Sydney’s residential property prices have been flat in

the three months up to the June Quarter; yet, in Milsons

Point it’s another story.

For the financial year up to June 2012 property prices had fallen about 5% across Sydney; this is largely

due to the upper end of the price spectrum, which has fallen more noticeably than the price of more

affordable properties.

Sydney’s Lower North Shore has seen a small reduction in house value, whilst the small value gains

in apartments in March 2012 have been consolidated in the June Quarter, according to the quarterly

report prepared by the Real Estate Institute of NSW, Property Profile.

When analysing the results

suburb by suburb: Milsons

Point has been an outstanding

performer relative to the others

in this category; I reported in the

last issue that median apartment

prices in Milsons Point had

increased from $890,000 to

$915,000; and now to June

quarter $953,000, representing

about 7% increase for the six

months leading to June 2012.

Milsons Point recorded the third

highest median price in Sydney,

after Millers Point and Darling

Point; this displays that Milsons

Point is certainly maturing as one

of Sydney’s top residential areas

for apartment living, strongly

supported by the demand from

investors, owner occupiers and

quality tenants.

A quick scan through the sales data during the

June quarter shows only 15 sales recorded

for three months in Milsons Point; only one

exceeding $3million, the rest were mostly in the

middle price bracket which is proving to be the

place to be.

Residential Rental Market

In the past year we have seen rents increase

faster in the inner and middle suburbs than the

outer Sydney region; over the long-term, the

pattern has been consistent across all suburbs;

and as there is a fall in new housing construction,

lease terms have been increasing over time.

Vacancy rates are hovering just under 2% in the

inner suburbs, which is considered to be below

effective minimum level; moreover, here in the

Lower North Shore, we are recording levels of 1%

vacancy, certainly our property portfolio at Tower

& London is at this historically low vacancy level.

Property Marketing

In todays modern age property marketing is not

as black and white as in the past. Gone are the

days of simply placing a classified advertisement

in the Saturday paper, today there is a multitude

of different platforms through which you can

market a property.

Whilst newspaper advertising is still a valid

method, online advertising and smart phone

apps are proving to be an increasingly effective

method. Given the visual nature of these

platforms, it highlights the importance of property

presentation. The quality of the photographs

used and the way the property is presented are

crucial to attract prospective buyers and tenants.

Recently at Tower & London we have been trialing

property videos as a new way of advertising our

properties. These videos, like the photographs

showcase the best aspects of the property, and

allow a prospective purchaser/tenant to interact

with the property and move through it, rather

than just viewing still images and trying to

imagine what the property is like. Examples of

these videos can be seen on our website, for our

recent auctions of 34 Holdsworth Street, Neutral

Terminating Tenancy Agreements

In previous publications of our Property Review we

have covered aspects of the changes to The Residential

Tenancies Act 2010 enacted on 31 January 2011. One area

of the legislation which saw marked changes is the process

for which a landlord or tenant can terminate a tenancy

agreement.

In the instance of a fixed term tenancy:

A landlord can now provide 30 days’ notice prior to the

end of the fixed term should they wish to terminate the

agreement for any reason.

A tenant in the same situation can now provide 14 days’

notice prior to the end of the fixed term should they want to

vacate on the last day of their lease.

If the fixed term period has expired and the lease is now

periodic/month to month:

A landlord must serve the tenant with 30 days’ notice if the

property has been on the market for sale & the contracts

have exchanged between vendor & purchaser.

A landlord must serve the tenant with 90 days’ notice for

the tenant to vacate for any other reason except for nonpayment

of rent or any instance ordered by the Consumer

Trade & Tenancy Tribunal.

In the instance of non-payment of rent, a landlord may issue

a tenant with a Notice to Vacate once the rent has reached

14 days in arrears. However, the tenants are given a further

14 days to pay all rent owing.

One change which benefits the landlord is that we are no

longer required to wait the additional 14 days to apply to

the CTTT. An application can be made on the 15th day,

however if the tenant pays all rent owing by the 28th day

the Termination Notice and Application would be cancelled.

An exception to this exists only in situations of habitually

late paying tenants and a clear history of rent arrears can be

demonstrated.

In the event that a tenant instigates a lease break during

the fixed term period

The new legislation has introduced a lease break fee for

which tenants pay to vacate a property during a fixed term

period.

If the tenants vacate the property in the first half of the

lease, the tenant is liable to pay a fee equivalent to 6 weeks’

rent. If the tenant vacates in the second half of the lease, the

fee payable is equivalent to 4 weeks’ rent.

This fee is absolute. The tenant is not liable for rent until

another tenant is found, as previous legislation required;

the landlord would have to pay agent’s letting fee and any

other expenses related to reletting the property. The tenants

are not required to cover any advertising or reletting fees

incurred by the landlord in securing a replacement tenant.

Should the Lease break fee not be included in the tenancy

agreement the terms outlining the financial liability to the

tenant must be expressed clearly and agreed to by both

parties at the time the agreement is signed.

In the last edition of the Property Review

we mentioned our long term client who was

auctioning his fully leased North Sydney strata

office. It eventually sold on a 9% return. It is a

rather complex property to fully analyse the return

as it had a car space and store room on title, all

leased to different parties. Overall the purchaser

ended up with a very handsome 9% net return on

his investment (excluding acquisition costs).

In this edition I would like to focus on one of

Milsons Point’s popular lunchtime eating spots

– Milsons Village Food Court and some exciting

changes of tenancies that have taken place

recently.

I am very proud to announce that we have leased

Shop 5 to Tony Morgan, one of Sydney’s great

artisan bakers. Tony hand makes each loaf of

bread and has an amazing sour dough culture

which produces some of the best tasting bread

I have ever tried. Tony is going to expand his

range to include pies and sweet things in the near

future. It’s really worth a visit to see him in action.

The old pasta bar has been leased to Aman Puri

who is investing a considerable sum in a new fit

out to showcase his North Indian cuisine. Aman

will also provide a home delivery service. We

are all looking forward to seeing these 2 new

operators succeed and grow their businesses.
