SECTION II: LEGISLATIVE BRANCHA. The Senate shall not allow a member of the Executive Council to holdmore than one office simultaneously.B. The Senate shall not allow a member of the Executive Council to holdoffice if his/her cumulative and/or semester grade point average dropsbelow the required minimum.C. The Senate shall adopt resolutions by a majority vote of the quorum. Aquorum shall consist of 50 percent plus one of its voting membership.D. To maintain, as a student of <strong>New</strong> <strong>River</strong> <strong>Community</strong> <strong>College</strong>, a minimumcumulative and semester grade point average of 2.25.E. May not hold another executive office of other school organizations orclubs in the college.SECTION III: COMBINED DUTIES OF EXECUTIVE AND LEGISLATIVE BRANCHESA. All elected members of the Student Government Association shallassemble weekly. All meetings of the Student Government Association shallbe open to any member of the student body, except in cases which a closedmeeting is deemed necessary by both branches.B. Issues will be determined by a majority of vote, which will be noted in themeeting minutes. Elected members only will have voting rights and can alsoexercise the option to abstain from voting. In case of a tie in the vote, a revoteby secret ballot will take place. If a tie remains, the issue will be tableduntil a resolution can be found.C. Members will initial Student Government Association folders or sign-insheets located in the <strong>SGA</strong> Office daily. Deviation from this schedule must beapproved by the Activities Counselor.D. Attend all meetings as part of committee assignments.E. Attend all Student Government Association sponsored activities.F. Assist in duties delegated by the Activities Counselor.SECTION IV: ELECTIONSA. Qualifications of the Executive Council (president, vice president,secretary, treasurer)1. Each candidate for these offices must have attended <strong>New</strong> <strong>River</strong><strong>Community</strong> <strong>College</strong> for at least two terms prior to the election andmust plan to attend the following academic year.2. Each candidate must have and maintain a 2.5 cumulative/semestergrade point average.3. Each candidate must carry and maintain twelve (12) credit hoursper semester.4. Each candidate for office must present a petition signed by twentyfive(25) members of the student body which requests that the personbe allowed to seek election.B. Qualifications of the Legislative Branch (Senators)1. Each candidate for Senator must have attended <strong>New</strong> <strong>River</strong><strong>Community</strong> <strong>College</strong> for at least one term prior to the election andmust plan to attend the following academic year.2. Each candidate must have and maintain a 2.25cumulative/semester grade point average.3. Each candidate must carry and maintain twelve (12) credit hoursper semester. An individual may run for Senator position and carryless than twelve (12) hours if the following conditions apply:a. previously served on the Executive or Legislative Branch ofthe Student Government Association.b. is in good standing with Student Government.


c. have approval of elected members of Student GovernmentAssociation.d. agree to be compensated for the appropriate hours that arecarried.4. Each candidate for office must present a petition signed by twentyfive(25) members of the student body which request that the personbe allowed to seek election.C. Election Procedure1. Any member of the student body who meets the abovequalifications may submit his/her petition to the ActivitiesOffice by the deadline appointed by the president.2. Qualifications of nominees will be checked by the activitiescounselor and <strong>SGA</strong> President.3. The candidates shall meet with the officers who hold the positionsthat they seek and the Activities Counselor to review the electionregulations and expectations of their offices.4. The election time will be designated by the Student GovernmentAssociation. Each member of the student body may cast one vote foreach office. All Student Government elections will be by secret ballot.5. The candidate receiving the highest number of votes for each officeshall be elected and announced.SECTION V: IMPEACHMENT PROCEDURESA. The impeachment procedures are as follows for all elected or appointedofficials:1. A motion to bring impeachment procedures must be made at aregularly scheduled meeting.2. The charged official must be present for the discussion of themotion or be notified prior to the motion.3. This motion must then be passed by a two-thirds majority vote ofthe Senate.4. Should the motion carry, the official in question shall appearbefore the Senate to present his/her position and to answer thecharges brought against him/her.5. After the Senate has heard the official in question and has heard allof the evidence, it will then vote as to whether the official in questionshould be removed from office.6. A two-thirds vote of the full Senate membership is required toimpeach an official.7. An impeached officer may appeal to the Dean of Instruction andStudent Services where no further appeals will be granted.B. Any elected member absent from more than two (2) unexcused meetingsper semester shall be dropped from office. Absences are excusable ifexcused before the meeting and noted in the minutes. Two (2) tardies (laterthan five minutes) will be considered half of an unexcused absence.SECTION VI: TUITION REIMBURSEMENT AND EVALUATIONAny Member of either the Executive or Legislative Branch who does notuphold the duties of his/her office may not be given tuition reimbursement for thatsemester. Percentage of tuition reimbursement will be based on an evaluation bythe Activities Counselor, once a semester. The president and other executive orlegislative branch members may be called upon by the Activities Counselor to aid inthe evaluation.SECTION VII: AMENDMENTS TO CONSTITUTION AND/OR BYLAWS


A proposed amendment shall be submitted to the Student GovernmentAssociation for an adequate time of study. The amendment after study must pass atwo-thirds majority vote of the Student Government Association to become asection of the <strong>Constitution</strong>.SECTION VIII: VACANT OFFICER SEATSAny Student Government Association members, including current StudentGovernment Association Officers, may be considered for filling a vacant seat in anyof the two branches.A. QualificationsEach candidate must meet all of the respective qualifications to beconsidered for nomination.B. Filling Vacancies1. All vacant seats will be announced.2. All positions, if more than one, will be determined by election. Ifthere is only one opening, the position will be filled by appointment.3. Each candidate’s qualifications will be checked by the ActivitiesCounselor and President of the Student Government Association.4. If needed, an election of the candidates by the student body will beheld, the time to be decided by the President. Those candidatesreceiving the highest respective votes shall be elected and serve theremaining term.5. If appointment is necessary, the Executive Council shall recognizethose candidates who meet the respective office requirements andnominate one of them for office.6. The Senate will then vote on the candidate. A two-thirds majorityvote will elect the candidate.
