Full name of the person who lodged the subpoena, FOI request or legal process;b. Reference number of the police history check;c. Deadline by which the agency is required to determine the subpoena, FOI request orlegal process;d. Details of the circumstances surrounding the subpoena, FOI request or other legalprocess requiring the agency to produce the requested information;e. If an agent has requested information pertaining to documents relating to policerecords of the Applicant, confirmation that this agent is their legal representative withthe Applicant's written consent; andf. Confirmation as to whether the agency is still in possession of the police historyinformation in question or whether the police history information be accessed only viaNSS.The agency must clearly identify the specific police history information or letter/assessmentreport (their permanent records) that is the subject of the subpoena, FOI request or legalprocess. This can be achieved by transmitting a copy to <strong>CrimTrac</strong> using fax number (02) 62687989 or by sending a scanned copy to NSSgeneralenquiries@crimtrac.gov.au.The <strong>Agency</strong> is responsible for notifying the applicant that personal information will betransmitted to <strong>CrimTrac</strong> as part of this process.Advisory Note<strong>CrimTrac</strong> requires an advisory note on ALL copies of documentation that the accredited agencyprovides to the “individual Applicant” as part of this process to stating the following:IMPORTANT! This information has been provided in accordance with the Privacy Act 1988 orFreedom of Information Act 1982 and is not to be used for employment screening, probitychecking and personnel security vetting for employment/engagement with an organisation.10.
