• Statutory Authority: The Implementing Recommendations of the 9/11 Commission Act of 2007 (P. L. 110-53) established an electronic<br />

authorization system to pre-screen travelers prior to arrival in the United States. This mandate was made operational by the creation of<br />

the Electronic System for Travel Authorization (ESTA).<br />

• Authorized Uses: ESTA collections fund operational costs to administer the ESTA program and maintain information technology (IT)<br />

equipment including the cost of the revenue program, and funds the salaries and benefits of personnel, overtime, and the cost to<br />

maintain the system.<br />

• Change Mechanism: The House Foreign Affairs, House Energy & Commerce, House Oversight & Government Reform, House Ways &<br />

Means, House Transportation and Infrastructure, House Homeland Security, House Intelligence (Permanent), House Judiciary, Senate<br />

Homeland Security & Government Affairs are the <strong>Congressional</strong> committees of jurisdiction for ESTA.<br />

Changes to the fee requires regulatory action.<br />

Changes to regulatory fees require a fee study and notice and comment rulemaking (notice of proposed rulemaking/request for public<br />

comments and final rule) for each fee change would be needed. The entire process normally takes at least 2 years.<br />

• Previous Changes: There has been no rate change since the inception of the ESTA program in September 2010.
