ARTICLE 6<br />

New oenological practices – safeguard provisions<br />

1. If one Contracting Party authorises for its wines an oenological practice or process which is<br />

not authorised by the other Contracting Party by virtue of Article 5, it may make a request to the<br />

other Contracting Party for authorisation. In this case, the Party making the request shall place at<br />

the disposal of the other Contracting Party an appropriate dossier including the information<br />

necessary for the evaluation of the request.<br />

2. A request in accordance with paragraph 1 shall be evaluated in particular in terms of the<br />

following criteria:<br />

(a) requirements for protection of human health,<br />

(b) requirements for consumer protection,<br />

(c) rules of good oenological practice, and in particular the requirement that the oenological<br />

practice or process in question does not involve an unacceptable change in the composition of<br />

the wine treated or a deterioration in the organoleptic characteristics thereof, and<br />

(d) the adequacy of the requesting Contracting Party's internal regulations concerned.<br />
