Moller - <strong>Maersk</strong> will give preference toSuppliers who excel in quality and price and share our commitmentto <strong>conduct</strong> business in an ethical, environmentaland socially responsible manner. We will therefore requestthe Supplier to work with us in an open and transparentway, to assess whether the Supplier effectively complieswith the Code <strong>of</strong> Conduct. The process <strong>of</strong> such assessmentmay consist <strong>of</strong> an initial collection <strong>of</strong> Code related informationby A.P. Moller - <strong>Maersk</strong>, in a dialogue with the Supplier,followed by information provided by the Supplier throughanswering a more detailed self-assessment questionnaireor an on-site audit and a subsequent improvement programme.Good Businss Practice:1. The Supplier has developed sustainability targets andindicators (economic, environmental and social).2. The Supplier maintains appropriate records including,but not limited to:a. Name and ages <strong>of</strong> all employees.b. Timesheets.c. Payroll records, including wage slips and overtimewage records.d. Health and safety records, including materialsafety data sheets, accident records and relevantcertificates and permits.3. The Supplier has appointed a senior managementrepresentative(s) with the responsibility for and authorityto ensure compliance with the Code.4. The Supplier ensures that adequate and relevanttraining is provided to all employees in a language thatthe employee understands.5. The Supplier participates in announced, as well asunannounced on-site audits and provides unhinderedaccess to all Supplier facilities, records, companyprovidedaccommodation, if any, as well as employeesfor confidential interviews.6. Where instances <strong>of</strong> non-compliance with the requirements<strong>of</strong> the Code <strong>of</strong> Conduct are identified, the Suppliershall promptly take corrective action to remedythe deficiencies as well as taking expedient measuresto prevent similar problems from recurring in the future.The Supplier is willing to engage in a constructive dialoguewith A.P. Moller - <strong>Maersk</strong> for it to support the developmentand implementation <strong>of</strong> a corrective action plan,with appropriate time scales for implementation andimprovements to be achieved. In the event <strong>of</strong> repeated orserious breaches <strong>of</strong> the requirements <strong>of</strong> the Code <strong>of</strong> Conduct,A.P. Moller - <strong>Maersk</strong> will endeavour to terminate thebusiness relationship with the Supplier and possibly cancelany production or delivery in progress.e. Environmental records, including data from themonitoring <strong>of</strong> significant environmental impactsand relevant permits.f. Records <strong>of</strong> any significant instances <strong>of</strong> non-complianceencountered in relation to the areas <strong>of</strong> theCode <strong>of</strong> Conduct, including, but not limited to, antifraud,anti-corruption, anti-trust law, tax, socialconditions, immigration, health & safety or the environment.A.P.
