Sydney’s residential property prices have been flat in<br />

the three months up to the June Quarter; yet, in Milsons<br />

Point it’s another story.<br />

For the financial year up to June <strong>2012</strong> property prices had fallen about 5% across Sydney; this is largely<br />

due to the upper end of the price spectrum, which has fallen more noticeably than the price of more<br />

affordable properties.<br />

Sydney’s Lower North Shore has seen a small reduction in house value, whilst the small value gains<br />

in apartments in March <strong>2012</strong> have been consolidated in the June Quarter, according to the quarterly<br />

report prepared by the Real Estate Institute of NSW, Property Profile.<br />

When analysing the results<br />

suburb by suburb: Milsons<br />

Point has been an outstanding<br />

performer relative to the others<br />

in this category; I reported in the<br />

last issue that median apartment<br />

prices in Milsons Point had<br />

increased from $890,000 to<br />

$915,000; and now to June<br />

quarter $953,000, representing<br />

about 7% increase for the six<br />

months leading to June <strong>2012</strong>.<br />

Milsons Point recorded the third<br />

highest median price in Sydney,<br />

after Millers Point and Darling<br />

Point; this displays that Milsons<br />

Point is certainly maturing as one<br />

of Sydney’s top residential areas<br />

for apartment living, strongly<br />

supported by the demand from<br />

investors, owner occupiers and<br />

quality tenants.<br />

A quick scan through the sales data during the<br />

June quarter shows only 15 sales recorded<br />

for three months in Milsons Point; only one<br />

exceeding $3million, the rest were mostly in the<br />

middle price bracket which is proving to be the<br />

place to be.<br />

Residential Rental Market<br />

In the past year we have seen rents increase<br />

faster in the inner and middle suburbs than the<br />

outer Sydney region; over the long-term, the<br />

pattern has been consistent across all suburbs;<br />

and as there is a fall in new housing construction,<br />

lease terms have been increasing over time.<br />

Vacancy rates are hovering just under 2% in the<br />

inner suburbs, which is considered to be below<br />

effective minimum level; moreover, here in the<br />

Lower North Shore, we are recording levels of 1%<br />

vacancy, certainly our property portfolio at Tower<br />

& London is at this historically low vacancy level.<br />

Property Marketing<br />

In todays modern age property marketing is not<br />

as black and white as in the past. Gone are the<br />

days of simply placing a classified advertisement<br />

in the Saturday paper, today there is a multitude<br />

of different platforms through which you can<br />

market a property.<br />

Whilst newspaper advertising is still a valid<br />

method, online advertising and smart phone<br />

apps are proving to be an increasingly effective<br />

method. Given the visual nature of these<br />

platforms, it highlights the importance of property<br />

presentation. The quality of the photographs<br />

used and the way the property is presented are<br />

crucial to attract prospective buyers and tenants.<br />

Recently at Tower & London we have been trialing<br />

property videos as a new way of advertising our<br />

properties. These videos, like the photographs<br />

showcase the best aspects of the property, and<br />

allow a prospective purchaser/tenant to interact<br />

with the property and move through it, rather<br />

than just viewing still images and trying to<br />

imagine what the property is like. Examples of<br />

Terminating Tenancy Agreements<br />

In previous publications of our Property Review we<br />

have covered aspects of the changes to The Residential<br />

Tenancies Act 2010 enacted on 31 January 2011. One area<br />

of the legislation which saw marked changes is the process<br />

for which a landlord or tenant can terminate a tenancy<br />

agreement.<br />

In the instance of a fixed term tenancy:<br />

A landlord can now provide 30 days’ notice prior to the<br />

end of the fixed term should they wish to terminate the<br />

agreement for any reason.<br />

A tenant in the same situation can now provide 14 days’<br />

notice prior to the end of the fixed term should they want to<br />

vacate on the last day of their lease.<br />

If the fixed term period has expired and the lease is now<br />

periodic/month to month:<br />

A landlord must serve the tenant with 30 days’ notice if the<br />

property has been on the market for sale & the contracts<br />

have exchanged between vendor & purchaser.<br />

A landlord must serve the tenant with 90 days’ notice for<br />

the tenant to vacate for any other reason except for nonpayment<br />

of rent or any instance ordered by the Consumer<br />

Trade & Tenancy Tribunal.<br />

In the instance of non-payment of rent, a landlord may issue<br />

a tenant with a Notice to Vacate once the rent has reached<br />

14 days in arrears. However, the tenants are given a further<br />

14 days to pay all rent owing.<br />

One change which benefits the landlord is that we are no<br />

longer required to wait the additional 14 days to apply to<br />

the CTTT. An application can be made on the 15th day,<br />

however if the tenant pays all rent owing by the 28th day<br />

the Termination Notice and Application would be cancelled.<br />

An exception to this exists only in situations of habitually<br />

late paying tenants and a clear history of rent arrears can be<br />

demonstrated.<br />

In the event that a tenant instigates a lease break during<br />

the fixed term period<br />

The new legislation has introduced a lease break fee for<br />

which tenants pay to vacate a property during a fixed term<br />

period.<br />

If the tenants vacate the property in the first half of the<br />

lease, the tenant is liable to pay a fee equivalent to 6 weeks’<br />

rent. If the tenant vacates in the second half of the lease, the<br />

fee payable is equivalent to 4 weeks’ rent.<br />

This fee is absolute. The tenant is not liable for rent until<br />

another tenant is found, as previous legislation required;<br />

the landlord would have to pay agent’s letting fee and any<br />

other expenses related to reletting the property. The tenants<br />

are not required to cover any advertising or reletting fees<br />

incurred by the landlord in securing a replacement tenant.<br />

Should the Lease break fee not be included in the tenancy<br />

agreement the terms outlining the financial liability to the<br />

tenant must be expressed clearly and agreed to by both<br />

parties at the time the agreement is signed.<br />
