Preparing the Solicitation<br />
fter an agency determines which statutory solicitation method is appropriate, the solicitation document is<br />
prepared. (Refer to Chapter 2 for the various procurement types). Keep in mind that except as otherwise<br />
provided by statute, a purchase <strong>of</strong> or contract for goods or services shall, whenever possible, be accomplished<br />
through competitive solicitation. In preparing the solicitation document, review the relevant statutes and<br />
rules to identify each <strong>of</strong> the statutory and regulatory requirements necessary to comply with the law before attempting<br />
to draft a solicitation document. viii A<br />
Employees involved in preparing a solicitation should sign and submit a Non-<br />
Disclosure Statement (See Appendix 7) and conflict <strong>of</strong> interest statement prior to beginning work on a solicitation.<br />
Preparing the Statement <strong>of</strong> Work<br />
The Statement <strong>of</strong> Work is very important as it forms the basic framework for the resulting contract. The needs<br />
assessment discussed in Chapter 2 is the foundation for the Statement <strong>of</strong> Work. The Statement <strong>of</strong> Work is a detailed<br />
description <strong>of</strong> what is required <strong>of</strong> the contractor to satisfactorily perform the work. The success or failure <strong>of</strong> a contract<br />
can usually be linked to the adequacy <strong>of</strong> the planning, analysis and thoroughness <strong>of</strong> the statement <strong>of</strong> work. Time spent<br />
planning, analyzing, and drafting the statement <strong>of</strong> work will result in saving time, resources, money and will improve<br />
the quality <strong>of</strong> the goods or services provided. It is very important that the statement <strong>of</strong> work:<br />
• Secure the best economic advantage utilizing best value;<br />
• Be clearly defined;<br />
• Be contractually sound;<br />
• Be unbiased and non-prejudiced toward respondents;<br />
• Encourage innovative solutions to the requirements described, if appropriate; and<br />
• Allow for free and open competition to the maximum extent reasonably possible.<br />
Specification Types<br />
There are many types <strong>of</strong> specifications. (http://www.window.state.tx.us/procurement/pub/manual/2-23.pdf) This<br />
<strong>Guide</strong> will focus on two (2) <strong>of</strong> the most common types: Performance Based Specifications and Design Specifications.<br />
