<strong>Bon</strong> Appétit <strong>Management</strong> <strong>Company</strong> <strong>at</strong> <strong>Biola</strong> University’s“Bling Our Food Truck” Contest official rules for entry.1. INTRODUCTIONThis document describes the official rules ("Rules") of the <strong>Bon</strong> Appétit<strong>Management</strong> <strong>Company</strong> <strong>at</strong> <strong>Biola</strong> University’s "Bling Our Food Truck"Contest (the "Contest"). The object of this contest is to show off yourcre<strong>at</strong>ivity and promote the <strong>Bon</strong> Appétit Food Truck <strong>at</strong> <strong>Biola</strong> University. Thewinning design will be fe<strong>at</strong>ured on our Food Truck and our website.2. DEFINITIONS"Entry" means a design cre<strong>at</strong>ed by the Entrant for this Contest."Entrant" means the individual or group of individuals th<strong>at</strong> offers the Entryunder the terms of this Contest."Sponsor" means <strong>Bon</strong> Appétit <strong>Management</strong> <strong>Company</strong>, loc<strong>at</strong>ed <strong>at</strong> 13800<strong>Biola</strong> Ave., La Mirada, CA 90639.3. ACCEPTANCEParticip<strong>at</strong>ion constitutes the Entrant's full and unconditional agreement toand acceptance of these Rules. By particip<strong>at</strong>ing in the Contest, theEntrant is representing and warranting th<strong>at</strong> he/she has read andunderstood, and agrees to be bound by, these Rules. Including the guidesand rules referred to herein, these Rules constitute the entire agreementbetween the Entrant and the Sponsor in rel<strong>at</strong>ion to the Contest. Theygovern the Entrant's particip<strong>at</strong>ion and supersede any prior or otheragreements between the Entrant and the Sponsor and rel<strong>at</strong>ing to theContest.4. ELIGIBILITYThe Contest is open only to individuals who are enrolled in the 2012-2013academic year <strong>at</strong> <strong>Biola</strong> University. Contest is void where prohibited bylaw. Employees and contractors of <strong>Bon</strong> Appétit <strong>Management</strong> <strong>Company</strong>or <strong>Biola</strong> University are not eligible to particip<strong>at</strong>e.6. CONTEST PERIODThe Contest begins <strong>at</strong> 9:00 a.m. PST on Friday, August 31 st 2012 and ends<strong>at</strong> 12:00 a.m. on Monday September 24 th 2012. Sponsor may in its solediscretion cancel or postpone the Contest.7. HOW TO ENTERTo enter the Contest, the Entrant must submit a low-res pdf. file of theirdesign via yousendit.com to Stephen.rall@cafebonappetit.com.Submissions must be submitted by 12:00 a.m. on Monday September 24 th2012. Each Entrant must be the named and authorized account holder ofthe email address submitted in connection with th<strong>at</strong> Entrant's Entry. Theauthorized account holder is the n<strong>at</strong>ural person who is assigned to theemail address by an internet access provider, online service provider, or


other organiz<strong>at</strong>ion th<strong>at</strong> is responsible for assigning email addresses or thedomain associ<strong>at</strong>ed with the submitted email address. Entries submittedwill not be returned or acknowledged.Without limiting any represent<strong>at</strong>ions or warranties, the Sponsor has theright (though not the oblig<strong>at</strong>ion) to, in the Sponsor's sole discretion, rejector remove from the Sponsor's websites, servers and computer systems anyEntry th<strong>at</strong>, in the Sponsor's sole discretion, viol<strong>at</strong>es these Rules or anyapplicable Sponsor policy or is in any way harmful or objectionable.Sponsor also reserves the right to disqualify any Entrant or Entry <strong>at</strong> theSponsor's sole discretion. No correspondence shall be entered intoregarding Sponsor's decision.8. SUBMISSION CRITERIAEntrant may submit up to three designs. All Entries must meet specificdesign criteria to be accepted into the contest: (a)design must be ingood taste and free of any profanity or potentially offensive m<strong>at</strong>erial; (c)save your file as a PDF, JPG, or GIF image and send viawww.yousendit.com to Stephen.rall@cafebonappetit.com. Submissiondeadline 12:00 a.m. on Monday September 24 th 2012.Please include your name and contact inform<strong>at</strong>ion along with yoursubmission.9. PRIZESThere will be one Grand Prize WinnerThe Grand Prize Winner will receive $1000 towards tuition <strong>at</strong> <strong>Biola</strong>University. Restrictions may apply.The prizes are non-transferable and no substitution by winner or cashequivalent is permitted. The winner will be responsible for all federal,provisional, st<strong>at</strong>e, local and other applicable taxes rel<strong>at</strong>ing to the prize.10. JUDGING AND SELECTION OF WINNERFirst Round Judging.All Entries will be judged and scored by an internal Sponsor team. Thejudging panel will select the top five (5) designs based on the followingjudging criteria: (a) Concept/Originality; (b) Effective Communic<strong>at</strong>ion ofthe <strong>Bon</strong> Appétit brand and <strong>Biola</strong> University Culture (c) Completeness ofdesign; (d) Visibility. The top five (5) designs selected (the "Finalists") will beselected on or around Thursday September 27 th 2012. Sponsor will contactthe Finalists via email to inform them of being chosen as a Finalist. AllFinalists will need to provide camera ready – full layer design files <strong>at</strong> thistime in high resolution .eps or illustr<strong>at</strong>or files. All Finalists will be subject toverific<strong>at</strong>ion of eligibility.


Second Round Judging.On or around Monday, October 1 st 2012, the Finalists will be posted in The<strong>Biola</strong> Café, and fe<strong>at</strong>ured online <strong>at</strong> www.cafebonappetit.com/cafebiolafor public voting. Voting is worldwide and open to everyone. Voting willclose five (5) calendar days after the d<strong>at</strong>e & time voting begins. In case ofa tie, Sponsor shall decide the winner. Winners will be notified on oraround Monday October 8 th . In the event of non-compliance with any ofthe Rules, th<strong>at</strong> Finalist's prize will be forfeited.12. INTELLECTUAL PROPERTYAny submission idea, document<strong>at</strong>ion, photograph or video entered in thisContest shall remain the exclusive property of Sponsor and Entrant agreesth<strong>at</strong> Sponsor and its designees shall have the perpetual, worldwide,irrevocable right to edit, publish and use these m<strong>at</strong>erials in any way and inany and all media now or hereafter known for trade, advertising,promotional and/or other purposes as Sponsor may determine in its solediscretion without further consider<strong>at</strong>ion to Entrant or winner. The Entrantagrees to assign all rights, title and interest in to the submission, includingcopyright, to Sponsor and waives his/her moral rights in the submission.13. AUTHORIZATION TO USE WINNER'S NAMESubmission constitutes permission for the Sponsor to make public andotherwise use entrant's name, voice, picture, likeness, opinions,biographical inform<strong>at</strong>ion, city and country of residence, and submittedwork without further compens<strong>at</strong>ion in any media now known or hereafterdeveloped for promotional and/or publicity purposes, unless prohibited bylaw. Each entrant also agrees to particip<strong>at</strong>e in and cooper<strong>at</strong>e with anypromotional activity and/or publicity rel<strong>at</strong>ing to the Contest as theSponsor shall reasonably request from time to time.BY PARTICIPATING IN THE CONTEST, THE ENTRANT AGREES THAT THESPONSOR ENTITIES MAKE NO WARRANTY, REPRESENTATION, OR GUARANTEEOF ANY KIND, EXPRESSED OR IMPLIED, IN FACT OR IN LAW, RELATING TOTHE CONTEST AND/OR THE PRIZES.By particip<strong>at</strong>ing in the Contest, the Entrant agrees th<strong>at</strong> the Sponsor is notresponsible, and will in no event be held liable, for any: (a) lost, l<strong>at</strong>e,illegible, misdirected, damaged, incomplete, corrupted or garbledentries; (b) telephone, computer, or network malfunction or error; (c)communic<strong>at</strong>ion disruption or other disruptions rel<strong>at</strong>ed to Internet traffic,virus, bug, worm, or non-authorized intervention; or (d) damage causedby a computer virus or otherwise resulting to any computer from Entrant'saccess of the Contest website. If the Contest is termin<strong>at</strong>ed before thescheduled end of the Contest Period, the Sponsor will determine thewinner from all eligible entries received as of the termin<strong>at</strong>ion d<strong>at</strong>e. Persons


found tampering with or abusing any aspect of the Contest, or whom theSponsor believes to be causing or <strong>at</strong>tempting or intending to cause anymalfunction, error, disruption, or damage will be disqualified. The Sponsorreserves the right to disqualify any unauthorized entries, including, withoutlimit<strong>at</strong>ion, or any entries made through robotic, autom<strong>at</strong>ic, mechanical,programmed or similar multiple-entry, or entry duplic<strong>at</strong>ion, method and todisqualify any person or entity using such a method.NOTWITHSTANDING ANYTHING HEREIN TO THE CONTRARY, AND ONLY TOTHE MAXIMUM EXTENT PERMISSIBLE BY THE APPLICABLE LAW, BYPARTICIPATING IN THE CONTEST, THE ENTRANT AGREES THAT IN NO EVENTWILL THE SPONSOR OR ANY SPONSOR ENTITY BE LIABLE TO ENTRANTS ORANY OTHER PARTY FOR ANY DIRECT, INDIRECT, SPECIAL, CONSEQUENTIALOR EXEMPLARY DAMAGES, REGARDLESS OF THE BASIS OR NATURE OF THECLAIM, RELATING IN ANY MANNER TO THESE OFFICIAL RULES, THE CONTESTOR THE ENTRANT'S PARTICIPATION THEREIN, EVEN IF THE SPONSOR OR ASPONSOR ENTITY WERE EXPRESSLY ADVISED OF THE POSSIBILITY OF SUCHDAMAGES. ALSO NOTWITHSTANDING ANYTHING HEREIN TO THECONTRARY, BY PARTICIPATING IN THE CONTEST, THE ENTRANT FURTHERAGREES THAT IN NO EVENT WILL THE LIABILITY OF THE SPONSOR OR ANYSPONSOR ENTITY RELATING IN ANY MANNER TO THESE OFFICIAL RULES.SOME JURISDICTIONS MAY NOT ALLOW THE EXCLUSION OR LIMITATION OFLIABILITY FOR CERTAIN INCIDENTAL OR CONSEQUENTIAL DAMAGES, SOSOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO THE ENTRANT. IN THEEVENT THAT THE PRECEDING RELEASE IS DETERMINED BY A COURT OFCOMPETENT JURISDICTION TO BE INVALID OR VOID FOR ANY REASON, THEENTRANT AGREES THAT, BY ENTERING THE CONTEST, (I) ANY AND ALLDISPUTES, CLAIMS, AND CAUSES OR ACTION ARISING OUT OF OR INCONNECTION WITH THE CONTEST, OR ANY PRIZES AWARDED, SHALL BERESOLVED INDIVIDUALLY WITHOUT RESORT TO ANY FORM OF CLASSACTION; AND (II) ANY CLAIMS, JUDGEMENTS AND AWARDS SHALL BELIMITED TO ACTUAL OUT-OF-POCKET COSTS INCURRED, INCLUDING COSTSASSOCIATED WITH ENTERING THE CONTEST, BUT IN NO EVENT ATTORNEY'SFEES.For the avoidance of doubt, to the extent th<strong>at</strong> English law applies, nothingin these Rules shall limit or exclude either party's liability for fraud, or forde<strong>at</strong>h or personal injury caused by its negligence, or any other liability tothe extent such liability cannot be excluded or limited as a m<strong>at</strong>ter of law.15. PRIVACYExcept as otherwise st<strong>at</strong>ed herein or as otherwise agreed by the Entrantand the Sponsor, the inform<strong>at</strong>ion communic<strong>at</strong>ed by the Entrant inconnection with Entry to the Contest will be used for the purposes rel<strong>at</strong>ing


to this Contest, and will not be communic<strong>at</strong>ed to third-parties withoutprior permission.16. TRADEMARK INFORMATIONThe names <strong>Bon</strong> Appétit <strong>Management</strong> <strong>Company</strong> and <strong>Biola</strong> University aswell as their logos are all registered trademarks. Any use of those or anyother Sponsor trademark, service mark, trade name or logo outside of thisContest is strictly prohibited.19. CONSIDERATIONThe Entrant agrees th<strong>at</strong> the ability to particip<strong>at</strong>e in the Contest and tocompete for the prizes offered in connection with the Contest constitute,where required, sufficient consider<strong>at</strong>ion for the Entrant's oblig<strong>at</strong>ions underthese Rules.
