Agencies are required to bring to the notice of the Applicant any matters relating to policehistory information obtained from a National Police History Check report that could cause anadverse decision with respect to the purpose of the check request. This process affords theApplicant the opportunity to identify any errors or mistakes as to their identity.As the NPCS is a name-based process, notification provides the Applicant an opportunity todispute the accuracy of the check outcome in whole or part. Notification also allows anopportunity to detail any mitigating circumstances, such as their age and circumstances at thetime of the offence and any subsequent non-offending periods. Below are the options availableto accredited agencies for notifying Applicants.Notifying the Applicant Verbally:When notifying the Applicant verbally, including by telephone, the agency must ask thefollowing challenge questions in order to confirm the Applicant’s identity:a. full nameb. date of birthc. current address; andd. confirmation of the Purpose of the check request submitted.Once the Applicant’s identity has been established the agency indicates to the Applicant thatpolice history information has been returned. The agency then provides date(s) and a summaryof the substance of the police history information verbally to the Applicant.If the Applicant wishes to dispute the accuracy of the information, either in part or in full, theagency will proceed with the “NPCS Dispute Process” outlined in section 8.1 below.Notifying the Applicant by Providing Supervised Access:The agency may provide the Applicant supervised access to the police history information. If theApplicant wishes to dispute the accuracy of the information, either in part or in full, the agencywill proceed with the “NPCS Dispute Process” outlined below. It should be noted that in somecases, the dispute process is contained within legislation (e.g. relevant working-with-childrenlegislation).Notifying the Applicant by Letter:When notifying the Applicant in writing that releasable police history information has resultedfrom a National Police History Check which may, or may not, relate to the Applicant, the agencyshould advise the Applicant to contact the agency to discuss.UNCLASIFIED38
