5.4 Government or the District Collector to publish Notification U/S 4(1) ofthe Act in the official Gazette and in two daily News Papers of whichatleast one shall be in regional language.5.5 Public Notice of the substance of Notification also to be given in thelocality.5.5(a) State Amendment of Section 4 regarding service of public notice within40 days from 4(1) Notification got diffused on introduction of CentralAmendment Act, 68 of 1984.- Refer Article 254 of the Constitution of India. IV.DRAFT DECLARATION STAGE6.1 Enquiry U/S 5-A : Any person interested may, within thirty days ofcausing public notice U/S 4(1), object to the acquisition of land.(Section 5-A(1)of the Act).6.2 Every objection shall be made to the Collector in writing. (Section 5-A(2).6.3 Collector to give to the objector an opportunity of being heard and afterhearing and further inquiry, to make a report, containing hisrecommendations to the Government or the District Collector fordecision and such decision shall be final. (Section 5-A(2) of the Act).6.4 Notice U/s 5-A shall be in Form-3.7. SURVEY AND SUB-DIVISION WORK7.1 Demarcation and Sub-Division work based on enjoyment on ground tobe taken up immediately after publication of 4(1) Notification, afterservice of notices U/S 6 of the S&B Act, 1923.7.2 Sub-Division records to be got scrutinised by the DIOS, concerned.8. DRAFT DECLARATION U/S 68.1 Government or the District Collector, after considering the report U/S5-A, to make declaration U/S 6 of the Act within one year from the dateof publication of the Notification U/S 4(1). (Section 6(1) of the Act).8.2 Period of stay, if any, granted by a Court to be excluded.8.3 To be published in the official Gazette and in two daily News Papers ofwhich at least one shall be in regional language. (Section 6(2) of theAct).8.4 Collector to cause public notice of the substance of such declaration tobe given at convenient places in the locality. (Section 6(2) of the Act).8.5 The last of the dates of such publication to be the date of publication ofthe declaration. (Section 6(2) of the Act).8.6 Such declaration shall be the conclusive evidence that the land isneeded for a public purpose. (Section 6(3) of the Act).7
