’s in the M<strong>an</strong>ual?<br />

Chapter One, “Internal Support,” discusses how to secure internal <strong>an</strong>d external support for your <strong>program</strong>, whether you’re<br />

starting a new <strong>program</strong> or exp<strong>an</strong>ding <strong>an</strong> existing one; how to know if you are ready to begin a <strong>legal</strong> <strong>program</strong>; doing a needs<br />

assessment; <strong>an</strong>d creating <strong>an</strong>d using a business pl<strong>an</strong> for your <strong>program</strong>.<br />

Chapter Two, “Space, Equipment, <strong>an</strong>d Tools,” describes the physical things you need to run a <strong>legal</strong> <strong>program</strong>. The chapter<br />

covers office space; computer hardware <strong>an</strong>d software (with attention to confidentiality requirements <strong>an</strong>d security concerns);<br />

library materials; <strong>an</strong>d <strong>legal</strong> malpractice insur<strong>an</strong>ce.<br />

Chapter Three, “Staffing,” delves into the different staffing choices available in a nonprofit <strong>immigration</strong> <strong>program</strong>. It covers<br />

the kinds of work that attorneys, accredited representatives, law graduates <strong>an</strong>d law students may <strong>legal</strong>ly do; the kinds of work<br />

that non-accredited staff may <strong>legal</strong>ly do; hiring <strong>an</strong>d retraining considerations; supervision of <strong>legal</strong> staff; m<strong>an</strong>aging a <strong>program</strong><br />

in multiple physical locations; <strong>an</strong>d effective use of volunteers, including interpreters.<br />

Chapter Four, “Authorization,” explains what constitutes “unauthorized practice of law” <strong>an</strong>d provides instruction on how to<br />

avoid it by gaining Board of Immigration Appeals recognition for your agency <strong>an</strong>d accreditation for your non-attorney staff.<br />
