Review and CommentWho Says BrooklynitesDon’t Care?By Carl BlumenthalFor Brooklyn Daily EagleI didn’t see it coming. Not a bus barreling through a red light, but ourcar breaking down after a Saturday night on the town.My wife, Susan, and I had celebrated our 18 th anniversary, with her sister,Rosemary, at an Indian restaurant on 3 rd Avenue at 73 rd Street in BayRidge. Afterwards, Susan and I headed south on 4 th Avenue toward the 17 thStreet entrance to the Prospect Expressway, and our home off the FortHamilton Parkway exit. When the various warning lights started flickering on the dash as wepassed Green-Wood Cemetery, I became concerned, but not overly so. Ibelieved it was just an electrical ghost in the machine; we could ride itout. However, when the headlights dimmed, I feared we wouldn’t makeit. Our 2004 Subaru Forrester ground to a halt in the right turning lane to17 th Street, where we were sitting ducks for anyone wanting to get on theProspect. And guess what? Not only was I slow to understand the meltdownwarning signs, but Susan and I are semi-Luddites in another way—wedon’t own cell phones. While she went into the corner grocery store,Earth’s Basket, to call Allstate for a tow, I tried to route vehicles aroundours, a dangerous proposition because even temporary parking isn’t allowedthere. Eventually, I moved a sawhorse on the sidewalk of an adjacentconstruction site to the road in front of my car to prevent a collision.Meanwhile, the store’s owners were nice enough to let my wife usetheir phone while she haggled with Allstate and their supposedly localcontractor to arrange our rescue. (They refused to deliver the car to ourmechanic, McGready’s, on Coney Island Avenue at Avenue U.)Back on the street, a dozen people of all races, classes, and genders offeredhelp, including a couple of local tow truck operators. In good faith,I could not accept their assistance because Allstate’s tower confirmed hewas on his way. Had a passing NYPD squad car and tow truck stopped, Iwould have refused them too. After more than two hours of waiting for Allstate, Earth Basket’s principalowner, Sam Sarsour, offered to move his legally-parked car fromin front of the store. With his and his brother’s help, as I steered our3,500-pound Subaru, we pushed it to that spot. Sam wouldn’t accept anymoney, neither for the use of his phone nor for his labor. On Monday morning I called our mechanic for the name of a reliabletowing company. While I stood in the rain for only 30 minutes duringrush hour until Citywide Towing arrived, Sam emerged from Earth’s Basketto confirm he closed at 1 a.m. Sunday; Allstate never showed.I suppose all’s well that ends well! Citywide jumped our car, allowingme to maneuver it to the back of one of the company’s new flat-bedtrucks. From there we went to McGready’s. As I belatedly suspected, anewly installed alternator had failed to deliver juice from the battery tothe electrical system. Fortunately, it was under warranty. Therefore, the moral of this tale is don’t depend in tight spots on thebig guys. Rely on the little people, who know what it’s like to be at themercy of impersonal forces. Fort Hamilton Dedicates Bluff to Fallen SoldierBy Paula KatinasBrooklyn EagleAt Brooklyn’s Fort HamiltonArmy Base, there is abluff on the waterfront thatoffers a breathtaking viewof the Narrows and the Verrazano-NarrowsBridge. Startingthis past Thursday, thatbucolic space will foreverbe known as EngeldrumBluff in memory of ChristianEngeldrum, a firefighter-turned-soldierkilled in theIraq War.Engeldrum, 39, a staff sergeantin the 69th InfantryRegiment of the New YorkArmy National Guard, waskilled when his vehicle hit animprovised explosive device(IED) while he was on dutyoutside of Baghdad on Nov.29, 2004.Before his tour of duty inIraq, Engeldrum, who hailedfrom the Bronx, was a NewYork City firefighter assignedto Ladder Co. 61 in his nativeborough. He was a first responderat the World TradeCenter site following theSept. 11 attack, assisting in therecovery effort. He is buried atArlington National Cemetery. On Thursday, soldiers, firefighters, community leaders,Engeldrum’s wife Sharon, his mother Lenora and membersof his family gathered atthe fort for a ceremony dedicatingthe bluff in his name. The fort’s commander,Col. Eluyn Gines, had originallyplanned to hold theceremony on the bluff, but arainstorm forced a change ofvenue and the event was heldinside the fort’s Post Theater. The change gave the ceremonya much more intimate feelthat it might have had if it hadtaken place outside.A large photo showingthe plaque bearing Engeldrum’sname was unveiledon the theater’s stage duringthe ceremony.Gines called Engeldrum“an American hero,” and saidit was fitting that the ceremonywas taking place during aweek when the nation wascelebrating the 238th birthdayof the US Army and whenthe fort is marking its 188thbirthday. “It is a week of celebrationbut also of remembrance,”Gines said, addingthat it is important to recallthe lives lost in war and theloved ones they left behind.“Every life lost is a tragedy. There’s really no preparationfor it. It’s a pain that ripsthrough your soul,” he said.Gines announced thatin addition to the bluff dedication, the fort was also reservingfour permanent parkingspaces on the base for thefamilies of military memberskilled in war.New York City Fire CommissionerSalvatore Cassano, who noted that Engeldrumhad saved lives as afirefighter, said that he was“a true hero in every senseof the word.” After the Sept.11 attack, Engeldrum “rushedto the World Trade Center torescue thousands.” The firstresponders, Cassano said, were “among the first in thebattle against terrorism.”The firehouse where Engeldrumworked containsa plaque dedicated in hismemory. There is also a Veteransof Foreign Wars (VFW)post named after him, Cassanosaid. The fort dedicationis meaningful, the commissionersaid. “With this ceremony,Christian will foreverbecome a part of Fort Hamilton,”he said. The 69th Infantry Regiment, the unit Engeldrum belongedto, is known as the“Fighting 69th.” Lt. Col. JamesGonyo, commander of theregiment, recalled that Engeldrum’scolleagues called him“Chris,” or by his nickname,“Drum.” Gonyo said that visitingthe bluff “will allow us topause and remember; to goand remember and shed a tear.”Engeldrum Bluff will also givemilitary members a chance to“find the courage to go on withour lives,” Gonyo said.Gonyo read aloud theJoyce Kilmer poem “RougeBouquet,” about soldiersfrom the Fighting 69thkilled in a World War I battle. The poem included thelines, “Dead in their youthfulprime, never to laugh norThis portrait of Christian Engeldrum, firefighter and soldier who died in the Iraq War, was displayed atThursday’s ceremony at Fort Hamilton.Eagle photo by Paula Katinaslove again, nor taste the summertime.”Of all the speakers, the personwho received the mostsustained applause was theperson who spoke only a fewsentences. Engeldrum’s widow,Sharon, thanked all thosetaking part in the ceremony. “Ithank you for the great honor,”she said. She left the stage to astanding ovation.Following the ceremony,Lenora Engeldrum saidthe event made her happy.“It’s great to know that Chrisis being remembered,” shetold the Brooklyn Daily Eagle. She described her son as“an action man” and said hesigned up for the NationalGuard following the Sept. 11attacks. “He was outraged bywhat happened on 9/11,” sherecalled. Her son always hada sense of fairness and wouldbecome upset if he sawsomething unfair, she said. She wasn’t surprisedwhen Chris served in boththe military and the Fire Department.“That he was a littleboy, he was always playingwith a G.I. Joe. And hehad firetrucks, too,” she saidwith a smile.Thompson in Coney: CityMust Prepare for DisastersBy Paula KatinasBrooklyn EagleThe city needs to do abetter job of preparing andresponding to natural disasters, former Comptroller BillThompson said after takinga tour of areas of Coney Islanddamaged by SuperstormSandy.During a visit to a ConeyIsland senior center on June13, Thompson, one of the sixcandidates running in theDemocratic Party primaryfor mayor in September, outlineda series of steps he saidwould help prepare the cityfor the next natural disasteror terrorist attack.Thompson said that if heis elected mayor, he wouldcreate a new post of deputymayor for infrastructure andconstruction. The deputymayor would be in charge ofconverting billions of dollarsin post-Sandy federal aid intolong-term city planning toupgrade power, sewage andtelecommunication systems.“We must plan — andact — today to prepare fortomorrow,” Thompson said.“We cannot secure New York’spromise of opportunity ifsome families and communitiesare left fending for themselveswhen disaster strikes.”“When I’m mayor, communitiesin southeast Queens,Mayoral hopeful and former Comptroller Bill Thompson tours theSea Gate area with a community leader. Thompson calledfor the building and expansionof sand dunes and thestabilization of sand dunesand beach shrubs along theRockaways, in Jamaica Bayand in waterfront areas. His disaster preparednessplan includes the creationof a new emergency call systemthat would automaticallyroute fire and life-threateningcalls to local dispatchersin each borough, a move thatThompson said would savetime and lives. The calls wouldbypass the city’s Unified CallTaker System.Recalling the gasolineshortage that hit New Yorkersin the wake of Sandy, andthe long lines at gas stations,Thompson called for a temporarysuspension of maritimelaws that block bargesfrom delivering fuel to thecity. The plan would deliverlarger quantities of fuel tothe hardest-hit communities, remove trucks from alreadystrained roads, and help preventthe long gasoline linesexperienced after the hurricanehit, he said.Thompson said he wouldlaunch a new “Bringing BusinessesBack” initiative to assistsmall businesses withinsurance, planning, and resourcesbefore, during, andafter disasters. His plan alsoincludes using federal stimulusto lower the cost of renters’insurance for residentswho live in New York CityHousing Authority buildings, especially senior citizens andfamilies on fixed incomes livingin evacuation zones.Thompson also called forincreased support for families, small businesses andcommunities still reelingfrom Hurricane Sandy.Flood Watch Issued forBrooklyn and VicinityBy Mary FrostBrooklyn EagleThe National WeatherService issued a floodwatch through Friday eveningfor Brooklyn and therest of the city’s five boroughs,as a powerful stormcontinued along a pathtaking it from the OhioValley to south and east ofLong Island. This system is expectedto produce high windsand heavy rain, with rainfalltotals ranging from 2to 3 inches, and in someareas up to 4 inches. The watch is in effectthrough Friday evening.Early Thursday morning, winds estimated toA flood watch is in effect forBrooklyn and the GreaterNew York York area throughFriday evening.have reached 70 to 80 mphblew through some areassouth of Chicago fromthe same weather pattern. The storm briefly suspendedcompetition at the U.S.Open near Philadelphia onThursday morning.Friday, June 14, 2013 • Brooklyn Eagle • 3

S portsWhole New Ball Game for KiddBrooklyn’s Novice Coach Ready To Take Nets to Next LevelBy John TorenliSports EditorBrooklyn EagleJason Kidd’s numbers are to diefor. The future Hall of Fame pointguard ranks second all-time in assistsand steals, is the only playerever to put up at least 15,000 points,10,000 assists and 7,000 reboundsand is third in career triple-doubleswith 107 in the regular season and 11more in the playoffs. The 40-year-old San Francisconative also owns an NBA Championshipring, two Olympic Gold Medalsand was a 10-time NBA All-Star.His career record as an NBAcoach, however, currently stands at0-0, making his official hiring Thursdayafternoon as the 18th head manin Nets history a risky one, to saythe least, for Brooklyn general managerBilly King and ultra-demandingteam owner Mikhail Prokhorov.“Anytime you make a hire, youtake a risk,” admitted King duringKidd’s introductory press conferencejust inside the main entranceto the Barclays Center before athrong of media gathered to take itsfirst poke at the recently retired 19-year NBA veteran.“I’ve known him for a long time,so I don’t worry about whether guysare going to respond to him,” Kinginsisted. “He works hard and that’swhat I believe in.”As for Kidd, who finished up hiscareer with a well-chronicled scorelesseffort in the Knicks’ playoff seriesagainst Indiana last month, thechallenge of taking over a team thatwon 49 games a season ago andreached the playoffs for the firsttime since 2007 is one he embraces.Albeit with a bit of understandabletrepidation.Instead of fending off opposing point guards, new Nets head coach Jason Kidd has to deal with the New York media contingent.AP Photos“I’m nervous,” Kidd said. “I’m arookie. I go from being one of theoldest players in the league to beinga rookie head coach. I have a lotto learn about coaching. But this isa championship caliber-type team.Hopefully, I can communicate thatto the guys.”Kidd’s on-the-court communicationskills were never questionedduring his playing days. The most deft and defiant hardwoodquarterback of his era, thenewly minted coach must nowpass on those formidable skills andhis knowledge of the game to theNets’ $98 million point guard DeronWilliams, who struggled in that roleduring the first half of last season.“He’s the guy I want to pass thetorch to,” Kidd said of Williams, whowas on hand to welcome his thirdhead coach since the Nets openedthe Barclays in November. “He lovesthe competition and that’s where itall starts. I think Deron is one of thebest point guards in this league.”King, who cited a need for great-“Jason Kidd combined everythingwe were looking for. The onething about Jason is he’s alwaysworked hard. He doesn’t just wantto be good at something, he wantsto be great. He was an unselfishplayer. He wasn’t a great shooterwhen he came in the league, but hebecame a great shooter. He’ll makesure we go in the right direction.”“The mission is to win,” Kiddstated emphatically. “This is a teamthat should score at least 100 points(a night), but you can’t win championshipswithout defense. Deron isone of the best point guards in theleague. Brook Lopez is obviouslyvery talented. Those are two positionsthat we’re set. My job is to getthe most out of them. We want tobe like the best franchises in sports, like San Antonio. We want to win50 games for the next 12, 13 years.”Fortunately for Kidd, he won’thave to go it alone. There are already rumors circulatingthat former Nets coach andclose Kidd confidant LawrenceFrank will be brought in as a topassistant. Kidd openly campaignedfor the man he played under for thefour of his six seasons with the NewJersey Nets, whom he led to thefranchise’s only two NBA Finals appearancesin 2002 and 2003.“We’re in discussions about astaff. Lawrence would be a greatcandidate,” Kidd said. “I understandthat I will lean on my staffheavily and learn from them. Youhave to start with structure. It startswith your leader. Guys will hear metalking, My message will be simple:‘You have to play hard, play defenseand work together.’”While most head coaches runpractice with a whistle in theirmouths from the sideline, Kiddis still spry enough to get up anddown with the league’s best ath-General manager Billy King believes Jason Kidd has what it takes to get the Nets to the next level.Jason Kidd hopes to “pass the torch” to Deron Williams in Brooklyn.er toughness from the high-pricedroster he put together during a $330million spending spree last summer, firmly believes that Kidd haswhat it takes to make the Nets oneof the elite franchises in the league.“When this process started, wewere looking for a coach with greatleadership to help our players competeand play hard,” said King, whointerviewed Indiana assistant BrianShaw on Wednesday before committingto Kidd. That direction has to be up in2013-14, as Prokhorov is in NBA Finals-or-bustmode entering hisfourth season at the helm of the recentlyrelocated franchise.Armed with a “Big Three” ofWilliams, All-Star center Brook Lopezand shooting guard Joe Johnson, and a strong cast of supportingplayers, Kidd must take the Nets furtherthan the first round of the playoffsnext season for this hiring to bedeemed a prudent one by King.letes should he decide to lace themup again. But the best player in Nets historyisn’t about to entertain thoughtsof a comeback on the hardwood, especiallynot with all the work he hasahead of him in the film room and inadvance of this month’s NBA Draft.“I would have to take a lot ofAdvil,” Kidd jibed when the Eagleasked if he’d actively participate inteam practices. “I’ll just keep therunning to the treadmill.”4 • Brooklyn Eagle • Friday, June 14, 2013

In her ownwords about her childhood: “Iwas the kinda kid that wouldn’teven cut school when we had ahalf-day. But I was mouthy. Alwayshad an answer. My mouthgot me into trouble.” Even as achild she had a yen towards theacting profession maybe not asstrong as towards becoming asinger, but she realized she didn’tquite have the talent for that. She took ballet, tap and jazzdancing but decided that wasn’tfor her either. At age 13 Leah moved toLos Angeles with her motherand sisters. At 14 she droppedout of school. Her mother warned her thatwas okay only if she was goingto achieve some form of greatnessin life. Leah worked atwaitressing, selling car insurance, and as a telemarketer fora solar heating company and acontinuous job of auditioningfor acting roles.Leah developed an unapologeticattitude about her brazenattitude toward life and her actingcareer. A caustic wit pervadesnearly everything shesays; expletives pepper her sentences, reinforcing the stereotypeof a tough-talking Brooklynite. But asked if she’d consider toningdown her Brooklynese,Remini pounced: “No. Are youtrying to give me a hint that Ishould drop it? I can lose the accent;I just have to really focuson what I’m saying. Bill Would Give NY Adoptees AccessTo Birth Certificate, Medical HistoryLeft-right: Senator Velmanette Montgomery, Peter W. Franklin with Adoptees WithOut Liberty(holding baby) and Assemblyman David Weprin.Photo courtesy Assemblyman Weprin’s OfficeBy Mary FrostBrooklyn Daily EagleUnder a bill proposed byAssemblyman David I. Weprin(D-Fresh Meadows), adultadoptees in New York statewould be able to obtain a copyof their original birth certificatesand a medical historyform. The bill would also providea birth parent with a form to letthe child know if the parentwanted to be contacted directlyby the child or through an intermediary.Weprin, along with cosponsorSenator VelmanetteMontgomery (D-Brooklyn)and other representatives, helda joint press conference withthe New York StatewideAdoption Reform's “UnsealedInitiative” at City Hall to supportthe “Bill of Adoptee Rights.”“It is very important to mefor all people, especiallyadoptees, to have ready accessto their birth certificates andbirth family medical recordsfor their health and the wellbeingof their families,”Senator Montgomery said in astatement.“New York State adopteesare currently denied their originalbirth certificates and inturn knowledge of their originalfamilies, ethnicities, medicalhistories and more,” saidSenator Andrew J. Lanza (R-Staten Island). “No one shouldbe denied the right to obtaininformation about themselvesconcerning medical or otherpersonal information of thenature involved here.”Amending the existingNew York adoption lawswould provide adoptees ages18 and older with birth certificatesand in many cases informationabout religious andethnic ancestry as well asmedical information.Under the bill, the adopteewould receive a certified copyof his or her original birth certificate, according to the languageof the Senate version ofthe bill. The copy would state:“This is a certified copy of anoriginal birth certificate. Thisoriginal birth certificate hasbeen superseded by anothercertificate on file with the appropriategovernment agency.”Joyce Bahr, president ofAdoption Reform's UnsealedInitiative, urged the Assemblyand the Senate to pass the bill, saying, “No other group of U.S.citizens has their identitieswithheld by the state. The Billof Adoptee Rights gives alladult adoptees the right to anon-certified copy of their birthcertificate as well as familymedical records, and does sowith respect to birth parents, who will have the option to filea contact preference if theychoose so.”Currently, a New Yorkadoptee cannot access his orher original birth certificateunless they go through thecourts, and even then, the outcomeis not guaranteed. An online petition urgingpassage of the bill has garneredmore than 8,000 signaturesat PetitionOnline.comMaine, New Hampshire,Oregon, Alabama and RhodeIsland have passed openrecords legislation; Kansasand Alaska are the only statesthat have never sealed records.TAG SALECADMAN TOWERSBLDG BKLYN HTS101 CLARK ST(BET. The titlerole of the courtesan Violetta Valery, based on Camille in “The Lady of theCamellias” by Alexandre Dumas fils, was sung and acted to perfection bysoprano Andrea Bargabos. The drinkingsong “Libiamo,” sung with her eageryoung suitor, Alfredo, was a blendof bravura fireworks, with Ms. Bargabosrevealing a creamy voice of greatbeauty, agility and power. Her floating tones and portamentosof “Ah, Fors’è Lui” were astonishing, and Ms. Bargabos scored a triumphin a thrilling “Sempre Libera,”with ornamental phrasing and coloraturafireworks, and an electrifyinghigh E-flat at the end! Ms. Bargabosability to “swell” and diminish ona high note showed remarkable breathcontrol. In the second act, Ms. Bargabos’defiance to the elder Germont’s insistencethat she leave Alfredo to preservethe family honor, and her ultimateyielding to his request, washeartbreaking. Her “Alfredo, di questocore” in the third act gripped ourhearts with an outpouring of anguishand vocal gold. Her “Addio del Passato”in the final act and “Ah! Gran Dio!”and her sudden burst of life before herfatal collapse was riveting. Her letterscene was penned to last forever inmemory. Ms. Bargabos was a Violettafor the ages! Her Alfredo was the promisingyoung tenor David Bailey. Bailey’ssinging in the “Libiamo” revealed apurely lyric sound with a bit of bite toit. Bailey’s singing of “De’ Mei BollentiSpiriti” at the beginning of the secondact was nicely performed, and hehit a solid high C in the cabaletta thatfollowed. His plangent outpouring intheir final duet “Parigi, o Cara” had ardentsweetness. Bailey’s defiance ofthe elder Germont was effective, andhis remorse was touching. The role of the elder Germont wasin the secure hands of Ricardo Rosa, whose rich, round and mellow baritoneblended well with Violetta in the“Piangi” duet. Germont’s exquisite singingof “Di Provenza Il Mar, Il Suol“ conjuredup the great baritones of the past, and his remorse and request for forgivenessat the finale struck our hearts.Mezzo Jennie Mescon was a splendidFlora Bervoix, friend to Violetta, and vibrant baritone Kevin Rockowerwas a strong Baron Duphol. His resoundingglove slap of Alfredo at theend of Act 2 was great theater. The rest of the cast included NicholasConnelly as Marquis d’Obigny;Jonathan Dauermann as a resonantDr. Grenvil, a physician; ChristinaHourihan as Violetta’s loyal, sympatheticmaid Annina; Bryan Ribeiro’sGiuseppe, a servant; Daniel Kerr as acommissioner; and the multi-talentedWayne Olsen as Flora’s servant. The production featured brightand colorful period costumes by JuliaAt a party at Violetta’s house, Alfredo (Paolo Buffagni, seated left), Violetta (Alexis Cregger, seated right) and the rest of the guests enjoy the evening.Cornely, lighting by Tyler Learned andsupertitles by Linda Cantoni. The chorus sang with power andprecision. The plush sets, designed byLinda Lehr, of Violetta’s Paris salonwith its ribald parties, the Act 2 floralgardens, and the final act’s grim bedchamber, were remarkable. The stagedirection, also by Linda Lehr, broughtus into the drama of salons and thesplendor of Violetta’s world with fluidityand abandon. The brilliant conducting of MaestroScott Jackson Wiley and the 33splendid musicians of the Regina Orchestrakept things going at a briskpace. The strings, so prominent inthe preludes and throughout, werein the sterling hands of concertmasterYelena Savranskaya. Maestro Wileybrought out all of the nuance and poignancyof this magnificent score. Welook forward to the 44th season of operaat Regina!Friday, June 14, 2013 • Brooklyn Daily Eagle • 19

PAGE 20 June 14, 2013Brooklyn Becomes First Borough ToRequire Mediation in Civil CasesBy Charisma L. Miller, Esq.Brooklyn Daily EagleBrooklyn Supreme Court usheredin a new project Thursdayrequiring civil cases to pass througha mediation process prior to proceedingto trial. The first of its kind, themandatory mediation project hopesto alleviate some of the costs andother strains that civil litigationplaces on Brooklyn’s court system.“Brooklyn has over 54,000 casespending, which is more than anyother county in New York” BrooklynSupreme Court AdministrativeJudge for Civil Matters LawrenceKnipel told the Brooklyn DailyEagle. “Mandatory mediation willhopefully reduce to time and financialcosts of a trial not only for thecourt but for the attorneys and partiesinvolved.”Typically, once all parties haverequested and received evidencefrom either side, deposed witnesses, and conducted necessary investigations,a note of issue is filed and thecase is calendared for trial.Mandatory meditation, however, will apply after the discovery phaseand prior to the calendaring of a trialdate. The rationale, Knipelexplained, is that once discovery iscomplete, the parties will have anopportunity to mediate the issues ofthe case in the hope of reaching a settlement. This innovative attempt to reducethe time and costs involved in civilAttorney Bruce Baron, center, with the parents of Kevin Eng.litigation has been well received byBrooklyn attorneys, albeit with somereservation. “It is always a good ideato try to have mediation as soon aspracticable,” said Gary Zucker,B’klyn Teacher in Sex Scandal Case Pleads GuiltyBy Charisma L. Miller, Esq.Brooklyn Daily EagleErin Sayar, former Englishteacher at James Madison HighSchool in Marine Park, has pleadedguilty to sexual assault chargessteaming from accusations that sheengaged in a sexual relationshipwith her student, Kevin Eng.Sayar, 36, subsequently turnedherself in to Brooklyn’s SpecialVictims Unit on the eight criminalcounts of statutory rape, 16 countsof sexual abuse of a minor, andother related charges. She wasreleased on $10,000 bail. After appearing in BrooklynSupreme Court, Criminal Term,Sayar has pleaded guilty to thecharges and will receive a 10-yearprobation sentence.Despite the end of Sayar’scriminal case, there is still a civilcase pending against Sayar and theNew York City Department ofBrooklyn Administrative Judge for Civil Matters Lawrence Knipel andretired Supreme Court Justice Jules Spodek. Eagle photo by Mario BelluomoErin Sayar, former teacher atJames Madison High SchoolEducation for their alleged role inthe assault and battery of Eng. The suitalso asks for punitive damagesagainst Sayar and the Departmentof Education.“The Eng family is thankful toBrooklyn District Attorney CharlesJoe Hynes for securing swift justiceagainst Sayar for her unlawfulacts,” Baron said in a statement.“We now look forward to aggressivelypursuing all defendantsresponsible in the civil matterpending in Supreme Court KingsCounty.”named partner at Zucker & Bennett,P.C. “Hopefully some of these casesthat would otherwise back up thetrial calendar can be settled quicklyand efficiently.”The first round of cases that willbe affected by mandatory mediationare all cases involving the New YorkCity Transit Authority. “We wantedto narrow to scope for the initialcases selected for the pilot program,”Knipel said. “There are about 10-12Transit Authority cases a week, andwe decided that that was a manageablenumber.”“The success of the pilot programwill depend on the TransitAuthority,” Zucker noted. “The Cityof New York has an aggressive settlementpolicy. It will depend onwhether or not the Transit Authoritywill approach cases in the same mannerand make a concerted effort tosettle.” Zucker also noted that themediators will also play a large rolein the success of the program. The mediators will be selectedfrom a group of volunteers who willwork without compensation. FormerSupreme Court Justice Jules L.Spodek, father to current BrooklynSupreme Court Justice EllenSpodek, will serve as the project’sfirst mediator. “It is always betterwhen all parties agree to settle,”noted Knipel.“I expect mandatory meditationto be effective in weeding out thetrial backlog in Brooklyn SupremeCourt,” said Knipel. Knipel hopes tosoon expand the mediation toinclude a wide variety of civil litigationcases.Justice DepartmentWeighs In On NYCStop-and-Frisk CaseBy Colleen LongAssociated PressThe U.S. Justice Department hastreaded carefully into the debateover the New York PoliceDepartment's stop, question andfrisk policy, telling a federal judgethat it strongly endorses an independentmonitor to oversee changesshould she decide civil rights violationshave occurred.Lawyers for the JusticeDepartment filed a 21-page statementof interest in the case lateWednesday, the last day to filepaperwork.
