depending on the issues <strong>and</strong> structures in<br />

each country. She was reminiscent <strong>of</strong> the fact<br />

that the important thing about human rights<br />

defenders is not who they are, but rather what<br />

they do. All the same, they are vulnerable to<br />

prejudice, exclusion <strong>and</strong> public denunciation<br />

<strong>and</strong> should be protected. The Ug<strong>and</strong>a <strong>Human</strong><br />

<strong>Rights</strong> Commission (UHRC) provides<br />

protection through complaints h<strong>and</strong>ling <strong>and</strong><br />

follow up <strong>of</strong> violations, inspection <strong>of</strong> places <strong>of</strong><br />

detention <strong>and</strong> monitoring the government’s<br />

compliance with international human rights<br />

obligations, including the analysis <strong>of</strong> national<br />

laws. Some challenges remain however such<br />

as the general lack <strong>of</strong> awareness <strong>of</strong> human<br />

rights by the public, intolerance by the state, limited enforcement mechanisms for tribunal<br />

rulings <strong>and</strong> lack <strong>of</strong> full independence from the state.<br />

Hon Miria Matembe discussed the m<strong>and</strong>ate <strong>of</strong> the <strong>Africa</strong>n Commission on <strong>Human</strong> <strong>and</strong><br />

People’s <strong>Rights</strong> (ACHPR). She pointed out that the ACHPR is the first regional human rights<br />

body to create a special procedure to deal with the protection <strong>of</strong> defenders’ rights, having<br />

created the Special Rapporteur on <strong>Human</strong> <strong>Rights</strong> Defenders in <strong>Africa</strong> as far back as 1994. That<br />

<strong>of</strong>fice examines <strong>and</strong> acts upon information on the situation <strong>of</strong> human rights defenders in <strong>Africa</strong>.<br />

The Special Rapporteur <strong>of</strong> the ACHPR has similar functions<br />

to those carried out by the UN Special Representative on<br />

<strong>Human</strong> <strong>Rights</strong> Defenders.<br />

The Special Rapporteur can issue urgent appeals regarding<br />

violations against human rights defenders in the region. The<br />

Special Rapporteur can also carry out <strong>of</strong>ficial country visits<br />

to assess the situation <strong>of</strong> the defenders there. It is important<br />

to note that the Special Rapporteur can work together with<br />

the Special Rapporteur on the <strong>Rights</strong> <strong>of</strong> Women in <strong>Africa</strong><br />

<strong>and</strong> together they can strengthen the advancement <strong>of</strong> the<br />

rights <strong>of</strong> women human rights defenders in the Region. The<br />

Commission is however limited by lack <strong>of</strong> funds as well as<br />

political allegiances that may not allow its commissioners to<br />

act independently at all times.<br />

substantiated the general role <strong>of</strong> the United Nations (UN) as<br />

being that <strong>of</strong> setting st<strong>and</strong>ards relating to the protection <strong>of</strong><br />
