Youth and Oil & Gas Governance inGhanaWho Owns the Oil?Article 257(6) of the Ghanaian Constitution of 1992 states: “Everymineral in its natural state in, under or upon any land in Ghana,rivers, streams, water courses throughout Ghana, the exclusiveeconomic zone and any area covered by the territorial sea or continentalshelf is the property of the Republic of Ghana and shall bevested in the President on behalf of, and in trust for the people ofGhana.”However, the right for exploration, development and productionof different offshore blocks was sold in 2004. Chapter 2ExcurseTraditional Ghanaian Land OwnershipMost the Ghanaian land is either owned by stools, skins, familiesor clans, usually held in trust by the chief or the head of family/clan. But as stated in the constitution, “minerals under or uponany land” belong to the Government of Ghana.Especially directly after the findings, there should have been bettercommunication between the Government and the local communities.Apparently the chiefs and people of Ahanta and Nzema,the local ethnic groups next to the oil exploration sites, were verydisappointed that they were not officially in-formed about the discoveryof oil on their ancestral land. Though by law the oil clearlybelongs to the state, demands for royalties arose. 6The Oil Policy of the Government of GhanaGhana is member of the Extractive Industries Transparency Initiative(EITI). The organisation was launched in 2002 and “encouragesgovernment, extractive companies, international agenciesand NGO’s to work together to develop a framework to promotetransparency of payments in the extractive industries”. 7 The aimof the initiative is to create an environment of transparency andaccountability between companies, governments and citizensin resource rent-seeking states. After publishing data and independentreports on the country’s mining sector, Ghana achievedcompliance with the EITI in October 2010. Even though the membershipof Ghana in the EITI is a major step towards a transparentre-source management policy, it has to be noted that it is first andforemost focusing on Ghana’s mining sector.
