The following small items may be sold with a permit:<br />

1. Caps, containing not more than one quarter grain of explosive mixture.<br />

2. Toy snakes, which contain no Mercury.<br />

3. Sparklers, not exceeding thirty six (36) inches or 0.25 inch in outside<br />

diameter which do not contain Magnesium, Clorate or Perchlorate.<br />

4. Party poppers designed to spray out paper confetti or streamers and which<br />

contain less than one-quarter grain of explosive mixture.<br />

5. Devices designed to produce an audible sound but not explode, spark, move<br />

or emit an external flame after ignition and which do not exceed three grams<br />

in total weight.<br />

6. Smoke bombs with no external flame which do not leave the ground.<br />

7. Cylindrical fountains 100 gram or less in total weight with an inside tube<br />

diameter not exceeding 0.75 inch, designed to sit on the ground and emit<br />

only sparks and smoke.<br />

8. Cone fountains not exceeding 75 gram total weight, designed to sit on the<br />

ground and emit only sparks and smoke.<br />

9. The name of the manufacturer and the words "Class C Common Fireworks"<br />

must be clearly visible on every fireworks item or on every package (for<br />

very small devices). If they do not appear, the item may have been made<br />

illegally and could be very unsafe.<br />

Items that can be sold with a permit are not allowed to explode or jump off the<br />

ground.<br />

D. No person shall, within the City, sell or offer for sale any Class C common<br />

fireworks, as defined above, without a fireworks seller's permit.<br />

E. Repealed (see MMC 9.1302 Schedule A).<br />

F. The Fire Department shall inspect all places of sale of fireworks to determine<br />

compliance with applicable provisions of this code, as well as state statutes,<br />

and issue or revoke permits based on their findings as required.<br />

G. No person shall use, posses, or allow to be used, any fireworks other then<br />

those defined in (C) above.<br />

5.0218 OUTDOOR BURNING, RECREATIONAL AND COOKING FIRES<br />

A. Outdoor Burning Prohibited<br />

Except as provided below, all outdoor burning is prohibited within the City of<br />

Marinette.<br />
