Accredited Agency Contract (Customers) - TEMPLATE - CrimTrac

8.5.1 During this Contract, the Accredited Agency shall permit the CrimTrac Representative, or anyperson authorised by the CrimTrac Representative, access to its premises, and access to any ofits records or accounts relevant to or impacting on the work undertaken under this Contract,including but not limited to copies of any Customer Contracts.8.5.2 For the purposes of clause 8.5, access to records or accounts includes access to records oraccounts held on remote facilities by, or on behalf of, the Accredited Agency.8.5.3 Without limiting the generality of clause 8.5.1, the purposes for which the CrimTracRepresentative or any person authorised by the CrimTrac Representative may require accessinclude:a. conducting audits to ensure compliance with the handling of Police HistoryInformation and the NPCS Assurance and Audit Program Guidelines contained in theNPCS User Manual at Attachment G and as updated by CrimTrac from time to time;andb. conducting audits under the Auditor-General Act 1997 (Cth).8.5.4 The Accredited Agency must promptly take, at no additional cost to CrimTrac, corrective actionto rectify any error, non-compliance or inaccuracy identified in any CrimTrac or CrimTracsponsoredaudit.8.5.5 The Accredited Agency shall ensure that any Customer Contracts entered into under thisContract require the Customer to give the CrimTrac Representative, and any person authorisedby the CrimTrac Representative, access to the Customer’s premises, and to records andaccounts in connection with the handling of Police History Information, including the right tocopy.8.5.6 If the Accredited Agency enters into a Subcontract in accordance with clause 8.6, theAccredited Agency shall ensure that Subcontracts require Subcontractors to give the CrimTracRepresentative, and any person authorised by the CrimTrac Representative, access to theSubcontractor’s premises, and to records and accounts in connection with the performance ofwork under the Subcontract, including the right to copy.8.5.7 CrimTrac shall comply with, and shall require any delegate or person authorised by theCrimTrac Representative, to comply with any reasonable Accredited Agency, Subcontractor orCustomer safety and security requirements, or codes of behaviour for the premises.8.6 Subcontracts8.6.1 The Parties acknowledge that the Accredited Agency may utilise Subcontractors as part of thework under this Contract or in connection with this Contract. Subcontractors are deemed to bePersonnel for the purposes of this Contract.8.6.2 The Accredited Agency, by subcontracting any part of the work under this Contract, shall not berelieved of its liabilities or obligations under this Contract, and shall be responsible for allSubcontracts.8.6.3 The Accredited Agency will ensure that any Subcontract for the performance of any part of itsobligations under this Contract contains, so far as they are relevant to the subcontractedobligations, provisions equivalent to this Contract. The Accredited Agency should have regardto the obligations listed in Attachment H when making arrangements to subcontractperformance of aspects of this agreement.8.6.4 The Accredited Agency, if requested by the CrimTrac Representative, shall provide the CrimTracRepresentative with names of all Subcontractors and a copy of any subcontract, with prices (orrates) and other confidential information redacted. The Accredited Agency acknowledges andUNCLASIFIED12
