Regional Workshop on Women <strong>and</strong> Minority <strong>Human</strong> <strong>Rights</strong> Defenders<br />

Ms. Val Kalende <strong>and</strong> Dr. Chris Dolan (Executive Director, Refugee Law Project) took members<br />

through the subject <strong>of</strong> Lesbian, Gay, Bi-Sexual, Trans-Sexual <strong>and</strong> Inter Sexual (LGBTI) rights.<br />

LGBTI are considered a minority due to the immense levels <strong>of</strong> discrimination against them. As<br />

relayed <strong>of</strong> the Ug<strong>and</strong>an experience, a space <strong>of</strong> only five years has enabled the creation <strong>of</strong><br />

visibility for sexual minorities. Participants were informed that it is only as late as 2005 when<br />

the gay movement in Ug<strong>and</strong>a started forming, raising awareness, doing advocacy <strong>and</strong> service<br />

provision. It is now comprised <strong>of</strong> a number <strong>of</strong> a number <strong>of</strong> associations <strong>and</strong> works towards<br />

crafting a comprehensive underst<strong>and</strong>ing <strong>of</strong> gay rights. The movement has managed to raise<br />

awareness on key issues affecting the well being <strong>of</strong> MRDs working to defend LGBTI rights.<br />

Despite these efforts, numerous factors confront the full realization <strong>of</strong> rights <strong>of</strong> MRDs. These<br />

include stringent legal regimes. For instance Sudan <strong>and</strong> Djibouti have death sentences for<br />

homosexuality.<br />

Other factors that need to be highlighted include;<br />

� There is little or no information existing on LGBTI in the <strong>East</strong> <strong>and</strong> <strong>Horn</strong> <strong>of</strong> <strong>Africa</strong> as well<br />

as a poor underst<strong>and</strong>ing <strong>of</strong> the same especially arising from the fact that these groups<br />

are not permitted to engage in public.<br />

� The ‘unnatural’ silence on the aspect <strong>of</strong> LGBTI does not preclude the fact that these<br />

persons exist, <strong>and</strong> their rights should be protected.<br />

� The glaring lack <strong>of</strong> support from mainstream human rights organizations.<br />

One participant had this to say after the presentations;<br />

“ No one should be discriminated against because <strong>of</strong> their sexual orientation. Everyone should<br />

be treated with unconditional positive regard.” (Per Dr. Thomas Aquinas Mugumbya).<br />

G. Gender Based Violence against Women <strong>Human</strong><br />

<strong>Rights</strong> Defenders <strong>and</strong> Minority <strong>Rights</strong> Defenders<br />

Gender Based Violence (GBV) is any act that results in, but is not limited to, acts <strong>of</strong> physical,<br />

sexual, <strong>and</strong> psychological violence in the family, community, or perpetrated or condoned by the<br />

State, wherever it occurs. This definition is wide <strong>and</strong> follows a continuum, with both small acts<br />

<strong>and</strong> gross violations that all build up to a violation <strong>of</strong> women’s <strong>and</strong> sexual minority’s rights.<br />

Testimonies from women <strong>and</strong> minority rights defenders were recounted at the workshop<br />

making reference to their experiences with gender based violence. All the stories evidenced the<br />

fact that the gender based violence that was suffered covered different forms including<br />

physical, sexual <strong>and</strong> psychological forms <strong>of</strong> violence, whether occurring in public or in private<br />

life. The practice also extends to denial <strong>of</strong> basic necessities <strong>of</strong> life such as HIV drugs, food <strong>and</strong><br />
