32Schedule 1 – Relevant Vic<strong>to</strong>rian LegislationVersion No. 051Residential Tenancies Act 1997No. 109 of 199711 Farming and grazingThis Act does not apply <strong>to</strong> a tenancy agreement if <strong>the</strong> rented premises are included in or on o<strong>the</strong>rpremises let <strong>to</strong> <strong>the</strong> tenant by <strong>the</strong> landlord that are for <strong>the</strong> time being used, or are ordinarily used, for<strong>the</strong> purpose of—(a)grazing, including agistment; or(b) farming, including dairy farming, pig-farming, poultry farming, fish-farming, treefarming,bee-keeping, viticulture, horticulture, fruit growing or <strong>the</strong> growing of crops of any kind.Division 8—Rights of entry85 Entry of rented premisesA landlord or <strong>the</strong> landlord's agent has a right <strong>to</strong> enter rented premises <strong>to</strong>ge<strong>the</strong>r with any personswho are necessary <strong>to</strong> achieve <strong>the</strong> purpose of <strong>the</strong> entry—(a) at any time agreed with <strong>the</strong> tenant if <strong>the</strong> tenant has consented not more than 7 daysbefore <strong>the</strong> entry; or(b) for a purpose set out in section 86, at any time between 8 a.m. and 6 p.m. on anyday (except a public holiday) if at least 24 hours notice has been given <strong>to</strong> <strong>the</strong> tenant in accordancewith section 88.86 Grounds for entry of rented premises(1) A right of entry in respect of rented premises may be exercised if—(a) before giving notice of entry, a notice <strong>to</strong> vacate or a notice of intention <strong>to</strong> vacate <strong>the</strong>rented premises had been given and entry is required <strong>to</strong> show <strong>the</strong> premises <strong>to</strong> a prospective tenant;orAshling Gandy v Australia, Individual Communication <strong>to</strong> <strong>the</strong> Human Rights Committee
