258 K.N. Daly law which has caused rampant prison overcrowding and an aging prison population with skyrocketing medical costs which the public must bear. There is increasing social, political, and financial pressure to address chronic prison overcrowding particularly in light of crime rates that have continually declined over decades. There is ever-mounting attention to the racial sentencing disparities particularly among those who have suffered long prison sentences for relatively minor crimes. Public sentiment will not support the release of those incarcerated for sex crimes nor will it advocate for changes in how sex offenders are charged, sentenced, or otherwise confined. While legal scholars continue to question the constitutional soundness of civil confinement which looks and feels very much like criminal punishment, the public at large does not appear to share such concerns. Rather the public is increasingly relying on the sciences in general and mental health professionals in particular to dictate the results in the courtroom. The outcomes in criminal trials are influenced more and more by scientific evidence. Because of advances in science and the influence of popular culture, juries have come to expect forensic evidence in every case. The trier of fact has come to believe science can provide answers to legal questions involving issues of human rights and due process. The more entrenched those beliefs become, the more mental health professionals will find themselves on the witness stand explaining mental diseases and disorders, trying to explain how likely is “likely” and whether or not a person has a “serious difficulty” in controlling their actions. As this process continues mental health professionals, and in particular forensic practitioners, are going to have to be increasingly diligent in regulating their profession. The temptation to make the wrong diagnosis for the right reason, to testify someone meets the criteria for a sexually violent predator to prevent a future harm when the individual does not fit the diagnoses, must be avoided. While it may be argued that society has already begun down the slippery slope toward preventative detention, care must be taken to go no further down the path. References Appelbaum, P. S. (2006).
