Collectors and Courts passed after 30-04-1982 and before 24-09-1984.iii)Provisions of Section 34 (Interest to be awarded by Collector)apply to (a) cases of possession of land taken before 30-04-1982 and compensation not paid till such date, w.e.f. that datei.e., 30-04-1982 and(b) to cases where possession taken on or after 30-04-1982but before 24-09-1984 without payment of compensationwith effect on and from the date of taking possession.2. DEFINITIONS2.1 Land includes benefits to arise out of land and things attached to theearth. Refer Section 3(a)2.2 Person interested includes all persons claiming an interest incompensation. A person shall be deemed to be interested in land, ifhe is interested in an easement affecting the land (Section 3(b) of theAct). (Section 3(c) of the Act).2.4 Court means a Principal Civil Court of original jurisdiction. (Section3(d) of the Act)2.5 Corporation owned or controlled by the State means any bodycorporate established under a Central or State Act and includes aGovernment Company, as defined in Section 617 of the CompaniesAct 1956 (Section 3(C.C)).2.6 Company means a Company as defined in Section3 of the CompaniesAct 1956, other than a Government Company, a registered Societyand a Cooperative Society (Section 3 (e)).2.7 Public purpose includes a purpose which the general interest of theCommunity, as opposed to the particular interest of individuals isdirectly or vitally concerned. It generally includes provision andextension of village rites, provision of land for town and rural planning,provision of land for planned development from public funds, provisionof land for a Government Corporation provision of land for residentialpurposes to the poor, provision of land for carrying out any4
educational, housing, health or slum clearance scheme, sponsored byGovernment or a local authority, but does not include acquisition ofland for Companies. (Section 3 (f) of the Act).3. DELEGATION OF POWERS AND DUTIES TO THE DISTRICTCOLLECTOR3.1 State Government may, by Notification in the official Gazette, directthat any power conferred or any duty imposed on them by the Act beexercised or discharged by the District Collector(Section 3-A of the Act)(Inserted by State Amendment Act 22of 1976)II.PRELIMINARY PROCEEDINGS4.1 While selecting land for acquisition, Requisitioning Department to seethat the public interest and Government interests are considered.(BSO 90(3)).4.2 Requisitioning Department to send application in Form-1 to the L.A.Omarking copy to the District Collector indicating purpose of acquisition,provision of funds along with a plan of the land, details of S.No. wiseextents, boundaries and the name and designation of the officernominated for joint inspection. (BSO 90(6)(ii)).4.3 In scheduled areas, before taking up acquisition, Gram Sabha orPanchayat to be consulted as per Panchayats (Extension to theScheduled Areas) Act, 1996. Refer Govt.
