Collectors and Courts passed after 30-04-1982 and before 24-09-1984.iii)Provisions <strong>of</strong> Section 34 (Interest to be awarded by Collector)apply to (a) cases <strong>of</strong> possession <strong>of</strong> land taken before 30-04-1982 and compensation not paid till such date, w.e.f. that datei.e., 30-04-1982 and(b) to cases where possession taken on or after 30-04-1982but before 24-09-1984 without payment <strong>of</strong> compensationwith effect on and from the date <strong>of</strong> taking possession.2. DEFINITIONS2.1 <strong>Land</strong> includes benefits to arise out <strong>of</strong> land and things attached to theearth. Refer Section 3(a)2.2 Person interested includes all persons claiming an interest incompensation. A person shall be deemed to be interested in land, ifhe is interested in an easement affecting the land (Section 3(b) <strong>of</strong> the<strong>Act</strong>). Beneficiary is also a person interested Refer Neyvely LigniteCorporation Ltd., Vs Special Tashildar (LA) (1995)1-S.C.C 221 Alsorefer Section 50-2.2.3 Collector means the Collector <strong>of</strong> a District and any <strong>of</strong>ficer, speciallyappointed by Government to perform the functions <strong>of</strong> a Collector underthe <strong>Act</strong>. (Section 3(c) <strong>of</strong> the <strong>Act</strong>).2.4 Court means a Principal Civil Court <strong>of</strong> original jurisdiction. (Section3(d) <strong>of</strong> the <strong>Act</strong>)2.5 Corporation owned or controlled by the State means any bodycorporate established under a Central or State <strong>Act</strong> and includes aGovernment Company, as defined in Section 617 <strong>of</strong> the Companies<strong>Act</strong> 1956 (Section 3(C.C)).2.6 Company means a Company as defined in Section3 <strong>of</strong> the Companies<strong>Act</strong> 1956, other than a Government Company, a registered Societyand a Cooperative Society (Section 3 (e)).2.7 Public purpose includes a purpose which the general interest <strong>of</strong> theCommunity, as opposed to the particular interest <strong>of</strong> individuals isdirectly or vitally concerned. It generally includes provision andextension <strong>of</strong> village rites, provision <strong>of</strong> land for town and rural planning,provision <strong>of</strong> land for planned development from public funds, provision<strong>of</strong> land for a Government Corporation provision <strong>of</strong> land for residentialpurposes to the poor, provision <strong>of</strong> land for carrying out any4
