The electronic-components you havepurchased are covered by one (1) year warranty on material andworkmanship; greatly exceeding the customary 90 day warrantiesoffered by most electronic equipment manufactures.Sensus meter reading equipment is designed to withstand therugged environment normally encountered in meter reading, anenvironment which often presents problems for even the bestelectronic devices. And, few utilities employ electronic servicetechnicians qualified to maintain such equipment.With these facts in mind, Sensus is now providing an extendedwarranty program to extend the protection of your equipmentbeyond the basic one year warranty.This economical program becomes effective the day your oneyear warranty expires, and is renewable on an annual basis for upto five (5) years total from the date of original product shipment.The program covers parts (including “D” batteries) and labor onequipment that has failed to perform during normal usage. Sensusfactory-trained electronics technicians will make necessary repairson items determined to be defective.Under ordinary conditions, your equipment will be returned to youwithin five working days. Special arrangements to handle emergencysituations can be made through your Sensus Representative or call:1-800-METER-IT.To take advantage of this extended warranty program, simplycomplete the application and return it to us. On the application,please list the product name, model number and serial numbers ofequipment you wish to include.APPLICATION FORMWHAT WE WILL DO: In consideration of payment of the contractprice, Sensus will furnish labor and replacement parts necessaryto maintain the product(s) specified in this contract (Product) inoperating condition during the term of the Program (Term), providedsuch service is necessitated by Product failure during normal usage.LOCATION OF SERVICE: Service will be performed at Sensus’Uniontown, Pennsylvania manufacturing facility or other repairfacility designated by Sensus. Subscriber will ship Product tolocation designated by Sensus, freight prepaid; Sensus will returnto Subscriber, freight prepaid, lowest cost routing at Sensus’ option.WHAT IS NOT COVERED: This Program applies only to theoperation of the specific Product under conditions for which it wasdesigned and does not cover: (1) any product or parts therefor notmanufactured by Sensus, (2) defects caused by failure to providea suitable installation environment for such Product, (3) damagecaused by use of the Product for purposes other than those forwhich it was designed, (4) damage caused by disasters such asfire, flood, wind, lightning or other acts of God, (5) the refinishingor replacement of any Product case parts due to finish defects,scratches or chipping, (6) replacement or conversation of Productto incorporate features of new models introduced during Termby Sensus, (7) damage caused by unauthorized attachments ormodification, or (8) any other abuse or misuse by the Subscriber.DISCLAIMER OF WARRANTY: Sensus MAKES NO WARRANTYOF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUTLIMITATION, ANY WARRANTY OF MERCHANTABILITY ORFITNESS FOR A PARTICULAR PURPOSE with respect to thesubject matter hereof, service to be performed by Sensus pursuantto the terms hereof, or parts to be supplied hereunder.FORCE MAJEURE: Sensus shall not be liable to Subscriber forany delay of failure by Sensus to perform its obligations underthis Program or otherwise if such delay or failure arises fromany cause or causes beyond the reasonable control of Sensus,including but not limited to labor disputes, strikes, other labor orindustrial disturbances, acts of God, floods, lightning, shortages ofmaterials, rationing, utility or communication failures, earthquakes,casualty, war acts of public enemy, riots, insurrections, embargoes,blockages, actions, restrictions, regulations or orders of anygovernment, agency or subdivision thereof, or temporaryunavailability of qualified service personnel at Sensus’ office due toservice call(s) received before Subscriber’s call.LIMITATION OF LIABILITY: Subscriber agrees that Sensus’total liability hereunder, including but not limited to, any allegednegligence of Sensus, shall not exceed the annual charge paid bythe Subscriber to Sensus under this Program attributable to theparticular Product directly involved. IN NO EVENT WILL Sensus BELIABLE FOR ANY SPECIAL, INCIDENTAL OR CONSEQUENTIALDAMAGES.TERM OF PROGRAM: This Program shall be for a term of twelve(12) or forty-eight (48) months beginning the first of a month. Iftwelve (12) month term is purchased, such term shall automaticallybe renewed for additional like Terms at Sensus’ published annualmaintenance program charges unless, at least sixty (60) days priorto the expiration of the Term, Subscriber or Sensus gives writtennotice to the other party to terminate this Program at the expirationof such original or renewal Term.ENTIRE AGREEMENT: This Program shall be governed by thelaws of the Commonwealth of Pennsylvania and constitutes theentire agreement between the parties hereto with respect to theservice to be provided hereunder, and shall supersede all previousnegotiations and writings with respect to the matters set forthherein. It may only be modified by a writing signed by authorizedrepresentatives of both parties.
