Review and CommentSearch for MotivesIn Boston BombingWith so much uncertainty about the motives for the Boston Marathonbombings, journalists and investigators are probing every life detail of thetwo accused brothers, Tamerlan and Dzhokhar Tsarnaev.Were they angry at America? Islamic jihadists? Mentally unstable?Could this have been Chechen-style tribalistic revenge for a wrongdone? Were they influenced by violent video games, academic failures, ortheir parents’ breakup?Much is now being read into their public statements.“Worldview: Islam. Personal priority: career and money,” wrote Dzhokhar.“I don’t have a single American friend, I don’t understand them,” saidthe older brother, Tamerlan.Their uncle, Ruslan Tsarni, told reporters: “Being losers, not being ableto settle themselves and thereby just hating everyone else who did.”The list of possible reasons goes on as more information about themis revealed – perhaps even by an injured Dzhokhar from his hospital bed.The public desire for a simple explanation is driven by a desire for simplesolutions to prevent a similar attack. After almost every mass killing –Boston, Newtown, Aurora, 9/11, etc. – the public fear of a recurrence pushesthe drive for quick remedies, especially from government. Yet too oftenelected leaders and law enforcement respond hastily with simplistic oreven wrong preventive measures.Remember the five-color “threat alert system” from the Department ofHomeland Security? It’s gone. The invasion of Iraq, too, looks like a misguidedresponse to 9/11. Airport security checks are being constantly revised.Pinning down the motives of an attacker can be an impossible task, makingprevention more complex. And merely adding more “hard” defenses – suchas armed teachers in schools, drone attacks on terrorists, or bag checks at publicevents like a marathon – may not be enough without dealing with motives.Background checks for gun buyers, however, at least begin to deal with motives– weeding out those not stable or trustworthy enough to own a gun.As the final capture of the suspected Boston bombers shows, governmentneeds everyone to be alert in helping solve and perhaps prevent a masscrime. The bombers had been filmed by private citizens, for example, andDzhokhar was discovered in a boat by an alert resident of Watertown, Mass.Such actions speak to a deeper need to be aware of others – mainlytroubled young men – who may act or speak in a way that could lead to violence.Would-be killers can be stopped if only one person perceives somethingwrong and works to counteract it.This isn’t always easy. Being alert to evil motives takes discernment aswell as well-meaning and sensitive outreach. How many mass killings havebeen prevented by wise intervention? We may never know. City Council Passes Resolution To Save LICHBy Mary Frost<strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong>The City Council voted Thursdayafternoon in favor of a resolution tosave <strong>Brooklyn</strong>’s Long Island CollegeHospital (LICH) from closing.The non-binding resolution, introducedby City CouncilmembersBrad Lander and Stephen Levin,calls on the State University of NewYork and the state Department ofHealth to work with stakeholdersto find a new owner for the 150–year–old Cobble Hill institution.LICH supporters have been holdingmarches and signing petitionssince SUNY voted twice to close LICH,an affiliate of financially-troubledSUNY Downstate in East Flatbush.Residents fear that SUNY Downstatewill sell LICH’s valuable realestate to developers and use thefunds to prop up the nearly bankruptDownstate.LICH serves a booming sectionof <strong>Brooklyn</strong> stretching from RedHook to Williamsburg.To preserve health care in theseneighborhoods, the resolution stipulatesthat “all resources gained fromThe full New York City Council approved on Thursday a non-binding resolutionto save <strong>Brooklyn</strong>’s Long Island College Hospital (LICH), shown above.any sale or transfer of LICH assetsare used exclusively for the preservationof these services.” It also authorizesthe speaker to file amicus briefson behalf of the council in support ofthe preservation of these services.“The loss of Long Island CollegeHospital would be a tremendousblow to the Downtown <strong>Brooklyn</strong>community and our entire city,”City Council Speaker ChristineQuinn said in a statement. “TheCouncil Resolution sends the messagethat preserving access to vitalhealth care in Downtown <strong>Brooklyn</strong>is a top priority for us.”“I appreciate Speaker Quinnlending her support for our community’sefforts, and I am very gladthat that the City Council will beproviding an amicus brief in thelawsuit,” said Lander. “The communitystands ready to work withall stakeholders to preserve criticalhealth services at LICH.”Levin pointed out that LICH providesmedical care for over 100,000patients each year and employsmore than 2,000 people. “Togetherwith Speaker Quinn and CouncilMember Lander, we are callingon SUNY and the state Departmentof Health to work toward the acquisitionof LICH by another healthcare institution so that the peopleof <strong>Brooklyn</strong> can continue to receivehealth care they depend on," he said.City Council Health CommitteeChair Maria del Carmen Arroyopointed out that Red Hook is especiallydependent on LICH. “For morethan 150 years, LICH has been a criticalpart of the <strong>Brooklyn</strong> healthcaresystem, including the Red Hook area,a neighborhood specifically designatedas a ‘Health Professional ShortageArea’ by the U.S. Department ofHealth and Human Services.”While the resolution does nothave force of law, it would be “a tremendousshow of support from theCity Council and would help putpressure on state elected officials,the Department of Health, and SUNYto find a solution to keep LICH openfor care,” Eliza Bates, a spokespersonfor the New York State Nurses Association,said Tuesday.Loreto Gasmen, a nurse at LICHsince 1975, thanked the City Councilfor its support. “This resolutionwill help strengthen our movementto keep LICH open for care so thatwe can keep saving lives.”“Wait times in <strong>Brooklyn</strong> ERs arealready some of the highest in thecity,” said Anne Bové, an official ofthe New York State Nurses Association.“Instead of closing hospitalsin one of our most medically-underservedboroughs, state officialsneed to expand healthcare accessfor <strong>Brooklyn</strong> patients.”The Council’s health subcommitteeunanimously approved theresolution on Wednesday, <strong>April</strong> 24.On Thursday, supporters and representativesheld a press conferenceon the steps of New York City Hallin support of LICH.According to the New York <strong>Daily</strong>News, LICH officials pledgedWednesday to step up their searchfor a new operator for the facility.Bay Ridge Residents Fear Influx of Drug DealersBy Paula Katinas<strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong>Bay Ridge residents are demandingaction to combat drug dealerswho they say are invading the areaaround an important commercialzone, making neighbors and storeownersfearful and angry.The drug dealers and their customersappear to be congregatingon Fifth Avenue and the side streetsadjacent to the shopping area, accordingto residents. The illegal activitycan also be found on theblocks from 72nd to 76th streets betweenFourth and Sixth avenues.“It’s a serious problem and it’sbeen going on a long time. You’reafraid to go out at night. What’s happeningis that you become a prisonerin your own home,” June Johnson,a longtime 76th Street resident, toldthe <strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong>. “I’ve heardreports of people running in and outof houses. And I spoke to a deli owneron Fifth Avenue who told me he hasseen drug deals going on,” she said.A 74th Street resident who askedthat his name not be used said hestarted to become concerned twoyears ago when he saw suspiciousactivity on his block. “I would noticea kid on the corner and anotherkid on a bicycle halfway up theBay Ridge residents fear that drug dealers are invading quiet streets such as thisone.<strong>Eagle</strong> photo by Paula Katinasblock. People would give money tothe kid on the corner and then goget the drugs from the kid on the bicycle,”he said.The resident said he wasn’t surewhat types of drugs were beingsold. “But I think it could have beenheroin or cocaine,” he said. “I’m veryworried about this. I have three children,two of whom are still livingat home, and they come home atnight,” he added.The same resident said he oftenfinds the sidewalk in his block litteredwith small plastic bags in themorning.Residents said they’re fearfulthat the drug dealing will lead toviolence and that innocent peoplewill be caught in the middle. “Whatif a drug deal goes bad and thesepeople start shooting at each other?”Johnson asked.Jim Clark, president of the BayRidge Fifth Avenue Business ImprovementDistrict, said storeownerson the avenue are concernedabout their personal safety andabout the possibility of losing business.“It’s difficult to do businessif people are afraid to come out atnight and shop.”The BID represents hundreds ofstoreowners and property ownerson Fifth Avenue between 65th and85th Streets.The BID’s board of directors recentlysent an informational flier toeach of the hundreds of store ownerson the avenue containing adviceon how to stay safe and who to callin the event of a crime.A group of residents have voicedtheir concerns to the local communityboard, Community Board 10,which contacted the 68th PolicePrecinct and <strong>Brooklyn</strong> District AttorneyCharles Hynes’ office.At a recent meeting focusing onthe issue, police told residents theyare aware of the problem and doingtheir best to address it. Police alsourged residents to call 911 wheneverthey see something suspicious.Fran Vella-Marrone, chairmanof Community Board 10’s Police andPublic Safety Committee, issued areport on the drug danger in BayRidge. “The community board hasreceived numerous complaints regardingthis matter and has workedwith community residents to assistthem,” wrote Vella-Marrone. Shecalled the drug problems “seriousmatters that need to be addressed.”To that end, the communityboard voted at its <strong>April</strong> 15 meetingto request that the NYPD install AR-GUS surveillance cameras on FifthAvenue. Following the meeting, aletter was sent to Police CommissionerRaymond Kelly.Vella-Marrone pointed out thatCouncilman Vincent Gentile (D-BayRidge-Dyker Heights-Bensonhurst)and state Sen. Marty Golden (R-C-Bay Ridge-southern <strong>Brooklyn</strong>) haveboth allocated funds toward thepurchase of surveillance cameras.The cameras would serve asa crime deterrent, said Gentile. “Ihave allocated funds for several surveillancecameras in my district andhave suggested a number of locationswhere we felt they would bemost effective. Even if the actualact of crime is not recorded in thecameras, they help to deter criminalsfrom committing a crime inthe first place. And ultimately, thatis our goal.”But the 74th Street residentwho regularly finds evidence ofdrug sales on the sidewalk said thatwhile he thinks installing camerasis a good idea, he also believes moreshould be done. “We need morecops on the street. We need policewalking the beat as opposed to drivingby in a car.”Wireless Capability in Subway Grows, But <strong>Brooklyn</strong> Will Have To WaitBy Raanan Geberer<strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong>Thirty more subway stations,in addition to six that were partof a pilot program two years ago,now have Wi-fi capabiity, allowingsubway riders to make andreceive phone calls, texts, emailsand more.What’s more, Verizon andSprint are in talks to join the network,according to the MTA. Inthe pilot program, only AT&T andT-Mobile USA users were able topick up the signal in the stations(to the consternation of this writer,a Verizon customer, who livesnear one of the original six stations).However, <strong>Brooklyn</strong> subwayriders have a long time to wait.The 30 new stations, as well as theoriginal six, are all in MidtownManhattan.Although MTA has contractedto install wireless capability in277 underground stations by 2017,<strong>Brooklyn</strong> is considered “Phase 5”of the project,” behind “Uptownand Downtown Manhattan,”Queens and the Bronx, accordingto MTA spokesman Kevin Ortiz.One activist involved in transitissues, who preferred not to benamed, said, “My understandingis that they’re beginning wherethe highest user-ship is and themost infrastructure is available,and that’s in Manhattan. I don’tthink their intention was to excludethe other boroughs.”The announcement was madeon Thursday at Times Square,where MTA officials were joinedby executives from Transit Wireless,AT&T, T-Mobile USA and BoingoWireless to demonstrate thenew capability.The 36 stations that are nowonline have an average annualridership of approximately 7 millioncustomers per station.Transit Wireless, the maincontractor, and the carriers themselvesare paying 100 percent ofthe cost of the project. TransitWireless has also established asublicense arrangement with BoingoWireless to manage and operatethe wi-fi services.The stations that are now “online”are all between 14 th Streetand 96 th Street.The one place you can easily find payphones like these are in the subwaystations, but their days may be numberedbecause the MTA is increasingWi-fi capability underground.<strong>Eagle</strong> file photoNew Trial in B’klynDice Game MurderNew York’s top court has ordered anew murder trial for a 22-year-old convictedof shooting another man at an undergrounddice game in <strong>Brooklyn</strong>, saying ajudge was wrong not to allow his motherinto the courtroom before jury selection.The Court of Appeals said Thursdaythat defendants have a constitutional rightto a public trial, that overcrowding doesn’tjustify closing a courtroom, and the judge“failed to consider reasonable alternatives.”Daniel Floyd’s lawyer told Judge MichaelGary that his client’s mother waswaiting outside because she was unable tofind a courtroom seat and that she had aright to be there as a spectator. From Classmates to Co-Curators:Pratt Duo Opens Bed-Stuy GalleryNarrows Community TheaterPresents ‘9 to 5: The Musical’Molly Myer and Jackie Cantwell.By Samantha Samel<strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong>What began as a school project soonturned into The Bishop – a new galleryand project space in the heart of Bedford-Stuyvesant,opened just last monthby co-directors Jackie Cantwell and MollyMyer. The two <strong>Brooklyn</strong>-based artists metjust last year as graduate students at Pratt,and put their heads (and good eyes) togetherquickly to create an arts and cultural centerin Bed-Stuy.The Bishop is committed to showcasingelements of the local community andaims to draw from Bed-Stuy’s history anddiversity. In addition to curating art exhibitions,Cantwell and Myer hope to use theirspace to promote philanthropic activitiesand educational workshops.Cantwell and Myer recently opened The Bishop,a new gallery and project space in Bed-Stuy.Photo by Scott LevinThe Bishop opened on March 15 witha group exhibition titled “Six Degrees ofSeparation.” The show highlighted humanconnectedness and was inspired by theinception of the gallery itself. soon afterCantwell and Myer met – through an elevatorspeech assignment – a friend of Jackie’smentioned to her that his family hada space in Bed-Stuy that might be suitablefor a gallery.Neither Cantwell nor Myer is originallyfrom <strong>Brooklyn</strong> – Cantwell grew up outsideof D.C. and Molly grew up in Maine – butboth have come to find <strong>Brooklyn</strong> a wonderfullysupportive environment for artists.Myer, who moved to New York about fiveyears ago, first lived in Manhattan, whichshe found overwhelming. “When I finallymoved to <strong>Brooklyn</strong> I realized I could reallylive here for a while,” Myer told <strong>Brooklyn</strong><strong>Eagle</strong>. “<strong>Brooklyn</strong> has such a great vibe,great food, and the community feel that Iwas used to in Maine.”Cantwell, too, has grown to love <strong>Brooklyn</strong>since moving here two years ago. “I’venever felt more at home than I do here in<strong>Brooklyn</strong>. I live in Bushwick and spendmost of my time in Bed-Stuy near the gallerywhere I see a lot of familiar faces, shopowners are actually in their business’ working,and the energy is alive and awesome. Nearby businesshave invited them to leave flyers to promotetheir gallery, and the women continueto meet emerging artists and students atlocal coffee shops. “We’ve kept our doorsopen for ideas and they have been pouringin! We are also available for rentals, whichhas resulted in a flood of emails from localartists looking to show, bands lookingto rehearse, music festivals looking fora venue, teachers looking to hold classes,and the list goes on. Everyone we’ve spokento has been extremely supportive tous and what we are doing,” Cantwell andMyer said.Despite their devotion to The Bishop,both women are still Pratt students workingtoward finishing their Master’s, andboth have full-time jobs aside from the gallery.While they say it has been challengingto manage the daily operations of thespace, Cantwell and Myer are grateful forthe opportunities and resources they’vebeen awarded as students. “Unbelievably,around the same time the possibility ofopening a space became a reality, we werebeing asked to choose a topic for our thesis- so naturally the Bishop became our thesisand our thesis became the Bishop,” theytold the <strong>Eagle</strong>.While their premier show closed onThursday, Cantwell and Myer are alreadyhard at work preparing for their next exhibition,“FLEET,” which will open <strong>Fri</strong>day,May 3 rd , at 7 p.m. FLEET will highlight 4-5artists in The Bishop space, each of whomwill take over a large portion of the galleryto assemble and present their fleet of objects.“We really want each group to readas a unit that is possibly working togetherto defend or support one another, even ifin the most awkward or minimal way. Wealso think this will provoke some great visualpossibilities and perhaps provide theviewer with a playful banter of sorts,” saidCantwell and Myer.The women solicit new works througha variety of ways. They are active on socialmedia outlets, where they gain support andpublicity, and they also welcome differentkinds of proposals from children’s art showsto a guest curated exhibition by MFA studentsat Pratt. Their two upcoming shows,“FLEET” and a benefit show for the LeukemiaLymphoma Society, “Curating for aCure,” both have/had open calls for art.While The Bishop is less than twomonths old, Cantwell and Myer have alreadydemonstrated their unwaveringcommitment to maintaining the space asa community gem and haven for artistic innovation.The Bishop is located at 916 Bedford Avenuein Bed-Stuy and is open Thursdaysand <strong>Fri</strong>days from 11 a.m. to 6 p.m., and onSaturdays from 12 p.m. to 6 p.m.Three workers kidnap their sexist boss in “9 to 5: The Musical,” being presented by Narrows CommunityTheater. Thoughthe track was level andstraight and the weatherclear and sunny, Tagney conscientiouslywaved the flagback and forth.His efforts, thoughmandatory according to regulation,were only supplementary,since the entireroute was marked by signallights, all of which were red while Number 11was in the Naperville station. Yet, Tagneycould see in the distance the fast-approachingExposition Flyer, Burlington's speedy Number39. Whatall can agree on is <strong>Brooklyn</strong> is where Crane found his calling,“living in the shadow of that bridge.”Harold Hart Crane was born on July 21, 1899, in Garrettsville,Ohio, to a successful but distant candy manufacturer,Clarence Arthur Crane, and an overprotective, unstablemother, Grace Edna Hart. His father had invented Life Saversbut sold his interest for $2,900 before the candy gained popularity.An indifferent high school student, Crane was submittingpoems for publication by the age of 16; “C 33” was the first, inBruno’s Weekly, followed by “October-November” in ThePagan in the fall of 1916.Crane dropped out of high school his junior year and leftfor New York City.His mother soon followed him to New York, over-attentiveyet offering a new penname for her son, writing, “In signingyour name to your contributions & later to your books do youCookin’ With GasThe <strong>Brooklyn</strong> <strong>Daily</strong> <strong>Eagle</strong> of <strong>April</strong> 27, 19<strong>26</strong> printed an invitationto the women of <strong>Brooklyn</strong> to attend their three-day cookingschool. How would ‘HartCrane’ be?”Crane took up a rough lifestyle inNew York. He was gay, the rebelliousoutsider, seeking anonymous sex withsailors and others around the city, oftenleaving him battered and bruised for approachingthe wrong man. He was also aheavy drinker.Crane was regularly summoned toCleveland to work for his father, thenwould flee back to New York to write.Published in multiple magazines, Cranewas drawing both accolades and angst(Ezra Pound told one publisher to rejectCrane’s submission).Expanding beyond poetry, Crane wassoon writing essays (“The Case AgainstNietzsche”) and reviews. Still jumpingbetween Manhattan apartments andCleveland, 1922 would be the most pivotal year of Crane’s life.A banned copy of James Joyce’s Ulysses was smuggled intoAmerica and found its way into Crane’s hands (“I feel likeshouting EUREKA!”) and then T.S. Eliot’s “The Waste-Land”was published. Seeing Eliot as pessimistic on technology,Crane challenged himself to “properly evaluate the machine...”It would take him an ideal view from <strong>Brooklyn</strong> Heights andanother six years.Crane’s archaic yet lyrical voice emerged, as did a love affairwith Emil Opffer, a ship’s purser, who invited Crane to livein his father’s home in <strong>Brooklyn</strong> Heights.<strong>Brooklyn</strong> suited Crane’s every need. Arts patron Otto H.Kahn gave him $2,000 to work on an epic poem called “TheBridge.”Drinking heavily and struggling with “The Bridge” in19<strong>26</strong>, Crane had the end written but couldn't summon a beginning.Needing more money, he moved to Los Angeles andthere ran into his old love Emil Opffer (both were attacked andbeaten in San Pedro).Crane returned to New York in 1928, living with friendsand taking temporary jobs until moving back to <strong>Brooklyn</strong>, firstto 77 Willow St., then back to 110 Columbia Heights. Wearingout his welcome at the Opffers, Crane headed to Paris in 1929but his problems promptly followed him.When Harry and Caresse Crosby of Black Sun Press offeredto publish “The Bridge,” Crane responded by gettingdrunk at Cafe Select and fighting over the tab with waiters andpolicemen. Jailed for six days and fined 800 francs, Crane fledFrance for America — but finally finished “The Bridge.”Using a Fellowship, Crane headed to Mexico, reinvigoratedand eager to write. But yet another tumultuous time intervened:the sudden death of his father, threats to sue his motherover inheritance, and an affair with a friend’s wife, PeggyCrowley (perhaps his only heterosexual affair).The accounts from <strong>April</strong> 27 are characteristic Crane: Hewas beaten in the early hours and drunkenly raging about asthe boat crossed the Gulf of Mexico. Then, around noon, HartCrane exclaimed “Goodbye, everybody!” and hurled himselfoverboard in front of several witnesses.— By Brad LockwoodUnsinkable <strong>Brooklyn</strong>-Made WarshipConstruction of the USS Vincennes began in 1825 with alaunching on <strong>April</strong> 27, 18<strong>26</strong>. She was 700-tons and had 18 guns.Her history proves that when they made ’em in <strong>Brooklyn</strong> theywere made to last.USS Vincennes was named for the Indiana fort twice capturedby American forces under George Rogers Clark during the AmericanRevolution. She had one of the most extraordinary careers ofany ship in the U. S. Navy. Dispatched to the Pacific Squadronunder Master Commandant William Bolton Finch, she was orderedto look after American merchant and whaling interests in the Marquesas,Tahiti, and Sandwich Islands (Hawaii). From Hawaii shesailed east, stopping at Macao, Manila, Capetown, and St. Helenabefore returning to the <strong>Brooklyn</strong> Navy Yard on June 8, 1830.Captain John Cleves Symmes, a hero of the War of 1812,came up with a theory that the earth was hollow and composedof a series of concentric spheres, one contained within the otherso that they all had a common center. Symmes thought the interiorof the earth could be reached through large holes, a fewthousand miles in diameter, to be found at the North and SouthPoles. He felt the government should finance an expedition toone of the Poles, where, he wrote, “We will find a warm andrich land, stocked with thrifty vegetables and animals, if notmen, on reaching one degree northward of latitude 82.”Although his theory attained widespread consideration, Congressdeclined to sponsor a voyage of exploration. Symmes andhis theory eventually passed into memory, but the cause of a polarexpedition was taken up by his erstwhile disciple, JeremiahReynolds. In 1836 Congress reversed itself, and CommodoreThomas Catesby Jones was appointed to lead an expedition. Exhaustedby the endless politics of the preparations, Jones resigned,and command eventually fell to Captain Charles Wilkes, wellqualifiedas having been head of the Depot of Charts and Instruments.On August 18, 1838, an expedition sailed. The USS Vincenneswas one of a fleet that also included five other ships. Truman, (later president) and commissioned to the Navy on June11, 1944.. It was the last <strong>Brooklyn</strong>-made battleship commissioned in theU.S. Navy. Missouri reached the Caroline Islands in January 1945, andthe next month joined Task Force 58 for raids on the Japanese home islands.After gunfire support operations during the landings on Iwo Jima,against shore positions south of Tokyo, and against positions on Okinawa,Missouri became the flagship of Admiral William F. Halsey, Jr.Following the announcement of the Japanese surrender, Nissouri sailedinto Tokyo Bay on August 29. There, on September 2, Allied and Japaneserepresentatives, including General of the Army and Supreme Allied commanderin the Pacific Douglas MacArthur, Fleet Admiral Chester Nimitz, AdmiralSir Bruce Fraser, RN, and Foreign Minister Mamoru Shigemitsu,signed the formal articles of surrender ending World War II.Missouri did two tours of duty in Korea, from September 1950 toMarch 1951 and September 1952 to March 1953, providing gunfire supportfor UN ground forces on the peninsula. Decommissioned in 1955, the“Mighty Mo” remained in reserve until 1982, when she and her sisterships — Iowa, New Jersey, and Wisconsin — were reactivated duringPresident Ronald Reagan’s defense build-up. Missouri and Wisconsin sawaction during the Persian Gulf War in 1991, but the Pentagon later determinedthat the ships were prohibitively expensive, and they were decommissionedin 1992. On one end stands the hugecivic center of Borough Hall, on theother is the promenade, while thefour blocks in between are comprisedof restaurants and retailstores that feature beautiful architecture.Adding to Montague Street’suniqueness is the fact that severalof the commercial spaces on theblock are not actually on street level– many of them are above or belowon the parlor level, the garden level,or even on the second floor.“This is the way the street hasalways been and because it’s landmarked,it hasn’t changed over theyears,” said Montague Street BID’sExecutive Director Brigit Pinnell.“It makes it a great place to shop becausethere are more shops on theblock than there would otherwisebe, and you get to enjoy the beautifularchitecture of an old historicneighborhood while you are out.”Many shops on the block playup this historic feel.“If you are in a historic landmarkedbuilding, you can take advantageof the architectural detailsand accentuate it in your layout,”said Doctor Stuart Freedman, ownerof Heights Vision. “I didn’t wanta modern looking office in an oldbuilding, so we came up with aEstela Johannesen, owner of Weir Floral Co., was nervous about moving to a gardenlevel shop, but says she has come to love her store’s location.<strong>Eagle</strong> photos by Rob Abruzzesenice, creative presentation and ourpatients have really grown to appreciatethe historical throwback.”Typically, the street level storesare the most sought after, as theyare the most accessible for patronsand easiest for product deliveries.That doesn’t mean that being offstreet level is a bad thing, though;in fact, most shop owners like thecharm it brings.Estela Johannesen, who ownsJames Weir Floral Co., explainedthat when she moved into theshop’s current location, she worriedabout the steps leading down intothe shop. However, she said thatin the seven or eight years she hasbeen at that location, she has neverhad a problem.“The steps have not been a problemat all,” Johannesen said. “Wehave to help people sometimes gettingup or down, but that’s becomepart of our service and people havenever had a problem with it.”Juan Rivera, who owns thehouseware and hardware store VarietyMart, said that his family hasalways embraced being downstairs.“It’s unique.” said Rivera. “That’sthe way the store has always beenand it helps people remember us.We used to even have it on our sign:‘Three steps down.’”Second floor storeowners havesaid that on occasion they faceproblems involving deliveries orpeople having trouble getting upthe stairs, but ultimately they seemto embrace the difference.“I love this space,” said JenniferHanser, a manager at Area Yoga.“It’s nice to be able to practice andnot have to see people on the streetwalking by. We’ve even had pre-natalclasses here before and we hadto help some women up and downthe stairs, but it has never been aproblem.”Many have also remarked thatthey especially love dining in thesecond floor restaurants that providea better view of the street thanif they were on the street level.Of course, the different levelscome with different rents. The December 2012 reportdistributed by the Office ofCourt Administration further bolstersthis presumption — with morethan 54,000 pending civil cases in2012, <strong>Brooklyn</strong>’s civil term holdsthe largest caseload in the state.Showing the amount of casesfiled and disposed throughout theUnified Court System from 2008through 2012, the December reportdetails the efforts of <strong>Brooklyn</strong>’sjudges and personnel as they workto efficiently address caseloads.In criminal court, <strong>Brooklyn</strong> hasseen the sharpest reduction in itsbacklog. The desired benchmark forthe disposal of felony criminal casesis 180 days. In 2008, <strong>Brooklyn</strong> hadapproximately 2,221 pending felonycases for over 180 days. That numbersharply fell to 1,660 in 2012.While the overall numbers appearto show positive developments,the amount of cases pendingfor over two years has increased. In2008, there were only 99 casespending. However, that numberincreased each year, culminating in139 in 2012 — a 40-percentincrease.The December 2012 reportnotes that there is a priority for theHon. Neil FiretogHon. Barry Kaminsdisposal of cases over two years,because as a case ages, so does thememory of witness. Also, the likelihoodof evidence being lost or misplacedincreases with time.“We are gratified that we havebeen able to reduce the inventoryof cases over two years by 21 percentand the median age of pendingcases by 5 percent,” notedBarry Kamins, administrativejudge for criminal matters for theSecond Judicial District. “However,there is still much work to bedone. We are hoping to increasethe number of trials, and currentlywe have about 19 of our judges ontrial in felony cases.”The criminal court system withthe most difficult backlog issue isthe Bronx. The Bronx presently hasover 3,000 criminal cases that aremore than 180 days old, and morethan 900 of these cases are morethan two years old.“This acute backlog of felonycases is entirely unacceptable to allof us in the courts and the entire justicecommunity in Bronx County. Itsimply cannot continue any longer,”New York State Chief JudgeJonathan Lippman said.In order to jumpstart the backlogin the Bronx, Lippman enlisted thehelp of noted <strong>Brooklyn</strong> CriminalCourt Deputy Administrative JudgePatricia Di Mango. She was temporarilyreassigned to the Bronx,along with several judges from districtsoutside of New York City.<strong>Brooklyn</strong>’s civil courts havealso experienced some success, butthe staggering number of foreclosureshas placed a severe hindranceon case disposition statistics.
